TRADE AND PAYMENTS AGREEMENT BETWEEN JAPAN AND THE PEOPLE'S REPUBLIC OF BULGARIA DURING THE PERIOD FROM 1967 TO 1971
日本国とブルガリア人民共和国との間の千九百六十七年から千九百七十一年までの期間における貿易及び支払に関する協定
日本国政府及びブルガリア人民共和国政府は、平等互恵の原則に基づいて両国間の貿易関係をさらに促進し、かつ、発展させることを希望して、次のとおり協定した。
The Government of Japan and the Government of the People's Republic of Bulgaria, being desirous of promoting and developing further the trade relations between the two counties on the principle of equality and mutual benefit, have agreed as follows:
第一条 両政府は、両国間の貿易の量及び品目数をできる限り高い水準に引き上げるように努力するものとする。
Article 1 Both Governments will endeavour to increase the volume of trade and the number of items thereof between the two counties to the highest level practicable.
第二条 この協定の有効期間中に日本国とブルガリア人民共和国との間で取引される商品は、この協定の不可分の一部としてこれに附属するA表(ブルガリアの輸出)及びB表(日本国の輸出)によつて規制される。
Article 2 Goods to be traded between Japan and the People's Republic of Bulgaria during the period of validity of this Agreement shall be governed by List A (Bulgarian exports) and List B (Japanese exports) attached to this Agreement as an integral part thereof.
これらの表は、単に例示的なものであり、両政府の合意によつて調整することができる。
These Lists are only indicative and may be adapted by mutual agreement of both Governments.
両政府は、前記の表に掲げる商品についての数量又は金額を合意により確定することに同意する。
Both Governments will agree to establish, upon mutual consent, quantities or values for the goods enumerated in the above-mentioned Lists.
第三条 この協定のいかなる規定も、第二条にいう表に記載されていない商品の取引を排除するものではない。
Article 3 Nothing in this Agreement shall preclude trade in goods not specified in the Lists mentioned in Article 2.
第四条 各政府は、それぞれの国において施行されているか又は今後施行されることがある法律、規則及び命令に従つて、千九百六十七年一月一日から千九百七十一年十二月三十一日までの期間において第二条にいう表に掲げる商品の他方の国への輸出及びその国からの輸入を許可することに同意するものとする。
Article 4 Either Government will agree, in accordance with the laws, regulations and orders which are or may hereafter be in force in the respective country, to permit the export to and the import from the other country during the period from January 1, 1967 to December 31, 1971, of the goods enumerated in the Lists mentioned in Article 2.
第五条 各政府は、相互主義に基づいて、輸入許可及び輸出許可の発給を含む貿易に関する問題について、できる限り好意的な待遇を相互に与えるものとする。
Article 5 Either Government shall, on the basis of reciprocity, accord each other a treatment as favourable as possible in matters concerning trade, including the issuing of import and export permissions.
第六条 この協定に基づく商品の取引は、外国貿易に従事する日本国の法人又は自然人と独立の法人である外国貿易に従事するブルガリアの外国貿易企業又は団体との間で締結される契約に基づいて行なわれるものとする。
Article 6 The trade of goods under this Agreement shall be effected through contracts concluded between Japanese juridical or physical persons dealing in foreign trade, on the one hand, and Bulgarian foreign trade enterprises or organizations dealing in foreign trade which are autonomous and independent juridical persons, on the other.
第七条 日本国及びブルガリア人民共和国との間のすべての支払は、外国為替に関する法律、規制及び命令でそれぞれの国において施行されているか又は今後施行されることがあるものに従つて、交換可能な通貨で行なうものとする。
Article 7 All payments between Japan and the People's Republic of Bulgaria shall be effected in convertible currencies in accordance with the foreign exchange laws, regulations and orders which are or may hereafter be in force in each of the two countries.
第八条 両政府は、この協定の実施を容易にするため、両国間の貿易から又はそれに関連して生ずるすべての問題について、相互の合意により協議を行なうものとする。
Article 8 In order to facilitate the implementation this Agreement, both Governments shall enter into consultations, upon mutual consent, in respect of any matter arising from or in connection with the trade between the two counties.
この目的のため及び第二条に関連して、両政府の代表による混合委員会が設置されるものとし、同委員会は、相互の合意によつて決定される時に、東京又はソフィアで会合する。
For this purpose and in connection with Article 2 a Mixed Commission with representatives of both Governments shall be established and will meet either in Tokyo or in Sofia, at a time to be agreed upon by mutual consent.
第二条にいうA表及びB表に掲げる商品についての数量又は金額は、混合委員会によつて決定されるものとする。
The quantities or values for the goods enumerated in Lists A and B mentioned in Article 2 Shall be determined by the Mixed Commission.
第九条 この協定に基づいてその有効期間中に締結された契約でこの協定の終了の日までに履行を完了しなかつたものは、この協定の規定に従つて履行されるものとする。
Article 9 Contracts concluded under this Agreement during its effective period but not fully executed at its termination shall be carried out in conformity with the provisions of this Agreement.
第十条 両政府は、この協定に基づいて締結される契約から又はそれに関連して生ずる紛争の解決のため、両国の仲裁機関の利用をあらゆる可能な方法により奨励するものとする。
Article 10 Both Governments will encourage by every possible means the use of arbitration boards in both countries for the settlement of disputes which may arise out of or in connection with the contracts concluded on the basis of this Agreement.
第十一条 この協定の効力発生により、千九百六十一年二月二十四日の日本国政府とブルガリア人民共和国政府との間の貿易及び支払に関する協定の効力は、終了するものとする。
Article 11 Upon the coming into force of this Agreement the validity of the Trade and Payments Agreement between the Government of Japan and the Government of the People's Republic of Bulgaria of February 24, 1961 shall be terminated.
第十二条 この協定は、署名の日に効力を生じ、千九百七十一年十二月三十一日まで効力を有するものとする。ただし、この協定の規定は、千九百六十七年一月一日にさかのぼつて適用されるものとする。
Article 12 This Agreement shall come into force on the date of its signature and shall remain in force until December 31, 1971. However, the provisions of this Agreement shall be applied retroactively as from January 1, 1967.
千九百六十七年三月二十八日に東京で、英語により本書二通を作成した。

書簡をもつて啓上いたします。本大臣は、ブルガリア人民共和国と日本国との間の貿易及び支払に関する協定を本日署名するに至つた交渉の過程において、両政府が同協定に関税及び貿易の問題に関する最恵国待遇の相互許与のための独立の条項を含ませないことに合意した旨を申し述べる光栄を有します。
Monsieur le Ministre, I have the honour to state that in the course of the negotiations which resulted in the signing today of the Trade and Payments Agreement between the People's Republic of Bulgaria and Japan, both Governments have agreed not to include a separate article for the mutual granting of the Most Favoured Nations treatment in matters of tariffs and trade in the above-mentioned Agreement.
もつとも、ブルガリア代表団は、両国間においてこのような条項を含む通商航海条約をできる限りすみやかに締結することを提案いたしました。
The Bulgarian delegation, however, has pro-posed to conclude as soon as possible a Treaty of Commerce and Navigation between the two countries which includes such an article.
日本国代表団は、日本国政府としては、このような条項は両国間の通商航海条約に含まれることが適当であるとの見解をもつものであること及び近い将来においてこのような通商航海条約を締結する可能性について検討することを申し述べました。
The Japanese delegation has stated that the Government of Japan is of the opinion that such an article can appropriately be included in a Treaty of Commerce and Navigation between the two countries and that the Government of Japan will study the possibility of concluding such a Treaty of Commerce and Navigation in the near future.
本大臣は、閣下が、この書簡が両代表団の間で到達された了解を正しく述べていることを確認されれば幸いであります。
I shall be grateful, Your Excellency, if you would kindly confirm that this letter correctly sets out the understanding reached between the two delegations.

Monsieur le Ministre, With reference to the Trade and payments Agreement between Japan and the People's Re-public of Bulgaria signed today, I have the honour to confirm the understanding reached between the two Governments to the effect that the quantities or values, when established, for the goods mentioned in Article 2 of the above-mentioned Agreement shall only be estimates and not a commitment on the part of either Government.
本大臣は、さらに、閣下が前記の了解を確認されることを要請する光栄を有します。
