ARRANGEMENT BETWEEN THE GOVERNMENT OF JAPAN AND THE GOVERNMENT OF SIERRA LEONE FOR THE SUPPLY OF COTTON YARNS AND/OR CLOTH FROM JAPAN TO SIERRA LEONE PARTIALLY AGAINST RAW COTTON TO BE DELIVERED UNDER THE UNITED STATES AGRICULTURAL TRADE DEVELOPMENT AND ASSISTANCE ACT PROGRAMME

　アメリカ合衆国の農産物貿易の促進及び援助に関する法律による計画に基づいて引き渡される原綿を代金の一部とする日本国からシエラ・レオーネへの綿織物の供給のためのシエラ・レオーネ政府との間の取極

　ARRANGEMENT BETWEEN THE GOVERNMENT OF JAPAN AND THE GOVERNMENT OF SIERRA LEONE FOR THE SUPPLY OF COTTON YARNS AND/OR CLOTH FROM JAPAN TO SIERRA LEONE PARTIALLY AGAINST RAW COTTON TO BE DELIVERED UNDER THE UNITED STATES AGRICULTURAL TRADE DEVELOPMENT AND ASSISTANCE ACT PROGRAMME

　日本国政府及びシエラ・レオーネ政府は、綿糸又は綿織物の日本国からシエラ・レオーネへの輸出について、及び綿糸又は綿織物のF・O・B価額に対する一部支払(綿糸の場合には六十五パーセント又は綿織物の場合には五十五パーセント)としての約六十五万合衆国ドルに相当する原綿(以下「原綿」という。)のアメリカ合衆国から日本国への輸入(それぞれ三十五パーセント又は四十五パーセントの残額は合衆国ドルで支払われる。)について取極を行なうことを希望して、次のとおり取極を締結した。

　The Government of Japan and the Government of Sierra Leone desiring to make arrangements for the exportation of cotton yarns and/or cloth from Japan to Sierra Leone and for the importation of raw cotton from the United States of America to Japan amounting to approximately U.S.$650,000 (hereinafter referred to as "the Raw Cotton") in partial payment (65 percent in case of yarns and/or 55 percent in case of cloth) for the F.O.B. value of the cotton yarns and/or cloth (the balance, 35 percent and/or 45 percent respectively, to be paid in U.S. dollars), have concluded an arrangement as set forth below.

　この取極は、合衆国の改正後の農産物貿易の促進及び援助に関する法律第一章に基づいて千九百六十五年一月二十九日にシエラ・レオーネ政府との間で締結した農産物協定に従いシエラ・レオーネ政府に対して原綿の延払買付承認書(以下「CPA」という。)を発給すること、及びシエラ・レオーネ政府がCPAに基づいて原綿の輸入のための分割買付承認書を発給する権限を日本国政府に移譲することができることにアメリカ合衆国政府が同意したという了解の下に作成された。

　This Arrangement is made in the knowledge that the Government of the United States of America has agreed, under the Agricultural Commodities Agreement concluded on the 29th of January, 1965, with the Government of Sierra Leone pursuant to Title IV, United States Agricultural Trade Development and Assistance Act, as amended, to issue to the Government of Sierra Leone credit purchase authorizations (hereinafter referred to as "the CPA") for the Raw Cotton and has also agreed that the Government of Sierra Leone may transfer to the Government of Japan the authority to issue sub-authorizations under the CPA for the importation of the Raw Cotton.

I　日本国政府は、

I. The Government of Japan

A　日本国において加工された綿糸又は綿織物をシエラ・レオーネに競争価格で、かつ、日本国の関係輸出業者とシエラ・レオーネの関係輸入業者との間で合意する品質に従つて輸出することを容易にする。

A. Will facilitate the exportation to Sierra Leone of the cotton yarns and/or cloth processed in Japan at competitive prices and according to qualities agreed upon between exporters in Japan and importers in Sierra Leone concerned;

B　この取極に基づいてシエラ・レオーネに輸出される綿糸又は綿織物に対する一部支払として、アメリカ合衆国から原綿が輸入されるよう取り計らう。

B. Will arrange for the importation from the United States of America of the Raw Cotton in partial payment for the cotton yarns and/or cloth exported to Sierra Leone under this Arrangement;

C　原綿の契約がCPAに掲げる契約期間の最終期日以前に締結され、また、原綿の船積がCPAに掲げる船積期間の最終期日以前に行なわれるよう取り計らう。

C. Will arrange for the contraction for the Raw Cotton prior to the terminal dates of the contracting period set forth in the CPA and will arrange for its shipments prior to the terminal dates of the delivery period set forth in the CPA;

D　原綿が合衆国農務省の関係規則に基づいて輸入されるよう取り計らい、また、輸入される原綿の価額は信用状が開設された綿糸又は綿織物のF・O・B価額のそれぞれ六十五パーセント又は五十五パーセントとするという了解の下に、綿糸又は綿織物のためのそれぞれの信用状が開設されない限り原綿が日本国に輸入されないことに同意する。

D. Will arrange that the Raw Cotton shall be imported under the applicable regulations of the United States Department of Agriculture, and agrees that the Raw Cotton shall not be imported into Japan unless respective Letters of Credit for the cotton yarns and/or cloth have been opened, with the understanding that the value of the Raw Cotton to be imported will be 65 percent and/or 55 percent of the F.O.B. value of the cotton yarns and/or cloth respectively for which the Letters of Credit have been opened;

E　シエラ・レオーネ政府に対して、船積された綿糸又は綿織物のF・O・B価額、原綿のために開設された信用状及び実際に船積され日本国に輸入された原綿の純価額について随時通報する。

E. Will inform the Government of Sierra Leone from time to time of the F.O.B. value of shipments of the cotton yarns and/or cloth, of the Letters of Credit opened for the Raw Cotton, and of the net value of actual shipments of the Raw Cotton received in Japan;

F　原綿は、この取極がない場合にアメリカ合衆国及びその友好国から輸入されるものの上積みとなることを了承する。

F. Recognizes that the Raw Cotton will be additional to raw cotton that would otherwise be imported from the United States of America and countries friendly to the United States of America;

G　綿糸又は綿織物の品質の欠陥又は数量の不足に関するクレームが、日本国の輸出業者とシエラ・レオーネの輸入業者との間の交渉によつて通常の商慣行に従い解決されるべきこと、及び品質の欠陥又は数量の不足が、綿糸又は綿織物の追加供給によつて補てんされるか、又は、それができない場合には、シエラ・レオーネの輸入業者のために合衆国ドルで送金することによつて補てんされることを承諾する。

G. Accepts that claims in respect of deficiency in quality and/or quantity of the cotton yarns and/or cloth shall be settled by negotiations between exporters in Japan and importers in Sierra Leone in accordance with normal commercial practice, and that any deficiency in quality and/or quantity will b mad good by additional supplies of cotton yarns and/or cloth or, failing that, by remittance in U.S. dollars in favour of importers in Sierra Leone;

H
(1)　CPAに基づいて原綿の分割買付承認書を発給する権限を移譲された日から一箇月の後において、日本国の輸出業者とシエラ・レオーネの輸入業者との間に締結された綿糸又は綿織物の供給のための関係商業契約が、この取極に基づいて輸出されることとなる綿糸又は綿織物の価額の最小限二十五パーセントに達していないときは、シエラ・レオーネ政府が、日本国政府に通報した後、IIBに定める総額の残額についての同項に基づく義務を免れることができることを承諾する。

H.
(1) If, after one month from the date of the transfer of the authority to issue sub-authorizations under each CPA for the Raw Cotton, relevant commercial contracts for the supply of the cotton yarns and/or cloth have not been concluded between exporters in Japan and importers in Sierra Leone to a minimum of 25 percent of the value of the cotton yarns and/or cloth to be exported under this Arrangement, accepts that the Government of Sierra Leone may, after informing the Government of Japan, be Released from its under-taking under paragraph IIB below in respect of the balance of the total specified in that paragraph;

(2)　シエラ・レオーネ政府が、(1)の規定に基づくその権利をさらに一箇月の期間停止する用意がある場合には、追加契約価額の最小限を定めることができることを承諾する。

(2) In the event that the Government of Sierra Leone is prepared to suspend its right under the provisions of (1) above for an additional period of on month, accepts that the Government of Sierra Leone may specify a further minimum value of contracts;

I　アメリカ合衆国政府に対して、次のものを提供する。

I. Will furnish to the Government of the United States of America:

(1)　附属手続A2にいうそれぞれの信用状の写し一部

(1) A copy of each Letter of Credit as mentioned in A.2. of the Annexed Procedure;

(2)　四半期ごとの一覧表で当該四半期にCPAに基づいてアメリカ合衆国から輸入された原綿の数量及び価額並びに当該四半期にこの取極に基づいてシエラ・レオーネに輸出された綿糸又は綿織物の数量、種類、価額、原綿相当重量及び船積日付を記したもの

(2) A statement at the end of each calendar quarter showing the quantity and value of the Raw Cotton received from the United States of America under the CPA during such quarter and the quantity, kind, value, raw cotton equivalent weight, and date of shipment of the cotton yarns and/or cloth exported to Sierra Leone pursuant to this Arrangement during such quarter;

(3)　この取極に基づくシエラ・レオーネ向けの綿糸又は綿織物の船積を証明する譲渡不能本船渡し海洋船荷証券の署名写し一部

(3) A signed copy of a non-negotiable, on board, ocean bill of lading evidencing shipment of the cotton yarns and/or cloth to Sierra Leone pursuant to this Arrangement.

II　シエラ・レオーネ政府は、

II. The Government of Sierra Leone

A　シエラ・レオーネ政府がCPAを受領した後直ちに、CPAに基づいて六十五万合衆国ドルの価額の原綿の分割買付承認書を発給する権限を日本国政府に移譲する。

A. Will transfer to the Government of Japan the authority to issue sub-authorizations under the CPA for the Raw Cotton of the value of U.S.$650,000 immediately after the Government of Sierra Leone has received the CPA;

B　綿糸又は綿布が輸入されるよう取り計らい、かつ、この取極の効力発生後できる限りすみやかにシエラ・レオーネの輸入業者に対して輸入承認証を発給し、又は輸入割当てを行なう。ただし、輸出される綿糸のF・O・B価額の総額の六十五パーセント又は輸出される綿織物のF・O・B価額の総額の五十五パーセントが、合計で、原綿の価額である六十五万合衆国ドルに相当することを条件とする。

B. Will arrange for the importation of the cotton yarns and/or cloth and will issue licences and/or make allocations to importers in Sierra Leone as soon as possible after the coming into force of this Arrangement, provided that 65 percent of the total F.O.B. value of the exported cotton yarns and/or 55 percent of the total F.O.B. value of the exported cotton cloth shall be in the aggregate equivalent to the value of the U.S.$650,000 of the Raw Cotton.

　前記の輸入承認証は、日本国に対してのみ効力を有するものとし、「公法第四八◯号に基づく取引に限る。」という記載を有することによつて、通常の輸入承認と区別されるものとする。この輸入承認証又は輸入割当ては、千九百六十六年六月三十日まで効力を有する。

　Such licences shall be valid only for Japan and shall be distinguished from ordinary import authorizations by the notation; "For PL 480 Transactions only." The import licences and/or allocations shall be valid until the 30th of June, 1966;

C　シエラ・レオーネの綿糸又は綿織物の輸入業者が日本国の輸出業者との買付契約をできる限りすみやかに完了し、また、その買付契約ができる限り早期のかつ双方の業者に便利な船積期日を定めることとなるよう取り計らう。綿糸又は綿織物は、千九百六十六年六月三十日までにシエラ・レオーネに到着するものとする。

C. Will arrange that importers in Sierra Leone of the cotton yarns and/or cloth complete their purchase contracts with exporters in Japan as expeditiously as possible, and will arrange that such purchase contracts call for earliest and mutually convenient shipment dates. Yarns and/or cloth are not to arrive later than the 30th of June, 1966 in Sierra Leone;

D　シエラ・レオーネ政府とアメリカ合衆国政府との間の千九百六十五年の農産物協定及びCPAに基づいて必要とされるアメリカ合衆国政府への合衆国ドルの償還及びその未払残額に対する利子の支払について、単独で責任を負う。

D. Will solely be responsible for payment to the Government of the United States of America of the U.S. dollar disbursement, and its interest on the unpaid balance, as required under the Agricultural Commodity Agreement concluded on the 29th of January, 1965, between the Government of Sierra Leone and the Government of the United States of America and under the CPA;

E　この綿糸又は綿織物は、この取極がない場合にアメリカ合衆国及びその友好国から輸入される綿糸又は綿織物の上積みとなることを了承する。

E. Recognizes that the cotton yarns and/or cloth will be additional to cotton yarns and/or cloth that would otherwise be imported from the United States of America and countries friendly to the United States of America.

III　一般規定

III. General Provisions:

A　綿糸又は綿織物の引渡しのための商業契約は、日本国の輸出業者とシエラ・レオーネの輸入業者との間の交渉によつてこの取極の規定に従つて定められる条件に基づいて締結される。

A. Commercial contracts for the delivery of the cotton yarns and/or cloth shall be on terms and conditions to be negotiated between exporters in Japan and importers in Sierra Leone in accordance with the provisions of this Arrangement.

B　附属手続は、この取極の一部とみなされる。

B. The Annexed Procedure shall be regarded as a part of this Arrangement.

C　この取極は、署名の日に効力を生ずる。

C. This Arrangement shall come into force on the date of signature.

A　シエラ・レオーネが輸入する綿糸又は綿織物について

PROCEDURE
A. For the Cotton Yarns and/or Cloth that will be imported by Sierra Leone

1　シエラ・レオーネ政府は、自国の輸入業者に対して、綿糸又は綿織物のための輸入承認証を発給し、又は輸入割当てを行なう。

1. The Government of Sierra Leone will issue import licences and/or make allocations to importers in Sierra Leone for the cotton yarns and/or cloth.

2　シエラ・レオーネの輸入業者は、日本国の輸出業者に対してC・I・F建てで綿糸又は綿織物の発注を行ない、その買付けに充てるため、シエラ・レオーネの指定された外国為替銀行は、日本国の輸出業者のために合衆国ドル建一覧払取消不能信用状を開設する。すべての契約価格は、合衆国ドルで表示するものとする。信用状は、契約の締結後直ちに開設され、日本国の指定された外国為替銀行を通じて輸出業者に通知される。

2. Importers in Sierra Leone will place orders on the C.I.F. basis for the cotton yarns and/or cloth with exporters in Japan and the designated foreign exchange bank of Sierra Leone will open U.S. dollar irrevocable at sight Letters of Credit in favour of exporters in Japan to cover the purchases. All contract prices shall be expressed in U.S. dollars. The Letters of Credit will be opened immediately after the conclusion of relevant contracts and advised to the exporters through the designated foreign exchange bank of Japan.

3　日本国の輸出業者は、綿糸又は綿織物を船積し、かつ、信用状に対して手形を振り出す。手形は、合衆国ドル表示で、(a)輸出された綿糸のF・O・B価額の三十五パーセントの金額又は輸出された綿織物のF・O・B価額の四十五パーセントの金額に相当する加工賃並びに綿糸の海上運賃及び保険料の全額、並びに(b)輸出された綿糸の一部支払として、輸出された綿糸のF・O・B価額の六十五パーセントの金額又は輸出された綿織物のF・O・B価額の五十五パーセントの金額に相当する原綿の価額に対して別個に振り出されるものとする。

3. Exporters in Japan will ship the cotton yarns and/or cloth and draw drafts against the Letters of Credit. The drafts shall be drawn in U.S. dollars separately (a) for processing charges representing respectively the sum of 35 percent of the F.O.B. value of the exported cotton yarns and/or the sum of 45 percent of the F.O.B. value of the exported cotton cloth, and the full amount of freights and insurances incurred for the cotton yarns and/or cloth, and (b) for the value of the Raw Cotton in partial payment for the exported cotton yarns and/or cloth representing respectively the sum of 65 percent of the F.O.B. value of the exported cotton yarns and/or the sum of 55 percent of the F.O.B. value of the exported cotton cloth.

4　日本国の指定された外国為替銀行は、輸出業者が振り出した手形に対して支払を行なう。

4. The designated foreign exchange bank of Japan will pay the drafts drawn by the exporters.

5　日本国の指定された外国為替銀行は、信用状に基づいて要求される船積書類をシエラ・レオーネの指定された外国為替銀行に送付する。

5. The designated foreign exchange bank of Japan will forward the shipping documents required under the Letters of Credit concerned to the designated foreign exchange bank of Sierra Leone.

6　シエラ・レオーネの指定された外国為替銀行は、別途取り決められるところに従い、日本国の指定された外国為替銀行に対して、合衆国ドルで、加工賃、海上運賃及び保険料に対する手形の金額(この手続のA3の(a)及び(c)に定める金額に相当する。)を償還する。日本国の指定された外国為替銀行は、綿糸又は綿織物に対する一部支払としての原綿に対する手形の金額(この手続のA3の(b)及び(c)に定める金額に相当する。)をシエラ・レオーネの指定された外国為替銀行名義の合衆国ドル建エスクロ勘定に借記する。

6. The designated foreign exchange bank of Sierra Leone will make, as separately arranged, reimbursement to the designated foreign exchange bank of Japan in U.S. dollars for the sum of drafts for processing charges, freights and insurances, the amount of which corresponds to (a) in paragraph A.3. of this Procedure. The designated foreign exchange bank of Japan will debit the sum of drafts for the Raw Cotton in partial payment for the cotton yarns and/or cloth, the amount of which corresponds to (b) in paragraph A.3. of this Procedure, to the U.S. dollar Escrow Account in the name of the designated foreign exchange bank of Sierra Leone.

7　合衆国ドル建エスクロ勘定の金額は、B8の規定に従つてのみ貸記される。

7. The amounts in the U.S. dollar Escrow Account mentioned above will be credited only in accordance with the provisions of paragraph B.8. below.

B　日本国が輸入する原綿について

B. For the Raw Cotton that will be imported by Japan

1　合衆国農務省(商品金融公社)は、日本国の指定された外国為替銀行が原綿の輸出契約に基づいて開設する合衆国ドル建信用状について、シエラ・レオーネの指定された外国為替銀行が指定する合衆国の銀行に対して、債務引受承認証を発給する。

1. The United States Department of Agriculture (Commodity Credit Corporation) will issue Letters of Commitment of the United States bank nominated by the designated foreigh exchange bank of Sierra Leone in respect of the U.S. dollar Letters of Credit to be opened under the Credit Purchase Authorization (CPA) by the designated foreign exchange bank of Japan.

2　日本国の輸入業者は、アメリカ合衆国の輸出業者に対して原綿の発注を行なう。

2. Importers in Japan will place orders for the Raw Cotton with exporters in the United States of America.

3　日本国の指定された外国為替銀行は、原綿の輸出業者のために合衆国ドル建信用状を開設し、発給された債務引受承認証を保持する合衆国の銀行を通じて輸出業者に通知する。

3. The designate foreign exchange bank of Japan will open U.S. dollar Letters of Credit in favour of the exporters of the Raw Cotton and advise them thorough the United States bank holding Letters of Commitment which have been issued.

4　アメリカ合衆国の輸出業者は、原綿を船積みし、かつ、合衆国ドル建信用状に対して手形を振り出する。

4. Exporters in the United States of America will ship the Raw Cotton and draw drafts against the U.S. dollar Letters of Credit.

5　合衆国の銀行は、手形を買い取つてアメリカ合衆国の輸出業者に合衆国ドルで支払い、かつ、日本国の指定された外国為替銀行に船積書類を送付する。

5. The United States bank will negotiate the drafts and pay the exporters in the United States of America in U.S. dollars and will forward the shipping documents to the designated foreign exchange bank of Japan.

6　合衆国農務省(商品金融公社)は、合衆国の銀行が支払つた各船積の送り状価額の九十八パーセント又はそれ以下を償還する。残りの二パーセント又はそれ以上は日本国の輸入業者の勘定とする。商品金融公社は、総計で、CPAで承認されたドル価額の全額まで支払うものとする。船積みから生ずるいかなるクレームも、日本国の輸入業者とアメリカ合衆国の輸出業者との間で直接解決されるものとする。

6. The United States Department of Agriculture (Commodity Credit Corporation) will make reimbursement for 98 percent or less of the invoice value of each shipment financed by the United States bank, while the remaining 2 percent or more will be for the account of the importers in Japan. In the aggregate Commodity Credit Corporation will finance up to the full dollar amount authorized in the CPA. Any claims resulting from the shipments will be settled directly between the importers in Japan and the exporters in the United States of America.

7　合衆国の銀行は、シエラ・レオーネの指定された外国為替銀行に対して、商品金融公社が償還した合衆国ドルの金額を通知し、かつ、その金額をシエラ・レオーネ政府に通知するよう要求する。シエラ・レオーネの指定された外国為替銀行は、B8の規定に従つてその合衆国ドル建エスクロ勘定に貸記される金額を確認する。シエラ・レオーネ政府は、自己の勘定に、商品金融公社に支払うべき金額を記録する。

7. The United States bank will notify the designated foreign exchange bank of Sierra Leone of the U.S. dollar amount reimbursed by Commodity Credit Corporation, and request it to notify the Government of Sierra Leone thereof. The designated foreign exchange bank of Sierra Leone will confirm the amount to be credited to its U.S. dollar Escrow Account as provided in paragraph B.8. below. The Government of Sierra Leone will record the amount due Commodity Credit Corporation in its account.

8　日本国の指定された外国為替銀行は、合衆国の銀行から船積書類を受領した後、日本国の原綿の輸入業者から手形のドル価額に相当する日本国の通貨を徴集し、かつ、合衆国ドル建手形の金額を、シエラ・レオーネの指定された外国為替銀行名義の合衆国ドル建エスクロ勘定に貸記する。

8. The designated foreign exchange bank of Japan, upon receipt of the shipping documents from the United States bank, will collect Japanese currency equivalent to the dollar amount of the drafts from the importers of the Raw Cotton in Japan and credit the U.S. dollar Escrow Account in the name of the designated foreign exchange bank of Sierra Leone with the amounts of the U.S. dollar drafts.

9　シエラ・レオーネの指定された外国為替銀行は、シエラ・レオーネ政府と別途取り決めるところに従い、シエラ・レオーネ政府に帰属すべき現地通貨を管理する。

9. The designated foreign exchange bank of Sierra Leone will dispose of the local currency due the Government of Sierra Leone according to the arrangement separately made with the Government of Sierra Leone.

　書簡をもつて啓上いたします。本使は、合衆国の農産物貿易の促進及び援助に関する法律による計画に基づいて引き渡される原綿を代金の一部とする日本国からシエラ・レオーネへの綿糸又は綿織物の供給のための日本国政府とシエラ・レオーネ政府との間の取極を本日署名するに至るまでの日本国政府の代表者とシエラ・レオーネ政府の代表者との間の交渉に言及し、この交渉の過程において到達した次の了解を日本国政府に代わつて確認する光栄を有します。

　Excellency,I have the honour to refer to the negotiations between the representatives of the Government of Japan and of the Government of Sierra Leone leading up to the signing today of the Arrangement between the Government of Japan and the Government of Sierra Leone for the Supply of Cotton Yarns and/or Cloth from Japan to Sierra Leone partially against Raw Cotton to be delivered under the United States Agricultural Trade Development and Assistance Act Programme, and to confirm, on behalf of the Government of Japan, the following understandings reached during the course of the negotiations:

I　両国政府は、前記の取極に基づく取引を円滑に行なうため、日本国の輸出業者及びシエラ・レオーネの輸入業者がそれぞれ貿易団体を組織すること又はこれらの貿易団体が代理業者として一又は二以上の商社を指定することに同意し、かつ、この取引に従事する商社の数を最小限にするよう努める。

I. For the purpose of smooth transactions under the above-mentioned Arrangement, the two Governments agree to the formation of a trade body by exporters in Japan and importers in Sierra Leone respectively, or to the appointment by them of a commercial firm or firms as their respective agent of agents, and will endeavour to minimize the numbers of the firms to handle such transactions.

II　前記の取極にいう日本国の指定された外国為替銀行及びシエラ・レオーネの指定された外国為替銀行とは、それぞれ東京銀行大阪支店及びシエラ・レオーネ銀行をいう。

II. The designated foreign exchange bank of Japan and the designated foreign exchange bank of Sierra Leone mentioned in the above-mentioned Arrangement are the Bank of Tokyo, Limited, Osaka, and the Bank of Sierra Leone, respectively.

　I shall be grateful for your confirmation of the above-mentioned understandings on behalf of the Government of Sierra Leone.

　書簡をもつて啓上いたします。本使は、合衆国の農産物貿易の促進及び援助に関する法律による計画に基づいて引き渡される原綿を代金の一部とする日本国からシエラ・レオーネへの綿糸又は綿織物の供給のための日本国政府とシエラ・レオーネ政府との間の取極を本日署名するに至るまでの日本国政府の代表者とシエラ・レオーネ政府の代表者との間の交渉に言及し、この交渉の過程において到達した、前記の取極の実施のため原綿の延払買付承認書の有効期間の合理的延長が必要な場合には、シエラ・レオーネ政府は日本国政府の要請に基づき直ちにアメリカ合衆国政府と交渉を行なうとの了解を、日本国政府に代わつて確認する光栄を有します。

　Excellency,I have the honour to refer to the negotiations between the representatives of the Government of Japan and of the Government of Sierra Leone leading up to the signing today of the Arrangement between the Government of Japan and the Government of Sierra Leone for the Supply of Cotton Yarns and/or Cloth from Japan to Sierra Leone partially against Raw Cotton to be delivered under the United States Agricultural Trade Development and Assistance Act Programme, and to confirm, on behalf of the Government of Japan, the understanding reached during the course of the negotiations that in the event that a reasonable extension of CPA is required for the fulfillment of the Arrangement, the Government of Sierra Leone will, at the request of the Government of Japan, promptly enter into negotiations with the Government of the United States of America.
