日本青年海外協力隊の派遣に関する日本国政府とケニア政府との間の交換公文

31st March, 1966
書簡をもつて啓上いたします。本使は、ケニアに対する技術協力を促進するため日本青年海外協力隊(以下「協力隊」という。)をケニアに派遣することに関し日本国政府の代表とケニア政府の代表との間でナイロビにおいて行なわれた最近の討議に言及するとともに、これらの代表の間で到達した次の了解を日本国政府に代わつて確認する光栄を有します。
Excellency: I have the honour to refer to the recent discussions held in Nairobi by the representatives of the Government of Japan and the Government of Kenya concerning the dispatch to Kenya of Japan Overseas Cooperation Volunteers (hereinafter referred to as "the volunteers") with a view to promoting technical co-operation with Kenya. I wish to confirm on behalf of the Government of Japan the following understandings reached between them:
1日本国政府は、ケニア政府の要請に基づき、日本国の現行法令に従い、ケニアの社会的及び経済的開発に寄与するため、両国政府間で別個に合意される計画に従い、協力隊を派遣する。
1. At the request of the Government of Kenya, and in accordance with the laws and regulations in force in Japan, the Government of Japan will dispatch the volunteers for the purpose of contributing to the social and economic development of Kenya, according to the schedule to be separately agreed upon by the two Governments.
2 日本国政府は、予算措置が執られることを条件として、協力隊の隊員の日本国とケニアとの間の渡航費及びケニアにおける生活手当を負担し、並びに協力隊の隊員の任務遂行上必要な機械、器具、材料及び医薬品を供与する。
2. The Government of Japan will, subject to budgetary appropriations, bear the cost of international travel between Japan and Kenya, and of living allowances in Kenya for the volunteers, and shall make available such equipment, machinery, material and medical supplies as nessary for the performance of their duties.
3 ケニア政府は、協力隊の隊員に対し、次に掲げる特権、免除及び利益を与える。
3. The Government of Kenya will grant the volunteers the following privileges, exemptions and benefits:
(1) 2に掲げる機械、器具、材料及び医薬品の輸入について課される関税の免除。協力隊の隊員の身回品及び家庭用品も、関税を課されない。この規定は、協力隊の隊員の個人的使用のための自動車の無税輸入を含まない。
(1) The exemption from the payment of customs duties levied on or in connection with the importation of the equipment, machinery, materials and medical supplies mentioned in paragraph 2 above. The personal and household effects of the volunteers will also be exempt from the payment of duty. This provision does not include the importation duty free of a motor vehicle for the private use of a volunteer.
(2) 協力隊の隊員が本国政府から受領する給与に対する所得税及び累進個人税の免除
(2) The exemption from the payment of income tax and graduated personal tax on any allowances or emoluments received by them from their sponsoring Government.
(3) ケニア政府の公務員に与える医療の便宜と同様の便宜
(3) The same medical facilities as are ex-tended to Kenya Government Civil Servants.
(4) 協力隊の隊員がその任務を遂行する場所における無料の住居施設。住居施設の提供の代わわに、ケニア政府は、隊員一人当たり一率に一箇月三百シリングの住居費を支払うことに合意する。
(4) Rent-free housing accommodation at places where they are to perform their duties. Alternatively, the Government of Kenya agrees to pay each volunteer a straightforward housing allowance of Shs. 300/-permonth.
4 両国政府は、この交換公文により定められる計画の実施を成功させるため、随時協議する。
4. The two Governments shall enter into consultation, from time to time, for the successful implementation of the programmer established for the volunteers by this exchange of letters.
5 この取極は、千九百六十六年三月三十一日に効力を生ずる。
5. The present arrangement shall become effective on 31st March, 1966.
本使は、さらに、閣下が前記の了解をケニア政府にに代わつて確認されることを確認する光栄を有します。
I have further the honour to request you to be good enough to confirm the foregoing understandings on behalf of the Government of Kenya.
本使は、以上を申し進めるに際し、ここに重ねて閣下に向かつて敬意を表します。
