航空業務に関する日本国と中華民国との間の交換公文の修正に関する交換公文
Tipei. March 30,1966
書簡をもつて啓上いたします。本官は、千九百六十年五月十八日及び六月十八日に修正された千九百五十五年三月十五日の日本国と中華民国との間の航空業務に関する暫定取極に言及する光栄を有します。
I have the honor to refer to the Provisional Air Transport Arrangements between Japan and the republic of China of March 15, 1955 as revised by further agreements reached on May 18 and June 18, 1960, respectively.
日本国政府は、東京と台北との間の中間地点として名古屋及び福岡を加えることを希望しているので、この問題及び他の関連事項に関して日本国政府の代表者と中華民国政府の代表者との間で会談が行なわれた結果、次の了解に到達いたしました。
The Government of Japan desires that Nagoya and Fukuoka be added as intermediate points between Tokyo and Taipei, and conversations in connection with this and other related matters have been held between the representatives of the Governments of Japan and the Republic of China. In the cource of these conversations, the following understandings have been reached:
一 1(a)の路線を次のとおり修正する。
(1) air route specified in 1. (a) is revised to read:
「1(a) 名古屋、大阪、福岡及び沖繩を経て東京と台北との間」
"1. (a) between Osaka and Taipei via Fukuoka and Okinawa; and"
二 1(b)の路線を次のとおり修正する。
(2) air route specified in 1. (b) is revised to read:
「1(b) 福岡及び沖繩を経て大阪と台北との間」
"1. (b) between Osaka and Taipei via Fukuoka and Okinawa."
三 2(a)の路線を次のとおり修正する。
(3) air route specified in 2. (a) is revised to read:
「2(a) 沖繩、福岡、大阪及び名古屋を経て台北と東京との間」
"2. (a) between Taipei and Tokyo via Okinawa, Fukuoka., Osaka and Nagoya; and"
四 2(b)の路線を次のとおり修正する。
(4) air route specified in 2. (b) is revised to read:
「2(b) 沖繩及び福岡を経て台北と大阪との間」
2. (b) between Taipei and Osaka via Okinawa and Fukuoka."
五 4(a)(ii)の路線を次のとおり修正する。
(5) air route specified in 4. (a) (ii) is revised to read:
「4(a)(ii) 北太平洋における中間地点を経てサン・フランシスコまで、及び今後合意される他の以遠の地点まで」
"4. (a) (ii) to San Francisco via intermediate points the North Pacific, and to such other points beyond as may be agreed upon later, "
閣下が前記の了解が中華民国政府の了解であることを貴国政府に代わつて確認されるときは、この書簡及び閣下の返簡が両政府間の合意を構成するものと認められます。この合意は、閣下の返簡の日付の日に効力を生じます。
If Your Excellency would confirm on behalf of Your Government that the aforesaid understandings are also the understandings of the Government of the Republic of China, then this Note and Your Excellency's confirming Note shall be considered as constituting a further agreement between our two Governments. This agreement shall enter into force on the date of Your Excellency's Note in reply.
本官は、以上を申し進めるに際し、ここに重ねて閣下に向かつて敬意を表します。

I have the honour t Confirm that the understandings of the Government of Japan embodied in your Note as quoted above are also the understandings of the Government of the Republic of China and that your Note and this Note in reply shall be regarded as constituting a further agreement between our two Governments, which shall enter into force on the date of this Note in reply.

EXCHANGE OF NOTES BETWEEN JAPAN AND THE REPUBLIC OF CHlNA REGARDlNG THE AIR SERVICES

(在本邦中華民国特命全権大使から外務大臣にあてる書簡)
書簡をもつて啓上いたします。本使は、中華民国と日本国との間の及び両国をこえての定期航空業務に関して両政府の代表者の間で最近行われた会談に言及するとともに、その会談において合意され、かつ、両政府がそれぞれの行政権の範囲内において実施することを約束する次の取極を中華民国政府に代つて確認する光栄を有します。
Monsieur le Ministre, I have the honour to refer to the conversations recently held between the representatives of the Governments of the Republic of China and Japan regarding the scheduled air services between and beyond both countries, and to confirm, on behalf of the Government of the Republic of China, the following arrangements agreed upon in the course of these conversations, which the Governments of both countries undertake to apply within the limits of their administrative powers:
1 中華民国政府は、日本国政府により指定される一又は二以上の航空企業が次に掲げる商業航空路線において定期航空業務を運営することを認めるものとする。
l. The Government of the Republic of China shall authorize an airline or airlines to be designated by the Government of Japan cooperate scheduled air services on the following commercial air routes:
(a) 岩国及び沖繩を経て東京と台北との間
(a) between Tokyo and Taipei via Iwakuni and Okinawa; and
(b) 沖繩を経て岩国と台北との間
(b) between Iwakuni and Taipei via Okinawa.
2 日本国政府は、中華民国政府により指定される一又は二以上の航空企業が次に掲げる商業航空路線において定期航空業務を運営することを認めるものとする。
2. The Government of Japan shall authorize an airline or airlines to be designated by the Government of the Republic of China to operate scheduled air services on the following commercial air routes:
(a) 沖縄及び岩国を経て台北と東京との間
(a) between Tokyo and Taipei via Iwakuni and Okinawa; and
(b) 沖繩を経て台北と岩国との間
(b) between Iwakuni and Taipei via Okinawa.
3 中華民国政府は、日本国政府により指定される一又は二以上の航空企業に対し、1に定める航空路線を

(a) 香港、サイゴン及びバンコックまで、並びに今後合意される他の以遠の地点まで
(a) to Hong Kong. Saigon and Bangkok and to such other points beyond as may be agreed upon later, and
(b) マニラまで、及び今後合意される他の以遠の地点まで延長することを許可し、かつ、前記の地点に向けられた旅客、貨物及び郵便物を台北において積み込み、また、前記の地点からの旅客、貨物及び郵便物を台北において積み卸す権利を許与することに同意する。
(b) to Manila and to such other points beyond as may be agreed upon later, with right take to take on passengers, cargo and mail for such points, and to discharge passengers, cargo and mail from such points, in Taipei.
4 日本国政府は、中華民国政府により指定される一又は二以上の航空企業に対し、

(a) 2(a)に定める航空路線を
(a) to extend the air route as specified in paragraph 2 (a):
(i) 釜山、京城まで、及び今後合意される他の以遠の地点まで
(i) to Pusan, Seoul and to such other points beyond as may be agreed upon later, and
(ii) 北太平洋における中間地点を経て今後合意されるアメリカ合衆国内の一地点まで、及び今後合意される他の以遠の地点まで延長することを許可し、かつ、前記の地点に向けられた旅客、貨物及び郵便物を東京において積み込み、また、前記の地点からの旅客、貨物及び郵便物を東京において積み卸す権利を許与することに同意する。
(ii) to a point in the United States of America to be agreed upon later, via intermediate points in the North Pacific, and to such other points beyond as may be agreed upon later, with rights to take on passengers,cargo and mail for such points, and to discharge passengers, cargo and mail from such points, in Tokyo; and
(b) 2(b)に定める航空路線を、釜山、京城まで、及び今後合意される他の以遠の地点まで延長することを許可し、かつ、前記の地点に向けられた旅客、貨物及び郵便物を岩国において積み込み、また、前記の地点からの旅客、貨物及び郵便物を岩国において積み卸す権利を許与することに同意する。
(b) to extend the air route as specified in paragraph 2 (b) to Pusan, Seoul and to such other points beyond as may be agreed upon later, with rights to take on passengers, cargo and mail for such points, and to discharge passengers, cargo and mail from such points, in Iwakuni.
5 運航回数は、両政府の航空当局間の相互の合意により決定するものとする。
5. The frequency of flights will be decided upon by mutual consent between the aeronautical authorities of the two Governments.
6 前記の両国間の路線及びその延長路線上において、同路線の運営を認められた一又は二以上の航空企業は、中間地点における着陸を省略していずれかの地点の間の無着陸飛行を行うことができる。
6. On each of the routes and extended routes as specified above, the airline or airlines authorized to operate such route may operate nonstop flights between any of the points omitting stops at the intermediate points.
7 前記の両国間の路線及びその延長路線の運営を認められた航空企業による旅客及び貨物の運送のための運賃は、両政府の認可を受けなければならない。前記の航空企業が定めようとするすべての新たな運賃は、両政府の航空当局に対し、認可を受けるため、その運賃の実施の日の少くとも三十日以前に提出されなければならない。
7. The rates to be charged for the carriage of passengers and cargo by the airlines authorized to operate the routes and extended routes shall be subject to the approval of the two Governments. Any new rate proposed by such airlines shall be filed for approval with the aeronautical authorities of the two Governments at least thirty (30) days before the proposed date of introduction.
8 両政府は、前記の業務に関し、千九百四十四年十二月七日にシカゴで署名された国際民間航空条約の規定を適用することを約束する。
8. The two Governments undertake to apply, in connection with the services specified above, the provisions set forth in the Convention on International Civil Aviation signed at Chicago on December 7, l944.
9 いずれの一方の国の航空企業も、定期国際航空業務に関して、次に掲げる特権を享有するものとする。
9. Any airline of either country shall enjoy the following privileges in respect of scheduled international air services:
(a) 他方の国の領域を無着陸で横断する特権
(a) to fly without landing across the territories of the other country: and
(b) 運輸以外の目的で他方の国の領域に着陸する特権
(b) to make stops in the territories of the other country for nontraffic purposes.
10以上の取極は、千九百五十五年三月十五日から一年間効力を有するものとし、また、いずれか一方の政府がこの取極を終了させる意思を他方の政府に対して一年の期間が満了する九十日前に通告しない限り、引き続きそれぞれ一年の期間について自動的に効力を延長されるものとする。もつとも、この取極は、千九百五十二年四月二十八日に台北で署名された中華民国と日本国との間の平和条約第八条において予見される民間航空運送に関する協定が両国間で締結されたときは効力を失うものとする。
l0. The arrangements set forth above will remain in force for a period of one year as from March l5, l955, and shall be automatically extended for successive periods of one year each, unless either Government notifies the other ninety (90) days prior to the expiration of each period of one year,of its intention to terminate the arrangements. However, the present arrangements shall cease to be effective upon the conclusion between the two countries of an agreement relating to civil air transport as envisaged in Article VIII of the Treaty of Peace between the Republic of China and Japan signed at Taipei on April 28, l952.

書簡をもつて啓上致します。本使は、千九百五十五年三月十五日に東京で署名された航空業務に関する日本国と中華民国との間の取極に言及し、日本国政府に代つて、前記取極において日本国政府の指定する航空企業に与えられた路線1.(a)及び(b)のうち、「岩国」(Iwakuni)を「大阪」(Osaka)に改めることを提案する光栄を有します。
本使は、前記の提案が中華民国政府の同意を得るならば、この書簡及びこれに対する返簡が前記の事項に関する日本国政府と中華民国政府との間の取極を構成するものとみなし、この取極はこの書簡に対する貴部長の返簡の日付の日から効力を生ずることを提案いたします。

書簡をもつて啓上いたします。本使は、千九百六十年六月十八日付の閣下の次の書簡を受領したことを確認する光栄を有します。
「書簡をもつて啓上致します。本部長は、千九百五十五年三月十五日に東京で署名された航空業務に関する中華民国と日本国との間の取極に言及し、中華民国政府に代つて、前記取極において中華民国政府の指定する航空企業に与えられた路線2.(a)、(b)及び4.(b)のうち、「岩国」(Iwakuni)を「大阪」(Osaka)に改めることを提案する光栄を有します。
本部長は、前記の提案が日本国政府の同意を得るならば、この書簡及びこれに対する返筒が前記の事項に関する中華民国政府と日本国政府との間の取極を構成するものとみなし、この取極はこの書簡に対する貴大使の返簡の日付の日から効力を生ずることを提案いたします。」
本使は、日本国政府に代つて中華民国政府の前記の提案を受諾したことを閣下に通報し、かつ、閣下の書簡およびこの返書が前記の事項に関する両国政府間の取極を構成するものとみなし、この取極は本日から効力を生ずることを確認する光栄を有します。
本使は、以上申し進めるに際し、閣下に向かつて重ねて敬意を表します。
