オーストリアのある種の請求権の解決に関する日本国政府とオーストリア共和国連邦政府との間の交換公文

書簡をもつて啓上いたします。本大臣は、両国間の請求権問題の解決に関する最近の閣下との会談に言及するとともに、日本国政府が、両国政府が次の取極を合意することを提案する旨を閣下に通報する光栄を有します。
Monsieur 1' Ambassadeur,With reference to our recent conversations regarding the settlement of the problem of claims between our two Governments, I have the honour to inform Your Excellency that the Government of Japan proposes that the two Governments agree upon the following arrangements:
1 日本国政府は、第二次世界大戦(千九百三十七年七月七日からの支那事変を含む。)の間に日本国政府の機関が与えた損害及び苦痛であつて日本国政府が国際法に従い責任を有するものの賠償につきオーストリア共和国連邦政府が提起したすべての請求を満足させるため、これらの請求に対し一万六千七百合衆国ドルの金額をオーストリア共和国連邦政府に支払う。
l. For the purpose of satisfying all claims presented by the Federal Government of the Republic of Austria for indemnification of the damage and sufferings caused during the Second World War(including the hostilities in China from July 7, l937) by agencies of the Government of Japan and for which the Government of Japan is responsible according to international law, the Government of Japan will pay to the Federal Government of the Republic of Austria for these claims the amount of sixteen thousand seven hundred United States dollars.
2 前項に掲げる支払は、この取極の効力発生の時から三箇月をこえない最も短い実行可能な期間内に行なうものとする。
2. The payment referred to in the preceding paragraph will be made within the shortest practicable time not to exceed three months from the coming into effect of the present arrangements.
3 オーストリア共和国連邦政府は、1に掲げる金額の日本国政府による支払を、同項にいうすべての請求権の完全なかつ最終的な解決として受諾する。
3. The Federal Government of the Republic of Austria accepts the payment by the Government of Japan of the amount mentioned in paragraph 1 as a full and final settlement of all claims referred to in the said paragraph.
前記の金額の支払の後は、オーストリア共和国連邦政府は、同種のいかなるこれ以上の請求をも提起しない。
After the payment of the said amount,the Federal Government of the Republic of Austria undertakes not to raise any further claims of the same kind.
本大臣は、さらに、この書簡及び前記の提案の貴国政府による受諾を確認される閣下の返簡を、閣下の返簡の日付の日に効力を生ずる両国政府間の合意を構成するものとみなすことを提案する光栄を有します。
I have further the honour to propose that this Note and Your Excellenoy's reply confirming the acceptance by your Government of the above proposal shall be regarded as constituting an agreement between the two Governments which enters into effect on the date of Your Excellency's Note of reply.
本大臣は、以上を申し進めるに際し、ここに重ねて閣下に向かつて敬意を表します。

書簡をもつて啓上いたします。本使は、千九百六十六年十一月二十九日付けの閣下の次の書簡を受領したことを確認する光栄を有します。
I have the honour to acknpwledge the receipt of your Excellency's Note dated November 29, 1966, which reads as follows:

本使は、さらに、オーストリア共和国連邦政府が日本国政府の前記の提案を受諾することを閣下に通報し、かつ、閣下の書簡及びこの返簡を、本日効力を生する両国政府間の合意を構成するものとみなすことを確認する光栄を有します。
I have further the honour to inform Your Excellency that the Federal Government of the Republic of Austria accepts the above proposal of the Government of Japan and to confirm that Your Excellency's Note and this reply are considered as constituting an agreement between the two Governments which enters into effect on this date.
本使は、以上を申し進めるに際し、ここに重ねて閣下に向かつて敬意を表します。
