日本国とオーストリアとの間の貿易に関する交換公文 
(オーストリア側書簡)

(Austrian letter)


　

　Vienna, November 4,1966


　書簡をもつて啓上いたします。本官は、オーストリア連邦政府及び日本国政府の代表団が両国間の貿易関係を改善するため千九百六十六年十月三日から十月二十四日までウィーンで会合し、次のとおり合意したことを本国政府に代わつて確認する光栄を有します。

　Mr.Chairman,
On behalf of my Government I have the honour to confirm that Delegations of the Austrian Federal Government and the Government of Japan, having met in Vienna from October 3 to October 24, 1966, with a view to improving the trade relations between the two countries, have agreed as follows:


I　千九百六十六年五月一日から千九百六十六年十二月三十一日までの期間については、オーストリアと日本国との間の貿易に関する千九百六十五年四月三十日付けの交換公文による取極の規定が必要な修正を加えて引き続き適用され、したがつて同取極において割当てが定められている商品の輸入に対する輸入許可は、期間に応じた按分比例に基づき発給される。

I.For the period from May 1, 1966 until December 31, 1966 the provisions of the arrangement embodied in the letters exchanged on April 30, 1965 concerning the trade between Austria and Japan continue to be applied mutatis mutandis and licences for the importation of commodities, quotas of which are provided for in the aforementioned arrangement, will therefore be issued on a pro rata temporis basis.


II　千九百六十七年一月一日以降の期間については、次の規定が適用される。

II.As from January 1, 1967 the following provisions will apply;


1　両国政府は、両国間の貿易関係を一層発展させ、かつ、両国間の貿易関係に関しなお存在する困難をできる限り除去するため引き続き努力する。

1.The two Governments will continue their efforts to develop further the trade relations between the two countries and to eliminate, as far as possible, difficulties still existing with respect thereto.


2　オーストリアの権限のある当局は、この書簡に附属する「オーストリアの輸入品目表」に掲げられていない商品の日本国からの輸入に対し、いかなる数量制限も行なうことなく輸入許可を発給する。

2.The competent Austrian authorities will issue licences, without any quantitative restrictions, for the importation from Japan of the commodities which are not specified in the "Austrian Import List" attached to the present letter.


3　この書簡に附属する「オーストリアの輸入品目表」に掲げる商品の輸入に対しては、次の規定が適用される。

3.To the importation of the commodities which are enumerated in the "Austrian Import List" attached to the present letter the following provisions will apply:


(a)　オーストリアの権限のある当局は、ガット諸国からの輸入が自由化されていない商品の日本国からの輸入に対し、この書簡の日付の日においてガット諸国からの輸入に適用されている全地域向け割当制度及び自由裁量輸入許可発給手続の利益を与える。これらの商品のうちの一又は二以上の品目につきガット諸国からの輸入が自由化される場合は、それらの品目に対して(b)の規定が適用される。

a)The competent Austrian authorities will extend to the importation from Japan of the commodities of which the importation from the GATT member countries is not liberalized the benefits of the global quota systems and of discretionary licensing procedures applicable to importation from the GATT member countries on the date of the present letter.  In case the importation of one or more items among these commodities from the GATT member countries is liberalized, the provisions of subparagraph b) will apply to such items.


(b)　オーストリアの権限のある当局は、(a)にいうもの以外の商品の日本国からの輸入に対し輸入許可を発給する。オーストリア連邦政府は、オーストリアにおけるその時の経済的条件により絶対的に必要とされない限り、前記の商品に対する輸入許可の発給を拒否する意図を有しない。

b)The competent Austrian authorities will issue licences for the importation from Japan of the commodities other than those referred to in subparagraph a) above. The Austrian Federal Government has no intention to decline the issuance of licences for such commodities, unless absolutely required to do so by the economic conditions then prevailing in Austria.


4　原産地証明の提出については、オーストリアの自由化リスト(Zollaemterermaechtigungsliste)の関係規定がガット諸国からの輸入に適用されるのと同様に日本国からの輸入に適用される。

4.For submission of certificates of origin the relevant provisions of the Austrian liberalization list (Zollaemterermaechtigungsliste) will apply to importation from Japan in the same way as they apply to importation from the GATT member countries.


5　前記の諸項に関連し、日本国からオーストリアヘの綿製品の輸入については、関税及び貿易に関する一般協定の下で締結された綿製品の国際貿易に関する長期取極に従つて千九百六十二年九月十七日にウィーンで署名された日本国からオーストリアヘの綿製品の輸出に関するオーストリア連邦政府と日本国政府との間の取極の規定が適用されることが了解される。

5.In connection with the preceding paragraphs it is understood that the provisions of the Arrangement between the Austrian Federal Government and the Government of Japan concerning the export of cotton textiles from Japan to Austria, signed on September 17, 1962, at Vienna, in accordance with the Long-Term Arrangements Regarding International Trade in Cotton Textiles concluded under the auspices of the General Agreement on Tariffs and Trade, will apply with regard to the importation from Japan into Austria of cotton textile products.


6　日本国政府は、この書簡の日付の日における日本国の自由化及び全地域向け割当てのすべての利益をオーストリアからの商品の輸入に対して引き続き与える。

6.The Government of Japan will continue to accord all the benefits of its liberalization and of the global quotas existing on the date of the present letter to the importation of commodities from Austria.


7　両国において施行されている国家専売、外国為替管理その他の行政的性格をもつ管理に関連する法令に基づく商品の輸入、輸出及び通過の禁止及び制限は、この取極によつて影響されない。

7.The prohibitions and restrictions of the importation, exportation and transit of commodities in accordance with laws and regulations concerning state monopolies, foreign exchange control and other control of administrative nature existing in the two countries, will not be affected by the present arrangement.


8　両国政府の代表団は、両国間の貿易関係を一層改善するため、千九百六十七年十二月三十一日前に十分の余裕をもつて会合するものとする。

8.Delegations of the two Governments will meet, well in advance of December 31, 1967, with a view to arranging for further improvement of the trade relations between the two countries.


9　この取極は、千九百六十七年十二月三十一日まで効力を有する。いずれか一方の政府が他方の政府に対しこの取極を終了させる意思について文書による通告を期限満了の一箇月前に与えなかつた場合には、その効力は自動的にさらに一年間延長されるものとする。

9.The present arrangement shall be valid until December 31,1967. If neither Government has given written notice to the other Government of its intention to terminate the present arrangement one month prior to its expiration, its validity shall be automatically extended for another year.


　貴官が、前記のことを貴国政府に代わつて確認されれば幸いであります。

　I shall be grateful, if you would confirm the foregoing on behalf of your Government.
