半自動防空警戒管制組織（バッジ組織）に対する追加計画に関する日本国政府とアメリカ合衆国政府との間の交換公文

米国側書簡

　Tokyo, June 18. 1965.

　書簡をもつて啓上いたします。本使は、千九百五十四年三月八日に東京で署名されたアメリカ合衆国と日本国との間の相互防衛援助協定及び現存の日本国の航空機管制警戒組織を半自動航空兵器管制組織(基地対空防衛地上(バッジ)組織という。)に拡充し及び改造するための経費分担計画に関する千九百六十四年十二月四日付けのアメリカ合衆国特命全権大使と日本国外務大臣との間の交換公文に言及する光栄を有します。アメリカ合衆国政府及び日本国政府の代表者は、バッジ組織の性能を増大させる効果を有するバッジ組織に対する一定の追加計画に関し討議を行ないました。この討議の結果による本国政府の了解は次のとおりであります。

　Excellency,I have the honor to refer to the Mutual Defense Assistance Agreement between the United States of America and Japan signed at Tokyo on March 8, 1954 and the exchange of Notes dated December 4, 1964, between the Ambassador Extraordinary and Plenipotentiary of the United States of America and the Minister for Foreign Affairs of Japan, relating to the cost sharing program to expand and convert the existing Japanese aircraft control and warning system to a semiautomatic air weapons control system, referred to as the base air defense ground environment (BADGE) system. Representatives of the Governments of the United States of America and Japan have held discussions concerning certain additions to the BADGE system which would have the effect of enhancing its capability As a result of these discussions, the understanding of my Government is as follows:

1　アメリカ合衆国政府は、歳出予算に計上された資金があることを条件として、総額が五百万ドルをこえない範囲で、千九百六十四年十二月四日付けの交換公文に基づき設置されるバッジ組織に対する相互に合意される一定の追加計画の経費の二十五パーセントを分担する。アメリカ合衆国政府が分担する資金は、合衆国内において支出され、また、合衆国内において調達される装備及び資材並びに合衆国の契約者の役務の経費の支払に充てられる。この項に規定する合衆国の分担額をこえるすべての経費は、日本国政府が負担する。

1. The Government of the United States of America will contribute, subject to the availability of appropriated funds, 25 percent of the cost of certain additions, to be mutually agreed, to the BADGE system established pursuant to the Exchange of Notes of December 4, 1964, in an amount not to exceed $5 million. The funds contributed by the Government of the United States of America will be expended in the United States and will be applied toward payment of the cost of the equipment and materials procured in the United States and services of United States contractors. All costs in excess of the United States contribution as set forth herein will be borne by the Government of Japan.

2　バッジ組織に対する前記の追迦計画を実施するための技術的細目の取極は、両政府がその目的のため指名する代表者により締結される。

2. Detailed technical arrangements for carrying out the said additions to the BADGE system will be concluded by representatives to be designated for the purpose by the two Governments.

3　千九百六十四年十二月四日付けの交換公文の1、2、3、6、7及び8の規定は、必要な変更を加えて、バッジ組織に対する前記の追加計画について適用されるものとする。

3. Paragraphs 1, 2, 3, 6, 7 and 8 of the Exchange of Notes of December 4, 1964, shall apply, mutatis mutandis, to the said additions to the BADGE system.

　本使は、この了解が日本国政府により受諾される場合には、この書簡及び受諾する旨の閣下の返簡を閣下の返簡の日付の日に効力を生ずる両政府間の合意を構成するものとみなすことを提案する光栄を有します。

　I have the honor to propose that if this understanding is accept able to the Government of Japan, this Note and Your Excellency's reply to that effect shall constitute an agreement between our two Governments, which shall enter into force on the date of Your Excellency's reply.

　本使は、以上を申し進めるに際し、ここに重ねて閣下に向かつて敬意を表します。

　I have the honour to confirm on behalf of my Government that the foregoing understanding is acceptable to the Government of Japan, and to agree that the Note under acknowledgement, together with this Note, shall constitute an agreement between our two Governments, which shall enter into force this day.

　書簡をもつて啓上いたします。本使は、千九百五十四年三月八日に東京で署名されたアメリカ合衆国と日本国との間の相互防衛援助協定に言及する光栄を有します。同協定は、各政府が、他方の政府に対し、援助を供与する政府が承認することがある装備、資材、役務その他の援助を、両政府の間で行なうべき細目取極に従つて、使用に供するものとすることを特に規定しています。

　Excellency:I have the honour to refer to the Mutual Defense Assistance Agreement between the United States of America and Japan signed at Tokyo on  March 8, 1954, which provides, inter alia, that each Government will make available to the other such equipment, materials, services, or other assistance as the Government furnishing such assistance may authorize, in accordance with such detailed arrangements as may be made between them.

　アメリカ合衆国政府及び日本国政府の代表者は、日本国のための効果的な対空防衛組織を発展させることが相互の利益であることに考慮を払い、現存の日本国の航空機管制警戒組織を、半自動航空兵器管制組織(以下基地対空防衛地上(バッジ)組織という。)に拡充し及び改造するための経費分担計画について討議を行ないました。この討議の結果による本国政府の了解は次のとおりであります。

　Having regard to the mutual interest in the development of an effective air defense system for Japan, the representatives of the Governments of the United States of America and Japan have held discussions concerning a costsharing program to expand and convert the existing Japanese aircraft control and warning system to a semiautomatic air weapons control system, hereinafter referred to as the base air defense ground environment (BADGE) system. As a result of these discuss ions, the understanding of my Government is as follows:

1　日本国政府は、半自動航空兵器管制組織を設置する。この組織は、日本国政府により維持され、運営され及び使用される。また、同組織から得られる資料は、日本国の防衛に利用されるために、アメリカ合衆国政府の使用に供される。

1. The Government of Japan will establish a semi-automatic air weapons control system. This system will be maintained f operated and utilized by the Government of Japan, and the data obtained therefrom will be made available to the Government of the United States of America to be used for the defense of Japan.

2　アメリカ合衆国政府は、バッジ組織のために必要な一定の装備、資材及び役務を取得することにつき、日本国政府を援助する。

2. The Government of the United States of America will assist the Government of Japan in obtaining certain equipment, materials, and services necessary for the BADGE system.

3　バッジ組織のために調達される装備の少なくとも五十パーセントは、合衆国内において調達されるものとし、また、その比率は、合衆国の契約者の経費見積りに基づくドル価額によるものとする。

3. At least 5O percent of equipment to be procured for the BADGE system will be equipment the source of which is in the United States, and such percentage will be in terms of dollar value based on the United States Contractor t s cost estimate.

4　アメリカ合衆国政府は、歳出予算に計上された資金があることを条件として、総額にして九百万ドルをこえない範囲で、バッジの装備、資材及び役務の経費の二十五パーセントを贈与する。アメリカ合衆国政府により贈与される資金は、合衆国内において支出され、また、合衆国内において調達される装備及び資材並びに合衆国の契約者の役務の経費の支払に充てられる。この項に規定する合衆国の贈与額をこえるすべての経費は、日本国政府が負担する。

4. The Government of the United States of America will contribute, subject to the availability of appropriated funds, 25 percent of the cost of the BADGE equipment, materials and services, in an amount not to exceed $9 million. The funds contributed by the Government of the United States of America will be expended in the United States and will be appled towards payment of the cost of the equipment and materials procured in the United States and services of United States contractors. All costs in excess of the United States contribution as set forth herein will be borne by the Government of Japan.

5　この計画の完成のための技術的細目の取極は、両政府がその目的のため指名する代表者により締結される。

5. Detailed technical arrangements for completion of the project will be concluded by representatives to be designated for that purpose by the two Governmnets.

6　この合意及びこれに基づき結ばれるすベての取極に基づいていずれか一方の政府が負担する財政上の債務又は支出は、それぞれの国の憲法上の規定に従つた予算上の承認を得ることを条件とする。

6. Financial obligations or expenditures incurred by either Government under this agreement, and all arrangements to be concluded hereunder will be subject to budget authorization pursuant to the constitutional provisions of the respective countries.

7　この合意に基づき供与される技術上の知識及び特許権は、千九百五十六年三月二十二日に東京で署名された防衛目的のためにする特許権及び技術上の知識の交流を容易にするためのアメリカ合衆国政府と日本国政府との間の協定の規定に従うものとする。

7. Technical information and patent rights furnished under this agreement shall be subject to the provisions of the Agreement between the Government of the United States of America and the Government of Japan to Facilitate the Exchange of Patent Right and Technical Information for Purposes of Defense, signed at Tokyo on March 22, 1956.

8　日本国政府は、バッジ組織のため日本国に輸入される合衆国製の装備について、前記の相互防衛援助協定第六条に従い、関税及び内国税を免除する。

8. In accordance with Article VI of the aforementioned Mutual Defence Assistance

　本使は、この了解が日本国政府により受諾される場合には、この書簡及び受諾する旨の閣下の返簡を閣下の返簡の日付の日に効力を生ずる両政府間の合意を構成するものとみなすことを提案する光栄を有します。

　Agreement, the Government of Japan will waive custom duties and internal taxation on United States manufactured equipment imported into Japan for the BADGE system.

　I have the honor to propose that if this understanding is acceptable to the Government of Japan, this Note and Your Excellency's reply to that effect shall constitute an agreement between our two Governments, which shall enter into force on the date of Your Excellency's reply.
