日本国とアメリカ合衆国との間の綿製品の貿易に関する千九百六十三年から千九百六十五年までの期間についての取極を修正する交換公文

日本側書簡

　(Japanese Note)

　May 19, 1965.

　書簡をもつて啓上いたします。本使は、千九百六十三年八月二十七日付けの交換公文によつて行なわれた綿製品の貿易に関する日本国政府とアメリカ合衆国政府との間の取極を修正するため両政府の代表者の間でワシントンで行なわれた最近の討議に言及し、かつ、同取極の10その他の関連規定に従い同取極を次のとおり修正することを本国政府に代わつて提案する光栄を有します。

　Excellency,
　I have the honor to refer to the recent discussions held in Washington between the representatives of our two Governments for the modification of the Arrangement  Between the Government of Japan and the Government of the United States of America Concerning Trade in Cotton Textiles, effected by the Exchange of Notes on August 27, 1963, and to propose , on behalf of my Government, in accordance with paragraph 10 and other relevant provisions of the said Arrangement, that the following modifications be made with respect to the said Arrangement:

1　取極2の「第一群、第二群、第三群」で始まる文を削り、次の規定を置く。

1. In numbered paragraph 2 of the Arrangement the sentence commencing with "Within the annual aggregate limit" shall be deleted and replaced by the following:

　第一群、第二群、第三群及び第四群に対する枠は、年間合計枠の中で、五パーセントを限度として超過することができる。ただし、この「融通率」の規定に基づく増加は、附表A5の規定に従つて認めるか又は附表Aのそれぞれの群の中で掲げる「その他」の類についてのみ認めるものとする。

　"Within the annual aggregate limit, the limits for Groups I, II, III, and IV may be exceeded by not more than 5 percent, provided that this provision for ''flexibility" shall permit an increase only in accordance with paragraph 5 in Annex A or in the "Other" categories referred to in each  group in Annex A."

2　取極5bの最後の文を削り、次の規定を置く。

2. The last sentence in numbered paragraph 5b of the Arrangement shall be deleted and replaced by the following:

　そのような協議が行なわれている間、日本国政府は、当該製品の輸出を、両政府が関係輸出資料を入手することができる最近の十二箇月間における同製品の輸出の百五パーセントをこえない年間水準に、四半期を基礎として、維持することとする。

　"During the course of such consultations, the Japanese Government will maintain exports in the products in question on a quarterly basis at annual levels not in excess of 105 percent of the exports of such products during the twelve most recent months for which relevant export data are available to both Governments."

3　附表A1cを削り、次の規定を置く。

3. Paragraph 1c in Annex A shall be deleted and replaced by the following:

　c 「その他の織物」の中で、次に掲げる特定の上限はこえてはならないものとする。

4　附表A1fを削る。

4.Paragraph 1f in Annex A shall be deleted

5　附表A2a(4)を削る。したがつて、2a(5)及び(6)を、それぞれ、(4)及び(5)とする。新たな(5)を次のように改める。

5.Item (4) of Paragraph 2a in Annex A shall be deleted. Accordingly, items (5) and (6) of paragraph 2 a shall be renumbered as (4) and (5) respectively. The new item (5) shall be modified to read as follows:

6　附表A2bを削り、次の規定を置く。

7　附表A3a(1)を削る。3aの他のすべての項目の番号をそれに応じて改める。新たな(12)を次のように改める。

8　附表A3bを削り、次の規定を置く。

10　附表A4aの第一文の次に次の規定を加える。

10. The first sentence of paragraph 4a in Annex A shall be modified by inserting the following immediately after  "Miscellaneous cotton textiles"

　ただし、千九百六十五年のジッパー・テープ(他に掲げるものを除く。)に対する枠は、一万六千百五十五ポンドまで超過することができる。

　"provided that the limit for zipper tapes, n.e.s., for 1965 may be exceeded by 16, 155 lbs."

11　附表A4の次に5として次の新たな規定を加える。したがつて、現在の附表A5を6とし、かつ、4a(2)の文中の5を6とする。

11. The following new paragraph shall be inserted as paragraph 5 immediately after paragraph 4 in Annex A. Accordingly, present paragraph 5 in Annex A shall be renumbered as paragraph 6 and the phrase "paragraph5" in item (2) of paragraph 4 a shall be deleted and replaced by the phrase "paragraph 4 a shall be deleted and replaced by the phrase "paragraph 5":

　5 特定の製品に対する枠及び上限は、年間合計枠及び取極2に掲げる群に対する制限の中で、五パーセントを限度として超過することができる。ただし、第五種目、第六種目、第七種目、ダック、第四十五種目、第四十六種目、第五十種目、第五十一種目、第五十二種目、第五十三種目、第五十四種目及び第六十種目に対する枠及び上限を除く。

　"5. Within the annual aggregate limit and the limitation for the groups provided for in paragraph 2 of the Arrangement, the limits and ceilings set for specific products, except those for Categories 5, 6, 7, duck, 45, 46, 50, 51, 52, 53, 54, 60, may be exceeded by not more than 5 percent."

　本使は、前記の提案が貴国政府にとつて受諾しうるものであるときは、この書簡及び前記の提案に同意される旨の閣下の返簡が閣下の日付の日に効力を生ずる両政府間の合意を構成することを提案する光栄を有します。

　If the foregoing proposals are acceptable to your Government, I have the honor to pro pose that the present Note and your reply concurring therein shall constitute an agreement between our two Governments to modify the aforementioned Arrangement , which shall enter into force on the date of your reply.

　本使は、以上を申し進めるに際し、ここに重ねて閣下に向かつて敬意を表します。

　書簡をもつて啓上いたします。本官は、本日付けの閣下の次の書簡を受領したことを確認する光栄を有します。

　Excellency:
　I have the honor to acknowledge the receipt of your note of today's date, which reads as follows:

　本官は、閣下の書簡に述べられている提案が本国政府にとつて受諾しうるものであることを閣下に通報する光栄を有します。したがつて、閣下の書簡及びこの返簡が本日付けで効力を生ずる両政府間の合意を構成します。

　I have the honor to inform you that the proposals set forth in your note are accptable to my Government. Accordingly, your note and this reply shall constitute an agreement between the two Governments, which shall enter into force on this date.

　本官は、以上を申し進めるに際し、ここに重ねて閣下に向かつて敬意を表します。

　Accept, Excellency, the renewed assurance of my highest consideration.
