AGREEMENT FOR THE EXCHANGE OF MONEY ORDERS BETWEEN JAPAN AND THE UNITED KINGDOM OF GREAT BRITAIN AND NORTHERN IRELAND

　日本国政府及びグレート・ブリテン及び北部アイルランド連合王国政府は、

　The Government of Japan and the Government of the United Kingdom of Great Britain and Northern Ireland:

　両国の間の郵便為替の交換の業務を改善することを希望して、

　Being desirous of improving the service of exchange of Money 0rders between their respective countries:

　次のとおり協定した。

　Have agreed as follows:-

第一条
(1)　一方日本国と他方グレート・ブリテン及び北部アイルランド連合王国との間における通常為替及び電信為替の交換は、この約定の規定に従う。

Article1
(1)The exchange of 0rdinary Money 0rders and Telegraph Money 0rders between Japan on the one hand and the United Kingdom of Great Britain and Northern Ireland on the other hand shall be governed by the provisions of the present Agreement.

(2)　この約定において、「グレート・ブリテン及び北部アイルランド連合王国」には、チャネル諸島及びマン島を含む。

(2)In the present Agreement the expression "United Kingdom of Great Britain and Northern Ireland" includes The Channel Islands and Isle of Man.

第二条
(1)　郵便為替は、日本国政府及びグレート・ブリテン及び北部アイルランド連合王国政府のそれぞれの郵政庁間に特別の合意がない限り、名あて国の通貨で表示する。

Article2
(1) In the absence of any special agree-between the respective Postal Administrations of the Government of Japan and the Government of the United Kingdom of Great Britain and Northern Ireland, Money 0rders shall be expressed in the currency of the country of destination.

(2)　各郵政庁は、他方の郵政庁との合意により、郵便為替一口の振出最高額を定める。

(2)Each Postal Administration shall fix, in agreement with the other, the maximum amount for which it will issue a single Money 0rder.

第三条
　各郵政庁は、自己が振り出す郵便為替に適用する換算割合を事情に応じて定める権能を有する。

Article3
　Each Postal Administration shall have the power to fix, according to circumstances, the rate of conversion applicable to the Money 0rders issued by it.

第四条
(1)　各郵政庁は、自己が振り出す郵便為替について徴収する料金の割合を事情に応じて定める権能を有する。料金は、為替を振り出す郵政庁に帰属する。

Article4
(1)Each Postal Administration shall have the power to fix, according to circumstances, the rates of commission to be charged on the Money 0rders which it may issue. The commission shall belong to the Postal Administration which issues the 0rders.

(2)　各郵政庁は、自国で振り出され他方の国に通知される郵便為替の金額の二百分の一を他方の郵政庁に割り当てなければならない。

(2)Each Postal Administration shall allow to the other 1/2% (one-half of one per cent) of the amount of Money 0rders issued in its country and advised to the other country.

第五条
(1)　電信為替は、為替電報により通知する。

Article5
(1)Telegraph Money 0rders shall be advised by means of money order telegrams of advice.

(2)　国際電気通信条約(千九百五十九年ジュネーヴ)附属電信規則(千九百五十八年ジュネーヴ改正)又は将来これに代わる規則は、為替電報に適用する。

(2)The Telegraph Regulations (Geneva Revision, 1958) annexed to the International Telecommunication Convention (Geneva, 1959), or any regulation which may in future be substituted therefor, shall apply to money order telegrams of advice.

(3)　電信為替の差出人は、所要の附加語に対して相当する料金を支払つた上、受取人に送付することを希望する通信文を為替電報に附加することを許される。

(3)The remitter of a Telegraph Money 0rder shall be allowed, on paying at the appropriate rate for the extra words required, to add the to money order telegram of advice any communication which he may wish to send to the payee.

第六条
(1)　各郵政庁は、他方の郵政庁の仲介により、当該他方の郵政庁が郵便為替業務を実施している国又は地域に郵便為替によつて送金することができる。

Article6
(1)Each Postal Administration shall be at liberty to send, through the medium of the other Administration, Money 0rder remittances to any countries or territories with which the other Administration transacts Money 0rder business.

(2)　仲介業務を行なう郵政庁は、その業務に対して特別の料金を徴収することができるものとし、その料金は、仲介される各為替の金額から控除される。

(2)The Administration which acts as intermediary shall be entitled to charge for its services a special commission which shall be deducted from the amount of each re-advised 0rder.

第七条
　郵便為替の差出人は、振出しの際に、又は振出しの月の末日から十二箇月以内に、その為替の払渡済通知を請求することができる。

Article7
　The remitter of a Money 0rder may apply for an Advice of Payment of the 0rder either at the time of issue or within twelve months from the end of the month of issue.

第八条
　郵便為替は、振出しの月の満了の後十二箇月の間は払い渡される。この期間内に払い渡されなかつた郵便為替の金額は、振出郵政庁の規則に従つて処理されるため、振出郵政庁に返還する。

Article8
　A Money 0rder shall remain payable for twelve months after the expiration of the month of issue. The amounts of all Money 0rders not paid within that period shall be returned to the Postal Administration of issue to be dealt with in accordance with the regulations of that Administration.

第九条
　郵便為替の差出人は、受取人の氏名若しくは住所の訂正若しくは変更又はその為替の取りもどしを請求することができる。

Article9
　The remitter of a Money 0rder may apply for correction or alteration of the name or address of the payee, or withdrawal of the order from the service.

第十条
　一方の国から他方の国に送達される郵便為替は、振出しについては振出国の現行の規則に、払渡しについては名あて国の現行の規則に従う。

Article10
　Money 0rders sent from one country to the other shall be subject, as regards issue, to the regulations in force in the country of origin, and, as regards payment, to the regulations in force in the country of destination.

第十一条
(1)　特別の合意がない限り、各郵政庁が振り出した郵便為替の総額を記載した郵便為替計算書は、いずれか一方の郵政庁が、施行規則に定める条件に従い、他方の郵政庁に送付する。

Article11
(1)A Money 0rder Account showing the total amount of the Money 0rders issued by each Administration shall in the absence of any special agreement be furnished by either of the two Postal Administrations to the other under the conditions prescribed by the Detailed Regulations.

(2)　両郵政庁間に特別の合意がない限り、計算書の差額は、差額の支払を受ける国の通貨で表示する。このため、差額は、計算書が関係する期間内における借方国の市場為替相場の平均値によつて少額の貸高を多額の貸高を有する国の通貨に換算した上、多額の貸高から少額の貸高を差し引いて確定する。

(2)In the absence of any special agreement between the two Postal Administrations, the balance of the account shall be shown in the currency of the country to which it is due. In order that this may be done, the amount of the smaller credit shall be converted into the currency of the country with the larger credit at the average of the market rate of exchange in the debtor country for the period to which the account relates. The balance shall then be ascertained by the deduction of the smaller from the larger credit.

第十二条
(1)　両郵政庁間に特別の合意がない限り、計算書の差額の支払は、貸方国の通貨で行なわなければならない。

Article12 
(1)In the absence of any special agreement between the two Postal Administrations, payment of the balance of the account shall be made in the currency of the creditor country.

(2)　借方郵政庁は、貸方郵政庁に対し、施行規則に定める条件に従つて支払を行なわなければならない。

(2)Payment shall be made by the debtor Administration to the creditor Administration under the conditions prescribed by the Detailed Regulations.

第十三条
　いずれの郵政庁も、特別な事情により、郵便為替業務の全部又は一部を一時停止しなければならないときは、この事実を、必要なときは電信により、直ちに他方の郵政庁に通知しなければならない。

Article13
When either of the Postal Administrations finds itself obliged, owing to exceptional circumstances, temporarily to suspend the Money 0rder service, either wholly or in part, it shall at once notify the fact, if necessary by telegraph, to the other Postal Administration.

第十四条
　両郵政庁は、合意により、この約定の実施のために必要な施行規則を定める。

Article14
　The two Postal Administrations shall determine, by mutual agreement, the Detailed Regulations necessary for the execution of the present Agreement.

第十五条
(1)　この約定は、日本国がその国内法上の手続に従つてこの約定を承認した旨の書面による通告をグレート・ブリテン及び北部アイルランド連合王国政府が日本国政府から受領した日に、効力を生ずる。

Article15
(1)The present Agreement shall enter into force on the date on which the Government of the United Kingdom of Great Britain and Northern Ireland shall have received from the Government of Japan written notification that Japan has approved the Agreement in accordance with its legal procedures.

(2)　この約定は、いずれか一方の締約国が他方の締約国に対しこの約定を廃棄する意思を通告した後十二箇月を経過するまで、引き続き効力を有する。

(2)The present Agreement shall continue in force until twelve months after either of the Contracting Parties shall have notified the other of its intention to terminate it.

第十六条
　この約定は、次の協定を廃棄し、かつ、これに代わるものとする。

Article16
　The present Agreement shall supersede and be substituted for the following agreements:

(a)　千九百八年十一月四日にロンドンで、及び明治四十一年十二月七日に東京で署名された「日本逓信省竝大不列顛及愛蘭聯合王国郵政廰間郵便為替業務約定」

(a)Agreement between the Post 0ffice of the United Kingdom of Great Britain and Ireland and the Department of Communications of Japan for the Service of Money 0rders, signed in London on the 4th day of November, 1908 and in Tokyo on the 7th day of the 12th month of the 41st year of Meiji.

(b)　千九百十三年二月六日にロンドンで、及び大正二年三月六日に東京で署名された(ａ)に掲げる約定の追加規定

(b)Additional Articles to the Agreement referred to in paragraph (a) of this Article, signed in London on the 6th day of February, 1913 and in Tokyo on the 6th day of the 3rd month of the 2nd year of Taisho.

　以上の証拠として、下名は、それぞれの政府からこのために正当に委任を受け、この約定に署名した。

　In witness whereof the undersigned, being duly authorised thereto by their respective Governments, have signed the present Agreement.

　千九百六十五年二月二十二日に東京で、ひとしく正文である日本語及び英語により本書二通を作成した。

　Done in duplicate at Tokyo this twenty-second day of February, 1965 in the Japanese and English languages, both texts being equally authoritative.
