Kuala Lumpur, 23rd December, 1965
書簡をもつて啓上いたします。本使は、マレイシアに対する技術協力を促進するため日本青年海外協力隊のマレイシアへの派遣計画に関し日本国政府の代表とマレイシア政府の代表との間でクアラ・ランプールにおいて行なわれた最近の討議に言及するとともに、これらの代表者の間で到達した附属の覚書に掲げられた了解を日本国政府に代わつて確認する光栄を有します。
Excellency,I have the honour to refer to the recent discussions held in Kuala Lumpur by the representatives of the Government of Japan and the Government of Malaysia concerning the despatch programme of Japan Overseas Cooperation Volunteers to Malaysia with a view to promoting technical co-operation with Malaysia and to confirm on behalf of the Government of Japan the understandings reached between them which are set forth in the attached Memorandum.

日本青年海外協力隊の派遣計画に関する覚書
MEMORANDUM CONCERNING THE DESPATCH PROGRAMME OF THE JAPAN OVERSEAS CO-OPERATION VOLUNTEERS
1 派遣計画の目的
1. OBJECTIVE OF THE DESPATCH PROGRAMME
日本国政府は、この計画に関するマレイシアの唯一の調整機関である総理府経済企画部(以下「Ｅ・Ｐ・Ｕ」という。)を通じてのマレイシア政府の要請に基づき、日本国の現行法令に従い、技術援助を提供することによりマレイシアの各分野における経済開発の促進に寄与するため、日本青年海外協力隊(以下「協力隊」という。)を派遣する。協力隊の派遣は、両国政府間で外交経路を通じて別個に合意される計画に従つて行なわれる。
Upon request made by the Government of Malaysia through the Economic Planning Unit (hereinafter referred to as "E.P.U.")of the Prime Minister's Department, which is the sole co-ordinating authority in Malaysia in regard to this programme, the Government of Japan will despatch, in accordance with laws and regulations in force in Japan, Japan Overseas Co-operation Volunteers (hereinafter referred to as "Volunteers") to Malaysia, with a view to helping promote economic development in various fields of Malaysia, by providing technical assistance. The despatch of the volunteers will be made according to the schedule to be separately agreed upon by the two Governments through diplomatic channels.
この計画は、日本国国民及びマレイシア国民の間の技術協力、友好及び理解を促進するものと期待される。
It is envisaged that this programme will promote technical co-operation, friendship and understanding between the Japanese and Malaysian people.
2 技術援助の分野
2. THE FIELD OF TECHNICAL ASSISTANCE
マレイシア政府は、農業、小企業、土木、文化及びマレイシアの経済社会開発計画に関してマレイシア政府が役務を必要とする他の分野において、協力隊の役務を要請することができる。マレイシア政府は、要請を行なうにあたり、特定の分野及びその分野のそれぞれについて要請される協力隊の隊員の数を、必要な資格及び技術の詳細とともに、明示する。
The Government of Malaysia may request for the services of the volunteers in the fields of agriculture, small scale industries, civil engineering and cultural affairs and such other fields relating to the economic and social development programme of Malaysia as the Government of Malaysia requires the service. In submitting the request, the Government of Malaysia will indicate the specific fields and number of the volunteers requested for each of the fields, together with the details and particulars of qualifications and skills required.
この覚書に定める協力隊の隊員の最小限の資格は、大学の学位又はこれに相当する実際上の経験とする。日本国の海外技術協力事業団は、Ｅ・Ｐ・Ｕに対し、協力隊の各隊員のマレイシアへの派遣に先だつて、その履歴、資格及び経験を通報する。
The minimum qualification for the volunteers covered by this Memorandum shall be the possession of a college degree or a corresponding practical experience. Japan Overseas Technical Co-operation Agency will inform the E.P.U. of biographic data and qualifications and experience concerning each volunteer prior to his despatch to Malaysia.
3 職務責任
3. JOB RESPONSIBILITIES
協力隊の隊員は、マレイシアの関係省及び関係機関に配属される。協力隊の隊員は、配属された機関に対して直接の責任を負い、その行政管理に服するものとし、要請された役務を行なうことを期待される。協力隊の隊員は、配属された省及び機関において施行されている政府の現行の規則に従う。
The volunteers shall be assigned to the Malaysian departments or agencies concerned. The volunteers will be directly responsible to and under the administrative control of the agencies where they are assigned and shall be expected to perform the services requested. They shall observe the existing Government rules and regulations which are enforced in the Government departments or agencies to which they are assigned.
4 マレイシアにおける協力隊の隊員の訓練
4. ORIENTATION TRAINING ON THE VOLUNTEERS IN MALAYSIA
協力隊の隊員は、日本において受ける基礎的訓練に加えて、正規の任務に先だつて、クアラ・ランプールにおいて訓練を受ける。この訓練は、最小限二週間行なわれる。
In addition to the basic training which the volunteers will undergo in Japan, they will have an orientation training in Kuala Lumpur prior to their regular assignment. The orientation training mentioned above shall be for a minimum period of two weeks.
協力隊の隊員は、クアラ・ランプールにおける訓練の期間中、マレイシアの事情について一般的説明を受ける政府の現存の施設において、無料で宿泊設備(食事は、含まれない。)の提供を受ける。
During the period of orientation training in Kuala Lumpur, the volunteers will be given free accommodation (but not board) in existing Government institutions, where they will be given a general briefing on Malaysian affaires.
5 任務の期間
5. THE TERM OF ASSIGNMENT
協力隊の隊員の任務の期間は、二年間とする。ただし、この期間は、日本国政府及びマレイシア政府の間の合意により、延長することができる。
The term of assignment of the volunteers will be for a period of two years. However, the term may be extended on mutual agreement of the Governments of Japan and Malaysia.
6 行政上の取決め
6.ADMINISTRATIVE ARRANGEMENTS
(1) 関税の免除
(1) Exemption of Custom Duty:
協力隊の隊員は、その任務遂行上必要な機械、器具、材料及び医薬品並びに身回品及び家庭用品について、到着の際又は任務の最初の六箇月間、関税その他すべての種類の課徴金の支払を免除される。
The volunteers are exempted form the payment of custom duties and charges of any kind imposed on or in connection with their importation of the equipment, machinery, materials and medical supplies required for the performance of their duties as well as personal and household effects at the time of their arrival of during the first six months period of their assignment.
(2) 所得税の免除
(2) Exemptions of Income Tax:
協力隊の隊員は、生活手当等の協力隊の隊員に対する海外からの送金について、所得税その他すべての種類の課徴金の支払を免除される。
The volunteers are exempted form the payment of income tax and charges of any kind imposed on or in connection with any allowances to be remitted form overseas for the volunteers such as the living allowances.
(3) 手当
(3)Allowances:
協力隊の隊員の生活手当は、予算措置が執られることを条件として、日本国政府が負担する。
Living allowances for the volunteers, subject to budgetary appropriations, will be borne by the Government of Japan.
(4) 交通
(4) Transportation:
日本国政府は、予算措置が執られることを条件として、協力隊の隊員の日本国とマレイシアにおける任務地との間の渡航費を負担する。公式の任務の遂行に関する協力隊の隊員の現地における交通費は、隊員を受け入れる省及び機関が負担する。
The Government of Japan will, subject to budgetary appropriations, bear the cost of travel of volunteers between Japan and the place of assignment in Malaysia. Local travel expenses in connection with the performance of official duties of the volunteers will be borne by the receiving departments and agencies.
(5) 住居
(5) Housing:
マレイシア政府は、任務地又はその附近において政府の住居が利用できるときは、協力隊の隊員に対し、同等の地位におけるマレイシア政府の職員に与えられるものと同様の住居を無料で提供する。このような政府の住居が利用できないときは、関係省又は関係機関の長は、適当な宿泊設備又は宿舎(家賃は、協力隊の隊員が支払う。)を定めるにあたり、できる限りの援助を与える。協力隊の隊員は、マレイシア人の同僚又はマレイシア人の家庭とともに宿泊することを奨励される。
Where Government housing is readily available at or near the place of assignment, the Government of Malaysia will provide free housing to the volunteers as provided to Malaysian Government officers in equivalent positions. When such Government housing is not available, the heads of the departments or agencies concerned will render whatever assistance possible in locating suitable accomodation or quarters the rental for which will be paid for by the volunteers themselves. Volunteers are encouraged to be housed with their Malaysian colleagues or Malaysian families.
(6) 医療
(6) Medical Care:
マレイシア政府は、協力隊の隊員に対し、同等の地位におけるマレイシア政府の職員に与えられるのと同じ程度に、医療(歯科は、含まれない。)及び病院における診療の便宣を与える。
The Government of Malaysia will provide for medical (but not dental) and hospital care for the volunteers to the same extent that such care is provided for Malaysian Government officers in equivalent positions.
7 協議、修正及び終了
7. CONSULTATION, MODIFICATION AND TERMINATION
両国政府は、この計画の実施を成功させるため、随時協議する。前記の了解は、両国政府間の合意により修正することができ、かつ、一方の政府により、その終了の意思を書面により他方の政府に通告した日から三十日後に、終了させることができる。
The two Governments shall enter into consultation, form time to time, for the successful implementation of this programme. The foregoing understandings may be modified upon agreement by both Governments and terminated by either Government effective thirty days after the date of a notice in writing given by either Government to the other of its intention to terminate it.
