日本国政府とチリ政府との間のチリの対日延払商業債務に対する再融資に関する交換公文

日本側書簡

(Japanese Note)

　Tokyo, August 31, 1965.

　書簡をもつて啓上いたします。本官は、千九百六十五年二月二十三日から二月二十四日までパリで開催された会合においてチリの代表とその主要債権国の代表との間に到達した了解に従つて、チリが自国の現在の外国為替事情の要請に対処することを援助するためのチリに対する日本国の資金援助について日本国政府の代表とチリ政府の代表との間に最近行なわれた会談に関し、その会談において到達した次の了解を確認する光栄を有します。

　Sir,With reference to the recent negotiations between the representatives of the Government of Japan and of the Government of Chile, that were held pursuant to the understanding reached between the representatives of Chile and her principal creditor countries at the meeting held at Paris from February 23 to February 24,1965, regarding the Japanese financial assistance to Chile to help the latter met the present requirements of her foreign exchange position, I have the honour to confirm the following understanding reached in the course of the said negotiations.

1　チリに対する資金援助は、パリの会合における前記の了解に定める日本国に対するチリの延払商業債務の再融資の形で、かつ、日本国の関係法令に従い供与される。

1. The financial assistance to Chile will be extended in the form of refinancing of such Chilean deferred payment commercial debts to Japan as were defined in the said understanding at the Paris meeting and in accordance with the relevant laws and regulations of Japan.

2　再融資は、千九百六十五年及び千九百六十六年に支払期限の到来する前記の債務の元金の額の百パーセントについて適期される。

2. The refinancing shall cover one hundred (100) percent of the principal amount falling due in the years of 1965 and 1966 of the above-mentioned debts.

3　日本輸出入銀行(以下「輸銀」という。)は、1に掲げる債務の再融資のために、チリ中央銀行(以下「銀行」という。)に対し、輸銀と銀行との間に締結される借款契約(以下「借款契約」という。)に従い、六百二十四万三千四百九十ドル七十セント(六、二四三、四九〇・七〇ドル)に相当する元金の額二十二億四千八百万円(二、二四八、〇〇〇、〇〇〇円)を限度とする借款を交換可能な日本円で使用に供するものとする。

3. Towards the refinancing of the debts mentioned in paragraph 1 above the Exportimport Bank of Japan (hereinafter referred to as "the Eximbank") will make available to the Banco Central de Chile (hereinafter referred to as "the Banco") a loan in convertible Japanese yen amounting up to the limit of two billion two hundred and forty eight million yen (2,248, 000,000) in principal amount, equivalent to six million two hundred and forty three thousand four hundred and ninety dollars seventy cents ($6,243, 490. 70) at the present International Monetary Fund parity rate, in accordance with a loan agreement (hereinafter referred to as "the Loan Agreement") to be concluded between the Eximbank and the Banco, which will contain, inter alia, the following principles:

(1)　借款に基づく元金の償還は、次の表に従い行なわれるものとする。

(1) The repayment of the principal under the loan shall be effected in accordance with the following schedule:

(2)　利子率は、年五・七五パーセントとし、銀行は随時の未払元金残高について三箇月ごとに利子を文払うものとする。

(2)  The rate of interest will be five and three quarters (5.75) percent per annum and the Banco shall pay the interest quarterly on the balance of principal outstanding from time to time.

(3)　元金の償還及び利子の支払は、チリ政府により保証されるものとする。

(3)  The repayment of principal and payment of interest shall be guaranteed by the Government of Chile.

4　チリ政府は、借款契約に基づく融資の対象となる債務の支払のための送金の自由を保証するものとする。

4.  The Government of Chile shall guarantee the free transferability of the payments of the debts which are the objects of the financing under the Loan Agreement.

5　チリ政府は、日本国に対する遅滞商業債務の弁済を促進するため必要な措置を執るものとする。

5.  The Government of Chile shall take necessary steps to expedite the liquidation of the outstanding commercial arrears to Japan.

6　チリ政府は、同性質でかつ比肩しうる額の債務の繰延べに関し他のいかなる債権国に対し与える待遇よりも不利でない待遇を日本国に対し与えるものとする。

6.  The Government of Chile shall accord to Japan treatment not less favourable than that accorded to any other creditor country for the consolidation of debts of the same nature and of comparable amount.

7　両政府は、この了解から又はそれに関連して生ずるいかなる問題についても相互に協議するものとする。

7.  The two Governments shall consult with each other in respect to any matter that may arise from or in connection with the present understanding.

　本官は、貴下がチリ政府に代わつて前記の了解を確認されれば幸いであります。

　I should be grateful if you would confirm the foregoing understanding on behalf of the Government of Chile.

　本官は、以上を申し進めるに際し、ここに重ねて貴下に向かつて敬意を表します。
