　TRADE AGREEMENT BETWEEN THE GOVERN-MENT OF JAPAN AND THE GOVERNMENT OF THE REPUBLIC OF IRAQ

　日本国政府及びイラク共和国政府は、平等及び相互の利益を基礎として、それぞれの国の間の貿易関係を拡大し、及び強化することを希望して、次のとおり協定した。

　The Government of Japan and the Government of the Republic of Iraq, being desirous of expanding and strengthening trade relations between their respective countries on the basis of equality and mutual benefit, have agreed as follows:

第一条
　両政府は、両国間の貿易の量を増大し、かつ、商品(この協定に附属する附表A及びBに掲げる商品を含む。)の交換をあらゆる可能な方法により容易にするよう努力する。

Article I
　The two Governments shall endeavour to increase the volume of trade between the two countries and facilitate in all possible ways the exchange of goods including those listed in Schedules A and B attached to this A-greement.

第二条
　いずれの一方の国の政府も、輸出及び輸入の許可証の発給について、それぞれの国において施行されている法令の範囲内で、他方の国の産品に対し、他の外国に与える待遇よりも不利でない待遇を与えるものとする。

Article II
　The Government of either country shall accord, with respect to the issue of import and export licenses, to the products of the other country a treatment no less favourable than that accorded to any other foreign country, within the scope of the laws and regulations in force in the respective countries.

第三条
　いずれの一方の国の政府も、関税、租税その他の課徴金及びそれらに関連する手続について、他方の国の産品に対し、それぞれの国において施行されている法令の範囲内で、他の外国に与える待遇よりも不利でない待遇を与えるものとする。

Article III
　The Government of either country shall accord, with respect to customs duties, taxes, other charges and the formalities connected therewith, to the products of the other country a treatment no less favourable than that accorded to any other foreign country, within the scope of the laws and regulations in force in the respective countries.

第四条
　両国間の貿易に関する支払は、それぞれの国において施行されている法令に従い、交換可能な通貨により行なうものとする。

Article IV
　Payments related to trade between the two countries shall be effected in convertible currencies, in accordance with the laws and regulations in force in the respective countries.

第五条
　両政府は、それぞれの国の領域内における経済の発展及び生活水準の向上に資するため、科学的知識及び技術の交換を含む両国間の経済及び技術協力の最も適当な方式を見出すよう努力する。

Article V
　With a view to contributing to the economic development and improvement of standards of living within the territories of their respective countries, the two Governments shall endeavour to find the most appropriate form of economic and technical cooperation between the two countries, including the interchange of scientific know-ledge and technology.

第六条
　いずれの一方の国の政府も、両国間の貿易及び経済関係を促進するため、それぞれの国において施行されている法令の範囲内で、かつ、無差別の原則に従い、他方の国の国民の自国の領域への入国、同領域からの出国並びに同領域内における滞在、旅行、居住及び事業活動を容易にするものとする。

Article VI
　The Government of either country shall, within the scope of the laws and regulations in force in the respective countries and in conformity with the principle of non-discrimination, facilitate the entry into, departure from, sojourn, travel, residence and business activities within its territory of nationals of the other country, with a view to promoting trade and economic relations between the two countries.

第七条
　両政府は、それぞれの国において施行されている法令の範囲内で、それぞれの国の領域内における見本市及び展示会を開催するために必要な便宜を相互に与えるものとする。

Article VII
　The two Governments shall grant each other, within the scope of the laws and regulations in force in their respective countries, necessary facilities for holding trade fairs and exhibitions in the territories of their respective countries.

第八条
　両政府の代表者で構成される混合委員会は、この協定の実施を検討し、かつ、その規定の履行を確保するため、いずれか一方の政府の要請があつたときはいつでも開催されるものとする。

Article VIII
　A Mixed Commission composed of representatives of the two Governments shall be held at any time upon the request of either Government for the purpose of reviewing the implementation of this Agreement and ensuring the fulfilment of its provisions.

第九条
　この協定は、この協定がそれぞれの国の国内法上の手続に従つて承認されたことを確認する公文が交換された日に効力を生ずる。この協定は、一年間効力を有し、いずれか一方の国の政府が、他方の国の政府に対しこの協定を終了させる意思を少なくとも三箇月前に書面によつて予告しない限り、次の一年間について、毎年自動的に更新されるものとする。

Article IX
　This Agreement shall come into force on the date of the exchange of notes confirming that the Agreement has been approved in accordance with the legal procedures of each country. It shall be valid for a period of one year and shall be automatically renewed every year for the next one year period, unless the Government of either country has previously given to the Government of the other country at least three months' written notice of its intention to terminate the Agreement.

Annex Letter No. 1a

　書簡をもつて啓上いたします。本官は、本日署名されたイラク共和国政府と日本国政府との間の貿易協定第二条及び第三条の規定に関し、同規定に定める待遇は、同規定に従い、次の利益には適用されないことをイラク共和国政府に代わつて確認する光栄を有します。

　Excellency,With reference to Articles II and III of the Trade Agreement between the Government of the Republic of Iraq and the Government of Japan signed today, I have the honour to confirm on behalf of the Government of the Republic of Iraq that according to the provisions of the said Articles, treatments provided therein do not apply to:

(a)　いずれか一方の国が国境貿易を容易にするため隣接国に与える利益

(a) advantages accorded by either country to adjacent countries in order to facilitate frontier trade;

(b)　いずれか一方の国が構成国であり若しくは構成国となる関税同盟又は自由貿易地域の存在に基づいて当該一方の国が与える利益

(b) advantages accorded by either country by virtue of a customs union or a free-trade area of which it is or may become a member; or

(c)　イラク共和国がいずれかのアラブの国に与える利益

(c) advantages accorded by the Republic of Iraq to any Arab country.

　本官は、さらに、この書簡及び閣下の返簡が前記の協定の不可分の一部と認められることを確認する光栄を有します。

　I have further the honour to confirm that this letter and Your Excellency's reply shall be considered as an integral part of the said Agreement.

　本官は、閣下が前記のことを日本国政府に代わつて確認されれば幸いであります。

　I should be obliged if Your Excellency could confirm the foregoing on behalf of the Government of Japan.

　書簡をもつて啓上いたします。本官は、本日署名されたイラク共和国政府と日本国政府との間の貿易協定に関し、いずれの一方の国の政府も、他方の国から輸入される商品に対し、輸出国の権限のある機関が発給する原産地証明書を添付すべき旨の要件を課することができることをイラク共和国政府に代わつて確認する光栄を有します。両政府は、前記の要件は必要な場合に限り課されるべきことに同意いたします。本官は、この書簡及び閣下の返簡が前記の協定の不可分の一部と認められることを確認する光栄を有します。
本官は、閣下が日本国政府に代わつて前記のことを確認されれば幸いであります。
本官は、以上を申し進めるに際し、ここに閣下に向かつて敬意を表します。

　Excellency,With reference to the Trade Agreement between the Government of the Republic of Iraq and the Government of Japan signed today, I have the honour to confirm on behalf of the Government of the Republic of Iraq that the Government of either country may require the goods imported from the other country to be accompanied by a certificate of origin issued by competent organizations of the exporting country. The two Governments agree that the above requirement should be made only when it is necessary.
I have further the honour to confirm that this letter and Your Excellency's reply shall be considered as an integral part of the said Agreement. I should be grateful if Your Excellency could confirm the foregoing n behalf of the Government of Japan. I avail myself of this opportunity to extend to Your Excellency the assurances of my highest consideration.

　書簡をもつて啓上いたします。本使は、本日署名された日本国政府とイラク共和国政府との間の貿易協定第五条の規定に関し、日本国政府が、日本国の法令に従い、かつ、両政府が合意する条件により、イラクの経済及び技術の発展を促進するため、技術協力、特にイラク国民の日本国における技術及び職業の研修並びに日本国の専門家のイラクへの派遣を実施するために必要な措置を執ることとする旨を閣下に通報する光栄を有します。

　Excellency,With reference to Article V of the Trade Agreement between the Government of Japan and the Government of the Republic of Iraq signed today, I have the honour to confirm that the Government of Japan will, in accordance with the laws and regulations in Japan and on such terms as may be agreed upon by both Governments, take necessary measures to provide technical cooperation, inter alia, technical and vocational training in Japan of Iraqi nationals and dispatching of Japanese experts to Iraq with a view to promoting the economic and technical development of Iraq.

　本使は、閣下が前記のことをイラク政府に代わつて確認されれば幸いであります。

　I should be obliged if Your Excellency could confirm the foregoing on behalf of the Government of the Republic of Iraq.
