EXCHANGE OF NOTES BETWEEN THE GOVERNMENT OF JAPAN AND GOVERNMENT OF CANADA CONCERNING RECIPROCAL WAIVING OF PASSPORT VISAS AND PASSPORT VISA FEES

Tokyo, September 5, 1964.
書簡をもつて啓上いたします。本大臣は、日本国民のカナダへの一時的な入国及びカナダ市民の日本国への一時的な入国のための査証の要件を緩和することを目的としてカナダ政府と日本国政府との間に、次の条件による取極を行なうことを提案する光栄を有します。
Excellency,I have have the honour to propose that an Agreement be concluded between the Government of Canada and the Government of Japan for the easing of the visa requirements for the temporary entry of Japanese nationals to Canada and Canadian citizens to Japan in the following terms:
(1) 有効な日本国旅券を所持する日本国民であつて、継続して三箇月をこえない期間滞在する意図をもつてカナダに入国することを希望するものは、査証を取得することなく、カナダに入国することができる。
(1) Japanese national in possession of valid Japanese passports who are seeking entry to Canada with the intention of staying there for a period not exceeding three consecutive months, may enter Canada without obtaining a visa.
(2) 有効なカナダ旅券を所持するカナダ市民であつて、継続して三箇月をこえない期間滞在する意図をもつて日本国に入国することを希望するものは、査証を取得することなく、日本国に入国することができる。
(2) Canadian citizens in possession of valid Canadian passports who are seeking entry to Japan with the intention of staying there for a period not exceeding three consecutive months, may enter Japan without obtaining a visa.
(3) カナダ政府は、(1)の規定に基づいて査証なしにカナダに入国した日本国民であつて、滞在期間を三箇月をこえて延長することを希望するものの滞在期間の延長を許可することができる。
(3) The Government of Canada may grant extensions of the period of stay of Japanese nationals who, having entered Canada without a visa under the provisions of (1) above, desire to extend the period of stay beyond three months.
(4) 日本国政府は、(2)の規定に基づいて査証なしに日本国に入国したカナダ市民であつて、滞在期間を三箇月をこえて延長することを希望するものの滞在期間の延長を許可することができる。
(4) The Government of Japan may grant extensions of the period of stay of Canadian citizens who, having entered Japan without a visa under the provisions of (2) above, desire to extend the period of stay beyond three months.
(5) この査証の要件の免除は、有効な日本国旅券を所持する日本国民であつて、就職し、永住し、自由職業若しくは他の生業を営み、報酬を得る目的で芸能(スポーツを含む。)に従事し、又は継続して三箇月をこえる期間滞在する意図をもつてカナダに入国することを希望するものについては、適用しない。
(5) This waiver of visa requirements shall not apply to Japanese nationals in possession of valid Japanese passports, who are seeking entry to Canada with the intention of seeking employment or permanent residence, of exercising a profession or other occupation or of engaging in a public entertainment (including sport) for remunerative purposes or with the intention of staying there for a period exceeding three consecutive months.
(6) この査証の要件の免除は、有効なカナダ旅券を所持するカナダ市民であつて、就職し、永住し、自由職業若しくは他の生業を営み、報酬を得る目的で芸能(スポーツを含む。)に従事し、又は継続して三箇月をこえる期間滞在する意図をもつて日本国に入国することを希望するものについては、適用しない。
(6) This waiver of visa requirements shall not apply to Canadian citizens in possession of valid Canadian passports, who are seeking entry of Japan with the intention of seeking employment or permanent residence, of exercising a profession or other occupation or of engaging in a public entertainment (including sport) for remunerative purposes or with the intention of staying there for a period exceeding three consecutive months.
(7) 査証を取得することが要求される場合において査証が付与されるときは、その査証は、無料であるものとし、かつ、発給の日から十二箇月の期間内のいかなる回数の入国についても有効であるものとする。ただし、カナダ政府及び日本国政府は、個個の場合において、一回限りの入国について有効な査証を付与する権利を保有する。
(7) Visas, when required and granted, shall be free of charge and valid for any number of entries within twelve months from the date of issue, provided that the Government of Canada or Japan, as the case may be, retains the right to grant visas valid for a single entry in particular cases.
(8) この取極は、それぞれカナダ及び日本国に入国する日本国民及びカナダ市民が外国人の入国、居住(一時的な居住であるか永住であるかを問わない。)及び雇用又は生業に関する当該国の法令に服することを免除するものではない。入国管理当局に対し、これらの法令に服することについて十分に証明することができない者は、入国又は上陸の許可を拒否されることがある。
(8) This Agreement shall not exempt Japanese nationals and Canadian citizens entering Canada and Japan respectively from the necessity of complying with the respective laws and regulations of the country concerned regarding entry, residence (whether temporary or permanent) and employment or occupation of foreigners and persons who are unable to satisfy the immigration authorities that they comply with these laws and regulations are liable to be refused leave to enter or land.
本大臣は、前記の提案が日本国政府にとつて受諾しうるものであるときは、この書簡及びその旨の閣下の返簡が両国政府間の合意を構成すること、その合意が千九百六十四年九月二十日に効力を生じ、かつ、いずれか一方の政府による終了の通告が受領された日から二箇月を経過する日まで効力を存続するものとすること並びに千九百五十五年六月十三日付け交換公文によつて効力を生じ、かつ、千九百六十年十一月八日付け交換公文によつて修正された数次査証の相互付与に関する両国政府間の取極がこの取極によつて終了させられることを提案する光栄を有します。
If the above proposals are acceptable to the Government of Japan, I have the honour to suggest that this Note and Your Excellency's reply to that effect shall constitute an Agreement between our two Governments which shall come into force on September 20, 1964 and which shall remain in force until two months after the date of the receipt of notice of termination by either Government and that this Agreement shall terminate the Agreement between the two Governments for the reciprocal granting of multiple-entry visas effected by an Exchange of Notes of June 13, 1955, as amended by an Exchange of Notes of November 8, 1960.

Excellency,I have the honour to acknowledge receipt of Your Excellency's Note of today's date, which reads as follows:

本大臣は、前記の提案が日本国政府にとつて受諾しうるものであることを閣下に通報し、並びに閣下の書簡及びこの返簡が両国政府間の合意を構成すること、その合意が千九百六十四年九月二十日に効力を生じ、かつ、いずれか一方の政府による終了の通告が受領された日から二箇月を経過する日まで効力を存続するものとすること並びに千九百五十五年六月十三日付け交換公文によつて効力を生じ、かつ、千九百六十年十一月八日付け交換公文によつて修正された数次査証の相互付与に関する両国政府間の取極がこの取極によつて終了させられることに同意する光栄を有します。
I have the honour to inform Your Excellency that the proposals set out above are acceptable to the Government of Japan and to agree that Your Excellency's Note and this reply should constitute an Agreement between our two Governments which shall come into force on September 20, 1964 and which shall remain in force until two months after the date of the receipt of notice of termination by either Government and that this Agreement shall terminate the Agreement between the two Governments for the reciprocal granting of multiple-entry visas effected by an Exchange of Notes of June 13, 1955, as amended by an Exchange of Notes of November 8, 1960.
