December 28, 1964.
書簡をもつて啓上いたします。本使は、千九百五十三年十二月八日にラングーンで署名された日本国とビルマとの間の貿易取極及び日本国総領事小長谷綽とビルマ連邦政府貿易省次官バ・サンとの間の同日付けの交換公文を千九百六十五年一月一日から千九百六十五年十二月三十一日までの一年間延長するという了解が両政府の間で成立したことを申し述べる光栄を有します。
Dear Colonel San Win,I have the honour to set forth the understanding reached between the two Governments that the Trade Arrangement between Japan and Burma signed at Rangoon on the 8th December 1953, together with the letters exchanged on the same date between Mr.Yutaka Konagaya, Consul-General of Japan and U Ba San, Secretary, Ministry of Trade Development, the Government of the Union of Burma, shall be extended for a period of one year, that is to say, from the 1st of January 1965 to the 31st of December 1965.
なお、千九百六十五収穫年度のビルマ米の売買は、別途に取りきめられることが確認されます。
It is confirmed that the purchase and sale of Burma rice for the crop year 1965 will be settled separately.
本使は、前記の了解が正しいものであることを貴下が確認されれば幸いであります。
I shall be grateful to receive confirmation from you to the effect that the above understading is correct.

日本国政府及びビルマ連邦政府は、両国間の通商及び貿易を最高度に促進し、かつ、拡大することが望ましいのにかんがみ、次の諸条を合意した。
Having in view the desirability to promote and enlarge commerce and trade between the two countries at the highest possible level, the Government of Japan and the Government of the Union of Burma have agreed to the following Articles:
第一条
Article I.
ビルマ連邦政府は、日本国の商品及び貨物のビルマへの輸入(輸入許可の発給を含む。)を、その時に有効な輸入許可発給手続に従つて、他のいずれの軟貨国とも同じ基礎において取扱うものとする。
The Government of the Union of Burma shall treat importation, including issuing of licences, into Burma of any goods or commodities from Japan on the same basis as from any soft currency country in accordance with the licencing procedures in force from time to time.
日本国政府は、ビルマの商品及び貨物の輸入を、その時に有効な手続に従つて、他のいずれのスターリング地域国よりの輸入に比べて同様に好意的に取扱うものとする。
The Government of Japan shall treat importation into Japan of any goods or commodities from Burma equally favourably as compared to those from any other sterling area country in accordance with procedures in force from time to time.
ただし、前記の規定は、両国のいずれかがいずれの第三国との間の双務貿易取極によつて負う義務に影響を与えないものと了解する。
It is understood, however, that the above provisions shall not prejudice any obligation incurred by either country under bilateral trade arrangements between either of the two countries and any third country.
第二条
Article II.
両国政府は、この取極の実施を容易にするため、この取極の実施に関連する情報及び統計を定期に交換するものとする。
In order to facilitate the implementation of this Arrangement, the two Governments will periodically exchange information and figures relating to the fulfilment of this Arrangement.
いずれか一方の政府は、その輸入許可の制度及び規制に関するいかなる変更も他方の政府に通報し、かつ、他方の政府の要請があれば、それから生じ又はそれに関連するすべての事項に関して協議することに同意する。
Either Government will further inform the other of whatever changes that may be made in its licensing systems and regulations, and upon request of the other agree to enter into consultation in respect of any matter arising therefrom or in connection therewith.
第三条
Article III.
日本国とビルマとの間の貿易は、改正された千九百四十七年十月三十日にスイスのジュネーヴで署名された関税及び貿易に関する一般協定の規定に従つて行われるものとする。
The trade between Japan and Burma will be conducted in accordance with the provisions of the General Agreement on Tariffs and Trade signed at Geneva, Switzerland, on the 30th October, 1947, as amended.
第四条
Article IV.
日本国政府は、日本の会社及び個人がその技術上の経験をビルマの産業のために提供するよう奨励する。両国政府は、この分野における契約が有効な規制に従つて関係者双互間で直接に商業採算に基き締結されるという了解でこれらの契約の取極を援助する。
The Government of Japan will encourage Japanese companies and individuals to place their technical experiences at the disposal of Burmese industrial interests. The two Governments will assist in arranging for contracts in this field on the understanding that such contracts will be made directly between the parties concerned on a commercial basis in accordance with regulations in force.
第五条
Article V.
日本国政府は、可能又は必要な場合に、日本国におけるビルマ技術者の訓練に対し援助を与える。
The Government of Japan will afford assistance, where possible or necessary, for the training in Japan of Burmese technicians.
第六条
Article VI.
別添附属A及びB表は、それぞれビルマ及び日本国から輸出する商品及び貨物を掲記する。ただし、右表は、いかなる意味でも制限的なものとみなさないものとする。
Schedules "A" and "B" as appended hereto list the goods and commodities to be exported from Burma and Japan respectively. However, they shall not be construed as restrictive in any way.
A及びB表並びに別添の交換公文は、この取極の不可分の一部をなすものとみなされる。
Schedules "A" and "B" and the exchanges of letters as appended hereto shall be construed to form an integral part of this Arrangement.
第七条
Article VII.
この取極の運用は、通常一年の間隔をおいて毎年再検討し、かつ、各再検討の後この取極の条項の調整は、必要ある場合には、両国政府の相互の同意を得て行われる。
The working of this Arrangement will be reviewed every year generally at one year's interval, and adjustments in terms of this Arrangement after each review will be made if necessary with the mutual consent of the two Governments.
この取極の終了の日の一箇月前に、日本国政府及びビルマ連邦政府は、両国政府の間に合意さるべき変更を加えてこの取極を延長するか又は新規の取極を締結することが望ましいかどうかについて相互に協議するものとする。
One month before the expiry of this Arrangement, the Government of Japan and the Government of the Union of Burma shall consult each other on the desirability of extending this Arrangement with such changes as may be agreed upon between the two Governments or of entering into a new Arrangement.
第八条
Article VIII.
千九百五十年三月十六日に作成され、千九百五十二年四月三十日に在ラングーン日本国在外事務所長服部比佐治とビルマ連邦政府外務大臣サオ・クン・キオとの間の書簡交換により延長された占領下の日本国とビルマ連邦との間の貿易協定は、この取極の効力発生の日にこの取極によつて置き換えられるものとする。
The Trade Agreement between Occupied Japan and the Union of Burma executed on the 16th March, 1950, and extended by the exchange of letters on the 30th April, 1952, between Mr.H.Hattori, Head of Japanese Government Overseas Agency, Rangoon, and Honourable Sao Hkun Hkio, Minister for Foreign Affairs, Government of the Union Burma, shall be superseded by this Arrangement as from the day of its coming into force.
第九条
Article IX.
この取極は、署名の日に効力を生じ、千九百五十七年十二月三十一日まで有効とする。
This Arrangement shall come into force from the date of signature and shall remain in force until the 31st December 1957.

Sir,With reference to the Trade Arrangement signed today by us, I have the honour, on behalf of the Government of Japan, to State that the Government of Japan will endeavour to provide the same facilities as those given to nationals of other countries in accordance with the rules and regulations in effect from time to time for the entry and residence in the territories of Japan to the nationals of the Union of Burma and for the transport of goods and commodities between the two countries to the vessels registered in the Union of Burma. ビルマ米売買に関する取極
ARRANGEMENT FOR SALE AND PURCHASE OF BURMESE RICE.
一九五三年十二月八日調印された貿易取極に基き日本国及びビルマ連邦両政府はビルマから日本への定期的米の供給を維持するため次の取極に同意した。
In connection with the Trade Arrangement signed on the 8th December 1953, the Gvernment of Japan and the Government of the Union of Burma, with a view to maintaining a regular supply of rice to Japan from the Union of Burma, have agreed upon an Arrangement as follows:
一、 本取極の期間は一九五四年一月一日より一九五七年十二月三十一日までとする。
1. The period of this Arrangement shall be from the 1st January, 1954 to the 31st December 1957.
二、 ビルマ連邦政府及び日本国政府は、両国間において一九五四年度(暦年度)三〇万トン、翌年度以降本取極期間中の三年の間、年間最高三〇万トン、最低二〇万トンの米が売買されるよう配慮することに同意する。右の売買を実行するため両国政府は前年十一月十五日までに米の輸出余力及び需要見込額に関する予備的情報を交換する。
2. The Government of the Union of Burma and the Government of Japan agree to see to it that the quantity of rice to be sold and bought between the two countries will run at 300,000 long tons in the calendar year of 1954, and a minimum of 200,000 long tons and a maximum of 300,000 long tons in each of the subsequent 3 calendar years during the period mentioned in paragraph 1 above. For the implementation of the above, the two Governments will exchange the preliminary information regarding the export availability and the estimated requirement of rice by the 15th November of the preceding calendar year.
三、各暦年中に売買される米の前記最低量をこえる確定全量及びその品種別数量は日本国政府が前年十二月十五日までに通知し、かつ両国政府の合意により決定される。
3. The exact quantity above the said minimum and breakdown by each quality of the total quantity to be sold and bought in each calendar year shall be notified by the Government of Japan and settled by mutual agreement before the 15th December of the preceding calendar year.
四、一九五四年度の価格はナッセンSMS一ロングトン当りFOBビルマで六六六チャット六七とし、その他の品種に対する価格は右を基準として定められた別表記載の一九五三年度政府間貿易価格による。次年度以降三年の間の価格は当該年度においてビルマ政府がセイロン政府との間に一九五三年九月二十六日に締結した期間四年のビルマ米貿易協定の如き長期取極の条項により第三国と契約せる最低価格より高からざる価格をもつて毎年決定する。
4. Price for the year 1954 will be kyats 666.67 per long ton f.o.b.port of Burma for Ngasein S.M.S., prices of other qualities being in exact proportion to the Government to Governments price adopted for the year 1953 as mentioned in the Schedule attached hereto. Prices for the subsequent 3 years will be decided each year in such a way that they will not be higher than the lowest price contracted for with any other country by the Government of the Union of Burma for the corresponding year under such similar long term arrangement as the Four Year Rice Trade Agreement between the Government of Ceylon and the Government of the Union of Burma signed on the 26th September 1953.
五、売買される米は、当該年度の新穀とし、ビルマ政府は日本政府の要求する品種米を極力供給するよう努力する。変質粒混入許容限度は一%とする。
5. The rice to be sold and bought will be the new crop for each year and the Government of the Union of Burma will do its best to supply rice of such qualities as required by the Government of Japan; tolerance of damaged and off-coloured rice will be 1%.
六、ビルマ連邦政府は、日本国政府が間に合うように十分なる配船をするときは、毎年六月末までに船積を完了するようできる限り努力する。
6. Utmost endeavour will be made by the Government of the Union of Burma to complete the shipment of rice sold in each calendar year by the end of June if the Government of Japan provides sufficient shipping space in time.
七、前各条に記載する事項以外の詳細については、本取極に基き毎年締結される契約書に規定する。
7. Further details will be prescribed in the contract which will be made every year in accordance with this Arrangement.

ARRANGEMENT FOR SALE AND PURCHASE OF BURMESE RICE.
書簡をもつて啓上いたします。本日署名されたビルマ米売買取極に関し、本官はいずれかの側の政府取引の現在の機構について、この取極の具体的遂行に影響を与える変更が行われることが予想される場合には、この取極が実質的に影響を受けることのないよう両国政府はこの取極実施の具体的方法に関して協議するとの本官の了解を申し述べる光栄を有します。
In connection with the Trade Arrangement signed on the 8th December 1953, the Government of Japan and the Government of the Union of Burma, with a view to maintaining a regular supply of rice to Japan from the Union of Burma, have agreed upon an Arrangement as follows:

1. The period of this Arrangement shall be from the 1st January 1954 to the 31st December 1957.
本官は、右を申し進めますに際し、貴官に向つて敬意を表します。
2. The Government of the Union of Burma and the Government of Japan agree to see to it that the quantity of rice to be sold and bought between the two countries will run at 300,000 long tons in the calendar year of 1954, and a minimum of 200,000 long tons and a maximum of 300,000 long tons in each of the subsequent 3 calendar years during the period mentioned in paragraph 1 above. For the implementation of the above, the two Governments will exchange the preliminary information regarding the export availability and the estimated requirement of rice by the 15th November of the preceding calendar year.

3. The exact quantity above the said minimum and breakdown by each quality of the total quantity to be sold and bought in each calendar year shall be notified by the Government of Japan and settled by mutual agreement before the 15th December of the preceding calendar year.

4. Price for the year 1954 will be Kyats 666.67 per long ton f.o.b. port of Burma for Ngasein S.M.S., prices of other qualities being in exact proportion to the Government to Government prices adopted for the year 1953 as mentioned in the Schedule attached hereto. Prices for the subsequent 3 years will be decided each year in such a way that they will not be higher than the lowest price contracted for with any other country by the Government of the Union of Burma for the corresponding year under such similar long term arrangement as the Four Year Rice Trade Agreement between the Government of Ceylon and the Government of the Union of Burma signed on the 26th September 1953.

5. The rice to be sold and bought will be the new crop for each year and the Government of the Union of Burma will do its best to supply rice of such qualities as required by the Government of Japan; tolerance of damaged and off-coloured rice will be 1%.
6. Utmost endeavour will be made by the Government of the Union of Burma to complete the shipment of rice sold in each calendar year by the end of June if the Government of Japan provides sufficient shipping space in time.

Dear U Ba San, With reference to recent discussions between representatives of the Government of Japan and of the Government of the Union of Burma, I have the honour to set forth the understanding reached between us that, subject to the approval by the Government of the Union of Burma, the Trade Arrangement between Japan and Burma signed in Rangoon on the 8th of December, 1953, together with the letters exchanged on the same date between Mr. Yutaka Konagaya, Consul-General of Japan and U Ba San, Secretary, Ministry of Trade Development, the Government of the Union of Burma, shall be further extended for the period of one year, that is to say, from the 1st of January, 1958 to the 31st of December 1958.
It is also understood that the arrangements for the purchase and sale of Burma rice for the year of 1985 shall be agreed upon separately.
I shall be grateful for your confirmation that the above understanding is correct.I avail myself of this opportunity to renew to you the assurance of my highest consideration.
