自己の名において、かつ、現行の諸協定に従いルクセンブルグ大公国政府をも代表して行動するベルギー王国政府は、
Acting together under the Treaty establishing the Benelux Economic Union signed at The Hague on February 3, 1958, on the other hand,
オランダ王国政府、ベルギー王国政府及びルクセンブルグ大公国政府が関税及び貿易に関する一般協定第三十五条の規定の日本国に対する援用を撤回することに関連して、千九百六十年十月八日に東京で署名された通商に関する一方日本国と他方オランダ王国及びベルギー＝ルクセンブルグ経済同盟との間の協定(以下「協定」という。)を改正することを希望して、
Desiring to amend the Agreement on Commerce between Japan on the One Hand and the Kingdom of the Netherlands and the Belgo-Luxemburg Economic Union on the Other Hand, signed at Tokyo on October 8, 1960, (hereinafter referred to as "the Agreement"), in relation to the withdrawal by the Government of the Kingdom of the Netherlands and the Government of the Kingdom of Belgium and the Government of the Grand Duchy of Luxemburg of the Invocation against Japan of Article XXXV of the General Agreement on Tariffs and Trade,
次のとおり協定した。
Have agreed as follows:
第一条 協定第三条1及び2を削り、次の規定を置く。この協定のいかなる規定も、いずれか一方の締約国が関税及び貿易に関する一般協定の締約国として有し又は有することがある権利及び義務に対しては、双方の締約国が関税及び貿易に関する一般協定の締約国である限り、影響を及ぼすものではない。
Article I Paragraphs 1 and 2 of Article III of Agreement are deleted and replaced by the following: "Nothing in the present Agreement shall affect the rights and obligations that either Contracting Party has or may have as a contracting party to the General Agreement on Tariffs and Trade, so long as both Contracting Parties are contracting parties to the General Agreement on Tariffs and Trade."
第二条 協定第六条1を削る。
Article II Paragraph 1 of Article VI of the Agreement is deleted.
第三条 この議定書は、批准されなければならない。批准書は、日本国政府に寄託するものとする。この議定書は、三番目の批准書が寄託された日に効力を生ずる。
Article III The present Protocol shall be ratified and the instruments of ratification shall be deposited with the Government of Japan. The Protocol shall come into force on the date when the third instrument of ratification has been deposited.
以上の証拠として、このために正当に委任された下名の代表者は、この議定書に署名した。

書簡をもつて啓上いたします。本使は、通商に関する一方オランダ王国及びベルギー＝ルクセンブルグ経済同盟と他方日本国との間の協定を改正する議定書及びそれらの間の貿易関係に関する議定書を本日署名するに際し、オランダ王国政府は、これらの議定書の効力発生とともに、関税及び貿易に関する一般協定第三十五条の規定の日本国に対する援用を撤回し、かつ、オランダ王国と日本国との間に同協定を適用することに同意する旨を、閣下に通報する光栄を有します。
Excellency,On the occasion of the signature today of the Protocol Amending the Agreement on Commerce between the Kingdom of the Netherlands and the Belgo-Luxemburg Economic Union on the One Hand and Japan on the Other Hand and of the Protocol Concerning Trade Relations between them, I have the honour to inform Your Excellency that the Government of the Kingdom of the Netherlands will withdraw, on the coming into force of the said Protocols, the invocation against Japan of Article XXXV of the General Agreement on Tariffs and Trade and consent to the application of the General Agreement between the Kingdom of the Netherlands and Japan.

AGREED MINUTES
日本国政府代表及びベネルックス諸国の政府代表は、ベネルックス諸国による関税及び貿易に関する一般協定第三十五条の日本国に対する援用を撤回するための両代表団の間の交渉の過程において到達した次の了解をここに記録する。
The representatives of the Government of Japan and the representatives of the Governments of the Benelux countries hereby record the following understandings which have been reached during the course of the negotiations between their respective delegations for the withdrawal by the Benelux countries of their invocation against Japan of Article XXXV of the General Agreement on Tariffs and Trade:
1 両代表団は、2に定める協議において合意が行なわれるまでの間、千九百六十年十月八日に署名された合意された議事録Cの規定が本日署名された日本国とベネルックス諸国との間の貿易関係に関する議定書6の実施として、千九百六十年十月八日に署名された第二議定書がその7に基づき効力を失つた後も、必要な修正を加えて引き続き適用され、また、千九百六十二年八月三十一日付けの交換公文の附表が千九百六十三年の初めから事実上適用されることを合意した。
1. The two Delegations agreed that, pending the conclusion of an agreement in the consultations provided for in paragraph 2 below, the provisions of PART C of the Agreed Minutes signed on October 8, 1960, would continue to be applied mutatis mutandis, as an implementation of paragraph 6 of the Protocol Concerning Trade Relations between Japan and the Benelux countries signed today, after the Second Protocol signed on October 8, 1960, ceased to be in effect in accordance with paragraph 7 thereof, and the List attached to the Exchange of Letters dated August 31, 1962, would be applied de facto from the beginning of 1963.
前記の附表に掲げる割当てに対し発給される輸入許可は、前記の協議において定める割当てから差し引かれることが了解される。
It is understood that the import authorizations to be issued against the quotas enumerated in the List referred to above shall be deducted from the quotas to be established during the consultations referred to above.
2 日本国代表団は、池田日本国総理大臣とJ・E・デ・クワイ オランダ国総理大臣及びT・ルフェーヴル ベルギー国総理大臣との間の最近の会談の結果原則的合意に達したことを想起した。この会談において、池田日本国総理大臣は、千九百六十二年十一月九日付けの口上書に述べられたベネルックス諸国の政府の提案を二条件を付して受諾した。この二条件の一つは、日英交渉の場合のように、日本国とベネルックス諸国との間に完全なガット関係が確立される時にベネルックス諸国の適用する輸入制限品目表が実質的に削減されるべきことであつたが、同輸入制限品目表の削減に関する日本国とベネルックス諸国との間の協議はわずか二、三箇月前に終結したので、このような協議をこの際行なうことは実際的ではないと認められた。しかし、ベネルックス諸国の政府側においては千九百六十三年の協議において輸入制限品目表を実質的に削減するため格段の努力を払うこととする旨が、了解された。
2. The Delegation of Japan recalled the recent conversations between Prime Minister of Japan, Mr. H. Ikeda and Prime Minister of the Netherlands, Prof. Dr. J.E. de Quay and Prime Minister of Belgium, Mr. Th. Lefevre which led to an agreement in principle. In these conversations, Prime Minister of Japan, Mr. Ikeda accepted the proposal of the Governments of the Benelux countries stated in the Note Verbale dated November 9, 1962, with two conditions. One of them was that the list of sensitive items applied by the Benelux countries ought to be reduced substantially when the full GATT relations would be established between Japan and the Benelux countries as had been the case in the Japan-British negotiation, but, since the consultations between Japan and the Benelux countries concerning the reduction of the latter's list of sensitive items had been concluded only two or three months before, it was deemed impractical to hold such consultations at this time, but there should be an understanding on the part of the Governments of the Benelux countries to make special efforts to reduce substantially the list of sensitive items in the consultations in 1963.
以上にかんがみ、日本国代表団は、ベネルックス諸国の政府が千九百六十三年六月前に行なわれるべき協議において現行の輸入制限品目表を実質的に削減するため格段の努力を払うよう要請した。
In the light of this, it was requested by the Delegation of Japan that the Governments of the Benelux countries would make special efforts to reduce substantially the present list of sensitive items in the forthcoming consultations to be held before June, 1963.
ベネルックス諸国代表団は、日本国代表団が表明した希望を了知し、かつ、ベネルックス諸国の政府は日本国の産品につきベネルックス諸国における輸入制限の自由化及び輸入の可能性の増大をできる限り実質的に達成するため前記の協議において格段の努力を行なうことを約束すると述べた。
The Delegation of the Benelux countries took note of the desire expressed by the Delegation of Japan and stated that their Governments undertook to exercise special efforts in the said consultations to achieve a liberalization of import restrictions and an increase of import possibilities for Japanese products in the Benelux countries as substantially as possible.
3 両代表団は、前記の議定書1に関し、ガット締約国団の千九百六十年十一月十九日の決定に述べられている合意を確認した。この決定の抜すいは、次のとおりである。
3. The two Delegations confirmed, with reference to paragraph 1 of the Protocol referred to above, the agreement stated in the Decision of November 19, 1960, of the CONTRACTING PARTIES to the GATT, an extract of which was recorded as follows:
「これらの事態(市場撹乱)は、一般に次の要素の組合せを含む。
"These situations (market disruption) generally contain the following elements in combination:
(i) 特定産品の特定原産地からの輸入の急激かつ実質的な増加又は潜在的な増加
(i) a sharp and substantial increase or potential increase of imports of particular products from particular sources;
(ii) これらの産品が輸入国市場における同様の品質をもつ同種産品の通常の価格を実質的に下回る価格で提供されること
(ii) these products are offered at prices which are substantially below those prevailing for similar goods of comparable quality in the market of the importing country;
(iii) 国内生産者に対する重大な損害又はそのおそれが存在すること
(iii) there is serious damage to domestic producers or threat thereof;
(iv) (ii)にいう価格差が価格の決定若しくは形成における政府の介入又はダンピング慣行から生ずるものでないこと
(iv) the price differentials referred to in paragraph (ii) above do not arise from governmental intervention in the fixing or formation of prices or from dumping practices.
事態によつては他の要素も存在するので、前記の列挙は、市場撹乱の包括的な定義を意図したものではない。」
In some situations other elements are also present and the enumeration above is not, therefore, intended as an exhaustive definition of market disruption."
以上の証拠として、下名の代表者は、各自の政府のためにこの合意された議事録に署名した。
