EXCHANGE OF NOTES CONCERNING A PROGRAM OF EDUCATIONAL EXCHANGE BETWEEN THE GOVERNMENT OF JAPAN AND THE GOVERNMENT OF THE UNITED STATES OF AMERICA

　アメリカ合衆国特命全権大使から日本国外務大臣にあてた書簡

　書簡をもつて啓上いたします。本使は、アメリカ合衆国政府が、教育上の接触を通ずる知識及び専門的技能の広範な交換によりアメリカ合衆国及び日本国の国民の間の相互理解を一層促進することを希望して、昭和三十年五月三十一日及び昭和三十一年二月十日に東京で署名された農産物に関する協定に従つて、かつ、第七十九議会の公法第五百八十四号で改正された千九百四十四年の合衆国余剰財産法の条項の範囲内で行われるべき教育交換計画を提案すること、並びにその計画の詳細は附属の覚書に規定するとおりであることを閣下に通報する光栄を有します。

　Excellency:
  I have the honor to inform Your Excellency that the Government of the United States of America, desiring further to promote mutual understanding between the peoples of the United States of America and Japan by a wide exchange of knowledge and professional talents through educational contacts, proposes a program of educational exchange to be conducted in accordance with the Agreements on Agricultural Commodities signed at Tokyo on May 31, 1955, and February 10, 1956, and within the terms of the United States Surplus Property Act of 1944, as amended by Public Law No. 584, 79th Congress, the details of which program are as provided for in the attached Memorandum.

　日本国政府が前記の提案を受諾されるときは、この書簡及び閣下の返簡は、この問題についての両政府間の合意を構成するものと認められます。

　If the foregoing proposal is acceptable to the Government of Japan, I propose that this Note and Your Excellency's reply be considered as constituting an agreement between the two Governments on this subject.

　本使は、以上を申し進めるに際し、ここに重ねて閣下に向つて敬意を表します。

　アメリカ合衆国政府と日本国政府との間の教育交換計画に関する覚書

　MEMORANDUM CONCERNING A PROGRAM OF EDUCATIONAL EXCHANGE BETWEEN THE GOVERNMENT OF THE UNITED STATES OF AMERICA AND THE GOVERNMENT OF JAPAN

第一節

Section 1

　在日合衆国教育委員会(以下「委員会」という。)と称する委員会を設立する。委員会は、教育交換計画のため合衆国が保有し又は同国の支出に使用しうる日本国通貨からアメリカ合衆国政府がこの覚書の条項に従つて同委員会に提供すべき資金を財源とするこの計画の運用を容易にするために創設された機関として、アメリカ合衆国政府及び日本国政府によつて承認されるものとする。この覚書に規定するところを除き、委員会は、アメリカ合衆国の国及び地方の法律がこの覚書に掲げた目的のための通貨及びこれに代る債権の使用及び支出に関係する限りにおいて、これらの法律から免除される。資金及び財産は、日本国においては、外国政府の財産とみなす。

　There shall be established a Commission to be known as the United States Educational Commission in Japan (hereinafter designated "the Commission"), which shall be recognized by the Government of the United States of America and the Government of Japan as an organization created and established to facilitate the administration of an educational exchange program to be financed by funds made available to the Commission by the Government of the United States of America from currency of Japan held or available for expenditure by the United States for such purpose in accordance with the terms of the present memorandum Except as provided herein the Commission shall be exempt from the domestic and local laws of the United States of America as they relate to the use and expenditure of currencies and credits for currencies for the purposes set foth herein. The funds and property shall be regarded in Japan as property of a foreign government.

　以下に掲げる条件及び制限の下にこの覚書に基いて提供される資金は、委員会又はアメリカ合衆国政府及び日本国政府の合意する他の機関が、改正された千九百四十四年の合衆国余剰財産法の第三十二節(b)に掲げた次の目的のために使用する。

　The funds made available under the present memorandum, within the conditions and limitations hereinafter set forth, shall be used by the Commission or such other instrumentality as may be agreed upon by the Government of the United States America and the Government of Japan, for the purpose, as set forth in Section 32(b) of the United States Surplus Property Act of 1944, as amended, of

(1)　日本国に所在する高等教育の学校及び施設におけるアメリカ合衆国市民の若しくはアメリカ合衆国市民のための学習、研究、教授及び他の教育的活動又は合衆国本土、ハワイ、アラスカ(アリューシャン諸島を含む。)、プエルト･リコ及びヴァージン諸島以外に所在する合衆国の高等教育の学校及び施設における日本国市民の学習、研究、教授及び他の教育的活動の資金を供給すること。資金の供給は、輸送費、授業料、生計費及び学術的活動に附随する他の経費のための支払を含む。

(1) financing studies, research, instruction, and other educational activities of or for citizens of the United States of America in schools and institutions of higher learning located in Japan, or of the citizens of Japan in United States schools and institutions of higher learning located outside the continental United States, Hawaii, Alaska (including  the Aleutian Islands), Puerto Rico, and the Virgin Islands, including payment for transportation, tuition, maintenance, and other expenses incident to scholastic activities; or

(2)　合衆国本土、ハワイ、アラスカ(アリューシャン諸島を含む。)プエルト･リコ及びヴァージン諸島に所在する合衆国の高等教育の学校及び施設に就学することを希望し、かつ、その就学がアメリカ合衆国市民のこれらの学校及び施設に就学する機会を奪うことにならない日本国市民に旅費を供給すること。

(2) furnishing transportation for citizens of Japan who desire to attend United States schools and institutions of higher learning in the continental United States, Hawaii, Alaska (including the Aleutian Islands), Puerto Rico, and the Virgin Islands and whose attendance will not deprive citizens of the United States of America of an opportunity to attend such schools and institutions.

第二節
　前記の目的を達成するために、委員会は、この覚書の規定に従うことを条件として、次のことを含めてこの覚書の目的を遂行するために必要なすべての権能を行使することができる。

Section 2
　In furtherance of the aforementioned purposes, the Commission may, subject to the provisions of the present memorandum, exercise all powers necessary to the carrying out of the purposes of the present memorandum including the following:

(1)　改正された千九百四十四年の合衆国余剰財産法の第三十二節(b)の目的及びこの覚書の目的に従つて計画を立案し、採択し、及び遂行すること。

(1) Plan, adopt, and carry out programs, in accordance with the purposes of Section 32 (b) of the United States Surplus Property Act of 1944, as amended, and the purposes of the present memorandum;

(2)　改正された千九百四十四年の合衆国余剰財産法に規定した対外奨学金委員会に対して、前記の法律に従つて計画に参加する資格のある日本国に居住する学生、教授、研究員、教師及び日本の機関を推薦すること。

(2) Recommend to the Board of Foreign Scholarships, provided for in the United States Surplus Property Act of 1944, as amended, students, professors, research scholars, teachers resident in Japan, and institutions of Japan qualified to participate in the program in accordance with the aforesaid Act;

(3)　前記の対外奨学金委員会に対して、計画への参加者の選定のための資格条件でこの覚書の目的を達成するために委員会が必要と認めるものを勧告すること。

(3) Recommend to the aforesaid Board of Foreign Scholarships such qualifications for the selection of participants in the programs as it may deem necessary for achieving the purposes and objectives of the present memorandum;

(4)　委員会の会計主任又は委員会が指定する他の者の名義で銀行口座に預託すべき資金を受領する権限を、委員会の会計主任又は委員会が指定する他の者に与えること。会計主任又はこのような被指定人の任命は、国務長官によつて承認されなければならず、会計主任又はこのような被指定人は、受領した資金をアメリカ合衆国国務長官が指定した受託機関に預託しなければならない。

(4) Authorize the Treasurer of the Commission or such other person as the Commission may designate to receive funds to be deposited in bank accounts in the name of the Treasurer of the Commission or such other person as may be designated. The appointment of the Treasurer or such designee shall be approved by the Secretary of State and he shall deposit funds received in a depository or depositories designated by the Secretary of State of the United States of America;

(5)　この覚書で認められる目的のために資金の支出並びに資金の交付及び前渡しを行うことを許すこと。

(5) Authorize the disbursement of funds and the making of grants and advances of funds for the authorized purposes of the present memorandum:

(6)　アメリカ合衆国国務長官によつて選定された会計検査官が指令したとおり委員会の会計主任の会計の定期検査を規定すること。

(6) Provide for periodic audits of the accounts of the Treasurer of the Commission as directed by auditors selected by the Secretary of State of the United States of America;

(7)　幹事一人、事務職員及び書記職員を雇用し、かつ、この覚書に基いて提供された資金からこれらの者の給与及び賃金を支払うこと。

(7) Engage an Executive officer, administrative and clerical staff and fix and pay the salaries and wages thereof out of funds made available under the present memorandum.

第三節
　委員会が認可したすべての約束、債務負担及び支出は、アメリカ合衆国国務長官が規定する規則に従つて同長官が承認すべき年次予算に従つて行わなければならない。

Section 3
　All commitments, obligations and Expenditures authorized by the Commission shall be made pursuant to an annual budget to be approved by the Secretary of State of the United States of America pursuant to such regulations as he may prescribe.

第四節
　委員会は、八人の理事で構成し、そのうちの四人は、アメリカ合衆国市民とし、他の四人は、日本国市民とする。さらに、日本国駐在アメリカ合衆国外交使節団の首席職員(以下「使節団長」という。)を委員会の名誉議長とする。名誉議長は、委員会の投票が同数であつた場合に決定投票を行い、また、委員会の議長を任命しなければならない。議長は、委員会の正規の理事として投票権を有する。使節団長は、委員会を構成するアメリカ合衆国市民を指名し及び免職する権限を有する。日本人理事は、日本国政府が指名するものとし、また、同政府が免職することができる。

Section 4
　The Commission shall consist of eight members, four of whom shall be citizens of the United States of America and four of whom shall be citizens of Japan. In addition, the principal officer in charge of the Diplomatic Mission of the United States of America to Japan (hereinafter designated "Chief of Mission") shall be Honorary Chairman of the Commission. He shall cast the deciding vote in the event of a tie vote by the Commission and shall appoint the Chairman of the Commission. The Chairman as a regular member of the Commission shall have the right to vote. The Chief of Mission shall have the power to designate and remove the citizens of the United States of America on the Commission. The Japanese members shall be designated and may be removed by the Government of Japan.

　理事は、指名の時から次の十二月三十一日まで服務し、かつ、再指名されることができる。辞職、日本国外への住所の移転、任期の満了その他による空席は、ここに掲げた手続に従つて補充する。

　The members shall serve from the time of their designation until the following December 31 and shall be eligible for redesignation. Vacancies by reason of resignation, transfer of residence outside Japan, expiration of service or otherwise, shall be filled in accordance with the procedure set forth herein.

　理事は、無報酬で服務するが、委員会は、委員会の会議に出席し及び委員会が定めた他の公務の遂行に当つての理事の必要な経費を支払う権限を有する。

　The members shall serve without Compensation but the Commission is authorized to pay the necessary expenses of the members in attending the meetings of the Commission and in performing other official duties assigned by the Commission.

第五節
　委員会は、委員会の事務を行うために必要と認める内規を採択し、かつ、小委員会を設置する。

Section 5
　The Commission shall adopt such by-laws and appoint such committees as it shall deem necessary for the conduct of the affairs of the Commission.

第六節
　委員会の活動については、形式内容ともにアメリカ合衆国国務長官が承認しうる報告書を、アメリカ合衆国国務長官及び日本国政府に毎年提出しなければならない。

Section 6
　Reports acceptable in form and content to the Secretary of State of the United States of America shall be made annually on the activities of the Commission to the Secretary of State of the United States of America and the Government of Japan.

第七節
　委員会の本部は、日本国の首都に置く。ただし、委員会及びその小委員会の会議は、委員会が随時に定める他の場所で開くことができ、また、委員会の役員又は職員の活動は、委員会が承認する場所で行うことができる。

Section 7
　The principal office of the Commission shall be in the capital city of Japan, but meetings of the Commission and any of its committees may be held in such other places as the Commission may from time to time determine, and the activities of any of the Commission's officers or staff may be carried on at such places as may be approved by the Commission.

第八節
　昭和三十年五月三十一日及び昭和三十一年二月十日に東京で署名された農産物に関するアメリカ合衆国と日本国との間の協定に従つて行われた販売の結果としてアメリカ合衆国政府に生じた日本国通貨であつて、それぞれの協定の第五条1(4)及び第四条1(4)の規定に従い国際教育交換活動の資金に充てるために使用されるべきものは、この覚書の目的のために総額七億四千三百七十六万円まで使用されるものとする。ただし、いかなる場合にも、前記の協定により実際に生じ、かつ、同協定の前記の規定に基いて使用することができる資金の額をこえないものとする。昭和二十六年八月二十八日の交換公文に添付された覚書に基いて提供された資金の未使用残高も、この覚書の目的のために使用することができることが、了解され、かつ、合意される。

Section 8
　The currency of Japan accruing to the Government of  the United States of America as a consequence of sales made pursuant to the Agreements on Agricultural Commodities between the United States of America and Japan signed at Tokyo on May 31, 1955, and February 10, 1956, which is to be used for the purpose of financing international educational exchange activities in accordance with the provisions of paragraph 1 (4) of Articles V and IV of the respective Agreements, is to be used for the purposes of the present memorandum, up to an aggregate amount of 743,760,000 yen but in any case not to exceed the amount of funds actually generated under the said Agreements and available under the above mentioned provisions thereof. It is understood and agreed that any unused balance in the funds made available under the memorandum attached to the exchange of Notes of August 28, 1951, may also be used for the purposes of the present memorandum.

　この覚書の実施は、合衆国の法令により要求されるときは、同国が保有し又は同国の支出に使用しうる日本国通貨に対応して合衆国国庫に償還するための予算がアメリカ合衆国国務長官に割り当てられていることを条件とする。

　The performance of the present memorandum shall be subject to the availability of appropriations to the Secretary of State of the United States of America when required by the laws of the United States, for reimbursement to the Treasury of the United States for currency of Japan held or available for expenditure by the United States.

　アメリカ合衆国国務長官は、この覚書の目的のために必要とされる額の日本国通貨を、委員会の認める支出のために提供するものとする。ただし、いかなる場合にも、この覚書の第三節に従つて定める予算上の限度をこえないものとする。

　The Secretary of State of the United States of America will make available for expenditure as authorized by the Commission currency of Japan in such amounts as may be required for the purposes of the present memorandum but in no event in excess of the bndgetary limitations established pursuant to Section 3 of the present memorandum.

第九節
　アメリカ合衆国政府及び日本国政府は、この覚書で認めた人員交換計画を容易にしかつこの計画の運用上生ずる問題を解決するため、あらゆる努力をしなければならない。

Section 9
　The Government of the United States of America and the Government of Japan shall make every effort to facilitate the exchange of persons programs authorized in the present memorandum and to resolve problems which may arise in the operations thereof.

第十節
　この覚書において「アメリカ合衆国国務長官」という語を用いたときはいつでも、アメリカ合衆国国務長官又は同長官が自己に代つて行動することを命じたアメリカ合衆国政府の職員若しくは被用者をいうものと了解する。

Section 10
　Wherever, in the present memorandum, the term "Secretary of State of the United States of America" is used, it shall be understood to mean the Secretary of States of the United States of America or any officer or employee of the Government of the United States of America designated by him to act in his behalf.

第一節

第二節
　前記の目的を達成するために、委員会は、この覚書の規定に従うことを条件として、次のことを含めてこの覚書の目的を遂行するために必要なすべての権能を行使することができる。

　委員会は、八人の理事で構成し、そのうちの四人は、アメリカ合衆国市民とし、他の四人は、日本国市民とする。さらに、日本国駐在アメリカ合衆国外交使節団の首席職員(以下「使節団長」という。)を委員会の名誉議長とする。名誉議長は、委員会の投票が同数であつた場合に決定投票を行い、また、委員会の議長を任命しなければならない。議長は、委員会の正規の理事として投票権を有する。使節団長は、委員会を構成するアメリカ合衆国市民を指名し及び免職する権限を有する。日本人理事は、日本国政府が指名するものとし、また、同政府が免職することができる。

Section 4
　The Commission shall consist of eight members, four of whom shall be citizens of the United States of America and four of whom shall be citizens of Japan. In addition, the principal officer in charge of the Diplomatic Mission of the United States of America to Japan (hereinafter designated "Chief of Mission") shall be Honorary Chairman of the Commission. He shall cast the deciding vote in the event of a tie vote by the Commission and shall appoint the Chairman of the Commission. The Chairman as a regular member of the Commission shall have the right to vote. The Chief of Mission shall have the power to designate and remove the citizens of the United States of America on the Commission. The Japanese members shall be designated and may be removed by the Government of Japan.

　理事は、指名の時から次の十二月三十一日まで服務し、かつ、再指名されることができる。辞職、日本国外への住所の移転、任期の満了その他による空席は、ここに掲げた手続に従つて補充する。

　The members shall serve from the time of their designation until the following December 31 and shall be eligible for redesignation. Vacancies by reason of resignation, transfer of residence outside Japan, expiration of service or otherwise, shall be filled in accordance with the procedure set forth herein.

　理事は、無報酬で服務するが、委員会は、委員会の会議に出席し及び委員会が定めた他の公務の遂行に当つての理事の必要な経費を支払う権限を有する。

　The members shall serve without Compensation but the Commission is authorized to pay the necessary expenses of the members in attending the meetings of the Commission and in performing other official duties assigned by the Commission.

第五節
　委員会は、委員会の事務を行うために必要と認める内規を採択し、かつ、小委員会を設置する。

Section 5
　The Commission shall adopt such by-laws and appoint such committees as it shall deem necessary for the conduct of the affairs of the Commission.

第六節
　委員会の活動については、形式内容ともにアメリカ合衆国国務長官が承認しうる報告書を、アメリカ合衆国国務長官及び日本国政府に毎年提出しなければならない。

Section 6
　Reports acceptable in form and content to the Secretary of State of the United States of America shall be made annually on the activities of the Commission to the Secretary of State of the United States of America and the Government of Japan.

第七節
　委員会の本部は、日本国の首都に置く。ただし、委員会及びその小委員会の会議は、委員会が随時に定める他の場所で開くことができ、また、委員会の役員又は職員の活動は、委員会が承認する場所で行うことができる。

Section 7
　The principal office of the Commission shall be in the capital city of Japan, but meetings of the Commission and any of its committees may be held in such other places as the Commission may from time to time determine, and the activities of any of the Commission's officers or staff may be carried on at such places as may be approved by the Commission.

第八節
　昭和三十年五月三十一日及び昭和三十一年二月十日に東京で署名された農産物に関するアメリカ合衆国と日本国との間の協定に従つて行われた販売の結果としてアメリカ合衆国政府に生じた日本国通貨であつて、それぞれの協定の第五条1(4)及び第四条1(4)の規定に従い国際教育交換活動の資金に充てるために使用されるべきものは、この覚書の目的のために総額七億四千三百七十六万円まで使用されるものとする。ただし、いかなる場合にも、前記の協定により実際に生じ、かつ、同協定の前記の規定に基いて使用することができる資金の額をこえないものとする。昭和二十六年八月二十八日の交換公文に添付された覚書に基いて提供された資金の未使用残高も、この覚書の目的のために使用することができることが、了解され、かつ、合意される。

Section 8
　The currency of Japan accruing to the Government of  the United States of America as a consequence of sales made pursuant to the Agreements on Agricultural Commodities between the United States of America and Japan signed at Tokyo on May 31, 1955, and February 10, 1956, which is to be used for the purpose of financing international educational exchange activities in accordance with the provisions of paragraph 1 (4) of Articles V and IV of the respective Agreements, is to be used for the purposes of the present memorandum, up to an aggregate amount of 743,760,000 yen but in any case not to exceed the amount of funds actually generated under the said Agreements and available under the above mentioned provisions thereof. It is understood and agreed that any unused balance in the funds made available under the memorandum attached to the exchange of Notes of August 28, 1951, may also be used for the purposes of the present memorandum.

　この覚書の実施は、合衆国の法令により要求されるときは、同国が保有し又は同国の支出に使用しうる日本国通貨に対応して合衆国国庫に償還するための予算がアメリカ合衆国国務長官に割り当てられていることを条件とする。

　The performance of the present memorandum shall be subject to the availability of appropriations to the Secretary of State of the United States of America when required by the laws of the United States, for reimbursement to the Treasury of the United States for currency of Japan held or available for expenditure by the United States.

　アメリカ合衆国国務長官は、この覚書の目的のために必要とされる額の日本国通貨を、委員会の認める支出のために提供するものとする。ただし、いかなる場合にも、この覚書の第三節に従つて定める予算上の限度をこえないものとする。

　The Secretary of State of the United States of America will make available for expenditure as authorized by the Commission currency of Japan in such amounts as may be required for the purposes of the present memorandum but in no event in excess of the bndgetary limitations established pursuant to Section 3 of the present memorandum.

第九節
　アメリカ合衆国政府及び日本国政府は、この覚書で認めた人員交換計画を容易にしかつこの計画の運用上生ずる問題を解決するため、あらゆる努力をしなければならない。

Section 9
　The Government of the United States of America and the Government of Japan shall make every effort to facilitate the exchange of persons programs authorized in the present memorandum and to resolve problems which may arise in the operations thereof.

第十節
　この覚書において「アメリカ合衆国国務長官」という語を用いたときはいつでも、アメリカ合衆国国務長官又は同長官が自己に代つて行動することを命じたアメリカ合衆国政府の職員若しくは被用者をいうものと了解する。

Section 10
　Wherever, in the present memorandum, the term "Secretary of State of the United States of America" is used, it shall be understood to mean the Secretary of States of the United States of America or any officer or employee of the Government of the United States of America designated by him to act in his behalf.

　本大臣は、さらに、日本国政府がアメリカ合衆国政府の前記の提案を受諾することを閣下に通報し、かつ、閣下の書簡及びこの返簡がこの問題についての両政府間の合意を構成するものと認められることを確認する光栄を有します。

　I have the further honour to inform Your Excellency, that the Government of Japan accepts the above proposal of the Government of the United States of America and to confirm that Your Excellency's Note and this reply are considered as constituting an agreement between the two Governments on this subject.

　本大臣は、以上を申し進めるに際し、ここに重ねて閣下に向かつて敬意を表します。

　I avail myself of this opportunity to renew to Your Excellency, Monsieur l'Ambassadeur, the assurance of my highest consideration.
