EXCHANGE OF NOTES BETWEEN THE GOVERNMENT OF JAPAN AND THE GOVERNMENT 0F THE UNITED STATES OF AMERICA CONSTITUTING AN ARRANGEMENT CONCERNING EXCHANGE OF OFFICIAL PUBULICATIONS

書簡をもつて啓上いたします。本使は、公の刊行物の交換に関してアメリカ合衆国政府代表と日本国政府代表との間で行われた会談に言及し、かつ、閣下に対し、アメリカ合衆国政府が次の規定に従つて公の刊行物を両政府の間で交換することに同意することを通報する光栄を有します。
Excellency: I have the honor to refer to the conversations which have taken place between representatives of the Government of the United States of America and representatives of the Government of Japan in regard to the exchange of official publications, and to inform Your Excellency that the Government of the United States of America agrees that there shall be an exchange of official publications between the two Governments in accordance with the following provisions:
1 両政府は、それぞれ、他方の政府が選択して作成しかつこの取極の締結後に外交上の経路により通達する表に掲げられる自国政府の公の刊行物の各一部を定期的に提供するものとする。各政府が選択した刊行物の表は、随時改訂することができ、また、他方の政府の公の刊行物でその表に示されていないもの又は当該他方の政府が将来設置することのある新たな機関の刊行物を含めるよう拡張することができる。
1. Each of the two Governments shall furnish regularly a copy of each of its official publications which is indicated in a selected list prepared by the other Government and communicated through diplomatic channels subsequent to the conclusion of the present arrangement. The list of publications selected by each Government may be revised from time to time and may be extended to include any other official publication of the other Government not specified in the list, or publications of new offices in which the other Government may establish in the future.
2 アメリカ合衆国政府の刊行物の送達のための公式の交換事務所は、スミスソニァン･インスティテューションとする。日本国政府の刊行物の送達のための公式の交換事務所は、国立国会図書館とする。
2. The official exchange office for the transmission of publications of the Government of the United States of America shall be the Smithsonian Institution. The official exchange office for transmission of publications of the Government of Japan shall be the National Diet Library.
3 刊行物は、アメリカ合衆国のためには議会図書館が、また、日本国のためには国立国会図書館が受領する。
3. The publications shall be received on behalf of the United States of America by the Library of Congress and on behalf of Japan by the National Diet Library.
4 この取極は、いずれの政府に対しても、書入れ用紙、公的性格を有しない回章又は秘密刊行物を提供する義務を課するものではない。
4. The present arrangement does not obligate either of the two Governments to furnish blank forms, circulars which are not of a public character, or confidential publications.
5 両政府は、それぞれ、両政府の刊行物について自国内における輸送、さらに自国政府の刊行物については他方の政府の交換事務所にとつて合理的に考えて便利な港その他の適当な場所への輸送に関してこの取極に基いて生ずるすべての費用(郵便料金、鉄道料金及び船積運賃を含む。)を負担するものとする。
5. Each of the two Governments shall bear all charges, including postal, rail and shipping costs, arising under the present arrangement in connection with the transportation within its own country of the publications of both Governments and the shipment of its own publications to a port or other appropriate place reasonably convenient to the exchange office of the other Government.
6 この取極は、一方の政府の省又は機関と他方の政府の省又は機関との間の現行の交換取極を修正するものとみなしてはならない。
6. The present arrangement shall not be considered as a modification of any existing exchange arrangement between a department or agency of one of the Governments and a department or agency of the other Government.
7 この取極に定める約束は、両政府がそれぞれ自国の予算及び関係法令の許す限りにおいて遂行するものと了解される。
7. It is understood that the undertakings set forth in the present arrangement shall be carried out by each of the two Governments insofar as their respective budget and applicable laws and regulations permit.
アメリカ合衆国政府は、前記の規定が日本国政府にとつて受諾しうるものである旨を述べた閣下の書簡を受領したときは、この書簡及び閣下の返簡がこの問題に関する両政府間の取極を構成し、この取極が閣下の返簡の日付の日に効力を生ずるものと認めます。
Upon receipt of a note from Your Excellency indicating that the foregoing provisions are acceptable to the Government of Japan, the Government of the United States of America will consider that this note and your reply constitute an arrangement between the two Governments on this subject, the arrangement to enter into force on the date of your note in reply.
本使は、以上を申し進めるに際し、ここに重ねて閣下に向つて敬意を表します。

書簡をもつて啓上いたします。昭和三十一年九月五日付の閣下の書簡、及び、公の刊行物の交換に関して日本国政府代表とアメリカ合衆国政府代表との間で行われた会談に関し、本大臣は、日本国政府が次の規定に従つて公の刊行物を両政府の間で交換することに同意することを閣下に通報する光栄を有します。
Monsieur l'Ambassadeur, With reference to Your Excellency's note of September 5, 1956, and to the conversations between representatives of the Government of Japan and representatives of the Government of the United States of America in regard to the exchange of official publications, I have the honor to inform Your Excellency that the Government of Japan agrees that there shall be an exchange of official publications between the two Governments in accordance with the following provisions:

The Government of Japan considers that your note and this reply constitute an arrangement between the two Governments on this subject, the arrangement to enter into force on the date of this note.
