PROTOCOL AMENDING THE AGREEMENT FOR COOPERATION BETWEEN THE GOVERNMENT OF JAPAN AND THE GOVERNMENT OF THE UNITED STATES OF AMERICA CONCERNING CIVIL USES OF ATOMIC ENERGY
日本国政府及びアメリカ合衆国政府は、
The Government of Japan and the Government of the United States of America;
千九百五十八年六月十六日にワシントンで署名された原子力の非軍事的利用に関する協力のための日本国政府とアメリカ合衆国政府との間の協定(以下「協力協定」という。)を改正することを希望して、
Desiring to amend the Agreement for Cooperation between the Government of Japan and the Government of the United States of America Concerning Civil Uses of Atomic Energy, signed at Washington on June 16, 1958, hereinafter referred to as the "Agreement for Cooperation";
次のとおり協定した。
Have agreed as follows:
第一条 協力協定第五条A中「プルトニウムについては十グラム、U―二三三については十グラム」を「U―二三三については十グラム、加工された箔及び線源の形状のプルトニウムについては二百五十グラム、他の形状のプルトニウムについては十グラム」に改める。
Article I Article V, paragraph A. of the Agreement for Cooperation is amended by deleting the phrase "10 grams of plutonium, and 10 grams of U-233" and substituting in lieu thereof the phrase "10 grams of U-233, 250 grams of plutonium in the form of fabricated foils and sources, and 10 grams of plutonium in other forms".
第二条 協力協定第七条Cを次のように改める。
Article II Article VII, paragraph C, of the Agreement for Cooperation is amended to read as follows:
C 合衆国委員会は、要請を受けたときは、その裁量によつて、前記の特殊核物質の一部を、ウランに含まれるU―二三五が八キログラムをこえない燃料の装備でそれぞれ運転することができる研究用及び材料試験用原子炉における使用のため、九十パーセントまで濃縮された物質として提供することができる。
"C. The United States Commission may, upon request and in its discretion, make a portion of the foregoing special nuclear material available as material enriched up to ninety per cent (90%) for use in research and materials testing reactors, each capable of operating with a fuel load not to exceed eight (8) kilograms of contained U-235 in uranium".
第三条 協力協定第七条F中「購入する優先権」の上に「、平和的目的にのみ使用するため」を加える。
Article III Article VII, paragraph F, of the Agreement for Cooperation is amended by inserting the phrase "for use for peaceful purposes only" immediately after the phrase "a first option to purchase".
第四条 この議定書は、それぞれの政府が、他方の政府から、この議定書の効力発生のための法律上及び憲法上のすべての要件を満たした旨の文書による通告を受領した日に効力を生じ、かつ、協力協定の効力の存続期間中効力を有する。
Article IV This Protocol shall enter into force on the day on which each Government shall receive from the other Government written notification that it has complied with all statutory and constitutional requirements for the entry into force of such Protocol and shall remain in force for the period of the Agreement for Cooperation.
以上の証拠として、下名は、正当に委任を受け、この議定書に署名した。
IN WITNESS WHEREOF, the undersigned, duly authorized, have signed this Protocol.
