ARRANGEMENT BETWEEN THE GOVERNMENT OF JAPAN AND THE UNITED KINGDOM OF GREAT BRITAIN AND NORTHERN IRELAND REGARDING SETTLEMENT OF CERTAN CLAIMS
英国のある種の請求権の解決に関する日本国政府とグレート・ブリテン及び北部アイルランド連合王国政府との間の取極
ARRANGEMENT BETWEEN THE GOVERNMENT OF JAPAN AND THE UNITED KINGDOM OF GREAT BRITAIN AND NORTHERN IRELAND REGARDING SETTLEMENT OF CERTAIN CLAIMS(1)
日本国政府及びグレート・ブリテン及び北部アイルランド連合王国政府は、平和条約に関連して英国のある種の請求権の解決に到達することを希望して、次のとおり協定した。
The Government of Japan and the Government of the United Kingdom of Great Britain and Northern Ireland, desiring to reach a settlement of certain British claims in connection with the Treaty of Peace, have agreed as follows:
第一条 日本国政府は、戦争状態の存在前に財産の滅失若しくは損害又は身体傷害若しくは死亡に関して生じた請求権で連合王国政府が提起し又は再提起したものの当否を審議する千九百五十一年九月八日の平和条約第十八条(a)の規定に基づく義務の履行として、連合王国政府並びに英国の自然人及び法人によるこのような請求権で日本国政府が国際法に従い責任を有するすべてのものの解決として、五十万スターリング・ポンドの金額を連合王国政府に支払うものとする。
Article 1 The Government of Japan, in discharge of their obligations under Article 18(a) of the Treaty of Peace of the 8th of September, 1951, to consider on their merits claims for loss or damage to property or for personal injury or death which arose before the existence of a state of war and which have been presented or re-presented by the Government of the United Kingdom, shall pay to the Government of the United Kingdom the sum of 500,000 pounds sterling in settlement of all such claims by the Government of the United Kingdom and British physical and juridical persons for which the Government of Japan are responsible according to international law.
この取極の適用上、英国の自然人及び法人とは、該当の日本国の行為がなされた日及びこの取極の署名の日に英国の国籍を有していた自然人及び法人(海外領域の市民及び英国法に基づいて設立され、若しくは組織された法人又は英国民が全面的に所有する法人を含む。)であつて、連合王国政府が国際法に従いその利益を保護する権利を有するものをいう。
For the purpose of the present Arrangement, British physical and juridical persons shall mean those persons who at the date of the relevant Japanese actions were, and at the date of the signature of the present Arrangement are, of British nationality, including citizens of overseas territories as well as juridical persons incorporated or constituted under British law or wholly owned by British nationals, and whose interests the Government of the United Kingdom are under international law entitled to protect.
第二条 第一条に掲げた金額は、この取極の効力発生の時から三箇月をこえない最も短い実行可能な期間内に、連合王国政府に対してスターリング・ボンドで送達されるものとする。
Article 2 The amount mentioned in Article 1 shall be remitted in pounds sterling to the Government of the United Kingdom within the shortest practicable time not to exceed three months from the coming into force of the present Arrangement.
第三条 連合王国政府は、第一条に掲げる金額の日本国政府による支払を同条にいうすべての請求権の完全なかつ最終的な解決として受諾し、かつ、千九百三十七年七月七日からの支那事変から生ずる連合王国政府並びに英国の自然人及び法人の日本国政府に対する国際法に基づくこれ以上の請求権を放棄する。連合王国政府は、平和条約第十八条(ａ)の規定に基づくこれ以上のいかなる請求権も提起しないことを約束する。
Article 3 The Government of the United Kingdom accept the payment by the Government of Japan of the amount mentioned in Article 1 in full and final settlement of all claims referred to in the said Article and waive further claims under international law of the Government of the United Kingdom and British physical and juridical persons against the Government of Japan arising out of the China Incident from the 7th of July, 1937. They undertake not to present any further claims under Article 18(a) of the Treaty of Peace.
第四条 第一条に掲げた金額を請求権者に配分する責任は、連合王国政府のみが負うものとする。
Article 4 The responsibility for distributing the amount mentioned in Article 1 among the claimants shall be undertaken exclusively by the Government of the United Kingdom.
第五条 この取極は、署名の日に効力を生ずる。
Article 5 The present Arrangement shall enter into force on the date of signature.
以上の証拠として、下名は、各自の政府により正当に委任を受け、この取極に署名した。
In witness whereof the undersigned, being duly authorised thereto by their respective Governments, have signed the present Arrangement.
千九百六十年十月七日に東京で、ひとしく正文である日本語及び英語により本書二通を作成した。
Done in duplicate at Tokyo the seventh day of October, l960, in the Japanese and English languages, both texts being equally authentic.

連合王国特命全権大使から外務大臣にあてた書簡
Monsieur le Ministre,
書簡をもつて啓上いたします。本使は、本日署名された英国のある種の請求権の解決に関するグレート・ブリテン及び北部アイルランド連合王国政府と日本国政府との間の取極に関し、両政府間の次の了解を本国政府に代わつて確認する光栄を有します。
With reference to the Arrangement between the Government of the United Kingdom of Great Britain and Northern Ireland and the Government of Japan regarding settlement of certain British claims, signed today, I have the honour to confirm on behalf of my Government the following understanding between the two Governments.
2 前記の取極の規定にかかわらず、連合王国政府は、同取極の第一条第二項の定義に該当する者が次の請求権について行なうことがある交渉の申入れ又は実際の交渉に対して外交上の支特を与えることができる。
2. Notwithstanding the provisions of the Arrangement under reference, the Government of the United Kingdom may give diplomatic support to any proposals for negotiations, or to any actual negotiations, which may be put forward or undertaken by persons within the definition in the second paragraph of Article 1 of the said Arrangement about claims:
(a) 中国政府が発行したポンド貨債について、当該公債の担保となつていたある地域の中国の国有鉄道その他の中国政府の収入の源泉を日本国の軍隊が支配していた支那事変中の期間における利払に関する請求権
(a) in respect of the servicing of the sterling bonds issued by the Chinese Government for the period of the China Incident when the Japanese forces were in control of the Chinese State Railways in certain areas and other sources of Chinese Government revenue on which the loans were secured;
(b) 英国の鉱業権が存在した地域を日本国の軍隊が支配していた支那事変中の期間における中国の鉱山に関する権利の侵害に関する請求権
(b) in respect of the infringement of rights in connection with mines in China for the period of the China Incident when Japanese forces were in control of areas in which British mining rights existed.
もつとも、前記の請求権は、連合王国政府が日本国政府に対して提起することはなく、また、連合王国政府は、前記の交渉の当事者とはならない。
The above mentioned claims, however, will not be presented by the Government of the United Kingdom to the Government of Japan and the Government of the United Kingdom will not be a party to the negotiations mentioned above.
3 2の了解は、いかなる場合にも、日本国政府が同項に掲げる請求権に関する責任を認めることを意味するものと解してはならない。
3. The understanding stated in paragraph 2 of the present note shall in no way be construed to imply that the Government of Japan admit any liability in respect of the claims mentioned in that paragraph.
本使は、さらに、閣下が両政府間の前記の了解を確認されることを要請する光栄を有します。
I have the honour to request Your Excellency to be good enough confirm the above understanding between the two Governments.
本使は、以上を申し進めるに際し、ここに重ねて閣下に向かつて敬意を表します。

書簡をもつて啓上いたします。本大臣は、本日付けの閣下の次の書簡を受領したことを確認する光栄を有します。
Monsieur l'Ambassadeur, I have the honour to acknowledge the receipt of Your Excellency's Note of Today's date, which reads as follows:
本使は、本日署名された英国のある種の請求権の解決に関するグレート・プリテン及び北部アイルランド連合王国政府と日本国政府との間の取極に関し、両政府間の次の了解を本国政府に代わつて確認する光栄を有します。
with reference to the Arrangement between the Government of the United Kingdom of Great Britain and Northern Ireland and the Government of Japan regarding settlement of certain British claims, signed today, I have the honour to confirm on behalf of my Government the following understanding between the two Governments.
2前記の取極の規定にかがわらず、連合王国政府は、同取極の第一条第二項の定義に該当する者が次の請求権について行なうことがある交渉の申入れ又は実際の交渉に対して外交上の支持を与えることがでぎる。
2. もつとも、前記の請求権は、連合王国政府が日本国政府に対して提起することはなく、また、連合王国政府は、前記の交渉の当事者とはならない。
The above mentioned claims, however, will not be presented by the Government of the United Kingdom to the Government of Japan and the Government of the United Kingdom will not be a party of the negotiations mentioned above.
3 2の了解は、いかなる場合にも、日本国政府が同項に掲げる請求権に関する責任を認めることを意昧するものと解してはならない。
3. The understanding stated in paragraph 2 of the present note shall in no way be construed to imply that the Government of Japan admit any liability in respect of the claims mentioned in that paragraph.
本使は、さらに、閣下が両政府間の前記の了解を確認されることを要請する光栄を有します。
I have the honour to request your Excellency to be good enough to confirm the above understanding between the two Governments.
本大臣は、さらに、前記の了解を日本国政府に代わつて確認する光栄を有します。
I have further the honour to confirm the foregoing understanding on behalf of the Goveunment of Japan.
