　EXCHANGE OF NOTES CONCERNING MUTUAL RECOGNITION OF VESSEL INSPECTION CERTIFICATES.

　日本国臨時代理大使から連合王国外務大臣にあてた書簡

　London, April 17th, 1936.

　書簡をもつて啓上いたします。日本国の旅客船が、日本国の当局が発給して、検査港における英国の領事官が認証した特別の船舶検査証書でその船舶が日本国の法令の明記する通常の検査以外に、ある条件に関する検査を受けたという趣旨を記載するものを携帯している場合には、英国の当局は、その船の実際の状態が前記の証書と合致しているかどうかを確めるためにその船を臨検することはできるけれども、更に検査に付することはないということが日本国とグレート・ブリテンとの間に、千九百十年一月一日以来取り極められております。

　Sir, 
Since the 1st January 1910, it has been arranged between Japan and Great Britain that where a Japanese passenger ship bears a special certificate of survey, issued by the Japanese authorities and attested by a British consular officer at the port of survey, to the effect that the ship has undergone a survey regarding certain conditions in addition to an ordinary survey specified by the Japanese law, the British authorities shall not subject the ship to any further survey, though the ship may be visited in order to ascertain whether the actual condition of the ship is in conformity with the said certificate.

　日本国においては、海上における人命の安全のための国際条約及び国際満載きつ水線条約が千九百三十五年九月十一日に実施され、その結果として、日本国の旅客船は、現在では、安全証書、免除証書又は国際満載きつ水線証書を携帯しておりますし、また、これらの証書によつて証明されている事項に関しては、日本国の旅客船は、これらの条約の署名国による検査を免除されております。それのみではなく、千九百三十四年三月に実施された船舶安全法は、前記の二条約の内容のみでなく、同条約に掲げていない事項をも網らしていて、船舶及び船内の人命の安全を確保するための安全な規定を含んでおり、且つ、実質的に英国の船舶検査法と同一であります。

　In Japan the International Convention for the Safety of Life at Sea and the International Load Line Convention were put into operation on the 11th September, 1935, with the result that Japanese passenger ships are now furnished with Safety Certificates, Exemption Certificates or International Load Line Certificates, and as regards the matters certified thereby Japanese passenger ships are exempted from survey by the signatory States of those Treaties. Moreover the Law for the Safety of Vessels, which came into effect in March, 1934, contains full provisions for ensuring the safety of ships and human lives on board, covering not only the contents of the aforesaid two Treaties but also such matters as are not mentioned therein, and is the same in substance as the British law of survey.

　このような事情の下にあつては、日本国とグレート・ブリテンとの間の前記の取極は、必要なものではなくなつたと認められるという事実にかんがみ、本使は、本国政府からの訓令に基いて、日本国政府が、この取極が廃止されること、及び今後日本国の旅客船が権限のある日本国の当局の発給した船舶検査証書を携帯している場合には、英国の当局がこのような船舶に関して英国の船舶検査法が要求しているいかなる措置をも執らないことを希望していることを貴大臣に通知する光栄を有します。英国政府がこの提案に同意すれば、日本国政府は、日本国の港にある英国の旅客船に関しては、権限のある英国の当局が発給した旅客定員証書を携帯している限り、日本国の船舶検査法が要求しているいかなる措置をも執りません。

　In view of the fact that in such circumstances the above-mentioned arrangement between Japan and Great Britain appears no longer necessary, I have the honour to inform you, under instruction from my Government, that it is desired by the Japanese Government that the said arrangement should be abolished, and that hereafter where a Japanese passenger ship is furnished with a certificate of survey issued by the competent Japanese authorities the British authorities should not take any steps required by the British law of survey in regard to such a ship. Should the British Government agree to this proposal, the Japanese Government will not take any steps required by the Japanese law of survey in regard to a British passenger ship in a Japanese port, provided that she is furnished with a certificate of the fixed number of passengers issued by the competent British authorities.

　もつとも、本使は、前記の提案が移民船には及ばないことを付言しなければなりません。英国の船舶が、日本国の船舶検査法の意昧における移民船である場合には、その船舶は、特殊船検査に付されて、特殊船検査証書を与えられます。

　I have to add, however, that the above proposal does not extend to emigrant ships. Where a British ship is an emigrant ship within the meaning of the Japanese law of survey, she will be liable to a survey of special ships and will be furnished with a certificate of survey of special ships.

　日本国の商船関係の法令の次の訳文(改正前の)を英国改府の参考のためにここに同封いたします。

　本使は、貴大臣が本件を権限のある当局に提出せられ、且つ、日本国政府の前記の提案に関する連合王国における皇帝陛下の政府の意見を本使に御知らせ下さらば感謝の至に堪えません。

　I should be grateful if you would be good enough to place the matter before the competent authorities and let me have the views of His Majesty's Government in the United Kingdom on the above-mentioned proposal of the Japanese Government.

　書簡をもつて啓上いたします。千九百十年一月一日以来実施中の英国の港における日本国船舶の検査に関する特別取極は今や取り消されるべきであると申し入れた四月十七日の藤井氏の書簡第九十八号に関し、本大臣は、同書簡において説明されている事情にかんがみ、有効な安全証書及び日本国の規則に従つて載せることができる旅客の数を示している証書を呈示する連合王国を訪問する日本国の船舶の旅客宿泊施設の検査を免除するための訓令が検査官に対して発せられたことを閣下に通知する光栄を有します。

　Your Excellency, With reference to Mr. Fujii's note No. 98 of the 17th April, representing that the special arrangement in force since 1st January, 1910 relating to the survey of Japanese ships in British ports should now be cancelled I have the honour to inform Your Excellency that in view of the circumstances explained in that note instructions are being issued to surveyors to dispense with the survey of the passenger accommodation of any Japanese ships vesiting the United Kingdom which produce valid Safety Certificates together with certificates showing the number of passengers which may be carried according to the Japanese regulations.

2　これらの措置は、旅客証書及び安全証書の有効な合併証書で載せることができる旅客の数を特に示しているものを呈示する連合王国の登録済み旅客船の日本国の港における相互的待遇を予期して行われたものであります。証書の見本は、參考のために同封してあります。

2. These arrangements are being made in the anticipation of the reciprocal treatment in Japanese ports of United Kingdom registered passenger ships which produce valid combined passenger and Safety Certificates indicating, inter alia, the number of passengers which may be carried. A specimen certificate is enclosed for purposes of reference.

3　これらの措置は、移民船でこの種の船舶に適用される特別規則に、従来どおり、引き続き従うものには及ぼされません。

3. These arrangements will not extend to emigrant ships which will remain, as hitherto, subject to the special regulations applicable to ships of this class.

　書簡をもつて啓上いたします。日本国及び連合王国の港における旅客船の検査に関する千九百三十六年六月二十六日の書簡第Ｆ三五五三／二一一四／二三に関し、本使は、本国政府の訓令に基いて、千九百三十六年十二月一日に日本国逓信省が、従来どおり、引き統き特別の規則に従う移民船を除いて、有効な安全証書及び連合王国の規則に従つて載せることができる旅客の数を示している証書を呈示する日本国を訪間する連合王国のすべての船舶の旅客宿泊施設の検査を免除する命令を発したことを貴大臣に通知する光栄を有します。

　Sir, With reference to your note No. F 3553/2114/23 of the 26th June, 1936, regarding the survey of passenger ships at ports in Japan and the United Kingdom, I have the honnor, under the instructions of my Government, to inform you that the Japanese Department of Communications issued on the 1st December, 1936, an Ordinance which dispenses with the survey of the passenger accommodation of all ships of the United Kingdom visiting Japan which produce valid Safety Certificates together with certificates showing the number of passengers which may be carried according to the United Kingdom regulations,  excepting emigrant ships which will remain subject to special regulations as hitherto.

　この機会を利用して、本使は、千九百三十六年四月十七日のわが方の書簡第九十八号において提案された取極が、今や、貴我両国において、正当且つ相互的に実行されるに至つたことの喜びを表明したいと存じます。

　Availing myself of this opportunity, I wish to express my gratification that the arrangements proposed in our note No. 98 of the 17th April, 1936, have now, duly and reciprocally, been put into practice in our two countries.
