CULTURAL AGREEMENT BETWEEN JAPAN AND INDIA
日本国政府及びインド政府は、
The Government of Japan and the Government of India
両国間の幾多の世紀にわたる文化関係を認識し、
Conscious of many centuries of cultural relations between the two countries,
将来一層緊密な文化関係を助長し、かつ、発展させようとする共通の希望に動かされ、また、
Inspired by a common desire to promote and develop closer cultural relations in the future, and
両国間の関係と理解を、可能なあらゆる方法で助長しかつ深め、及び健全な基礎の上に置くことを希望して、
Desirous of promoting and deepening in every possible way and putting on a sound basis the relations and understanding between the two countries:
文化協定を締結することに決定し、このため、次のとおりそれぞれの全権委員を任命した。
Have decided to conclude a Cultural Agreement and have appointed for this purpose as their respective Plenipotentiaries,

これらの全権委員は、その全権委任状を示してそれが良好妥当であると認められた後、次の規定を協定した。
Who, having communicated to each other their full powers, found to be in good and due form, have agreed upon the following provisions:
第一条 両締約国は、特に次の諸手段により、相手国内において自国の文化が一層理解されるように、自国の法令に従い、できる限りの便宜を相互に与えるものとする。
Article 1 The High Contracting Parties will, subject to the laws and regulations of each Party, accord each other every possible facility so as to assure the better understanding of the culture of their respective country in the other country, especially by means of:
(a) 書籍、定期刊行物その他の出版物
(a) books, periodicals, and other publications;
(b) 講演、演奏会及び演劇
(b) lectures, concerts, and theatrical performances;
(c) 美術展覧会その他の文化的性質を有する展覧会
(c) art exhibitions and other cultural exhibitions;
(d) ラジオその他類似の手段
(d) radio and other similar means: and
(e) 科学的、教育的又は文化的性質を有する映画
(e) scientific, educational or cultural films.
第二条 (1) 両締約国は、教授、学者、学生並びに科学的及び文化的の機関の構成員の両国間における交換を奨励するものとする。
Article 2 (1) The High Contracting Parties will encourage the exchange between their countries of professors, scholars, students and the members of scientific and cultural institutions.
(2) 各締約国は、自国内の科学的、技術的及び工業的の機関における相手国の政府職員又はその政府の委嘱を受けた者の訓練のため、可能なあらゆる便宜を与えるものとする。
(2) Each High Contracting Party will accord every possible facility for the training of employees of the Government of the other High Contracting Party, or any other persons deputed by that Government in the scientific, technical and industrial institutions in its own country.
第三条 各締約国は、自国の領域内における相手国の文化施設の設立について可能なあらゆる便宜を与えるものとする。「文化施設」とは、教育センター、図書館、教育的性質を有する科学機関及び美術奨励のための機関(たとえば、美術館、美術センター、美術団体及びフィルム図書館)をいう。
Article 3 Each High Contracting Party will accord every possible facility for the establishment in its territory of cultural institute of the other High Contracting Party; the term "cultural institute" means educational centres, libraries, scientific institutions of an educational nature, and institutions for the promotion of art, such as art galleries, art centres, art societies and films libraries.
第四条 両締約国は、いずれか一方の締約国の国民が、他方の締約国内において修学若しくは研究を行い、又は技術を習得することができるように、これらの者に奨学金その他の便宜を与えるための方法を研究するものとする。
Article 4 The High Contracting Parties will study measures to provide the nationals of each country with scholarships and other facilities in order to enable such nationals to make study and research or to acquire technical training in the country of the other Contracting Party.
第五条 両締約国は、両国民の間における運動競技及び認められたスカウト組織の間における協力をできる限り奨励するものとする。
Article 5 The High Contracting Parties will encourage, as far as possible, sports competitions between nationals of their respective countries and collaboration between their recognized Scout Organizations.
第六条 各締約国は、自国の法令に従い、自国内において、通常一般に公開されている博物館、図書館その他資料編集施設の利用について相手国の国民に対し便宜を与えるものとする。
Article 6 Each High Contracting Party will subject to the laws and regulations of each Party accord, in its territory, the nationals of the other High Contracting Party the facilities of access to museums, libraries and other documentation centres normally open to the public.
第七条 (1) 両締約国は、この協定の実施を確保するため、二の日本・インド混合委員会を一は東京に他はニュー・デリーに設置することに同意する。
Article 7 (1) In order to assure the implementation of the present Agreement the Contracting Parties will agree to establish two Japanese-Indian Mixed Commissions, one in Tokyo, the other in New Delhi.
(2) 各委員会は、一人の委員長並びに日本国政府が指名する二人及びインド政府が指名する二人の四人の委員で構成される。
(2) Each Commission will be composed of a President and four other members, of whom two will be named by the Government of Japan and the other two by the Government of India.
(3) 東京においては、日本国政府が日本国民を委員長に指名し、ニュ・デリーにおいては、インド政府がインド国民を委員長に指名する。
(3) In Tokyo the Government of Japan will name a Japanese national as the President and in New Delhi the Government of India will name an Indian national as the President.
(4) 各委員会は、少くとも三年に一回委員長により招集される。
(4) Each Commission will be convened by the President at least once in 3 years.
第八条 (1) この協定は、批准されるものとし、できる限りすみやかにニュー・デリーで行われるべき批准書の交換の日に効力を生ずる。
Article 8 (1) The present Agreement shall be ratified and shall come into force on the date of exchange of the instruments of ratification which shall take place as soon as possible at New Delhi.
(2) この協定は、十年間効力を存統するものとし、その後においても、いずれか一方の締約国がこの協定の廃棄を通告した日から六箇月の期間が満了するまでなお効力を有する。
(2) The present Agreement shall remain in force for a period of ten years and thereafter until the expiration of six months from the day on which one of the Contracting Parties shall give notice of its intention to terminate the Agreement.
以上の証拠として、前記の全権委員は、この協定に署名調印した。
IN WITNESS WHEREOF, the aforementioned Plenipotentiaries have signed the present Agreement and have affixed hereunto their seals.
千九百五十六年十月二十九日に東京で、本書二通を作成した。両国政府は、この協定の日本語及びヒンディ語による本文を本日から一箇月以内に交換するものとする。
DONE in duplicate at Tokyo, this twenty-ninth day of October of 1956. Japanese and Hindi texts of this Agreement will be exchanged by the two Governments within one month of this date.
