LETTERS REGARDING THE TERMINATION OF STATE OF WAR BETWEEN JAPAN AND INDIA
インド連絡使節団長から外務大臣にあてた書簡

書簡をもつて啓上いたします。インド総理大臣が対日平和条約に関して行つた声明と、インドと日本国の間の戦争状態をできるだけ早い期日に終了し、且つ、二国間の完全な外交関係を設定する旨のインド政府の宣言された意思とに従つて、私は、現在サン・フランシスコで開会中である会議において署名を予定されている平和条約の効力発生と同時に発出することを、インド政府が予定している告示案をここに同封する光栄を有します。
Excellency, In accordance with the statements made by the Prime Minister of India in regard to the Japanese Peace Treaty and the declared intention of the Government of India to terminate the state of war between India and Japan at the earliest possible date and to establish full diplomatic relations between the two countries, I have the honour to enclose herewith a draft Notification, which the Government of India propose to issue simultaneously with the coming into force of the Peace Treaty which is scheduled for signature at the Conference now in session at San Francisco.
インド政府は、前記の提案が日本国政府によつて受諾されることを希望しつつ、すみやかな回答を受けうれば感謝いたします。
In expressing the hope that the above proposal will be acceptable to the Government of Japan, the Government of India would be grateful for an early reply.
本使は、貴大臣に向つてここに重ねて敬意を表します。

DRAFT NOTIFICATION
インド政府は、約六年前に日本国との現実の敵対行動が日本国の降服文書の署名によつて終了したこと及び日本国との平和条約が連合国の多数によつて千九百五十一年九月 日にサン・フランシスコで締結署名されたことにかんがみ、この平和条約が同条約第二十三条に掲げる規定に従つて効力を生じたこの時に当り、インドと日本国との間の戦争状態が本日から終了すべき旨を決定したことを、一般の情報のためにここに告示する。
It is hereby notified for general information that the Government of India. bearing in mind that active hostilities with Japan were ended by Japan's signature of the instrument of surrender nearly six years ago and that a Treaty of Peace with Japan has been concluded and signed at San Francisco on the...... September, 1951, by a large number of the Allied Powers, have de*rm*ed that the state of war between India and Japan shall cease to exist as soon as the said Treaty of Peace comes into force for any states in accordance with the provisions contained in Article 23 thereof.
インド政府は、できるだけ早い期日に、別個の二国間平和条約を日本国と締結することを提案する。これによつて、インド政府と日本国政府の間の関係は、日本国の開戦宣言前に両者の間に存在した友好関係に戻るであろう。
The Government of India propose to conclude' at the earliest practicable date a separate bilateral treaty of peace with Japan whereby the relations between themselves and the Government of Japan would be brought into conformity with the amity which existed between them before the declaration of war with Japan.
この条約において、インド政府は、サン・フランシスコ条約に基いて連合国及びその国民のために規定されたすべての権利、特権、補償及び利益をこれらを実行させる権利とともに、インド政府及びインド国民に確保する条項を規定したい意向である。
In that treaty the Government of India intend to stipulate provisions which will secure to themselves and the Nation of India all the rights, privileges, indemnities and advantages, together with the right to enforce the same, which under the Treaty of San Francisco have been stipulated in favour of the Allied Powers and their nations.

書簡をもつて啓上いたします。本大臣は、インド政府が、サン・フランシスコにおいて署名された日本国との平和条約の効力発生と同時に発出すべき告示案を同封した千九百五十一年九月八日付の貴簡第F二四(二二)／五一号を有難く受領したことを通報する光栄を有します。
Monsieur le Ministre, I have the honour to acknowledge with thanks the receipt of your letter No. F. 24 (22)/51 dated 8th September 1951, with which you enclosed a draft Notification which the Government of India propose to issue simultaneously with the coming into force of the Japanese Peace Treaty which has just been signed at San Francisco.
本大臣は、日本国政府が日本国とインドの間の戦争状態を終了し、且つ、二国間の完全な外交関係を設定する旨のインド政府の意図を心から歓迎することを日本国政府に代つて申し述べる光栄を有します。
On behalf of the Japanese Government, I have the honour to state that the Japanese Government heartily welcome the intention of the Government of India to terminate the state of war between Japan and India and to establish full diplomatic relations between the two countries.

本使は、貴大臣に対し、日本国とインドとの間の戦争状態を終結する次の告示が本日インド官報に掲載された旨を通知する光栄を有します。
Your Excellency, I have the honour to inform Your Excellency that the following notification has issued today in the official Gazette of India terminating the state of war between Japan and India:
「インド政府は、日本国との積極的な敵対打為が六年余前に日本国の降敗によつて終了したこと及び千九百五十一年九月八日にサン・フランシスコで多数の連合国が署名した日本国との平和条約が千九百五十二年四月二十八日前に同条約を批准したすべての国について同日から効力を生じたことに留意して、インドと日本国との間の戦争状態を千九百五十二年四月二十八日に終結させることに決定したことを、周知させるため、ここに告示する。
"It is hereby notified for general information that the Government of India bearing in mind that active hostilities with Japan were ended by Japan's surrender more than six years ago and that the Treaty of Peace with Japan signed at San Francisco on the 8th September 1951 by a number of the Allied Powers has come into force on the 28th April 1952 for all the States which have ratified it before that date, have determined that the state of war between India and Japan shall cease to exist on the 28th April l952.
インド政府は、できる限りすみやかに日本国との別個の平和条約を締結することを提案するものであり、インド政府と日本国政府との間の関係は、その条約により、日本国に対する宣戦布告前に両国間に存在した友好関係に則するものとされるであろう。」
The Government of India propose to conclude as soon as possible a separate Treaty of Peace with Japan whereby the relations between themselves and the Government of Japan would be brought into conformity with the amity which existed between them before the declaration of war with Japan ".

本大臣は、日本国とインドとの間の戦争状態を終結する次の告示が本日インド官報に掲載された旨を通知された本日付の貴簡F24(22)/1/52を受領したことを確認する光栄を有します。
Monsieur l'Ambassadeur, I have the honour to acknowledge the receipt of Your Excellency's letter No. F 24 (22)1/52 of today informing me that the following notification is issued today in the official Gazette of India terminating the state of war between Japan and India:
