経済及び技術協力に関する日本国政府とガーナ共和国政府との間の協定

AGREEMENT BETWEEN THE GOVERNMENT OF JAPAN AND THE GOVERNMENT OF THE REPUBLIC OF GHANA CONCERNING ECONOMIC AND TECHNICAL CO-OPERATION

　日本国政府及びガーナ共和国政府は、両国及び両国の国民の間にすでに存在する友好関係を強化しかつ緊密にすることを希望し、一層緊密な経済及び技術協力により両国にもたらされる利益を認め、かつ、このために経済及び技術の分野における両国の協力を促進することを希望して、次のとおり協定した。

　The Government of Japan and the Government of the Republic of Ghana, desiring to strengthen and intensify the friendly relations already existing between the two countries and their peoples, recognizing the benefit to be derived by both countries from closer economic and technical co-operation and hoping therefore to promote their co-operation in the economic and technical fields, have agreed as follows:

第一条
(1)　両政府は、経済及び技術の開発の分野において、平等と相互の利益を基礎として、できる限り協力するよう努力するものとする。

Article 1 
(1) The two Governments shall endeavour to co-operate as far as possible in the field of economic and technical development. Co-operation shall take place on the basis of equality and mutual benefit.

(2)　両政府は、両政府の間で相互に合意する経済及び技術協力計画を実施するため、必要な場合には、特別の取極を行なうことができる。

(2) The two Governments may make special arrangements, if necessary, in order to carry out projects for economic and technical co-operation to be mutually agreed Upon between the two Governments.

第二条
　日本国政府は、この協定の目的を達成するため、日本国の法令に従い、かつ、両政府が合意する条件により、次のことを行なうために必要な措置を執るものとする。

Article 2 
　In order to realize the aims of the present Agreement, the Government of Japan shall, in accordance with the laws and regulations in Japan and on such terms as may be agreed upon by both Governments, take necessary measures-

(a)　ガーナ共和国政府に対し、両政府の間で結ぶ協定の定めるところによりガーナに技術訓練センターを設置するため、教材、機械、設備、工具及び予備部品並びに日本側の技術職員及び教育職員の役務を供与すること

(a) to provide the Government of the Republic of Ghana with teaching aids and materials, machinery, equipment, tools and spare parts and the services of Japanese technical and teaching staff, with a view to establishing a technical training centre in Ghana as stipulated in an agreement to be concluded between the two Governments;

(b)　日本国における訓練のためにガーナ国民に対し研修手当を支給すること

(b) to make training 9wards available to Ghanaian nationals for training in Japan;

(c)　ガーナの経済及び技術の開発を促進するため日本側の専門家を派遣すること

(c) to dispatch Japanese experts in order to encourage the economic and technical development of Ghana;

(d)　ガーナ共和国政府に対し、供与される授助に関する必要な技術情報を提供すること

(d) to furnish the Government of the Republic of Ghana with necessary technical information on the assistance provided.

第三条
　ガーナ共和国政府は、この協定の目的を達成するため、次のことを行なうものとする。

Article 3 
　In order to realize the aims of the present Agreement, the Government of the Republic of Ghana shall---

(a)　第二条(a)に掲げる技術訓練センターの設置及び維持に必要な土地、建物、職員の役務、施設及び運営費を供与する。

(a) provide land, buildings, and the services of personnel as well as facilities and running expenses necessary to establish and maintain the technical training centre as referred to in paragraph (a) of Article 2;

(b)　技術訓練センターのために日本国政府が供与する第二条(a)に掲げる物品に対する関税を免除する。

(b) exempt from customs duty the articles, referred to in paragraph (a) of Article 2, provided by the Government of Japan for the technical training centre:

(c)　技術協力計画に基づいてガーナに派遣される日本側の専門家、技術職員及び教育職員並びにその家族に対し、最初にガーナに到着した時に申告することを条件として、身回り品及び家庭用品並びに一家族につき一台の原動機付車両をすべての関税その他租税としての課徴金を支払うことなくガーナに輸入し、また、再輸出することを許可する。ただし、ガーナ共和国政府は、身回り品及び家庭用品、又は原動機付車両が最初に輸入された時から三年以内にガーナで売却される場合には、当該物品に対し関税を課する権利を留保する。

(c) permit Japanese experts and technical and teaching staff assigned to Ghana under a technical co-operation project and their families to import into and re-export from Ghana, free of all customs duties and other fiscal charges, personal and household effects, and one motor vehicle per family, provided such items are declared at the time of the first arrival in Ghana. The Government of the Republic of Ghana reserves the right to charge duty in respect of personal and household effects or motor vehicles which are sold in Ghana within three years of their first importation;

(d)　日本側の専門家、技術職員及び教育職員並びにその家族に対し、技術協力計画に基づきガーナに派遣されている期間、すべての所得税及び社会保障税並びに自己の使用のための個人的財産(自動車を含む。)の所有又は使用に対する租税を免除する。ただし、この免除は、技術協力計画以外の源泉から生ずるこれらの者の所得又は収入には適用しないものとする。

(d) exempt the Japanese experts, technical and teaching staff and their families from all income and social security taxes as well as from taxes on the ownership or use of personal property (including automobiles) intended for their own use, for the duration of their assignment in Ghana under a technical co-operation project, provided that such exemption shall not apply to the income or earnings of such personnel accruing to them from sources other than a technical co-operation project.

第四条
　両政府は、経済及び技術の分野における知識及び経験の交流を促進するため、それぞれの国民及び会社の間の協力をできる限り容易にするものとする。

Article 4 
　The two Governments per as possible co-operation between their respective nationals and companies in order to promote the exchange of know1edge and experience in the economic and technical fields.

第五条
(1)　この協定は、署名の日に効力を生ずる。

Article 5 
(1) The present Agreement shall come into force on the date of signature.

(2)　この協定は、五年の期間効力を有する。ただし、各一年の期間が満了する三箇月以前にいずれか一方の政府が他方の政府に対し当該一年の期間の満了の際にこの協定を終了させる意思を書面により通告した場合は、この限りでない。

(2) The present Agreement shall remain in force for five years unless either Government notifies in writing the other Government, three months prior to the end of each period of one year, of its intention to terminate the Agreement at the end of that period.

(3)　両政府は、五年の期間が満了する以前に、この協定を延長又は修正することが望ましいかどうかについて協議することができる。

(3) Before the end of the period of five years, the two Governments may consult as to the desirability of extending or modifying the present Agreement.

(4)　この協定の規定は、この協定の有効期間中に開始され、かつ、この協定が終了する時にまだ完成していない技術及び経済協力計画については、引き続き適用するものとする。

(4) The provisions of the present Agreement shall continue to apply to any project for technical and economic co-operation which is commenced during the period of validity of the present Agreement and is not yet completed when the present Agreement is terminated.
