ARRANGEMENT BETWEEN THE GOVERNMENT OF JAPAN AND THE GOVERNMENT OF DENMARK REGARDING SETTLEMENT OF CERTAIN DANISH CLAIMS
日本国政府及びデンマーク政府は、
The Government of Japan and the Government of Denmark,
デンマークのある種の請求権を最終的に解決することを希望して、
Desiring to make a final settlement of certain Danish claims,
次のとおり協定した。
Have agreed as follows:
第一条 日本国政府は、第二次世界大戦の間に日本国政府の機関がデンマーク政府の機関並びにデンマークの自然人及び法人に与えた損害及び苦痛であつて日本国政府が国際法に従い責任を有するもののすべての賠償請求の解決として、百十七万五千合衆国ドルの金額をデンマーク政府に支払うものとする。
Article I The Government of Japan shall pay to the Government of Denmark the amount of 1,175,000 United States dollars in settlement of all c1aims for reparation of damage and sufferings inflicted upon the Danish Government agencies and Danish physical and juridical persons during the Second World War by agencies of the Government of Japan and for which the Government of Japan is held responsible according to International Law.
この取極の適用上、デンマークの自然人及び法人とは、該当の日本国の行為がなされた日に、デンマークの国籍を有していたもの及びデンマーク系であった法人をいう。
For the purposes of the present Arrangement Danish physical and juridical persons shall mean those who were of Danish nationality, as well as those juridical persons who were of Danish character, at the date of the relevant Japanese actions.
第二条 第一条に掲げた金額の支払は、この取極の効力発生の時から三箇月をこえない実行可能な最も短い期間内に、デンマーク政府の代理機関として行動する在コペンハーゲンデンマーク大蔵省に対して合衆国ドルで送達されるものとする。
Article II The payment of the amount mentioned in Article I shall be remitted in United States dollars to the Danish Ministry of Finance, Copenhagen, acting as the agent for the Government of Denmark, within the shortest practicable time not to exceed three months from the coming into force of the present Arrangement.
第三条 第一条に掲げた金額の支払により、日本国政府は、第二次世界大戦(千九百三十七年七月七日からの支那事変を含む。)の間に日本国政府の機関がデンマーク政府の機関並びにデンマークの自然人及び法人に与えた損害及び苦痛のすべての賠償請求にかかるすべての責任を完全にかつ最終的に免がれる。
Article III Payment of the amount mentioned in Article I fully and finally discharges the Government of Japan from all liability in respect of all the claims for reparation of the damage and sufferings inflicted by agencies of the Government of Japan upon the Danish Government agencies and Danish physical and juridical persons during the Second World War including the hostilities in China from July 7, l937.
第四条 第一条に掲げた金額を請求権者に配分する権限及び責任は、もつぱらデンマーク政府にあるものとする。
Article IV The authority and responsibility to distribute the amount mentioned in Article I among the claimants shall be exclusive1y incumbent upon the Government of Denmark.
第五条 この取極は、署名の日に効力を生ずる。
Article V The present Arrangement shall enter into force on the date of signature.
以上の証拠として、下名は、各自の政府により正当に委任を受け、この取極に署名した。
IN WITNESS WHEREOF, the undersigned, being duly authorized by their respective Governments, have signed the present Arrangement.
千九百五十九年五月二十五日に東京で、英語により本書二通を作成した。
