AGREEMENT BETWEEN THE GOVERNMENT OF JAPAN AND THE ROYAL GOVERNMENT OF AFGHANISTAN CONCERNING THE ESTABLISHMENT OF TRAINING CENTRE FOR SMALL SCALE INDUSTRIES

　日本国政府及びアフガニスタン王国政府は、両国間の経済的及び技術的協力を推進し、かつ、両国間の伝統的に存在する友好関係を一層強化することを切望し、次のとおり協定した。

　The Government of Japan and the Royal Government of Afghanistan, earnestly desiring to advance the economic and technical cooperation between the two countries and thereby to strengthen further the friendly relations which traditionally exist between the two countries, have agreed as follows:

第一条
　小規模工業のための訓練センター(以下「訓練センター」という。)をカブールに設立する。訓練センターは、次の業務を行なう。

ARTICLE I 
　There shall be established a Training Centre for Small Scale lndustries (hereinafter called "the Training Centre") at Kabul, which shall execute the following functions:

(a)　小規模工場のための職工及び技術者の実際的及び理論的訓練

(a) practical and theoretical training of workers and technicians for small scale industrial units;

(b)　アフガニスタンにおいて実施可能な工業技術の改良を目的とする研究及び実験

(b)  research and experiment with a view to improving industrial technique applicable in Afghanistan.

第二条
(1)　日本国政府は、日本国において施行されている法令に従い、附表Iに掲げる日本人の理事長並びに必要な日本人の指導職員及び技術職員(以下「日本人の職員」という。)の役務を自己の負担において供与するため必要な措置を執るものとする。

ARTICLE II 
(1) In accordance with laws and regulations in force in Japan, the Government of Japan will take necessary measures to provide at their own expense the services of a Japanese director and of requisite Japanese teaching and technical staff (hereinafter called "the Japanese staff") as listed in Annexure I.

(2)　日本人の職員は、附表IIに掲げる特権、免除及び便宜を与えられ、かつ、同様の状況の下において第三国の専門家に与えられるよりも不利でない特権、免除及び便宜を与えられるものとする。

(2) The Japanese staff shall be granted privileges, exemptions and benefits, as mentioned in Annexure II, and shall be granted privileges, exemptions and benefits no less favourable than those granted to the experts of the third countries under similar circumstances.

第三条
(1)　日本国政府は、日本国において施行されている法令に従い、附表IIIに掲げる訓練センターの各部門の設立に必要な教材、機械、設備、工具及び部分品を自己の負担において供与するため必要な措置を執るものとする。

ARTICLE III 
(1) In accordance with laws and regulations in force in Japan, the Government of Japan will take necessary measures to provide at their own expense teaching aids, machinery, equipment, tools and spare parts required for the establishment of the departments at the Training Centre as listed in Annexure III.

(2)　前記の物品は、トルカムにおいてc・i・f建てでアフガニスタンの関係当局に引き渡された時に、アフガニスタン王国政府の財産となるものとする。

(2) The articles referred to above shall become the property of the Royal Government of Afghanistan upon being delivered c.i.f. at Torkham to the Afghan authorities concerned.

(3)　前記の物品は、日本人及びアフガニスタン人の理事長の監督の下で訓練センターの目的にのみ使用するものとする。

(3) These articles shall be utilized exclusively for the purposes of the Training Centre under the supervision of the Japanese and the Afghan directors.

第四条
　アフガニスタン王国政府は、この協定に定めるアフガニスタンにおける職務の善意の遂行に起因し、又はその遂行中に発生し、若しくはその遂行に関連する日本人の職員に対する請求が生じた場合には、その責任を負うものとする。

ARTICLE IV 
　The Royal Government of Afghanistan undertake to bear claims, if any arise, against the Japanese staff resulting from, occurring in the course of, or otherwise connected with the bona fide discharge of their functions in  Afghanistan covered by this Agreement.

第五条
(1)　アフガニスタン王国政府は、自己の負担において次のものを供与するものとする。

ARTICLE V 
(1) The Royal Government of Afghanistan undertake to provide at their own expense;

(a)　附表IVに掲げるアフガニスタン人の理事長並びに必要な技術職員及び事務職員

(a) an Afghan director and requisite Afghan technical and administrative staff, as listed in Annexure IV;

(b)　附表Vに掲げる必要な建物並びにこれに要する土地及び附帯施設

(b) requisite buildings as listed in Annexure V as well as land and incidental facilities required therefor;

(c)　原材料並びに機械、設備及び工具の補充品並びに日本国政府が供与しない訓練センターの運営に必要なその他の材料

(c) raw materials, replacements of machinery, equipment and tools, and any other materials necessary for the operation of the Training Centre that are not provided by the Government of Japan:

(d)　日本人の職員のための適当な家具付き宿舎及び交通手段

(d) suitable furnished accommodation and transportation facilities for the Japanese staff.

(2)　アフガニスタン王国政府は、次の支払を行なうものとする。

(2) The Royal Government of Afghanistan undertake to meet;

(a)　第三条に掲げる物品についてアフガニスタンにおいて課される関税、内国税その他類似の課徴金

(a) customs duites, internal taxes and other similar charges, if any, imposed in Afghanistan in respect of the articles referred to in Article III;

(b)　第三条に掲げる物品のアフガニスタン内における輸送並びにそれらの物品の設置、操作及び維持に必要な経費

(b) expenses necessary for the transportation of the articles referred to in Article III within Afghanistan as well as for the installation, operation and maintenance thereof;

(c)　訓練センターの運営に必要なその他の運営費

(c) any other running expenses necessary for the operation of the Training Centre.

第六条
　日本人の理事長は、第一条に掲げる訓練センターの業務に関する技術的事項につき責任を有するものとする。アフガニスタン人の理事長は、それらの訓練センターの業務に関する事務的事項につき責任を有するとともに、そのような技術的事項につき日本人の理事長を補佐するものとする。

ARTICLE VI 
　The Japanese director shall be responsible for the technical matters pertaining to the functions of the Training Centre referred to in Article I, while the Afghan director shall be responsible for the administrative matters pertaining to these functions of the Training Centre and shall in addition assist the Japanese director in such technical matters.

第七条
　訓練センターの目的を推進し、かつ、訓練センターの運営についての日本・アフガニスタン協力を成功裡に促進するため、両政府間で協議を行なうものとする。

ARTICLE VII 
　There shall be mutual consultation between the two Governments for the purpose of advancing the objoctives of the Training Centre and of successfully promoting Afghan-Japanese cooperation in operating the Training Centre.

第八条
(1)　この協定は、署名の日に効力を生ずる。

ARTICLE VIII 
(1) This Agreement shall enter into force on the date of its signature.

(2)　この協定は、その効力発生の日から三年の期間効力を有し、その後も効力を存続する。ただし、この協定は、いずれか一方の政府が他の政府に対しこの協定を終了させる意思を少なくとも六箇月の予告をもつて書面により通告した場合には、前記の三年の期間の終了の日に又はその後に終了する。

(2) This Agreement shall remain in force for a period of three years from its entry into force and shall continue in force thereafter provided that it shall be terminated on the date of expiry of the above-mentioned three year period or thereafter if either Government have previously given to the other Government at least six months' written notice of their intention to terminate the Agreement.

附表II 　特権、免除及び便宜

ANNEXURE II PRIVILEGES, EXEMPTIONS AND BENEFITS

　アフガニスタン王国政府は、日本人の職員に対し、次の特権、免除及び便宜を与えるものとする。

　The Royal Government of Afghanistan shall accord to the Japanese staff the following privileges, exemptions and benefits:

(1)　アフガニスタンの所得税の支払免除

(1) Exemption from payment of Afghan incometax

(2)　通常の手荷物規則により可能な免税措置

(2) Duty-free concessions available under the normal baggage rules

(3)　次の物品の免税輸入

(3) Duty-free import of the following articles:

(a)　私有の自動車又は原動機付自転車一台

(a) one personal automobile of motor cycle;

(b)　冷蔵庫及び(又は)冷凍装置一台

(b) one refrigerator and/or home freezer;

(c)　ラジオ又はラジオ付蓄音機一台

(c) one radio or radio-gramophone;

(d)　小型電気器具及び附属品

(d) minor electrical appliances and acces-sories;

(e)　冷房装置

(e) air-conditioner;

(f)　専門装具及び附属装置

(f) professional equipment and gadgets; on condition that these articles shall be exported back when the Japanese staff leave Afghanistan on completion of their assignment, and that any of these articles can be disposed of in

　ただし、これらの物品は、日本人の職員がその任務を完了し、アフガニスタンを離れる時に国外に返送され、アフガニスタン王国政府の事前の許可を得た場合にのみアフガニスタンにおいて処分することができるものとし、その場合には、当該日本人の職員は、課されるべき率の関税を支払うものとする。

　Afghanistan only with the prior permission of the Royal Government of Afghanistan, and that, in such cases customs duty at the rates leviable shall be paid by the Japanese staff concerned.
