書簡をもって啓上いたします。本使は、千九百六十七年三月十四日にパリで署名された日本国における経済協力開発機構の特権及び免除に関する日本国政府と経済協力開発機構との間の協定（以下「協定」という。）及び同日付けの協定の規定の適用範囲に関する日本国政府と経済協力開発機構との間の交換公文（以下「千九百六十七年の交換公文」という。）に言及する光栄を有します。

							

						

						

							

								
I have the honour to refer to the Agreement between the Government of Japan and the Organisation for Economic Co-operation and Development on Privileges and Immunities of the Organisation in Japan signed at Paris on March 14, 1967 (hereinafter referred to as “the Agreement”), and the Notes exchanged between the Government of Japan and the Organisation for Economic Co-operation and Development on March 14, 1967 concerning the Agreement (hereinafter referred to as “the Notes of 1967”).

１　千九百六十七年の交換公文の２の規定は、この書簡及び貴事務総長の返簡によって構成される日本国政府と経済協力開発機構との間の合意が効力を生ずる年の翌年の一月一日以後に開始する各課税年度について同機構が日本国民に対して支払う給与及び手当については、適用されなくなる。

							

						

						

							

								
1. Paragraph 2 of the Notes of 1967 shall cease to have effect with respect to salaries and emoluments paid by the Organisation for Economic Co-operation and Development to the nationals of Japan for any taxable years beginning on or after the first day of January in the calendar year next following that in which an agreement between the Government of Japan and the Organisation constituted by this Note and your Note in reply shall enter into force.

(a) The privileges and immunities accorded under the Agreement are provided solely to ensure in all circumstances the unimpeded functioning of the Organisation for Economic Co-operation and Development and the complete independence of the persons to whom they are accorded.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
（ｂ）  経済協力開発機構は、同機構の規則に従い、（ａ）の特権及び免除の濫用を防止するためにあらゆる予防措置をとる。

							

						

						

							

								
(b) The Organisation for Economic Co-operation and Development shall take every precaution to prevent any abuse of these privileges and immunities, in accordance with the rules and regulations of the Organisation.

							

						

						

					

					
				
			
		
			
			
				
				

				
				
				
					

						

							

								
（ｃ）  経済協力開発機構は、（ａ）の特権又は免除の濫用が発生したと日本国政府が認める場合には、要請により、時宜を失することなく問題を解決するために日本国政府と協議する。

							

						

						

							

								
(c) Should the Government of Japan consider that an abuse of any of these privileges or immunities has occurred, the Organisation for Economic Co-operation and Development shall, upon request, consult with the Government of Japan to resolve the issue in a timely manner.

本使は、更に、前記の提案が経済協力開発機構にとって受諾し得るものであるときは、この書簡及び貴事務総長の返簡が日本国政府と同機構との間の合意を構成し、その合意が、日本国政府がその合意の効力発生のために必要とされる国内手続を完了した旨を同機構に通告した日の後三十日目の日に効力を生ずるものとすることを提案する光栄を有します。

							

						

						

							

								
I have further the honour to propose that, if the foregoing proposals are acceptable to the Organisation for Economic Co-operation and Development, this Note and your Note in reply shall constitute an agreement between the Government of Japan and the Organisation, which shall enter into force on the thirtieth day after the date on which the Government of Japan informs the Organisation that its internal procedures necessary to give effect to such agreement have been completed.
