Agreement between the Government of Japan and the Government of the Federal Republic of Germany on Cooperation in the Field of Environmental Protection

　日本国政府及びドイツ連邦共和国政府は、

　The Government of Japan and the Government of the Federal Republic of Germany,

　地球環境の悪化が人類の生存に対して重大な脅威をもたらすことに留意し、

　Noting that global environmental deterioration would pose serious threats to the survival of mankind,

　健全かつ持続可能な経済的及び社会的な発展を確保するため、環境の保護及び改善が重要であることを認識し、

　Recognizing the importance of environmental protection and improvement to ensure sound and sustainable economic and social development,

　両政府間の協力がそれぞれの国における環境の保護に関する同種の問題に対処する上で相互の利益となり、かつ、環境の保護及び改善に係る地域的及び地球的規模の努力に貢献することを信じ、

　Believing that cooperation between the two Governments is of mutual advantage in coping with similar problems of environmental protection in each country and will contribute to such regional and global efforts,

　千九百七十四年十月八日に署名された科学技術の分野における協力に関する日本国政府とドイツ連邦共和国政府との間の協定の下で行われてきた環境の保護の分野における協力を想起し、

　Recalling the cooperation in the field of environmental protection carried out under the Agreement between the Government of Japan and the Government of the Federal Republic of Germany on Cooperation in the Field of Science and Technology signed on October 8, 1974, and

　環境の保護の分野における両政府間の協力を強化することを希望して、

　Desiring to strengthen the cooperation between the two Governments in the field of environmental protection,

　次のとおり協定した。

　Have agreed as follows:

第一条
　両政府は、平等、相互主義及び相互の利益に基づき環境の保護の分野における協力を発展させる。

Article 1
　The two Governments shall develop cooperation in the field of environmental protection on the basis of equality, reciprocity, and mutual benefit.

第二条
　この協定に基づく協力活動は、次の形態により行うことができる。

Article 2
　Cooperative activities under this Agreement may take the following forms:

(a)　環境の保護に関連する活動、政策、法令及び技術についての情報及び資料の交換

(a) Exchange of information and data on activities, policies, legislation and regulations, and technology related to environmental protection;

(b)　人員の交流

(b) Exchange of personnel;

(c)　合同セミナー及び会合

(c) Joint seminars and meetings; and

(d)　相互に合意されるその他の形態の協力活動

(d) Other forms of cooperative activities as may be mutually agreed.

第三条
1　この協定に基づく協力活動は、地球的及び地域的に重要な次の分野において行うことができる。

Article 3
1. Cooperative activities under this Agreement may be undertaken in the following areas of global and regional concern:

(a)　地球の温暖化の防止

(a) Global warming prevention;

(b)　オゾン層の保護

(b) Protection of ozone layer;

(c)　砂漠化の防止

(c) Prevention of desertification;

(d)　生態系及び生物の多様性の保全

(d) Conservation of ecosystems and biological diversity;

(e)　酸性雨の防止

(e) Prevention of acid rain;

(f)　大気の汚染の防止

(f) Air pollution control;

(g)　水質の汚濁及び海洋の汚染の防止

(g) Water pollution control and marine pollution control;

(h)　土壌の汚染の防止

(h) Soil pollution control;

(i)　廃棄物の管理、資源の回収並びに有害廃棄物の規制及び処理

(i) Waste management, resource recovery, and control and disposal of toxic wastes; and

(j)　騒音の低減

(j) Noise abatement.

2　この協定に基づく協力活動は、相互に合意されるその他の環境の保護及び改善に関する分野において行うことができる。

2. Cooperative activities under this Agreement may be also undertaken in other areas of environmental protection and improvement as may be mutually agreed.

第四条
　この協定に基づく特定の協力活動の細目及び手続を定める実施取極は、両政府又は両政府の機関のいずれか適当なものを当事者として行うことができる。

Article 4
　Implementing arrangements setting forth the details and procedures of the specific cooperative activities under this Agreement may be made between the two Governments or their agencies, whichever is appropriate.

第五条
　両政府は、この協定に基づく協力活動に関し、公的部門又は民間部門の研究者及び組織（ドイツ連邦共和国については州を含む。）の参加を認めることができる。

Article 5
　With regard to the cooperative activities under this Agreement, the two Governments may allow the participation of researchers and organizations in both public and private sectors (including the Federal Laender in the case of the Federal Republic of Germany).

第六条
1　両政府は、この協定を効果的に実施するため、各政府が指名する委員からなる環境協力に関する合同委員会（以下「委員会」という。）を設置するものとし、委員会の任務は、次のとおりとする。

Article 6
1. In order to implement this Agreement effectively, the two Governments shall establish a Joint Committee on Environmental Cooperation (hereinafter referred to as "the Committee") consisting of the members designated by each Government.  The Committee shall have the following functions:

(a)　この協定の実施状況を検討すること。

(a) to review the progress of the implementation of this Agreement;

(b)　この協定に基づく協力活動を促進するための適切な措置を両政府に提案すること。

(b) to propose to the two Governments appropriate measures to promote cooperative activities under this Agreement; and

(c)　この協定の実施に関連するその他の事項を討議すること。

(c) to discuss other matters related to the implementation of this Agreement.

2　委員会は、原則として年一回、日本国及びドイツ連邦共和国において交互に会合する。

2. The Committee shall meet, in principle once a year, alternately in Japan and in the Federal Republic of Germany.

3　委員会の会合が開催されていない期間中の委員会の任務に関する連絡は、外交上の経路を通じて行う。

3. Contacts concerning the functions of the Committee when it is not in session shall be conducted through diplomatic channels.

第七条
　この協定の実施は、各国の利用可能な予算及び適用可能な法令に従うことを条件とする。

Article 7
　Implementation of this Agreement shall be subject to the availability of appropriated funds and to the applicable laws and regulations of each country.

第八条
　この協定のいかなる規定も、両政府間の協力に関する他の取極でこの協定の署名の日に存存するもの又はその後締結されるものに影響を及ぼすものと解してはならない。

Article 8
　Nothing in this Agreement shall be construed as to prejudice other arrangements for cooperation between the two Governments, existing at the date of signature of this Agreement or concluded thereafter.

第九条
1　この協定は、署名の日に効力を生ずる。この協定は、二年間効力を有し、最初の二年の期間の終わりに又はその後いつでもいずれか一方の政府が他方の政府に対しこの協定を終了させる意思を少なくとも六箇月の事前の予告をもって書面により通告することによって終了させない限り効力を存続する。

Article 9
1. This Agreement shall enter into force on the date of signature thereof.  It shall remain in force for two years and shall remain in force thereafter unless terminated by either Government at the end of the initial two-year period or at any time thereafter by giving to the other Government at least six months' written advance notice of its intention to terminate this Agreement.

2　この協定の終了は、第四条にいう実施取極に従って行われ、かつ、この協定の終了の時に履行を完了していないいかなる計画の履行にも影響を及ぼすものではない。

2. The termination of this Agreement shall not affect the completion of any program undertaken in accordance with the implementing arrangements referred to in Article 4 and not fully executed at the time of the termination of this

　千九百九十七年八月二十六日に東京で、ひとしく正文である日本語、ドイツ語及び英語により本書二通を作成した。日本語及びドイツ語の本文の解釈に相違がある場合には、英語の本文による。

　Done at Tokyo, on the 26th of August, 1997, in duplicate in the Japanese, German, and English languages, all three texts being equally authentic. In case of divergent interpretations of the Japanese and German texts, the English text shall prevail.
