アフリカ難民等に対する食糧援助に関する日本国政府と世界食糧計画との間の交換公文

Madam,
書簡をもって啓上いたします。本使は、日本国政府(以下「政府」という。)の代表者と世界食糧計画(以下「計画」という。)の代表者との間で最近行われたソマリア、スーダン、エティオピア、ジブティ、ケニア、コンゴー民主共和国、ルワンダ、ブルンディ、シエラ・レオーネ難民並びにソマリア及びシエラ・レオーネ国内被災民に対する食糧援助計画に関する協議に言及するとともに、千九百九十五年の食糧援助規約に関連して政府が計画を通じて供与する意向を有する援助に関する次の取極を提案する光栄を有します。
I have the honour to refer to the recent discussions held between the representatives of the Government of Japan (hereinafter referred to as "the Government") and of the World Food Programme (hereinafter referred to as "the Programme") in relation to the food aid programme for the Somali refugees, the Sudanese refugees, the Ethiopian refugees, the Djiboutian refugees, the Kenyan refugees, the Congolese refugees from the Democratic Republic of Congo, the Rwandese refugees, the Burundese refugees, the Sierra Leonean refugees and the suffering people in Somalia and Sierra Leone, and have further the honour to propose the following arrangements concerning the assistance which the Government intends to extend through the Programme in connection with the Food Aid Convention, 1995:
1 政府は、日本国の関係法令に従い、二十億五千万円(二、〇五〇、〇〇〇、〇〇〇円)を贈与の形で計画の使用に供する。
1. The Government shall make available to the Programme, in accordance with the relevant laws and regulations of Japan, the amount of two billion and fifty million yen (2,050,000,000) in the form of grant.
2 政府は、日本国の外国為替公認銀行の東京店に開設されている世界食糧計画の勘定に、1に定める額を日本円で払い込む。この額は、政府の関係当局と計画との間の合意によって延長されない限り、この取極が効力を生ずる日から千九百九十八年三月三十一日までの期間中に払い込まれる。
2. The Government shall make a payment of the amount referred to in paragraph 1 in Japanese yen to the World Food Programme Account opened in the Tokyo office of an authorized foreign exchange bank of Japan. This amount shall be paid during the period between the date of coming into force of the present arrangements and March 31, 1998, unless the period is extended by mutual agreement between the authority concerned of the Government and the Programme.
3 政府は、2の規定に従って払込みを行うことにより、その払込みを行ったときにその払込みの金額までこの取極に基づく援助を実施したとみなされる。
3. By and upon making the payment under the preceding paragraph, the Government shall be deemed to have made the assistance under the present arrangements to the extent of the amount of such payment.
4(1) 1に定める総額は、アメリカ合衆国及び(又は)カナダ及び(又は)オーストラリア及び(又は)欧州連合の加盟国において生産された小麦、メキシコ及び(又は)アルゼンティン及び(又は)タンザニア及び(又は)南アフリカ及び(又は)ジンバブエ及び(又は)ウガンダ及び(又は)中国及び(又は)アメリカ合衆国及び(又は)欧州連合の加盟国において生産されたメイズ及び南アフリカ及び(又は)アメリカ合衆国及び(又は)欧州連合の加盟国において生産されたメイズミール及び(又は)アメリカ合衆国及び(又は)欧州連合の加盟国及び(又は)南アフリカにおいて生産された豆並びにこれらの購入に関連する費用(輸送費、保険料及び計画に対する手数料を含む。)に使用される。
4.(1) The total amount referred to in paragraph 1 above shall be used for the purchase of wheat produced in the United States of America and/or Canada and/or Australia and/or the member States of the European Union and maize produced in Mexico and/or Argentina and/or Tanzania and/or South Africa and/or Zimbabwe and/or Uganda and/or China and/or the United States of America and/or the member States of the European Union and maize meal produced in South Africa and/or the United States of America and/or the member States of the European Union and/or pulses produced in the United States of America and/or the member States of the European Union and/or South Africa, and for the expenditures related to such purchases, including freight, insurance premium and the Programmers agency fees.
(2) アメリカ合衆国及び(又は)カナダ及び(又は)オーストラリア及び(又は)欧州連合の加盟国において生産された小麦、メキシコ及び(又は)アルゼンティン及び(又は)タンザニア及び(又は)南アフリカ及び(又は)ジンバブエ及び(又は)ウガンダ及び(又は)中国及び(又は)アメリカ合衆国及び(又は)欧州連合の加盟国において生産されたメイズ及び南アフリカ及び(又は)アメリカ合衆国及び(又は)欧州連合の加盟国において生産されたメイズミール及び(又は)アメリカ合衆国及び(又は)欧州連合の加盟国及び(又は)南アフリカにおいて生産された豆の現在の価格、運賃及び保険料を考慮して、次のことが期待される。
(2) Taking into account the current price of wheat produced in the United States of America and/or Canada and/or Australia and/or the member States of the European Union and maize produced in Mexico and/or Argentina and/or Tanzania and/or South Africa and/or Zimbabwe and/or Uganda and/or China and/or the United States of America and/or the member States of the European Union and maize meal produced in South Africa and/or the United States of America and/or the member States of the European Union and/or pulses produced in the United States of America and/or the member States of the European Union and/or South Africa, freight rates and insurance premium, it is anticipated that:
(a) 最小限七千七百万円(七七、〇〇〇、〇〇〇円)相当の欧州連合の加盟国及び(又は)アメリカ合衆国及び(又は)南アフリカにおいて生産されたメイズが購入され、船積みされ、ケニア国内のソマリア、スーダン及びエティオピア難民に引き渡されること。
(a) a minimum of seventy-seven million yen (77,000,000) of maize produced in the member States of the European Union and/or the United States of America and/or South Africa will be purchased, shipped and delivered to the Somali, Sudanese and Ethiopian refugees in Kenya;
(b) 最小限四千三百万円(四三、〇〇〇、〇〇〇円)相当のメキシコ及び(又は)アルゼンティン及び(又は)タンザニア及び(又は)南アフリカ及び(又は)ジンバブエ及び(又は)ウガンダ及び(又は)中国において生産されたメイズが購入され、船積みされ、ソマリア国内被災民に引き渡されること。
(b) a minimum of forty-three million yen (43,000,000) of maize produced in Mexico and/or Argentina and/or Tanzania and/or South Africa and/or Zimbabwe and/or Uganda and/or China will be purchased, shipped and delivered to the suffering people in Somalia;
(c) 最小限七千二百万円(七二、〇〇〇、〇〇〇円)相当のアメリカ合衆国及び(又は)カナダ及び(又は)オーストラリア及び(又は)欧州連合の加盟国において生産された小麦が購入され、船積みされ、エティオピア国内のソマリア、スーダン、ジブティ及びケニア難民に引き渡されること。
(c) a minimum of seventy-two million yen (72,000,000) of wheat produced in the United States of America and/or Canada and/or Australia and/or the member States of European Union will be purchased, shipped and delivered to the Somali, Sudanese, Djiboutian and Kenyan refugees in Ethiopia;
(d) 最小限八千三百万円(八三、〇〇〇、〇〇〇円)相当のアメリカ合衆国及び(又は)欧州連合の加盟国及び(又は)南アフリカにおいて生産されたメイズ及び(又は)アメリカ合衆国及び(又は)欧州連合の加盟国及び(又は)南アフリカにおいて生産された豆が購入され、船積みされ、ウガンダ国内のスーダン、コンゴー民主共和国及びルワンダ難民に引さ渡されること。
(d) a minimum of eighty-three million yen (83,000,000) of maize produced in the United States of America and/or the member States of the European Union and/or South Africa and/or pulses produced in the United States of America and/or the member States of the European Union and/or South Africa will be purchased, shipped and delivered to the Sudanese, Congolese from the Democratic Republic of Congo and Rwandese refugees in Uganda;
(e) 最小限三億千六百万円(三一六、〇〇〇、〇〇〇円)相当のメキシコ及び(又は)アルゼンティン及び(又は)タンザニア及び(又は)南アフリカ及び(又は)ジンバブエ及び(又は)ウガンダ及び(又は)中国において生産されたメイズが購入され、船積みされ、タンザニア、コンゴー民主共和国及びウガンダ国内のルワンダ及びブルンディ難民に引き渡されること。
(e) a minimum of three hundred and sixteen million yen (316,000,000) of maize produced in Mexico and/or Argentina and/or Tanzania and/or South Africa and/or Zimbabwe and/or Uganda and/or China will be purchased, shipped and delivered to the Rwandese and Burundese refugees in Tanzania, Uganda and the Democratic Republic of Congo; and
(f) 最小限一億七千六百万円(一七六、〇〇〇、〇〇〇円)相当の南アフリカ及び(又は)アメリカ合衆国及び(又は)欧州連合の加盟国において生産されたメイズミールが購入され、船積みされ、ギニア国内のシエラ・レオーネ難民及びシエラ・レオーネ国内被災民に引き渡されること。
(f) a minimum of one hundred and seventy-six million yen (176,000,000) of maize meal produced in South Africa and/or the United States of America and/or the member States of the European Union will be purchased, shipped and delivered to the Sierra Leonean refugees in Guinea and the suffering people in Sierra Leone.
(3) 計画は、(2)にいう小麦、メイズ及びメイズミール及び(又は)豆の購入並びに輸送及び保険のため、計画の財務規則に従い供給者と契約を締結する。
(3) The Programme shall enter into contracts with suppliers for the purchase of the wheat and the maize and the maize meal and/or the pulses referred to in sub-paragraph (2) and for the shipping and insurance in accordance with the Programme's financial rules.
5 計画は、4の規定に従って購入した小麦、メイズ及びメイズミール及び(又は)豆をできる限り速やかにソマリア、スーダン、エティオピア、ジブティ、ケニア、コンゴー民主共和国、ルワンダ、ブルンディ及びシエラ・レオーネ難民並びにソマリア及びシエラ・レオーネ国内被災民に引き渡すために必要なすべての措置をとる。
5. The Programme shall take all the necessary measures to deliver as soon as possible the wheat and the maize and the maize meal and/or the pulses purchased under the preceding paragraph to the Somali refugees, the Sudanese refugees, the Ethiopian refugees, the Djiboutian refugees, the Kenyan refugees, the Congolese refugees from the Democratic Republic of Congo, the Rwandese refugees, the Burundese refugees, the Sierra Leonean refugees and the suffering people in Somalia and Sierra Leone.
6 政府及び計画は、いずれか一方の要請により、この取極から又はこれに関連して生ずるいかなる事項についても、相互に協議する。
6. The Government and the Programme shall consult with each other, at the request of either of them, on any matter that may arise from or in connection with the present arrangements.
7(1) 計画は、供給者と契約を締結した後、遅滞なく次の事項を政府に通報する。
7.(1) When the Programme has entered into contracts with suppliers, it shall inform the Government, without delay, of the following:
(a) 計画が契約に従って支払う総額
(a) Total amount of payments to be made by the Programme under the contract;
(b) 購入した小麦、メイズ及びメイズミール及び(又は)豆の総額
(b) Total value of the wheat and the maize and the maize meal and/or the pulses purchased;
(c) 小麦、メイズ及びメイズミール及び(又は)豆の数量及び品質
(c) Quantity and quality of the wheat and the maize and the maize meal and/or the pulses;
(d) 小麦、メイズ及びメイズミール及び(又は)豆のFOB単価
(d) Unit F.O.B. price of the wheat and the maize and the maize meal and/or the pulses;
(e) 輪送費
(e) Freight costs;
(f) 保険料
(f) Insurance premium;
(g) 供給者の名称
(g) Names of the suppliers; and
(h) 船積みの予定日及び配布地への到着の予定日
(h) Expected dates of shipment to and arrival at distribution sites.
(2) 船積み、荷揚げ及び配布地への到着のたびに、計画は、これらの日付並びに小麦、メイズ及びメイズミール及び（又は）豆の数量及び品質を政府に通報する。
(2) Each time a shipment is loaded aboard a ship or unloaded therefrom or arrives at the distribution sites, the Programme shall inform the Government of the date and the quantity and condition of the wheat and the maize and the maize meal and/or the pulses.
(3) 計画は、最初の積荷が配布地に到着した後、三箇月ごとに小麦、メイズ及びメイズミール及び（又は）豆の配布に関する報告書を政府に提出するよう努める。
(3) After the arrival of the first shipment at the distribution sites, the Programme shall endeavour to submit to the Government a report on the distribution of the wheat and the maize and the maize meal and/or the pulses every three months.
(4) 計画は、この取極に従って購入した小麦、メイズ及びメイズミール及び(又は)豆の配布が完了した後、配布に関する最終報告書を、できる限り配布地における写真を付して、政府に提出する。
(4) Upon the completion of the distribution of the wheat and the maize and the maize meal and/or the pulses purchased under the present arrangements, the Programme shall provide for the Government a final report on the distribution, if possible together with photographs taken at the distribution sites.
(5) 計画は、小麦、メイズ及びメイズミール及び(又は)豆が日本国により贈与された旨の標示を小麦、メイズ及びメイズミール及び(又は)豆の袋に付すことを確保する。
(5) The Programme shall ensure that markings the wheat bags, the maize bags and the maize meal bags and/or the pulse bags bear indicate the wheat and the maize and the maize meal and/or the pulses have been donated by Japan.
本使は、更に、この書簡及び前記の取極を確認される貴官の返簡が政府と計画との間の合意を構成するものとみなし、その合意が貴官の返簡の日付の日に効力を生ずることを提案する光栄を有します。
I have further the honour to propose that the present Note and your reply confirming the foregoing arrangements shall be regarded as constituting an agreement between the Government and the Programme, which shall enter into force on the date of your reply.

I have further the honour to confirm the foregoing arrangements on behalf of the World Food Programme, and to agree that Your Excellency's Note and this reply shall be regarded as constituting an agreement between the Programme and the Government of Japan, which shall enter into force on the date of this reply.
