書簡をもって啓上いたします。本大臣は、ベルギー王国において予定される混合酸化物燃料（日本国に返還後日本国の商業動力炉において使用されるもの）の加工に関し、日本国政府の代表者と欧州原子力共同体(以下｢ユーラトム｣という。)を設立する条約の規定に基づいて与えられた権限及び管轄権を行使し、ユーラトムを代表して行動する欧州共同体委員会(以下｢委員会｣という。)の代表者との間で行われた最近の討議に言及する光栄を有します。
Excellency,I have the honour to refer to the recent discussions held between the representatives of the Government of Japan and of the Commission of the European Communities (hereinafter referred to as "the Commission") exercising the powers and jurisdiction conferred on it in accordance with the provisions of the Treaty establishing the European Atomic Energy Community (hereinafter referred to as "EURATOM") and acting on behalf of EURATOM, concerning the planned fabrication in the Kingdom of Belgium of mixed-oxide fuel which will be returned to Japan and used for commercial power reactors in Japan.
本大臣は、日本国及びユーラトムのすべての加盟国が核兵器の不拡散に関する条約の締約国であり、国際原子力機関(以下「機関」という。)の文書INFCIRC-二五四-Rev・二第一部として公表されている核物質等の移転に関する指針に含まれる原則に従って行動することに留意し、また、改正された原子力の平和的利用に関する協力のための日本国政府とフランス共和国政府との間の協定が効力を有していることを認識して、日本国政府に代わって次の了解を確認する光栄を有します。
I have further the honour to confirm the following understanding on behalf of the Government of Japan, bearing in mind that Japan and all the Member States of EURATOM are parties to the Treaty on the Non- Proliferation of Nuclear Weapons, and act in conformity with the principles contained in the "Guidelines for Nuclear Transfers", published as the document of the International Atomic Energy Agency (hereinafter referred to as "the Agency") INFCIRC/254/Rev. 2/Part 1 and recognizing that the Agreement between the Government of Japan and the Government of the French Republic for Cooperation in the Peaceful Uses of Nuclear Energy, as amended, is in force:
1 ベルギー王国の領域において、
1. In the territory of the Kingdom of Belgium:
(1) 委員会は、附属書の1に掲げるプルトニウム及びウラン(以下｢核物質｣という。)が、欧州原子力共同体を設立する条約に基づくユーラトムの保障措置の適用を受けること及び千九百七十七年二月二十一日に効力を生じた、核兵器の不拡散に関する条約第三条１及び４の規定の実施に関するユーラトム、その加盟国である非核兵器国及び機関の間の協定の適用を受けることを確保するものとする。
(1) the Commission shall ensure that the plutonium and the uranium specified in paragraph 1 of the Annex to this Note (hereinafter referred to as "the Nuclear Material") shall be subject to the safeguards applied by EURATOM pursuant to the Treaty establishing the European Atomic Energy Community and shall be subject to the agreement between EURATOM, its non-nuclear-weapon Member States and the Agency in implementation of Article III 1 and 4 of the Treaty of the Non-Proliferation of Nuclear Weapons, which entered into force on February 21, 1977;
(2) 委員会は、核物質が附属書の2に掲げる平和的非爆発目的にのみ使用されることを確保するものとする。
(2) further to subparagraph (1) above, the Commission shall ensure that the Nuclear Material shall be used only for the intended peaceful non-explosive purpose set forth in paragraph 2 of the Annex to this Note;
(3) 委員会は、核物質が附属書の3に掲げる施設(関係事業者が申告したもの)以外に配置されないことを確保するものとする。
(3) further to the subparagraphs above, the Commission shall ensure that the Nuclear Material shall not be located in any place other than the facilities specified in paragraph 3 of the Annex to this Note, as declared by the undertakings concerned; and
(4) 委員会は、適切な防護の措置か、ベルギー王国政府により最小限機関の文書INFCIRC-二五-Rev・二第一部の附属書Ｃに掲げられる水準において、核物質について適用されることを確認する。
(4) further to the above, the Commission confirms that adequate measures of physical protection will be applied by the Government of the Kingdom of Belgium to the Nuclear Material, as a minimum, at levels which satisfy the criteria set out in Annex C of the Agency document INFCIRC/254/Rev. 2/Part 1.
2 1(3)の規定にかかわらず、核物質は混合酸化物燃料の形態で、かつ、予定される移転を日本国政府に対し文書により少なくとも一箇月前に通告することにより、附属書の2に掲げるとおり、フランス共和国に移転することができる。
2. Notwithstanding the provisions of subparagraph (3) of paragraph 1 of this Note, the Nuclear Material in the form of mixed-oxide fuel may be transferred as specified in paragraph 2 of the Annex to this Note to the French Republic with at least one month's prior written notice to the Government of Japan of the intended transfer.
3 核物質は、委員会及び機関が1(1)において言及される協定の保障措置の終了に係る規定に従い、核物質が消耗したこと、保障措置の適用が相当とされるいかなる原子力活動にも使用することができないような態様で希釈されたこと又は実際上回収不可能となったことを決定した場合には、1の規定の適用を受けないものとする。
3. The Nuclear Material shall no longer be subject to the provisions of paragraph 1 of this Note if the Commission and the Agency determine, in accordance with the provisions for the termination of safeguards in the agreement for the application of the safeguards by the Agency referred to in subparagraph (1) of paragraph 1 of this Note, that the Nuclear Material has been consumed, or has been diluted in such a way that it is no longer usable for any nuclear activity relevant from the point of view of safeguards, or has become practically irrecoverable.
4 日本国政府及び委員会は、この書簡に関するいかなる問題についても、相互に受諾可能な解決を見いだすため、いずれか一方の要請に基づき、相互に協議するものとする。
4. The Government of Japan and the Commission shall consult with each other, at the request of either of them, on any matter concerning this Note with a view to finding a mutually acceptable solution.
5 この書簡のいかなる規定も日本国政府とユーラトムとの間又は日本国政府とユーラトム加盟国政府との間の協定で既存のもの又は将来締結されるものに影響を及ぼすものと解してはならない。
5. Nothing in the provisions of this Note shall be construed to prejudice the existing or future agreements between the Government of Japan and EURATOM or between the Government of Japan and the Government of a Member State of EURATOM.
本大臣は、更に、この書簡及び閣下の返簡が閣下の返簡の日付の日から、前記の了解についての日本国政府と委員会との間の合意を構成することを提案する光栄を有します。
I have further the honour to propose that this Note and Your Excellency's Note in reply shall be, from the date of Your Excellency's Note in reply onwards, the agreement between the Government of Japan and the Commission on the understanding set out above.

日本国において照射された核燃料からフランス共和国において回収された総量四百八十三キログラムのプルトニウム(日本国の事業者が所有するもの)
A total of 483 kg of plutonium recovered in the French Republic from nuclear fuel irradiated in Japan, which is owned by a Japanese undertaking.

二百二十一キログラムのプルトニウムが閣下の返簡の日付けの日の後千九百九十七年九月以前に、また、二百六十二キログラムのプルトニウムが同年三月の後千九百九十八年七月以前にフランス共和国からベルギー王国に移転される。
221 kg of the plutonium will be transferred after the date of Your Excellency's Note in reply but not later than September 1997 and 262 kg of the plutonium after March 1997 but not later than July 1998 from the French Republic to the Kingdom of Belgium.

総量三千八十八キログラムの天然ウラン及び同位元素ウラン二三五の濃縮度が天然ウランにおける混合率を超え十パーセント未満のウラン(日本国の事業者が所有するもの)
A total of 3,088 kg of natural uranium and uranium enriched above natural but less than 10 percent in the isotope 235, which is owned by a Japanese undertaking.

総量三千八十八キログラムのウランの二分の一が閣下の返簡の日付けの日の後千九百九十七年九月以前に、また、残りの二分の一が同年三月の後千九百九十八年七月以前に日本国からベルギー王国に移転される。
One half of the 3,088 kg of uranium will be transferred after the date of Your Excellency's Note in reply but not later than September 1997 and the other half after March 1997 but not later than July 1998 from Japan to the Kingdom of Belgium.
2 核物質の使用
2. Use of the Nuclear Material
核物質は、附属書3(1)及び(2)に掲げる施設において、混合酸化物燃料の加工のために使用される。その後、当該混合酸化物燃料は、フランス共和国を経由して日本国に返還され、日本国の商業動力炉において使用される。
The Nuclear Material will be used for the fabrication of the mixed-oxide fuel at the facilities specified in subparagraphs (1) and (2) of paragraph 3 of this Annex. After fabrication, the mixed-oxide fuel will be returned to Japan via the French Republic and used for commercial power reactors in Japan.
