New York, February 7, 1997
書簡をもって啓上いたします。本使は、千九百七十四年五月三十一日付け国際連合安全保障理事会決議第三百五十号により設立された国際連合兵力引き離し監視隊(以下「UNDOF」という。)の任務のための装備品の使用に関する日本国政府(以下「政府」という。)の貢献について政府の代表者と国際連合の代表者との間で行われた最近の協議に言及する光栄を有します。前記の協議の結果に関し、政府は、次のとおり了解します。
Sir, I have the honor to refer to the recent discussions held between the representatives of the Government of Japan (hereinafter referred to as "the Government") and of the United Nations concerning contribution of the Government regarding the utilization of equipment for the purpose of the mission of the United Nations Disengagement Observer Force established by the United Nations Security Council Resolution 350 dated May 31, 1974 (hereinafter referred to as "UNDOF"). The following is the understanding by the Government of the results of the above-mentioned discussions:
1 国際連合は、この書簡に添付した詳細手続に従って、政府に対し、UNDOFの任務のための使用の期間、次に掲げる装備品(以下「装備品」という。)の政府による使用に関連する経費を支払う。
1. In accordance with the Detailed Procedures attached hereto, the United Nations will pay to the Government the costs related to the utilization by the Government of the equipment listed below (hereinafter referred to as "the Equipment") during its utilization for the purpose of the mission of UNDOF.

2 国際連合は、UNDOFの任務のための使用の期間、装備品用の燃料、油脂、潤滑油(以下「燃料等」という。)を提供する。
2. The United Nations will provide petrol, oil and lubricant (hereinafter referred to as "POL") for the Equipment during its utilization for the purpose of the mission of UNDOF.
3(a) 国際連合は、日本国の部隊による業務の遂行中に装備品により第三者の財産に損失若しくは損害が生じ、又は第三者が死亡若しくは負傷した場合には、第三者によるいかなる請求についても、それを処理する責任を負う。
3.(a) The United Nations will be responsible to address any claims by third parties where the loss of or damage to their property, or death or personal injury, is caused by the Equipment in the performance of services by the Japanese contingent.
(b) ただし、その損失、損害、死亡又は負傷が、装備品を運用する日本国の部隊の要員の重大な過失又は悪意により生じたものである場合には、政府が、その損失、損害、死亡又は負傷に関する第三者による請求を処理する責任を負う。
(b) However, if the loss, damage, death or injury arises from gross negligence or willful misconduct of the personnel of the Japanese contingent operating the Equipment, the Government will be responsible to address claims by third parties for such loss, damage, death or injury.
4 国際連合は、日本国の部隊による業務の遂行中に装備品により国際連合が所有する装備及び財産に損失又は損害が生じた場合には、政府に対するあらゆる請求権を放棄する。ただし、その損失又は損害が装備品を運用する日本国の部隊の要員の重大な過失又は悪意により生じたものである場合は、この限りでない。
4. The United Nations will renounce any claims to the Government where the loss of or damage to United Nations-owned equipment and property is caused by the Equipment in the performance of services by the Japanese contingent unless the loss or damage arises from gross negligence or willful misconduct of the personnel of the Japanese contingent operating the Equipment.
5 政府及び国際連合は、この了解から生じるあらゆる問題に関し、相互に協議する。
5. The Government and the United Nations will consult with each other in respect of any matter that may arise from the present understanding.
6 政府及び国際連合は、この了解の終了の時期及び方法に関し、相互に協議する。
6. The Government and the United Nations will consult with each other on the timing and modalities for termination of the present understanding.
7 この了解は、政府については、日本国の法令に従って実施される。
7. With respect to the Government, the present understanding will be implemented in accordance with the laws and regulations of Japan.
本使は、更に、前記の了解が国際連合にとって受諾し得るものであるときは、この書簡及び受諾を表明される貴官の返簡が、政府と国際連合との間の合意を構成するものとみなし、その合意が貴官の返簡の日付の日に効力を生ずるものとすることを提案する光栄を有します。
I have further the honor to propose that, if the above understanding is acceptable to the United Nations, the present Note and your reply of acceptance shall be regarded as constituting an agreement between the Government and the United Nations which shall enter into force on the date of your reply.

国際連合による支払に関する詳細手続
DETAILED PROCEDURES FOR PAYMENT BY THE UNITED NATIONS
1 補償
1. Compensation
国際連合により政府に対し支払われる補償の額は、装備品の減耗並びに装備品の修理及び維持に関するその他の経費を考慮して、附属書Aに定めるところによる。この額は、装備品が附属書Bに定める性能規格に明記された条件を満たさない場合には、その程度に比例して減額される。
The amount of compensation to be paid by the United Nations to the Government will be as set out in Annex A taking into consideration depreciation of the Equipment and other expenses related to the repair and maintenance of the Equipment. This amount will be reduced proportionately in the event that the Equipment does not meet the conditions specified in the performance standards set out in Annex B.
2 補償期間
2. Period for compensation
装備品の補償に関する国際連合の支払義務は、装備品がUNDOFの任務地域に到着する日より開始し、UNDOFの任務地域において装備品の使用が終了する日をもって終了する。
The financial obligations of the United Nations with respect to the compensation for the Equipment start from the date of arrival of the Equipment in the mission area of UNDOF, and cease on the date the Equipment ceases to be used in the mission area of UNDOF.
3 追加的な条件
3. Additional conditions
国際連合による補償は、次の追加的な条件に基づいて実施される。
Compensation by the United Nations will be implemented under the following additional conditions:
(a) 装備品は、政府の財産であり、かつ、UNDOFの任務のために部隊のみにより使用される。
(a) The Equipment will remain the property of the Government and will be used solely by the contingent and for the purpose of the mission of UNDOF.
(b) 政府が、UNDOFより要請された塗装、標示及び冬季仕様等についての追加的な規格を整備する場合には、国際連合は、その経費を政府に対し支払う。同様に、国際連合は、国内用彩色への再塗装等、撤収時に装備品を国内装備用に整備するための経費を支払う。これらの経費は、経費の詳細に関する認証された書類が政府により提示された後に国際連合により支払われる。
(b) If the Government prepares the Equipment to additional standards requested by UNDOF (such as painting, marking, winterizing), costs will be paid to the Government by the United Nations. Similarly, costs for returning the Equipment to national stocks at the time of repatriation (such as repainting to national colors) will also be paid by the United Nations. The actual costs will be paid by the United Nations following the presentation by the Government of a certified document setting out the details of such costs.
4 検証手続
4. Verification process
(1) 政府は、検証に関する事項についての連絡責任者を指名する。当該責任者は、通常その職務により識別される。
(1) The Government will designate a person, normally identified through his function, who will be the responsible point of contact for verification matters.
(2) 国際連合は、UNDOFの長を通じて、政府により指名された連絡責任者と調整した上で、装備品が附属書Bに定める性能規格を満たしていること、及びこの詳細手続に従って使用されていることを検証する。
(2) The United Nations through its Head of Mission will, in coordination with the person designated by the Government, verify that the Equipment meets the performance standards set out in Annex B and is utilized in accordance with these Detailed Procedures.
(3) 検証手続の結果は、不一致を是正し、又は矯正措置を決定するために行われる、政府と国際連合との間の協議の基礎として用いられる。
(3) The results of the verification process are to be used as a basis of a consultative discussion between the Government and the United Nations in order to correct the discrepancies or decide on corrective action.
(4) 最初の検証は、装備品の任務地域への到着後直ちに実施され、一箇月以内に完了されなければならない。装備品は、国際連合により正当に指名された代表者により検査される。国際連合により正当に指名された代表者は、附属書Bに定める性能規格を確保するため、UNDOFの任務地域における装備品の使用期間中、定期的に検査を実施する。
(4) The first verification will take place immediately after arrival of the Equipment in the mission area and must be completed within one month. The Equipment will be inspected by duly designated representatives of the United Nations. Periodic inspections will take place by duly designated representatives of the United Nations during the period of utilization of the Equipment in the mission area of UNDOF to ensure performance standards set out in Annex B.
5 輸送
5. Transportation
(1) 国際連合は、政府と協議した上で、決定されるべき積込港から任務地域までの装備品の輸送であって配備のために行われるもの、及び任務地域から決定されるべき積卸港までの装備品の輸送であって撤収のために行われるものを手配し、かつ、それに関する経費を支払うことができる。政府が輸送を手配し、又は提供する場合には、実際の経費は、経費の詳細を記述する認証された書類が政府により提示された後に国際連合により支払われる。
(1) The United Nations, in consultation with the Government, may make arrangement for and meet the costs related to the transportation of the Equipment from the port of embarkation to be decided to the mission area for the deployment and from the mission area to the port of disembarkation to be decided for the repatriation. If the Government makes arrangement for or provides the transport, the actual costs will be paid by the United Nations following the presentation by the Government of a certified document setting out the details of such costs.
(2) 国際連合は、当初の所在地と積込港との間及び積卸港と最終目的地との間の装備品の内陸輸送を手配することができる。政府が輸送を手配し、又は提供する場合には、実際の経費は、経費の詳細を記述する認証された書類が政府により提示された後に国際連合により支払われる。
(2) The United Nations may make transport arrangements for inland transportation of the Equipment between the originating location and the port of embarkation as well as between the final destination and the port of disembarkation. If the Government makes arrangement for or provides the transport, the actual costs will be paid by the United Nations following the presentation by the Government of a certified document setting out the details of such costs.
(3) 日本国の運用上又は維持管理上の必要を満たすための装備品の交換に関連する経費は、国際連合により支払われない。
(3) Costs related with the rotation of the Equipment to meet national operational or maintenance requirements will not be paid by the United Nations.
(4) 装備品の予備部品及び消耗品の供給から生ずる輸送経費は、補償額に含まれるものとする。ただし、補償額は、附属書Aに示すとおり、それらの輸送距離に応じて調整される。
(4) Transportation costs resulting from the supply of spare parts and consumables for the Equipment are included in the compensation amounts which are to be adjusted according to the transportation distance for those items as shown in Annex A.
6 損失又は損害
6. Loss or damage
(a) 装備品に損失又は損害が生じた場合には、政府と国際連合は、その損失又は損害の補償を処理するための適切な方法に関し相互に協議する。
(a) In the event of loss of or damage to the Equipment, the Government and the United Nations will consult with each other on an appropriate manner to deal with compensation for such loss or damage.
(b) 国際連合は、装備品の損失又は損害が装備品を運用する日本国の部隊の要員の過失又は悪意により生じたものである場合には、政府に対し補償を行わない。
(b) The United Nations will not compensate the Government where the loss of or damage to the Equipment is due to negligence or willful misconduct of the personnel of the Japanese contingent operating the Equipment.
(c) 政府が単独で装備品の任務地域への輸送を手配し、又は提供する場合には、国際連合は、装備品の輸送中の損失又は損害に関し、責任を負わない。
(c) In the event the Government solely makes arrangement for or provides the transportation of the Equipment to the mission area, the United Nations will not be responsible in respect of loss of or damage to the Equipment during such transportation.
7 定義
7. Definitions
この詳細手続の適用上、
For the purpose of these Detailed Procedures:
(a) 「部隊」とは、UNDOFの任務地域に配備された政府の要員及び装備より構成されるすべての編成単位をいう。
(a) "contingent" means all formed units of personnel and equipment of the Government deployed to the mission area of UNDOF;
(b) 「UNDOFの長」とは、安全保障理事会の同意を得て事務総長により任命され、UNDOFにおける国際連合のすべての活動に責任を有する特別代表をいう。
(b) "Head of Mission" means the Special Representative appointed by the Secretary-General with the consent of the Security Council responsible for all United Nations activities of UNDOF.

Annex B
装備品の性能規格
PERFORMANCE STANDARDS FOR THE EQUIPMENT
1 装備品は、その本来の役割のために直ちに使用することが可能な状態になければならない。
1. The Equipment must be in an operationally serviceable condition for immediate use in its primary role.
2 装備品には、ジャッキ、運転手用器具、予備タイヤ等のすべての附属品及び車両に関連する消耗品(燃料等は除く。)が含まれる。
2. The Equipment includes all accessories (such as jacks, driver's tools, spare tire) and consumables (less POL) associated with the vehicle.
3 UNDOFのために使用可能と判断されるためには、装備品は、白色に塗装し、かつ、適切な国際連合の標示が塗装されていなければならない。国際連合は、この塗装が任務地域への到着以前に完了していない場合には、国際連合本部により特に承認されていない限り、この規格が満たされるまでの間、補償を行わないことができる。
3. To be considered operationally serviceable for UNDOF, the Equipment must be painted white with appropriate United Nations markings. If this painting is not completed before the arrival in the mission area, compensation may be withheld until the standard is reached unless specifically authorized by the United Nations Headquarters.
