書簡をもって啓上いたします。本長官は、日本国政府の｢宇宙開発に関する基本計画｣の一部として日本国宇宙開発事業団(以下｢事業団｣という。)が実施する環境観測技術衛星(ADEOS-II)計画(以下「計画」という。)に係るアメリカ合衆国航空宇宙局(以下｢NASA｣という。)、アメリカ合衆国海洋大気局（以下｢NOAA｣という。)及び事業団との間の協力に関しアメリカ合衆国政府の代表者と日本国政府の代表者との間で行われた最近の討議に言及する光栄を有します。
ExcellencyI have the honor to refer to the recent discussions between the representatives of the Government of the United States of America and of the Government of Japan concerning the cooperation among the National Aeronautics and Space Administration of the United States of America (hereinafter referred to as "NASA"), the National Oceanic and Atmospheric Administration of the United States of America (hereinafter referred to as "NOAA"), and the National Space Development Agency of Japan (hereinafter referred to as "NASDA") on the Advanced Earth Observation Satellite-11 (ADEOS-II) Program (hereinafter referred to as "the Program"), which is to be undertaken by NASDA as a part of the "Basic Program concerning Space Development" of the Government of Japan.
本長官は、更に、宇宙空間の平和的な探査及び利用の分野において両政府の間に引き続いて存在する相互に有益な関係を考慮し、千九百八十八年六月二十日にトロントで署名され、延長された科学技術における研究開発のための協力に関するアメリカ合衆国政府と日本国政府との間の協定に留意し、また、千九百九十五年四月二十四日にワシントンで署名された平和的目的のための宇宙の探査及び利用における協力のための損害賠償責任に係る相互放棄に関するアメリカ合衆国政府と日本国政府との間の協定及び代位請求に関する両政府間の同日付けの交換公文が計画に適用されることを再確認して、アメリカ合衆国政府に代わって次のとおり提案する光栄を有します。
In consideration of the continuing mutually beneficial relationship between the two Governments in the field of peaceful exploration and use of outer space; taking into account the Agreement between the Government of the United States of America and the Government of Japan on Cooperation in Research and Development in Science and Technology, signed at Toronto, on June 20, 1988, as extended; and reaffirming that the provisions of the Agreement between the Government of the United States of America and the Government of Japan Concerning Cross- Waiver of Liability for Cooperation in the Exploration and Use of Space for Peaceful Purposes, signed at Washington, on April 24, 1995, and the Exchange of Notes of the same date between the two Governments concerning subrogated claims shall apply to the Program, I have further the honor to propose on behalf of the Government of the United States of America the following:
1計画に係るNASA、NOAA及び事業団との間の協力は、海洋生物生産性についての研究を行う人工衛生の開発及び運行、同人工衛星のH-II型打上げ機による打上げ、及び関連の科学的活動に関してNASA、NOAA及び事業団との間において合意される実施取決め(了解覚書。以下｢MOU｣という。)の条件に従って実施されることとなる。
1.The cooperation among NASA, NOAA, and NASDA mentioned above will be conducted in accordance with the terms and conditions of implementing arrangements (Memorandum of Understanding, hereinafter referred to as "the MOU") to be agreed among NASA, NOAA, and NASDA for the development and operation of a satellite to study ocean bioproductivity, its launch by an H-II launch vehicle, and related scientific activities.
2MOUは、それぞれの国において施行されている法令に従って実施されることとなる。MOUの下での活動は、利用可能な予算に従うこととなる。
2.The provisions of the MOU will be implemented in accordance with the laws and regulations in force in each country. Activities under the MOU will be undertaken subject to the availability of appropriated funds.
3アメリカ合衆国政府及び日本国政府は、計画から又はそれに関連して生ずることのあるいかなる問題についても、相互に受け入れることのできる解決を図るために協議する。
3.The Government of the United States of America and the Government of Japan shall consult with each other on any matter that may arise from or in connection with the Program with a view to finding a mutually acceptable solution.
4この取極は、一方の政府が他方の政府に対してこの取極を終了させる意思を六箇月前に外交上の経路を通じて書面で通告することにより終了させない限り六年間効力を有する。この取極は、両政府間の相互の書面による合意により延長又は改正することができる。
4.The present arrangements shall remain in force for a period of six years, unless terminated by either Government upon six months' written notice of its intention to terminate them through diplomatic channels. The present arrangements may be extended or amended by mutual written agreement of the two Governments.
本長官は、更に、前記のことが日本国政府にとって受諾し得るものであるときは、この書簡及び閣下の返簡が両政府間の合意を構成し、その合意が閣下の返簡の日付の日に効力が生ずるものとすることを提案する光栄を有します。
I have further the honor to propose that, if the foregoing is acceptable to the Government of Japan, this Note and Your Excellency's Note in reply shall constitute an agreement between the two Governments, which will enter into force on the date of Your Excellency's reply.
