(Japanese Note)

　Colombo, September 29, 1997

　書簡をもって啓上いたします。本使は、千九百八十四年二月二十二日にコロンボで署名された航空業務に関する日本国政府とスリ・ランカ民主社会主義共和国政府との間の協定(以下「協定」という。)に言及するとともに、この書簡に添付されている前記の協定の新たな付表が千九百九十四年三月十八日の公文によって修正された現行の付表に代わるべきことを日本国政府に代わって提案する光栄を有します。

　Excellency,
  I have the honour to refer to the Agreement between the Government of Japan and the Government of the Democratic Socialist Republic of Sri Lanka for Air Services, signed at Colombo on 22nd February 1984 (hereinafter referred to as the "Agreement"), and to propose, on behalf of the Government of Japan, that the new Schedule of the Agreement as set out in the Attachment shall replace the existing Schedule amended by an Exchange of Notes on 18 March 1994.

　本使は、前記の提案がスリ・ランカ民主社会主義共和国政府にとって受諾し得うるものであるときは、この書簡及びその旨の閣下の返簡がこの問題に関する日本国政府とスリ・ランカ民主社会主義共和国政府との間の合意を構成するものとみなし、その合意が閣下の返簡の日付の日に効力を生ずることを提案いたします。

　If the above proposal is acceptable to the Government of the Democratic Socialist Republic of Sri Lanka, It is suggested that this Note and Your Excellency's reply to that effect shall be regarded as constituting an agreement between the Governments of Japan and the Democratic Socialist Republic of Sri Lanka on this matter, which shall enter into force on the date of Your Excellency's reply.

Schedule

1　日本国の一又は二以上の指定航空企業が両方向に運営する路線

1. Routes to be operated in both directions by the designated airline or airlines of Japan:

　日本国内の地点-後に特定される中間の三地点(注1、注4、注5)-コロンボ-後に特定される以遠の三地点(注2、注3、注4、注5)

　Points in Japan - three intermediate points to be specified later (Note 1, Note 4, Note 5) - Colombo three points beyond to be specified later (Note 2, Note 3, Note 4, Note 5)

注1　日本国は、中間の三地点を自国の選択により特定することができる。

Note 1: Japan can specify at its option any three intermediate points.

注2　日本国は、コロンボ以遠の三地点を自国の選択により特定することができる。ただし、オマーン、カタル、バハレーン、クウェイト、サウディ・アラビア及びレバノン内の地点、シャルジャ、フランクフルト・アム・マイン並びにロンドンを除く。

Note 2: Japan can specify at its option any three points beyond Colombo other than points in Oman, Qatar, Bahrain, Kuwait, Saudi Arabia and Lebanon and Sharjah, Frankfurt am Main and London.

注3　日本国の一又は二以上の指定航空企業は、コロンボ以遠の三地点に加え、日本国の選択により後に特定されるコロンボ以遠の二地点にも運航することができる。ただし、コロンボとこれらの追加された二地点との間の区間については、運輸権を行使しない。

Note 3: The designated airline or airlines of Japan can operate to any two points beyond Colombo to be specified later at the option of Japan in addition to the three points beyond Colombo, provided that no traffic right shall be exercised between Colombo and these two additional points.

注4　一度特定された地点は、別段の合意がない限り変更しない。

Note 4: The points once specified shall not be changed unless otherwise mutually agreed upon.

注5　日本国の一又は二以上の指定航空企業は、「後に特定される中間の三地点」及び「後に特定される以遠の三地点」のうちの一地点並びにコロンボをコターミナルとして、コロンボの直前及び(又は)直後に当該一地点を経由する協定業務を行うことができる。

Note 5: The designated airline or airlines of Japan may operate the agreed services through one point out of "three intermediate points to be specified later" and "three points beyond to be specified later" immediately before and/or after Colombo, by using the point and Colombo as co-terminals.

2　スリ・ランカ民主社会主義共和国の一又は二以上の指定航空企業が両方向に運営する路線

2. Routes to be operated in both directions by the designated airline or airlines of the Democratic Socialist Republic of Sri Lanka:

(a)　スリ・ランカ民主社会主義共和国内の地点-香港、シンガポール、クアラ・ランプール(注1)-東京

(a) Points in the Democratic Socialist Republic of Sri Lanka - Hong Kong (Note 1) - Tokyo
               Singapore
               Kuala Lumpur

(b)　スリ・ランカ民主社会主義共和国内の地点-福岡及び(又は)東京(注2)

(b) Points in the Democratic Socialist Republic of Sri Lanka - Fukuoka and/or Tokyo (Note 2)

(c)　スリ・ランカ民主社会主義共和国内の地点-福岡及び(又は)大阪

(c) Points in the Democratic Socialist Republic of Sri Lanka - Fukuoka and/or Osaka

注1　路線(a)については、スリ・ランカ民主社会主義共和国の一又は二以上の指定航空企業は、一の運航期間につき、中間の三地点のうち二地点のみを使用することかできる。

Note 1: In respect of route (a), the designated airline or airlines of the Democratic Socialist Republic of Sri Lanka can use only two of the three intermediate points during any one given operational period.

注2　路線(b)において、スリ・ランカ民主社会主義共和国の一又は二以上の指定航空企業は、福岡及び東京をコターミナルとして、東京の直前及び(又は)直後に福岡を経由する協定業務を行うことができる。

Note 2: In respect of route (b), the designated airline or airlines of the Democratic Socialist Republic of Sri Lanka may operate through Fukuoka immediately before and/or after Tokyo, by using Fukuoka and Tokyo as co-terminals.

3　いずれの締約国の一又は二以上の指定航空企業が提供する協定業務も、当該締約国の領域内の一地点をその起点としなければならないが、特定路線上の他の地点は、いずれかの又はすべての飛行に当たり当該指定航空企業の選択によって省略することができる。

3.  The agreed services provided by the designated airline or airlines of either contracting Party shall begin at a point in the territory of that Contracting Party, but other points on the route may at the option of the designated airline or airlines be omitted on any or all flights.

　書簡をもって啓上いたします。本大臣は、本日付けの閣下の次の書簡を受領したことを確認する光栄を有します。

　Excellency,
  I have the honour to acknowledge receipt of Your Excellency's Note of today's date which reads as follows:

　本大臣は、スリ・ランカ民主社会主義共和国政府が日本国政府の前記の提案を受諾する旨を閣下に通報するとともに、閣下の書簡及びこの返簡がこの問題に関する両国政府間の合意を構成するものとみなし、その合意がこの返簡の日付の日に効力を生ずることを確認する光栄を有します。

　I have the honour to inform Your Excellency that the Government of the Democratic Socialist Republic of Sri Lanka accepts the above proposal of the Government of Japan and to confirm that Your Excellency's Note and this reply shall be regarded as constituting an agreement between the two Governments on this matter, which shall enter into force on the date of this reply.

　本大臣は、以上を申し進めるに際し、ここに閣下に向かって敬意を表します。

　I avails myself of this opportunity to extend to Your Excellency the assurances of my highest consideration.
