円借款の供与に関する日本国政府とルーマニア政府との間の交換公文

書簡をもって啓上いたします。本大臣は、ルーマニアの経済の安定及び開発のための努力を促進することを目的として供与される日本国の借款に関して日本国政府の代表者とルーマニア政府の代表者との間で最近到達した次の了解を確認する光栄を有します。
Excellency, I have the honour to confirm the following understanding recently reached between the representatives of the Government of Japan and of the Government of Romania concerning a Japanese loan to be extended with a view to promoting the economic stabilization and development efforts of Romania:
1(1) 二百十九億八千九百万円(二一、九八九、〇〇〇、〇〇〇円)の額までの円貨による借款(以下「借款」という。)が、この書簡に附属する表(以下「付表」という。)に掲げる事業計画の実施のため、各事業計画につき付表に定める配分に応じ、海外経済協力基金(以下「基金」という。)により、日本国の関係法令に従って、ルーマニア政府に供与されることになる。
1.(1) A loan in Japanese yen up to the amount of twenty-one billion nine hundred and eighty-nine million yen (21,989,000,000) (hereinafter referred to as "the Loan") will be extended to the Government of Romania by the Overseas Economic Cooperation Fund (hereinafter referred to as "the Fund") in accordance with the relevant laws and regulations of Japan to implement the projects enumerated in the list attached hereto (hereinafter referred to as "the List") according to the allocation for each project as specified in the List.
(2) 借款は、千九百九十三年六月二十五日に日本国政府により公表された開発途上国への資金協力計画の2(2)に沿って供与されることになる。
(2) The Loan will be extended in line with sub-paragraph (2) of paragraph 2 of the "Funds for Development" Initiative announced by the Government of Japan on June 25, 1993.
2(1) 借款は、ルーマニア政府と基金との間で締結される借款契約に基づいて使用に供される。借款の条件及び使用に関する手続は、なかんずく次の原則を含むことになる前記の借款契約によって規制される。
2.(1) The Loan will be made available by loan agreements to be concluded between the Government of Romania and the Fund. The terms and conditions of the Loan as well as the procedures for its utilization will be governed by the said loan agreements, which will contain, inter alia, the following principles:
(a) 償還期間は、十年の据置期間の後二十年とする。
(a) The repayment period will be twenty (20) years after the grace period of ten (10) years;
(b)(ⅰ) 利子率は、年二・七パーセントとする。
(b)(i) The rate of interest will be two and seven-tenths per cent (2.7%) per annum;
(ⅱ) ただし、(ⅰ)にもかかわらず、借款の一部がコンサルタントに対して行う支払のために使用される場合には、当該部分に係る金利については、年二・三パーセントとする。
(ii) Notwithstanding sub-paragraph (b) (i) above, where a part of the loan is made available to cover payments to consultants, then the rate of interest on the said part will be two and three-tenths per cent (2.3%) per annum; and
(c) 支出期間は、付表の1に掲げる事業計画については、関係借款契約の発効の日から五年とし、付表の2に掲げる事業計画については、関係借款契約の発効の日から六年とする。
(c) The disbursement period will be five (5) years with regard to the project mentioned in 1 of the List, and six (6) years with regard to the project mentioned in 2 of the List from the date of coming into force of the relevant loan agreement.
(2) (1)にいう借款契約の各々は、基金が当該借款契約に係る計画の実行可能性(環境に対する配慮を含む。)を確認した後に締結される。
(2) Each of the loan agreements mentioned in sub-paragraph (1) above will be concluded after the Fund is satisfied of the feasibility, including the environmental consideration, of the project to which such loan agreement relates.
(3) (1)(c)にいう支出期間は、両政府の関係当局の同意を得て延長することができる。
(3) The respective disbursement periods mentioned in sub-paragraph (1) (c) above may be extended with the consent of the authorities concerned of the two Governments.
3(1) 借款は、ルーマニアの実施機関が調達適格国の供給者、請負業者又はコンサルタントに対して行う支払で、付表に掲げる事業計画の実施に必要な生産物又は役務の購入のために両者の間で締結されることのある契約に基づいて行われるものを対象として使用に供される。ただし、当該購入は、調達適格国において、それらの国で生産される生産物又はそれらの国から供給される役務について行われる。
3.(1) The Loan will be made available to cover payments to be made by the Romanian executing agencies to suppliers, contractors and/or consultants of eligible source countries under such contracts as may be entered into between them for purchases of products and/or services required for the implementation of the projects enumerated in the List, provided that such purchases are made in such eligible source countries for products produced in and/or services supplied from those countries.
(2) (1)にいう調達適格国の範囲は、両政府の関係当局間で合意される。
(2) The scope of eligible source countries mentioned in sub-paragraph (1) above will be agreed upon between the authorities concerned of the two Governments.
(3) 借款の一部は、付表に掲げる事業計画の実施のための適格な現地通貨の需要に充てるために使用することができる。
(3) A part of the Loan may be used to cover eligible local currency requirements for the implementation of the projects enumerated in the List.
4 ルーマニア政府は、3(1)にいう生産物又は役務が基金の調達のためのガイドライン(国際入札の手続が適用できないか又は適当でない場合を除くほか従うべき国際入札の手続をなかんずく定める。)に従って調達されることを確保する。
4. The Government of Romania will ensure that products and/or services mentioned in sub-paragraph (1) of paragraph 3 above are procured in accordance with the guidelines for procurement of the Fund, which set forth, inter alia, the procedures of international tendering to be followed except where such procedures are inapplicable or inappropriate.
5 ルーマニア政府は、借款に基づいて購入される生産物の海上輸送及び海上保険に関し、海運会社及び海上保険会社の間の公正かつ自由な競争を妨げることのあるいかなる制限も課さない。
5. With regard to the shipping and marine insurance of products purchased under the Loan, the Government of Romania will refrain from imposing any restrictions that may hinder fair and free competition of the shipping and marine insurance companies.
6 3(1)にいう生産物又は役務の供給に関連してルーマニアにおいてその役務が必要とされる日本国民は、作業の遂行のためルーマニアヘの入国及び同国における滞在に必要な便宜を与えられる。
6. Japanese nationals whose services may be required in Romania in connection with the supply of products and/or services mentioned in sub-paragraph (1) of paragraph 3 above will be accorded such facilities as may be necessary for their entry into Romania and stay therein for the performance of their work.
7 ルーマニア政府は、基金について、借款及びそれから生ずる利子に対して又はそれらに関連してルーマニアにおいて課されるすべての財政課徴金及び租税を免除する。
7. The Government of Romania will exempt the Fund from all fiscal levies and taxes imposed in Romania on and/or in connection with the Loan as well as interest accruing therefrom.
8 ルーマニア政府は、次のことを確保するために必要な措置をとる。
8. The Government of Romania will take necessary measures to ensure that:
(a) 借款が適正にかつ専ら3(1)にいう生産物又は役務を購入するために使用されること。
(a) the Loan be used properly and exclusively for the purchases of products and/or services mentioned in sub-paragraph (1) of paragraph 3; and
(b) 借款に基づいて建設される施設がこの了解に定める目的のために適正にかつ効果的に維持され及び使用されること。
(b) the facilities constructed under the Loan be maintained and used properly and effectively for the purposes prescribed in this understanding.
9 ルーマニア政府は、要請に応じ、日本国政府及び基金に対し、付表に掲げる事業計画の実施の進捗状況に関する情報及び資料を提供する。
9. The Government of Romania will, upon request, furnish the Government of Japan and the Fund with information and data concerning the progress of the implementation of the projects enumerated in the List.
10 両政府は、前記の了解から又はそれに関連して生ずることのあるいかなる事項についても相互に協議する。
10. The two Governments will consult with each other in respect of any matter that may arise from or in connection with the foregoing understanding.
本大臣は、閣下が前記の了解をルーマニア政府に代わって確認されれば幸いであります。
I should be grateful if Your Excellency would confirm the foregoing understanding on behalf of the Government of Romania.
本大臣は、以上を申し進めるに際し、ここに閣下に向かって敬意を表します。
