科学技術における協力に関する日本国政府とオランダ王国政府との間の協定

AGREEMENT BETWEEN THE GOVERNMENT OF JAPAN AND THE GOVERNMENT OF THE KINGDOM OF THE NETHERLANDS ON CO-OPERATION IN SCIENCE AND TECHNOLOGY

　日本国政府及びオランダ王国政府は、

　The Government of Japan and the Government of the Kingdom of the Netherlands;

　両国間の緊密かつ友好的な関係を一層促進することを希望し、また、科学的知識の急速な拡大並びにそれが二国間の及び国際的な協力の促進において果たしている積極的な貢献を認識し、

　Desiring to further promote the close and friendly relations existing between their two countries, and being aware of the rapid expansion of scientific knowledge and of its positive contribution in promoting bilateral and international co-operation;

　平和的目的及び相互利益のための豊かな協力関係の創造を通じた科学技術協力の範囲を広げることを希望し、

　Wishing to broaden the scope of scientific and technological co-operation through the creation of a productive partnership for peaceful purposes and for their mutual benefit; and

　科学技術における協力の一層の強化を確保することを確認し、

　Affirming their commitment to further strengthen co-operation in science and technology;

　次のとおり協定した。

　Have agreed as follows:

第一条
　両政府は、平和的目的のため、平等及び相互利益の原則に基づき、相互に合意される科学技術分野における協力活動を発展させる。

ARTICLE I
　The two Governments shall develop co-operative activities in such areas of science and technology as may be mutually agreed for peaceful purposes on the basis of equality and mutual benefit.

第二条
　この協定に基づく協力活動の形態には、次のものを含めることができる。

ARTICLE II
　Forms of the co-operative activities under this Agreement may include:

(a)　一般的な又は特定の問題の科学的及び技術的側面に関する討議及び情報の交換を行うための並びに協力を基礎として有益に実施することができる研究開発に関する計画を識別するための専門家の会合のような各種の形態の会合

(a) Meetings of various forms, such as those of experts, to discuss and exchange information on scientific and technological aspects of general or specific subjects and to identify research an development projects and programmes that may be usefully undertaken on a co-operative basis;

(b)　研究開発に関する活動、政策、慣行及び法令に関する情報の交換

(b) Exchange of information on activities, policies, practices, and laws and regulations concerning research and development;

(c)　合意された協力計画の実施

(c) Implementation of agreed co-operative projects and programmes;

(d)　一般的な又は特定の問題に関する科学者、技術者その他の専門家の訪問及び交流

(d) Visits and exchanges of scientists, technical personnel or other experts on general or specific subjects; and

(e)　相互に合意されるその他の形態の協力活動

(e) Other forms of co-operative activities as may be mutually agreed.

第三条
1　この協定に基づく特定の協力活動の細目及び手続を定める実施取極は、両政府又は両政府の機関のいずれか適当なものを当事者として行うことができる。

ARTICLE III
1. Implementing arrangements setting forth the details and procedures of the specific co-operative activities under this Agreement may be made between the two Governments or their agencies, whichever is appropriate.

2　この協定の効力発生の日までに開始され、かつ、完了していない両政府間の科学技術の分野における協力活動は、この協定の効力発生の日にこの協定の下に組み入れられる。

2. Co-operative activities between the two Governments in the field of science and technology which have been commenced and not completed by the date of the entry into force of this Agreement shall be incorporated under this Agreement as of that date.

第四条
　この協定を効果的に実施するため、両政府は、外交経路を通じて合意する日に会合し、この協定に基づく協力活動及び成果を検討し討議する。

ARTICLE IV
　 For the purpose of effective implementation of this Agreement, the two Governments shall meet on the dates to be agreed upon through the diplomatic channel to review and discuss the co-operative activities and accomplishments under this Agreement.

第五条
1　この協定に基づく協力活動から生ずる非所有権的性格の科学的及び技術的情報は、通常の経路を通じ、かつ、参加機関の一般的な手続に従い、いずれの政府によっても一般の利用に供することかできる。

ARTICLE V
1. Scientific and technological information of a non-proprietary nature arising from the co-operative activities under this Agreement may be made available to the public by either Government through customary channels and in accordance with the normal procedures of the participating agencies.

2　両政府は、この協定に基づく協力活動から生ずる知的所有権又は所有権的性格を有する他の権利の保護及び配分につき十分な考慮を払うものとし、必要に応じ、この目的のために相互に協議する。

2. The two Governments shall give due consideration to the protection and the distribution of intellectual property rights or other rights of a proprietary nature resulting from the co-operative activities under this Agreement and shall consult with each other for this purpose as necessary.

第六条
1　この協定の実施は、各国の利用可能な予算及び適用可能な法令に従うことを条件とする。

ARTICLE VI
1. Implementation of this Agreement shall be subject to the availability of appropriated funds and to the applicable laws and regulations of each country.

2　この協定に基づく協力活動のための費用は、相互に合意されるところに従って負担される。

2. Costs for the co-operative activities under this Agreement shall be borne as may be mutually agreed.

第七条
　この協定のいかなる規定も、両政府間の協力に関する他の協定でこの協定の署名の日に存在するもの又はその後締結されるものに影響を及ぼすものとは解されない。

ARTICLE VII
　Nothing in this Agreement shall be construed to prejudice other agreements for co-operation between the two Governments, existing at the date of signature of this Agreement or concluded thereafter.

第八条
1　この協定は、両政府がこの協定の効力発生のために必要なそれぞれの国内法上の手続が完了したことを確認する外交上の経路を通じた書面による通報の日付の日であって、いずれか遅い方の日付の日に効力を生じ、五年間効力を有する。この協定は、両政府の同意により延長し又は改正することができる。この協定の改正は、この協定の効力発生のための手続と同様の手続に従う。いずれの政府も、他方の政府に対し、この協定を終了させる意思をいつでも書面により通告することができ、その場合には、この協定は、そのような通告が行われた後六箇月で終了する。

ARTICLE VIII
1. This Agreement shall enter into force on the latter of the dates of the written notifications through the diplomatic channel by which the two Governments confirm that their respective internal legal requirements for the entering into force of this Agreement have been completed and shall remain in force for five years.  This Agreement may be extended or amended by mutual consent of the two Governments.  Any amendment of this Agreement shall follow the same procedure as its entering into force.  Either Government may at any time give written notice to the other Government of its intention to terminate this Agreement, in which case this Agreement shall terminate six months after such notice has been given.

2　この協定の終了は、この協定に基づいて行われ、かつ、この協定の終了の時までに履行を完了していないいかなる計画の実施にも影響を及ぼすものではない。

2. The termination of this Agreement shall not affect the carrying out of any project or programme undertaken under this Agreement and not fully executed at the time of the termination of this Agreement.
