債務救済措置に関する日本国政府とマケドニア旧ユーゴースラヴィア共和国政府との間の交換公文 
(日本側書簡)

　Skopje, October 6, 1997


　書簡をもって啓上いたします。本使は、千九百九十五年七月十七日にパリで開催された貴国政府の代表者と関係債権諸国政府の代表者との間の協議において到達した結論に基づき日本国政府の代表者と貴国政府の代表者との間で行われた最近の交渉並びに日本国とユーゴースラヴィア社会主義連邦共和国(以下「旧ユーゴー」という。)との間で締結され、効力を有していた条約その他の国際約束についての千九百九十七年二月四日の貴国外務大臣宛の書簡及び千九百九十七年二月四日の日本国特命全権大使宛の書簡に言及する光栄を有します。本使は、更に、当該交渉において到達した次の了解を確認する光栄を有します。

　Excellency,I have the honour to refer to the recent negotiations between the representatives of my Government and your Government that were held on the basis of the conclusions reached during the consultations between the representatives of your Government and of the Governments of the creditor countries concerned held in Paris on July 17, 1995, and refer to the Letter sent to Minister for Foreign Affairs of your country, dated February 4, 1997 and the Letter sent to Ambassador Extraordinary and Plenipotentiary of Japan, dated February 4, 1997, which are respectively concerning the treaties and other international agreements concluded and effective between Japan and the Socialist Federal Republic of Yugoslavia (hereinafter referred to as "the former Yugoslavia"). I have further the honour to confirm the following arrangements reached in the course of the said negotiations:


1(1)　債務救済措置が、日本輸出入銀行(以下「銀行」という。)により、日本国の関係法令に従ってとられることになる。

1.(1) A debt relief measure will be taken by the Export-Import Bank of Japan (hereinafter referred to as "the Bank") in accordance with the relevant laws and regulations of Japan.


(2)　繰り延べられる債務は、当時のユーゴースラヴィア・ナショナル銀行が負っていた債務であって、銀行による債務救済措置に関し千九百八十五年三月二十日、千九百八十五年十二月五日、千九百八十七年三月二十日、千九百八十七年九月十一日及び千九百八十九年三月一日に日本国政府と旧ユーゴー議会連邦執行評議会との間で交換された書簡(以下「従前の書簡」という。)により行われた取極に従って過去に繰り延べられた次の債務から成る。

(2) The debts to be rescheduled consist of the following debts which were owed by the then National Bank of Yugoslavia and previously rescheduled pursuant to the arrangements made by the Notes exchanged between the Government of Japan and the Federal Executive Council of the Assembly of the former Yugoslavia on March 20, 1985, December 5, 1985, March 20, 1987, September 11, 1987 and March 1, 1989 concerning the debt relief measures taken by the Bank (hereinafter referred to as "the Previous Notes"),


(a)　千九百九十五年六月三十日以前に弁済期限の到来した未払の元本及び繰延利子の五・四パーセント(それらの内訳は、この書簡の付表一に掲げられる。)

(a) The five point four per cent (5.4%) of the principal and rescheduling interest having fallen due on or before June 30, 1995 and not paid, the breakdown of which is shown in List 1 attached hereto.


(b)　千九百九十五年七月一日から千九百九十六年六月三十日までの間(両期日を含む。)に弁済期限の到来した未払の元本及び繰延利子の五・四パーセント(それらの内訳は、この書簡の付表二に掲げられる。)

(b) The five point four per cent (5.4%) of the principal and rescheduling interest having fallen due between July 1, 1995 and June 30, 1996 and not paid, both dates inclusive, the breakdown of which is shown in List 2 attached hereto.


(c)　付表一に掲げる当初の弁済期日から千九百九十五年六月三十日までの間に生じた(a)にいう債務の遅延利子(それらの遅延利子の内訳は、付表一に掲げられる。)

(c) The late interest on the debts referred to in (a) above having accrued between each original due date mentioned in List 1 and June 30, 1995.  The breakdown of such late interest is also shown in List 1.


(3)(a)　(2)(a)及び(b)にいう債務の総額は、一億五千九百四十三万六千六百四十九円(一五九、四三六、六四九円)になる。

(3)(a) The total amount of the debts referred to in sub-paragraph (2) (a) and (b) above will be one hundred fifty-nine million four hundred thirty-six thousand six hundred and forty-nine yen (159,436,649).


(b)　(2)(c)にいう債務の総額は、二千六百十万五十六円(二六、一〇〇、〇五六円)になる。

(b) The total amount of the debts referred to in sub- paragraph (2) (c) above will be twenty-six million one hundred thousand and fifty-six yen (26,100,056).


(4)　(3)にいう総額並びに付表一及び二は、貴国政府の関係当局及び銀行が行う最終的照合の後に両国政府の関係当局間の合意により修正されることがある。

(4) Modifications may be made to the total amount referred to in sub-paragraph (3) above and to List 1 and 2 by agreement between the authorities concerned of the two Governments after the final verification to be made by the authorities concerned of your Government and the Bank.


(5)　債務繰延べの条件は、貴国政府と銀行との間で締結される債務繰延契約であって、なかんずく次の原則を含むものにおいて規定される。

(5) The terms and conditions of the rescheduling will be stipulated in a rescheduling agreement to be concluded between your Government and the Bank, which will contain, inter alia, the following principles.


(a)　2(a)及び(b)にいう債務の各々は、この書簡の附属書に掲げる支払計画に従って千九百九十九年七月三十一日に始まる二十四回の半年賦払によって支払われる。

(a) Each of the debts referred to in sub-paragraph (2) (a) and (b) above will be paid in twenty-four (24) semi-annual installments beginning on July 31, 1999 in accordance with the payment schedule shown in Annex attached hereto.


(b)　(2)(a)及び(b)にいう債務に対する利子率は年六パーセントとし、付表一に掲げる債務については千九百九十五年七月一日から適用され、付表二に掲げる債務についてはそれぞれの当初の弁済期日から適用される。

(b) The rate of interest on the debts referred to in sub-paragraph (2) (a) and (b) will be six per cent (6%) per annum beginning from July 1, 1995 for the debts mentioned in List 1 and from each original due date for the debts mentioned in List 2.


(c)　(2)(c)にいう債務の各々は、千九百九十八年七月三十一日に始まる八回の均等半年賦払によって支払われる。

(c) Each of the debts referred to in sub-paragraph(2) (c) above will be paid in eight (8) equal semi-annual installments beginning on July 31, 1998.


(d)　(2)(c)にいう債務に対する利子率は年六パーセントとし、千九百九十五年七月一日から適用される。

(d) The rate of interest on the debts referred to in sub-paragraph (2) (c) above will be six per cent (6%) per annum beginning from July 1, 1995.


(6)　(5)にいう契約は、2及び3に定める支払の条件についても規定する。

(6) The agreement referred to in sub-paragraph (5) above will also stipulate the terms and conditions of the payments provided for in paragraphs 2 and 3 below.


2(1)　貴国政府は、当時のユーゴースラヴィア・ナショナル銀行が負っていた債務であり、かつ、従前の書簡により行われた取極に従って過去に繰り延べられた元本及び繰延利子であって干九百九十六年七月一日以後に弁済期限が到来したか又は到来するものの五・四パーセント(それらの内訳は、この書簡の付表三に掲げられる。)を従前の書簡の関連規定に従って銀行に支払う。

2.(1) Your Government will pay to the Bank, in accordance with the relevant provisions of the Previous Notes, the five point four per cent (5.4%) of the principal and rescheduling interest falling due on or after July 1, 1996, which were owed by the then National Bank of Yugoslavia and previously rescheduled pursuant to the arrangements made by the Previous Notes, the breakdown of which is shown in List 3 attached hereto.


(2)　(1)にいう債務の総額(遅延利子を除く。)は、三千四百十四万三百十五円(三四、一四〇、三一五円)になる。

(2) The total amount of the debts referred to in sub-paragraph (1) above, excluding the late interest, will be thirty-four million one hundred forty thousand three hundred and fifteen yen (34,140,315).


(3)　(2)にいう総額及び付表三は、貴国政府の関係当局及び銀行が行う最終的照合の後に両国政府の関係当局間の合意により修正されることがある。

(3) Modifications may be made to the total amount referred to in sub-paragraph (2) above and to List 3 by agreement between the authorities concerned of the two Governments after the final verification to be made by the authorities concerned of your Government and the Bank.


3(1)　貴国政府は、次の債務の総額を千九百九十八年七月三十一日に始まる八回の均等半年賦払により銀行に支払う。

3.(1) Your Government will pay to the Bank the total amount of the following debts in eight (8) equal semi- annual installments beginning on July 31, 1998.


(a)　千九百八十四年三月二十八日に銀行とユーゴーバンカーウドゥルジェナ・バンカ(以下「ユーゴーバンカ」という。)との間で締結された借款契約(以下「借款契約」という。)に従って支払われるべき元本及び契約上の利子であって、千九百九十五年六月三十日以前に弁済期限が到来した未払のもの(それらの内訳は、この書簡の付表四に掲げられる。)

(a) The principal and contractual interest payable under the Loan Agreement concluded between the Bank and Jugobanka-Udruzena Banka (hereinafter referred to as "Jugobanka") on March 28, 1984 (hereinafter referred to as "the Loan Agreement") having fallen due on or before June 30, 1995 and not paid, the breakdown of which is shown in List 4 attached hereto.


(b)　(a)にいう債務の遅延利子であって、付表四に掲げる当初の弁済期日から千九百九十五年六月三十日までの間に生じたもの(それらの内訳は、付表四に掲げられる。)。それらの遅延利子は、借款契約の規定に従って算定される。

(b) The late interest on the debts referred to in (a) above having accrued between each original due date mentioned in List 4 and June 30, 1995, the breakdown of which is also shown in List 4.  Such late interest is calculated in accordance with the provisions of the Loan Agreement.


(c)　借款契約に定める当初の弁済期日後に支払われた元本及び契約上の利子に対し千九百九十五年六月三十日以前に生じた遅延利子のうち未払のもの(それらの内訳は、この書簡の付表五に掲げられる。)

(c) The late interest on the principal and contractual interest payable under the Loan Agreement which were already paid after each original due date, having accrued on June 30, 1995 but not paid, the breakdown of which is shown in List 5 attached hereto.


(2)(a)　(1)(a)及び(b)にいう債務の総額は、三億千四百四十九万九千三百八十五円(三一四、四九九、三八五円)になる。

(2)(a) The total amount of the debts referred to in sub-paragraph (1) (a) and (b) above is three hundred fourteen million four hundred ninety-nine thousand three hundred and eighty-five yen (314,499,385).


(b)　(1)(c)にいう債務の総額は、八十三万六千八百二十三円(八三六、八二三円)になる。

(b) The total amount of the debts referred to in sub-paragraph (1) (c) above is eight hundred thirty-six thousand eight hundred and twenty-three yen (836,823).


(3)　(2)にいう総額並びに付表四及び五は、貴国政府の関係当局及び銀行が行う最終的照合の後に両国政府の関係当局間の合意により修正されることがある。

(3) Modifications may be made to the total amount referred to in sub-paragraph (2) above and to List 4 and 5 by agreement between the authorities concerned of the two Governments after the final verification to be made by the authorities concerned of your Government and the Bank.


(4)　(1)にいう債務に対する利子率は年五・三パーセントとし、千九百九十五年七月一日から適用される。

(4) The rate of interest on the debts referred to in sub-paragraph (1) above will be five point three per cent (5.3%) per annum beginning from July 1, 1995.


4　支払われる利子については、貴国のすべての租税及び課徴金が免除される。

4. The interest paid will be exempted from all taxes and duties of your country.


5　貴国政府は、関係債務の決済に伴って生じる銀行手数料を支払う。

5. Your Government will pay bank charges incidental to the settlement of the debts concerned.


6　貴国政府の代表者及び関係債権諸国政府の代表者が貴国の債務(この取極が対象とする債務を含む。)の再編に関して、特に貴国政府が責任を有する旧ユーゴーの債務の割合に関して、新たな結論に到達した場合には、日本国政府と貴国政府との間でこの取極の継続又は修正について討議するための協議が行われる。

6. If the representative of your Government and the representatives of the Governments of the creditor countries concerned come to a new conclusion in connection with reorganization of your country's debts including the debts covered by the present arrangements, especially with regard to the percentage of the portion of the former Yugoslav debts for which your Government is responsible, consultations will be held between my Government and your Government, in order to discuss the matter of continuation or modification of the present arrangements.
