(Japanese Note)

　Tokyo, February 10, 1997

　書簡をもって啓上いたします。本大臣は、ベルギー王国において予定される混合酸化物燃料(日本国に返還後日本国の商業動力炉において使用されるもの。以下「ＭＯＸ燃料」という。)の加工に関し、日本国政府の代表者とベルギー王国政府の代表者との間で行われた最近の討議に言及する光栄を有します。本大臣は、日本国政府に代わってこの協議の結果に関する次の了解を確認する光栄を有します。

　Sir,I have the honour to refer to the discussions which have taken place recently between the representatives of the Government of Japan and of the Government of the Kingdom of Belgium concerning the planned fabrication in the Kingdom of Belgium of mixed-oxide fuel (hereinafter referred to as "MOX fuel") which will be returned to Japan and used for commercial power reactors in Japan.

　ベルギー王国政府は、国際原子力機関の文書ＩＮＦＣＩＲＣ－二五四－Ｒｅｖ・二第一部に定められる防護の措置が、ベルギー王国において施行されている関係法令に従って、同国の領域において適用されていることを確認する。

　I have further the honour to confirm on behalf of the Government of Japan the following understanding as a result of these discussions:

　この枠組みの範囲内において、ベルギー王国政府は、適切な防護の措置が、最小限この書簡の附属書Ｂ(国際原子力機関の文書ＩＮＦＣＩＲＣ－二五四－Ｒｅｖ・二第一部の附属書Ｃの関連の部分より構成されたもの)に定められる水準において、この書簡の附属書Ａの1に掲げるプルトニウム及びウランについて、適用されることを確保することを約束する。

　The Government of the Kingdom of Belgium confirms that the measures of physical protection provided for in the Annex C of the International Atomic Energy Agency document INFCIRC/254/Rev. 2/Part 1 are applied in its territory in accordance with applicable laws and regulations in force in the Kingdom of Belgium.

　この書簡は、ベルギー王国において予定されるＭＯＸ燃料(日本国に返還後日本国の商業動力炉において使用されるもの)の加工に関し、千九百九十七年二月十日に日本国政府と欧州共同体委員会との間において交換された書簡の1(4)を補完する。

　Within this framework, it undertakes to ensure that adequate measures of physical protection will be applied to the plutonium and the uranium specified in paragraph 1 of Annex A to this Note, as minimum, at levels which satisfy the criteria set out in Annex B to this Note which consists of the relevant parts of Annex C of the document INFCIRC/254/Rev. 2/Part 1.

　本大臣は、更に、この書簡及び貴官の返簡が貴官の返簡の日付の日から、前記の了解についての日本国政府とベルギー王国政府との間の合意を構成することを提案する光栄を有します。

　This Note complements the paragraph 1 (4) of the notes exchanged on February 10, 1997 between the Government of Japan and the Commission of the European Communities concerning the planned fabrication in the Kingdom of Belgium of MOX fuel which will be returned to Japan.

　本大臣は、以上を申し進めるに際し、ここに貴官に向かって敬意を表します。

　I have further the honour to propose that this Note and your Note in reply shall constitute from the date of your Note in reply, an agreement between the Government of Japan and the Government of the Kingdom of Belgium on the understanding set out above.

1　核物質の明細

(1)　プルトニウム

　日本国において照射された核燃料からフランス共和国において回収された総量四百八十三キログラムのプルトニウム(日本国の事業者が所有するもの)

　 A total of 483 kg of plutonium recovered in the French Republic from nuclear fuel irradiated in Japan, which is owned by a Japanese undertaking.

(ii)　移転の予定

(ii) Schedule of Transfer

　二百二十一キログラムのプルトニウムが千九百九十七年二月十日の後同年九月以前に、また、二百六十二キログラムのプルトニウムが同年三月の後千九百九十八年七月以前にフランス共和国からベルギー王国に移転される。

　221 kg of the plutonium will be transferred after February 10, 1997 but not later than September 1997 and 262 kg of the plutonium after March 1997 but not later than July 1998 from the French Republic to the Kingdom of Belgium.

(i)　詳細

(i) Details

　総量三千八十八キログラムの天然ウラン及び同位元素ウラン二三五の濃縮度が天然ウランにおける混合率を超え十パーセント未満のウラン(日本国の事業者が所有するもの)

　A total of 3,088 kg of natural uranium and uranium enriched above natural but less than 10 percent in the isotope 235, which is owned by a Japanese undertaking.

(ii)　移転の予定

(ii) Schedule of Transfer

　総量三千八十八キログラムのウランの二分の一が千九百九十七年二月十日の後同年九月以前に、また、残りの二分の一が同年三月の後千九百九十八年七月以前に日本国からベルギー王国へ移転される。

　One half of the 3,088 kg of uranium will be transferred after February 10, 1997 but not later than September 1997 and the other half after March 1997 but not later than July 1998 from Japan to the Kingdom of Belgium.

2　核物質の使用

2. Use of the Nuclear Material

　核物質は、附属書の3(1)及び(2)に特定する施設において、ＭＯＸ燃料の加工のために使用される。その後、当該ＭＯＸ燃料は、フランス共和国を経由して日本国に返還され、日本国の商業動力炉において使用される。

　The Nuclear Material will be used for the fabrication of the MOX fuel at the facilities specified in sub- paragraphs 3 (1) and (2) of this Annex.  After fabrication, the MOX fuel will be returned to Japan via the French Republic and used for commercial power reactors in Japan.

第三群

CATEGORY III

　使用及び貯蔵に当たっては、出入りが規制されている区域内において行うこと。

　Use and storage within an area to which access is controlled.

　輸送に当たっては、特別の予防措置(荷送人、荷受人及び運送人の間の事前の取決め並びに国際輸送にあっては、供給国及び受領国それぞれの管轄権及び規制に服する者の間の事前の合意で輸送に係る責任の移転する日時、場所及び手続を明記したものを含む。)の下に行うこと。

　Transportation under special precautions including prior arrangements among sender, recipient and carrier, and prior agreement between entities subject to the jurisdiction and regulation of supplier and recipient States, respectively, in case of international transport, specifying time, place and procedures for transferring transport responsibility.

第二群

CATEGORY II

　使用及び貯蔵に当たっては、出入が規制されている防護区域内、すなわち、警備員若しくは電子装置による常時監視の下にあり、かつ、適切な管理の下にある限られた数の人口を有する物理的障壁によって囲まれた区域内又は防護の水準がこのような区域と同等である区域内において行うこと。

　Use and storage within a protected area to which access is controlled, i.e., an area under constant surveillance by guards or electronic devices, surrounded by a physical barrier with a limited number of points of entry under appropriate control, or any area with an equivalent level of physical protection.

　輸送に当たっては、特別の予防措置(荷送人、荷受人及び運送人の間の事前の取決め並びに国際輸送にあっては、供給国及び受領国それぞれの管轄権及び規制に服する者の間の事前の合意で輸送に係る責任の移転する日時、場所及び手続を明記したものを含む。)の下に行うこと。

　Transportation under special precautions including prior arrangements among sender, recipient, and carrier, and prior agreement between entities subject to the jurisdiction and regulation of supplier and recipient states, respectively, in case of international transport, specifying time, place and procedures for transferring transport responsibility.

第一群

CATEGORY I

　この群に属する核物質は、許可なしに使用されることのないように高度の信頼性を有する方式により、次のとおり防護される。

　Materials in this Category shall be protected with highly reliable systems against unauthorized use as follows.

　使用及び貯蔵に当たっては、高度に防護された区域内、すなわち、第二群について定められた防護区域であって、更に、信頼性の確認された者に出入が限られ、かつ、適当な関係当局と緊密な連絡体制にある警備員の監視の下にある区域内において行うこと。(このこととの関連においてとられる具体的な措置は、攻撃又は許可なしに出入が行われること若しくは許可なしに関係核物質が持ち出されることを発見し及び防止することを目的とする。)

　Use and storage within a highly protected area, i.e., a protected area as defined for Category II above, to which, in addition, access is restricted to person whose trustworthiness has been determined, and which is under surveillance by guards who are in close communication with appropriate response forces.  Specific measures taken in this context should have as their objective the detection and prevention of any assault, unauthorized access or unauthorized removal of material.

　輸送に当たっては、第二群及び第三群の核物質の輸送について定められた前記の特別の予防措置をとるほか、更に、護送者による常時監視の下及び適切な関係当局との緊密な連絡体制が確保される条件の下に行うこと。

　Transportation under special precautions as identified above for transportation of Category II and III materials and, in addition, under constant surveillance by escorts and under conditions which assure close communication with appropriate response authorities.

　注aトリガーリストにおいて特定されるもの。

　注b原子炉内で照射されていない核物質又は原子炉内で照射された核物質であって遮蔽がない場合にこの核物質からの放射線量率が一メートル離れた地点で一時間当たり百ラッド以下であるもの。

　注c第三群に掲げる量未満のもの及び天然ウランは、管理についての慎重な慣行に従って防護するものとする。

　なお、トリガーリストとは国際原子力機関の文書ＩＮＦＣＩＲＣ－二五四－Ｒｅｖ・二第一部の附属書Ａをいい、同リストにおいて、プルトニウムとは、プルトニウム二三八の同位体濃度が八十パーセントを超えるプルトニウムを除くすべてのプルトニウムとされる。
