　Hong Kong, June 18, 1997


　書簡をもって啓上いたします。本官は、千九百九十七年二月二十八日に香港で署名された航空業務に関する日本国政府と香港政府との間の協定(以下「協定」という。)に言及するとともに、協定の附属書第一部及び第二部の注2の規定に従って、この書簡の別添に定める双方の一又は二以上の指定航空企業が運営する路線上の地点の具体的な組合せに関し、協定に関する交渉の過程において両政府の代表者の間で到達した了解を日本国政府に代わって確認する光栄を有します。

　Sir,
  I have the honour to refer to the Agreement between the Government of Japan and the Government of Hong Kong for Air Services signed on 28 February 1997 (hereinafter referred to as "the Agreement") and to confirm, on behalf of the Government of Japan, the understanding reached between the representatives of the Governments of both sides, in accordance with the provisions of Note 2 in both Section I and Section II of the Annex to the Agreement, during the course of the negotiations on the Agreement concerning specific combinations of points on the routes to be operated by the designated airline or airlines of both sides, as set out in the Attachment to this Note.


　本官は、更に、貴官が前記の了解が香港政府の了解でもあることを香港政府に代わって確認されることを要請するとともに、当該了解が香港政府の了解でもあるときは、両政府の間で到達した前記の了解が協定の効力発生の日に効力を生ずるものとすることを提案する光栄を有します。

　I have further the honour to request you to be good enough to confirm, on behalf of your Government, that this is also the understanding of the Government of Hong Kong and propose that, if this is also the understanding of the Government of Hong Kong, the foregoing understanding reached between the two Governments will become effective on the date of entry into force of the Agreement.

第一部

SECTION I


　日本国の一又は二以上の指定航空企業が両方向に運営する路線

　Routes to be operated in both directions by the designated airline of airlines of Japan:


(1)　日本国内の一地点-東京-名古屋-大阪-福岡-鹿児島-那覇-台北-ソウル-香港-ホーチミン・シティ又はバンコック-クアラ・ランプール-シンガポール-ジャカルタ

(1) A point in Japan - Tokyo - Nagoya - Osaka - Fukuoka - Kagoshima - Naha - Taipei - Seoul - Hong Kong - Ho Chi Minh City or Bangkok - Kuala Lumpur - Singapore - Jakarta.


(2)　東京-名古屋-大阪-福岡-那覇-台北-香港-マニラ-ジャカルタ-ダーウィン-シドニー

(2) Tokyo - Nagoya - Osaka - Fukuoka - Naha - Taipei - Hong Kong - Manila - Jakarta - Darwin - Sydney.


(3)　札幌-香港

(3) Sapporo - Hong Kong.


(4)　日本国内の一地点-香港

(4) A point in Japan - Hong Kong.


注1　路線(1)では、日本国の航空当局は、香港の航空当局に対し「日本国内の一地点」を特定し又はその特定された地点を変更する意図を通告することができる。この特定又は変更は、原則としてその通告の日から六箇月以内に公文の交換によって確認される。

Note 1. On Route (1), the aeronautical authorities of Japan may notify the aeronautical authorities of Hong Kong of their intention to specify "a point in Japan" and to change the point thus specified, which will be confirmed by an exchange of notes within six months, in principle, from the date of such notification.


注2　路線(1)では、ソウルヘは貨物業務のみを行うことができる。ただし、ソウルにおいては香港で積み卸される貨物を積み込むことができず、また、香港で積み込まれた貨物を積み卸すことができない。

Note 2. On Route (1), Seoul may only be served with all-cargo services. No cargo to be discharged in Hong Kong may be taken on board in Seoul and no cargo taken on board in Hong Kong may be discharged in Seoul.


注3　路線(2)では、香港においてはマニラで積み卸される貨客を積み込むことができず、また、マニラで積み込まれた貨客を積み卸すことができない。この制限は、いずれかの地点から発し又はいずれかの地点で途中降機を行う貨客にひとしく適用される。

Note 3. On Route (2), no traffic to be discharged in Manila may be taken on board in Hong Kong and no traffic taken on board in Manila may be discharged in Hong Kong. This limitation will apply equally to traffic originating in or stopping over at either point.


注4　路線(4)では、日本国の航空当局は、香港の航空当局に対し「日本国内の一地点」を特定し又はその特定された地点を変更する意図を通告することができる。この特定又は変更は、原則としてその通告の日から六箇月以内に公文の交換によって確認される。

Note 4. On Route (4), the aeronautical authorities of Japan may notify the aeronautical authorities of Hong Kong of their intention to specify "a point in Japan" and change the point thus specified, which will be confirmed by an exchange of notes within six months, in principle, from the date of such notification.


注5　日本国の一又は二以上の指定航空企業が運営する協定業務は、日本国の協定地域内の一地点をその起点としなければならないが、特定路線上の他の地点は、いずれかの又はすべての飛行に当たり各指定航空企業の選択によって省略することができる。

Note 5. The agreed services operated by the designated airline or airlines of Japan shall begin at a point in the area of Japan, but other points on the specified routes may at the option of each designated airline be omitted on any or all flights.


第二部

SECTION II


　香港の一又は二以上の指定航空企業が両方向に運営する路線

　Routes to be operated in both directions by the designated airline or airlines of Hong Kong:


(1)　香港-アジア内の一地点-釜山-福岡-大阪-名古屋-東京-ソウル

(1) Hong Kong - a point in Asia - Pusan - Fukuoka - Osaka - Nagoya - Tokyo - Seoul.


(2)　香港-札幌

(2) Hong Kong - Sapporo.


(3)　香港-那覇-鹿児島-広島-仙台

(3) Hong Kong - Naha - Kagoshima - Hiroshima - Sendai.


注1　路線(1)では、釜山へは貨物業務のみを行うことができる。ただし、釜山においては日本国内の地点で積み卸される貨物を積み込むことができず、また、日本国内の地点で積み込まれた貨物を積み卸すことができない。

Note 1. On Route (1), Pusan may only be served with all-cargo services. No cargo to be discharged at points in Japan may be taken on board in Pusan and no cargo taken on board at points in Japan may be discharged in Pusan.


注2　路線(3)では、香港の航空当局は、日本国の航空当局に対し「広島」及び「仙台」として規定されている日本国内の地点のいずれかを変更する意図を通告することができる。その変更は、原則としてその通告の日から六箇月以内に公文の交換によって確認される。

Note 2. On Route (3), the aeronautical authorities of Hong Kong may notify the aeronautical authorities of Japan of their intention to change either of the points in Japan prescribed as "Hiroshima" and "Sendai", which will be confirmed by an exchange of notes within six months, in principle, from the date of such notification.


注3　香港の一又は二以上の指定航空企業が運営する協定業務は、香港の協定地域内の一地点をその起点としなければならないが、特定路線上の他の地点は、いずれかの又はすべての飛行に当たり各指定航空企業の選択によって省略することができる。

Note 3. The agreed services operated by the designated airline or airlines of Hong Kong shall begin at a point in the area of Hong Kong, but other points on the specified routes may at the option of each designated airline be omitted on any or all flights.

　書簡をもって啓上いたします。本官は、本日付けの貴官の次の書簡を受領したことを確認する光栄を有します。

  I have the honour to acknowledge the receipt of your Note of today's date, which reads as follows:

　本官は、更に、受領を確認した貴官の書簡に記載された了解を香港政府に代わって確認するとともに、このようにして両政府の間で到達した了解が航空業務に関する香港政府と日本国政府との間の協定の効力発生の日に効力を生ずるものとすることを確認する光栄を有します。

　I have further the honour to confirm on behalf of the Government of Hong Kong the understanding contained in your Note under acknowledgement and also confirm that the understanding thus reached between the two Governments will become effective on the date of entry into force of the Agreement between the Government of Hong Kong and the Government of Japan for Air Services.
