書簡をもって啓上いたします。本官は、千九百九十五年十二月十四日及び十五日にパリにて開催されたボリヴィア共和国政府の代表者と関係債権諸国政府の代表者との間の協議において到達した結論に基づき日本国政府の代表者とボリヴィア共和国政府の代表者との間で行われた最近の交渉に言及する光栄を有します。本官は、更に、当該交渉において到達した次の了解を確認する光栄を有します。
Excellency,I have the honour to refer to the recent negotiations between the representatives of the Government of Japan and of the Government of the Republic of Bolivia that were held on the basis of the conclusions reached during the consultations between the representatives of the Government of the Republic of Bolivia and of the Governments of the creditor countries concerned held in Paris on December 14 and 15, 1995. I have further the honour to confirm the following understanding reached in the course of the said negotiations:
1 債務繰延方式による債務救済措置が、海外経済協力基金(以下「基金」という。)により、日本国の関係法令に従ってとられることになる。
1. A debt relief measure in the form of rescheduling will be taken by the Overseas Economic Cooperation Fund (hereinafter referred to as "the Fund") in accordance with the relevant laws and regulations of Japan.
2(1) 繰り延べられる債務(以下「繰延債務」という。)は、ボリヴィア共和国政府が基金に対して負う債務であって、干九百九十五年十二月三十一日現在で償還されていない次の債務の元本から成る(それらの内訳は、この書簡の付表に掲げられる。)。
2.(1) Ｔhe debts to be rescheduled (hereinafter referred to as "the Rescheduled Debts") consist of the principal of the following debts owed by the Government of the Republic of Bolivia to the Fund and outstanding as of December 31, 1995, the breakdown of which is shown in the List attached hereto:
(a) 過去に繰り延べられなかった債務
(a) the debts not previously rescheduled;
(b) 千九百八十七年三月三十一日に日本国政府とボリヴィア共和国政府との間で交換された書簡により行われた取極に従って過去に繰り延べられた債務
(b) the debts previously rescheduled pursuant to the arrangements made by the Notes exchanged between the Government of Japan and the Government of the Republic of Bolivia on March 31, 1987;
(c) 千九百八十九年四月二十八日に日本国政府とボリヴィア共和国政府との間で交換された書簡により行われた取極に従って過去に繰り延べられた債務
(c) the debts previously rescheduled pursuant to the arrangements made by the Notes exchanged between the Government of Japan and the Government of the Republic of Bolivia on April 28, 1989;
(d) 千九百九十年十月二十五日に日本国政府とボリヴィア共和国政府との間で交換された書簡により行われた取極に従って過去に繰り延べられた債務
(d) the debts previously rescheduled pursuant to the arrangements made by the Notes exchanged between the Government of Japan and the Government of the Republic of Bolivia on October 25, 1990; and
(e) 千九百九十二年十一月二十三日に日本国政府とボリヴィア共和国政府との間で交換された書簡(千九百九十四年九月二十日付けの書簡による修正を含む。)により行われた取極に従って過去に繰り延べられた債務
(e) the debts previously rescheduled pursuant to the arrangements made by the Notes exchanged between the Government of Japan and the Government of the Republic of Bolivia on November 23, 1992 as amended on September 20, 1994.
(2) (1)にいう債務の総額は、三百四億四千九百八十一万七千円(三〇、四四九、八一七、〇〇〇円)になる。
(2) The total amount of the debts referred to in sub-paragraph (1) above will be thirty billion four hundred forty-nine million eight hundred and seventeen thousand yen (30,449,817,000).
(3) (2)にいう総額及びこの書簡の付表は、ボリヴィア共和国政府の関係当局及び基金が行う最終的照合の後に日本国政府及びボリヴィア共和国政府の関係当局間の合意により修正されることがある。
(3) Modifications may be made to the total amount referred to in sub-paragraph (2) above and to the List attached hereto by agreement between the authorities concerned of the Government of Japan and of the Government of the Republic of Bolivia, after the final verification to be made by the authorities concerned of the Government of the Republic of Bolivia and the Fund.
3 債務繰延べの条件は、ボリヴィア共和国政府と基金との間で締結される債務繰延契約であって、なかんずく次の原則を含むものにおいて規定される。
3. The terms and conditions of the rescheduling will be stipulated in a rescheduling agreement to be concluded between the Government of the Republic of Bolivia and the Fund, which will contain, inter alia, the following principles:
(1) 繰延債務は、この書簡の附属書に掲げる支払計画に従って二千十二年七月一日に始まる四十八回の半年賦払によって支払われる。
(1) The Rescheduled Debts will be paid in forty-eight (48) semi-annual installments beginning on July 1, 2012 in accordance with the payment schedule shown in the Annex attached hereto.
(2) 繰延債務に対する利子率は、年三・六八パーセントとし、千九百九十六年一月一日から適用される。
(2) The rate of interest on the Rescheduled Debts will be three point six eight per cent (3.68%) per annum beginning from January 1, 1996.
4 1から3までの規定にかかわらず、関係債権諸国が、千九百九十五年十二月十五日にパリにおいてボリヴィア共和国政府の代表者と関係債権諸国政府の代表者によって署名された合意議事録(以下「合意議事録」という。)に定めるボリヴィアの債務の削減及び再編成の条件に係る規定が合意議事録の規定に従って無効となると決定した場合には、日本国政府は、この書簡の規定が無効であることをボリヴィア共和国政府に対し書面により通告することができる。この書簡に述べられた了解は、そのような通告が日本国政府によってなされた場合には、この書簡の交換の日から無効となる。
4. Notwithstanding the provisions of the preceding paragraphs, the Government of Japan may notify in writing the Government of the Republic of Bolivia that the provisions of this Note are null and void, provided that the creditor countries concerned determine that the provisions concerning the terms of the reduction and reorganization of the Bolivian debts set out in the Agreed Minute signed by the representatives of the Government of the Republic of Bolivia and of the Governments of the creditor countries concerned in Paris on December 15, 1995 (hereinafter referred to as "the Agreed Minute") become null and void in accordance with the provisions of the Agreed Minute. The understanding contained in this Note shall be null and void from the date of exchange of the present Notes when such notification is made by the Government of Japan.
本官は、閣下が前記の了解をボリヴィア共和国政府に代わって確認されれば幸いであります。

書簡をもって啓上いたします。本官は、千九百九十五年十二月十四日及び十五日にパリで開催されたボリヴィア共和国政府の代表者と関係債権諸国政府の代表者との間の協議において到達した結論に基づき日本国政府の代表者とボリヴィア共和国政府の代表者との間で行われた最近の交渉に言及する光栄を有します。本官は、更に、当該交渉において到達した次の了解を確認する光栄を有します。
Excellency,I have the honour to refer to the recent negotiations between the representatives of the Government of Japan and of the Government of the Republic of Bolivia that were held on the basis of the conclusions reached during the consultations between the representatives of the Government of the Republic of Bolivia and of the Governments of the creditor countries concerned held in Paris on December 14 and 15, 1995. 1(1) この取極は、一方においてボリヴィア共和国政府及び政府企業並びにボリヴィアの民間団体と他方において日本国の居住者である関係債権者(以下「債権者」という。)との間で契約され、ボリヴィア共和国政府又はボリヴィア共和国の公共部門により支払が保証されたものであって、日本国政府が保険を引き受けた弁済期間が一年を超える次の商業上の債務(以下「繰延商業債務」という。)の総額に適用される。
1.(1) The present arrangements will apply to the total amount of the following commercial debts with a repayment period of more than one year insured by the Government of Japan, which were contracted between the Government and governmental corporations of the Republic of Bolivia and Bolivian private entities on the one hand and the creditors concerned resident in Japan (hereinafter referred to as "the Creditors") on the other, and which were covered by the guarantee of the Government of the Republic of Bolivia or its public sectors (hereinafter referred to as "the Rescheduled Commercial Debts"):
(a) 千九百八十七年三月三十一日に日本国政府とボリヴィア共和国政府との間で交換された書簡により行われた取極に従って過去に繰り延べられた債務であって、千九百九十五年十二月三十一日現在で償還されていない債務の元本(以下「債務I」という。)
(a) the principal of the debts previously rescheduled pursuant to the arrangements made by the Notes exchanged between the Government of Japan and the Government of the Republic of Bolivia on March 31, 1987 and outstanding as of December 31, 1995 (hereinafter referred to as "the Debts I");
(b) 千九百八十九年四月二十八日に日本国政府とボリヴィア共和国政府との間で交換された書簡により行われた取極に従って過去に繰り延べられた債務であって、千九百九十五年十二月三十一日現在で償還されていない債務の元本(以下「債務II」という。)
(b) the principal of the debts previously rescheduled pursuant to the arrangements made by the Notes exchanged between the Government of Japan and the Government of the Republic of Bolivia on April 28, 1989 and outstanding as of December 31, 1995 (hereinafter referred to as "the Debts II");
(c) 千九百九十年十月二十五日に日本国政府とボリヴィア共和国政府との間で交換された書簡により行われた取極に従って過去に繰り延べられた債務であって、千九百九十五年十二月三十一日現在で償還されていない債務の元本(以下「債務III」という。)
(c) the principal of the debts previously rescheduled pursuant to the arrangements made by the Notes exchanged between the Government of Japan and the Government of the Republic of Bolivia on October 25, 1990 and outstanding as of December 31, 1995 (hereinafter referred to as "the Debts III");
(d) 千九百九十二年十一月二十三日に日本国政府とボリヴィア共和国政府との間で交換された書簡(千九百九十四年九月二十日付けの書簡による修正を含む。)の1により行われた取極に従って過去に繰り延べられた債務であって、千九百九十五年十二月三十一日現在で償還されていない債務の元本(以下「債務IV」という。)
(d) the principal of the debts previously rescheduled pursuant to the arrangements made by the paragraph 1 of the Notes exchanged between the Government of Japan and the Government of the Republic of Bolivia on November 23, 1992 as amended on September 20, 1994 and outstanding as of December 31, 1995 (hereinafter referred to as "the Debts IV"); and
(e) 千九百九十二年十一月二十三日に日本国政府とボリヴィア共和国政府との間で交換された書簡(千九百九十四年九月二十日付けの書簡による修正を含む。)の4により行われた取極に従って過去に繰り延べられた債務であって、千九百九十五年十二月三十一日現在で償還されていない債務の元本(以下「債務V」という。)
(e) the principal of the debts previously rescheduled pursuant to the arrangements made by the paragraph 4 of the Notes exchanged between the Government of Japan and the Government of the Republic of Bolivia on November 23, 1992 as amended on September 20, 1994 and outstanding as of December 31, 1995 (hereinafter referred to as "the Debts V").
(2) 繰延商業債務は、日本円及び合衆国ドルによって契約された債務から成る。繰延商業債務の総額は、次のとおり見積もられる。
(2) The Rescheduled Commercial Debts consist of debts contracted in Japanese yen and United States dollars. The total amount of the Rescheduled Commercial Debts is estimated as follows.
(a) 債務Iの総額は、日本円によって契約された債務については一億九千四百六十八万八千七百三円(一九四、六八八、七〇三円)と見積もられる。
(a) The total amount of the Debts I is estimated at one hundred ninety-four million six hundred eighty-eight thousand seven hundred and three yen (194,688,703) for the debts contracted in Japanese yen.
(b) 債務IIの総額は、日本円によって契約された債務については十九億四千百三十六万六千五百三十六円(一、九四一、三六六、五三六円)、また、合衆国ドルによって契約された債務については二十四万千二百八十四合衆国ドル二十九セント(二四一、二八四、二九合衆国ドル)と見積もられる。
(b) The total amount of the Debts II is estimated at one billion nine hundred forty-one million three hundred sixty-six thousand five hundred and thirty-six yen (1,941,366,536) for the debts contracted in Japanese yen, and two hundred forty-one thousand two hundred and eighty-four United States dollars and twenty-nine cents ($241,284.29) for the debts contracted in United States dollars.
(c) 債務IIIの総額は、日本円によって契約された債務については十八億八千三百九十四万九千四百五十四円(一、八八三、九四九、四五四円)、また、合衆国ドルによって契約された債務については九十一万六千八百二十四合衆国ドル三十セント(九一六、八二四・三〇合衆国ドル)と見積もられる。
(c) The total amount of the Debts III is estimated at one billion eight hundred eighty-three million nine hundred forty-nine thousand four hundred and fifty-four yen (1,883,949,454) for the debts contracted in Japanese yen, and nine hundred sixteen thousand eight hundred and twenty-four United States dollars and thirty cents ($916,824.30) for the debts contracted in United States dollars.
(d) 債務IVの総額は、日本円によって契約された債務については十六億六千百八十六万五千八百六十五円(一、六六一、八六五、八六五円)、また、合衆国ドルによって契約された債務については七十九万九千四百八合衆国ドル九十一セント(七九九、四〇八・九一合衆国ドル)と見積もられる。
(d) The total amount of the Debts IV is estimated at one billion six hundred sixty-one million eight hundred sixty-five thousand eight hundred and sixty-five yen (1,661,865,865) for the debts contracted in Japanese yen, and seven hundred ninety-nine thousand four hundred and eight United States dollars and ninety-one cents ($799,408.91) for the debts contracted in United States dollars.
(e) 債務Vの総額は日本円によって契約された債務については千八百八十二万三千四十八円(一八、八二三、〇四八円)、また、合衆国ドルによって契約された債務については一万二千五百九十七合衆国ドル四十一セント(一二、五九七・四一合衆国ドル)と見積もられる。
(e) The total amount of the Debts V is estimated at eighteen million eight hundred twenty-three thousand and forty-eight yen (18,823,048) for the debts contracted in Japanese yen, and twelve thousand five hundred and ninety-seven Untied States dollars and forty-one cents ($12,597.41) for the debts contracted in United States dollars.
(3) (2)にいう総額は、日本国政府及びボリヴィア共和国政府の関係当局が行う最終的照合の後に両政府の関係当局間の合意により修正されることがある。
(3) Modifications may be made to the total amount referred to in sub-paragraph (2) above by agreement between the authorities concerned of the Government of Japan and of the Government of the Republic of Bolivia, after the final verification to be made by the authorities concerned of the two Governments.
2(1) ボリヴィア共和国政府は、ボリヴィア共和国中央銀行を通じて、繰延商業債務を決済するため(4)に定める支払計画(以下「支払計画」という。)に従って行われる支払の額及び日付について日本国政府に通告する。
2.(1) The Government of the Republic of Bolivia will notify the Government of Japan, through the Central Bank of the Republic of Bolivia, of the amount and the dates of payments which will be made in order to settle the Rescheduled Commercial Debts in accordance with the payment scheme as set out in sub-paragraph (4) below (hereinafter referred to as "the Payment Scheme").
(2) ボリヴィア共和国政府は、繰延商業債務の総額を支払計画に従いボリヴィア共和国中央銀行を通じ関係契約によって指定された通貨により債権者に支払う。
(2) The Government of the Republic of Bolivia will pay the total amount of the Rescheduled Commercial Debts to the Creditors in the currency or currencies designated in the contracts concerned through the Central Bank of the Republic of Bolivia in accordance with the Payment Scheme.
(3) 日本国政府は、商業上の関係債務が支払計画に従って行われる支払により決済されることを容易にするため、日本国において施行されている関係法令の範囲内で可能な措置をとる。
(3) The Government of Japan will take possible measures, within the scope of the relevant laws and regulations in force in Japan, to facilitate the settlement of the commercial debts concerned by the payment to be made in accordance with the Payment Scheme.
(4) 繰延商業債務の各々は、この書簡の附属書一に掲げる支払計画に従って千九百九十九年七月一日に始まる六十回の半年賦払によって支払われる。
(4) Each of the Rescheduled Commercial Debts will be paid in sixty (60) semi-annual installments beginning on July 1, 1999 in accordance with the payment schedule shown in Annex I attached hereto.
3(1) ボリヴィア共和国政府は、繰延商業債務を構成する債務の各々について、当該債務が決済されていない限り、(2)及び(3)に定めるところにより算定される利子を次の計画に従って債権者に支払う。
3.(1) The Government of the Republic of Bolivia will pay to the Creditors interest to be calculated as described in sub-paragraphs (2) and (3) below on each of the debts composing the Rescheduled Commercial Debts to the extent that they have not been settled, in accordance with the following schedule:
(a) 最初の利子の支払は、千九百九十八年一月一日に行われる。
(a) The first payment of the interest will be made on January 1, 1998; and
(b) 最初の支払の後に引き続き行われる利子の支払は、毎年一月一日及び七月一日に行われる。
(b) The consecutive payments of interest after the first payment will be made on January 1 and July 1 of each year.
(2)(a) 繰延商業債務に対して千九百九十六年一月一日からこの書簡の交換の日の前日までの間(両期日を含む。)に適用される利子率は、
(2)(a) The rate of interest on the Rescheduled Commercial Debts applied for the period between January 1, 1996 and the day previous to the date of exchange of the present Notes, both dates inclusive, will be:
(i) 債務Iに関し、日本円によって契約された債務については年七・一パーセントとする。
(i) With respect to the Debts I, seven point one per cent (7.1%) per annum for the debts contracted in Japanese yen.
(ii) 債務IIに関し、日本円によって契約された債務については年六・五パーセントとし、合衆国ドルによって契約された債務については年八・八パーセントとする。
(ii) With respect to the Debts II, six point five per cent (6.5%) per annum for the debts contracted in Japanese yen, and eight point eight per cent (8.8%) per annum for the debts contracted in United States dollars.
(iii) 債務IIIに関し、日本円によって契約された債務については年四・六パーセントとし、合衆国ドルによって契約された債務については年六・一パーセントとする。
(iii) With respect to the Debts III, four point six per cent (4.6%) per annum for the debts contracted in Japanese yen, and six point one per cent (6.1%) per annum for the debts contracted in United States dollars.
(iv) 債務IVに関し、日本円によって契約された債務については年八・八パーセントとし、合衆国ドルによって契約された債務については年九・二パーセントとする。
(iv) With respect to the Debts IV, eight point eight per cent (8.8%) per annum for the debts contracted in Japanese yen, and nine point two per cent (9.2%) per annum for the debts contracted in United States dollars.
(v) 債務Vに関し、日本円によって契約された債務については年九・二パーセントとし、合衆国ドルによって契約された債務については年九・六パーセントとする。
(v) With respect to the Debts V, nine point two per cent (9.2%) per annum for the debts contracted in Japanese yen, and nine point six per cent (9.6%) per annum for the debts contracted in United States dollars.
(b) 繰延商業債務に対してこの書簡の交換の日以後に適用される利子率は、
(b) The rate of interest on the Rescheduled Commercial Debts applied from the date of exchange of the present Notes will be:
(i) 債務I及び債務IIに関し、日本円によって契約された債務については年一・五〇四一パーセントとし、合衆国ドルによって契約された債務については年一・六六二一パーセントとする。
(i) With respect to the Debts I and the Debts II, one point five zero four one per cent (1.5041%) per annum for the debts contracted in Japanese yen, and one point six six two one per cent (1.6621%) per annum for the debts contracted in United States dollars.
(ii) 債務IIIに関し、日本円によって契約された債務については年二・二五一八パーセントとし、合衆国ドルによって契約された債務については年二・〇四八一パーセントとする。
(ii) With respect to the Debts III, two point two five one eight per cent (2.2518%) per annum for the debts contracted in Japanese yen, and two point zero four eight one per cent (2.0481%) per annum for the debts contracted in United States dollars.
(iii) 債務IV及び債務Vに関し、日本円によって契約された債務については年一・八七八〇パーセントとし、合衆国ドルによって契約された債務については年二・〇四八一パーセントとする。
(iii) With respect to the Debts IV and the Debts V, one point eight seven eight zero per cent (1.8780%) per annum for the debts contracted in Japanese yen, and two point zero four eight one per cent (2.0481%) per annum for the debts contracted in United States dollars.
(3) 支払われる利子の額は、未決済の債務の額に当該債務が決済されないままに経過した日数及び一日当たりの利子率を乗じて算定される。一日当たりの利子率は、(2)にいう利子率を三百六十五で除して算定される。前記の算定方法を算式で表したものが、この書簡の附属書二に掲げられる。
(3) The amount of interest to be paid will be calculated by multiplying the amount of the debt unsettled by the product of the number of the days the debt has not been settled and the daily interest rate. The daily interest rate is calculated by dividing the rate of interest referred to in (2) above by three hundred and sixty-five (365). The illustration in the form of numerical formula of the method of calculation mentioned above is shown in the Annex II attached hereto.
(4) ボリヴィア共和国政府は、支払計画((1)に定める利子の支払計画を含む。)上の支払が遅延した場合には、未払額から生ずる遅延利子を日本円によって契約された債務については年八・五パーセントの利子率によって、また、合衆国ドルによって契約された債務については年八・九パーセントの利子率によって支払う。
(4) In case where any payment under the Payment Scheme, including the payment schedule of interest set out in sub-paragraph (1) above, is retarded, the Government of the Republic of Bolivia will pay the late interest accruing from the overdue amount at rate of eight point five per cent (8.5%) per annum for the debts contracted in Japanese yen and eight point nine per cent (8.9%) per annum for the debts contracted in United States dollars.
(5) 支払われる利子については、ボリヴィア共和国のすべての租税及び課徴金が免除される。
(5) The interest paid will be exempted from all taxes and duties of the Republic of Bolivia.
4 ボリヴィア共和国政府は、商業上の関係債務の決済に伴って生ずる銀行手数料を支払う。
4. The Government of the Republic of Bolivia will pay bank charges incidental to the settlement of the commercial debts concerned.
5 関係契約の条件のうちこの書簡において特に言及されていないものは、関係契約の当事者間で別段の合意がある場合を除くほか、引き続き適用されることが確認される。
5. It is confirmed that the terms and conditions of the contracts concerned not specifically referred to in this Note will remain applicable, unless otherwise agreed upon by the parties to the contracts concerned.
6 ボリヴィア共和国政府は、いずれかの第三国の居住者であって債権を有する者に対し債務救済措置について2(4)に定める条件より有利な条件を与えた場合には、当該第三国の居住者に与えられる条件より不利でない条件を債権者に直ちに与える。
6. If the Government of the Republic of Bolivia accords to creditors resident in any third country terms and conditions more favourable than those referred to in sub-paragraph (4) of paragraph 2 with regard to debt relief measures, the Government of the Republic of Bolivia will forthwith accord to the Creditors the terms and conditions not less favourable than those accorded to creditors resident in such third country.
7 1から6までの規定にかかわらず、関係債権諸国が、千九百九十五年十二月十五日にパリにおいてボリヴィア共和国政府の代表者と関係債権諸国政府の代表者によって署名された合意議事録(以下「合意議事録」という。)に定めるボリヴィアの債務の削減及び再編成の条件に係る規定が合意議事録の規定に従って無効となると決定した場合には、日本国政府は、この書簡の規定が無効であることをボリヴィア共和国政府に対し書面により通告することができる。この書簡に述べられた了解は、そのような通告が日本国政府によってなされた場合には、この書簡の交換の日から無効となる。
7. Notwithstanding the provisions of the preceding paragraphs, the Government of Japan may notify in writing the Government of the Republic of Bolivia that the provisions of this Note are null and void, provided that the creditor countries concerned determine that the provisions concerning the terms of the reduction and reorganization of the Bolivian debts set out in the Agreed Minute signed by the representatives of the Government of the Republic of Bolivia and of the Governments of the creditor countries concerned in Paris on December 15, 1995 (hereinafter referred to as "the Agreed Minute") become null and void in accordance with the provisions of the Agreed Minute. The understanding contained in this Note shall be null and void from the date of exchange of the present Notes when such notification is made by the Government of Japan.

A: The amount of the debt unsettled
D: 債務が決済されていないままに経過した日数
D: The number of the days the debt has not been settled
R: 年間の利子率
R: The rate of interest (per annum)

(1) 3(1)(a)に基づく千九百九十八年一月一日における最初の利子の支払に関しては、Dは、千九百九十六年一月一日から最初の支払日の前日までの間(両期日を含む。)の日数に等しい。
(1) With respect to the first payment of the interest to be made on January 1, 1998 under (a) of sub- paragraph (1) of paragraph 3, D is equal to the number of days from January 1, 1996 to the previous day of the first payment, both dates inclusive; and
(2) 最初の支払の後に引き続き行われる利子の支払に関しては、Dは、該当支払に先立つ支払日から該当支払の前日までの間(両期日を含む。)の日数に等しい。
