証券規制当局間の情報交換に係る協力の強化に関する日本国政府と中華人民共和国政府との間の交換公文

書簡をもって啓上いたします。本使は、日本国政府と中華人民共和国政府との間のそれぞれの国の証券市場及び証券派生商品市場に関する情報の共有における協力の強化に関して、日本国政府の代表者と中華人民共和国政府の代表者との間で最近行われた討議に言及するとともに、次の取極を日本国政府に代わって提案する光栄を有します。
Excellency, I have the honor to refer to the recent discussions held between the representatives of the Government of Japan and of the Government of the People's Republic of China concerning intensification of cooperation between the two Governments in sharing information on securities markets and securities derivatives markets in their respective countries, and to propose on behalf of the Government of Japan the following arrangement:
1 日本国政府及び中華人民共和国政府は、次に掲げる条件の下で、両政府の権限のある当局の行政上の目的のために使用される情報の共有につき協力する。
1. The Government of Japan and the Government of the People's Republic of China will cooperate in sharing information to be used for administrative purposes of the competent authorities of the two Governments under the following conditions:
(1) いずれの一方の政府の権限のある当局も、相互主義に基づき、かつ他方の政府の権限のある当局の要請に応じて、当該一方の政府が必要かつ適当と認める情報を提供する。
(1) The competent authorities of either Government will provide, on a reciprocal basis, and in response to the request of such authorities of the other Government, information which the former Government deems necessary and appropriate.
(2) (1)にいう方法で入手された情報は、行政上の目的のためにのみ使用されるものとし、したがって、刑事の捜査、訴追及びその後の司法上の手続において使用されてはならない。
(2) The information obtained in the aforementioned manner shall be used solely for administrative purposes and, therefore, shall not be used in criminal investigation, prosecution or subsequent judicial proceedings.
いずれの一方の政府も、この取極の枠内で他方の政府の権限のある当局により提供されたいかなる情報についても秘密を保持する。
Either Government shall keep confidential any information provided by the competent authorities of the other Government within the framework of this arrangement.
(3) この取極の枠内でいずれか一方の政府の権限のある当局により入手された情報が刑事の捜査、訴追及びその後の司法上の手続において必要とされる場合には、当該一方の政府の関係当局は、外交上の経路を通じ、他方の政府の関係当局に対してその旨の要請を提出する。そのような要請を受けた政府が自国の関係法令により必要とされる国内手続に従って明示的な承認を与える前には、入手された情報は、刑事の捜査、訴追及びその後の司法上の手続において使用されてはならない。
(3) In the event that information obtained by the competent authorities of either Government within the framework of this arrangement may be needed in criminal investigation, prosecution or subsequent judicial proceedings, the relevant authorities of that Government shall submit a request to that effect to the relevant authorities of the other Government through the diplomatic channel. Before the explicit approval is made by the requested Government in accordance with its domestic procedures required under the applicable laws and regulations of the country of such requested Government, the information shall not be used in criminal investigation, prosecution or subsequent judicial proceedings.
2 1に規定する協力を実施するための詳細な取決めは、両政府の権限のある当局の間で締結される。
2. Detailed arrangements to implement the cooperation mentioned in paragraph I will be concluded between the competent authorities of the two Governments.
3 この取極の規定は、両政府により、それぞれの国において効力を有する法令に従って、かつ権限のある当局によるそれぞれの資源の利用可能性の範囲内で実施される。情報の提供が要請を受けた当局の国家の公益に反することとなる場合には、要請を受けた当局は、そのような情報提供の要請を拒否することができる。
3. The provisions of this arrangement shall be implemented by the two Governments in accordance with the laws and regulations in force in their respective countries and within the availability of their respective resources of the competent authorities. Where the provision of information would be contrary to the public interest of the country of the requested authorities, such request for information may be denied.
4 両政府は、この取極の実施に際して生じるいかなる問題を処理するためにも、外交上の経路を通じ協議することができる。
4. The two Governments may hold consultations through the diplomatic channel to deal with any problems which may arise in the implementation of this arrangement.
5 いずれの一方の政府も、いつでも他方の政府に対し、この取極を終了させる意図を書面により通告することかできる。この場合、そのような通告が行われてから一箇月の後に、この取極は終了する。
5. Either Government may at any time give written notice to the other Government of its intention to terminate this arrangement, in which case this arrangement will terminate one month after such notice has been given.
本使は、更に、この書簡及び中華人民共和国政府に代わって前記の取極を確認される閣下の返簡が両政府間の合意を構成するものとみなし、その合意が閣下の返簡の日付の日に効力を生ずることを提案する光栄を有します。
I have further the honor to propose that this Note and Your Excellency's Note in reply confirming on behalf of the Government of the People's Republic of China the foregoing arrangement shall be regarded as constituting an agreement between the two Governments, which will enter into force on the date of Your Excellency's reply.

I have further the honor to confirm on behalf of the Government of the People's Republic of China that the above proposal is acceptable to the Government of the People's Republic of China and to agree that Your Excellency's Note and this Note in reply shall be regarded as constituting an agreement between the two Governments, which will enter into force on the date of this reply.

書簡をもって啓上いたします。本使は、日本国政府と中華人民共和国政府との間のそれぞれの国の証券市場及び証券派生商品市場に関する情報の共有における協力の強化に関する本日付けの交換公文に関し、日本語、中国語及び英語により作成された同交換公文の解釈に相違がある場合には英語の本文によるものとすることを日本国政府に代わって提案する光栄を有します。
Excellency, With reference to the Exchange of Notes dated today concerning intensification of cooperation between the Government of Japan and the Government of the People's Republic of China in sharing information on securities markets and securities derivatives markets in their respective countries, I have the honor to propose, on behalf of the Government of Japan, that in case there is any divergence of interpretation of the said Exchange of Notes which is done in the Japanese, Chinese and English languages, the English text shall prevail.
