マイク・マンスフィールド研修計画の実施に関する日本国政府とアメリカ合衆国政府との間の交換公文

書簡をもって啓上いたします。本官は、アメリカ合衆国マイク・マンスフィールド研修法(以下「研修法」という。)により設立されたマイク・マンスフィールド研修計画(以下「計画」という。)の実施のためのアメリカ合衆国政府と日本国政府との間の協力に関して両政府の代表者の間で最近行われた討議に言及するとともに、次の了解をアメリカ合衆国政府に代わって提案する光栄を有します。
Sir,I have the honor to refer to the recent discussions between the representatives of the Government of the United States of America and the Government of Japan concerning cooperation between the two Governments for the implementation of the Mike Mansfield Fellowship Program (hereinafter referred to as "the Program"), established under the Mike Mansfield Fellowship Act of the United States of America (hereinafter referred to as "the Act"), and have further the honor to propose on behalf of the Government of the United States of America the following understanding:
1(1) 計画は、両政府の協力の下、アメリカ合衆国政府による「太平洋問題に関するマンスフィールドセンター」(以下「センター」という。)に対する毎年の支出があることを条件として、研修法の規定に基づいてセンターが実施する。この計画の目的は、日本国の政治、経済、文化及び言語についての深い知識並びに日本国政府の各機関の公務員及びその他実業、専門的職業又は学界の人々と職業上の関係を持った新しい世代のアメリカ合衆国政府公務員を育成することにある。また、計画は、センターと日本国内の非政府機関との協力によって促進させることもできる。
1.(1) The Program will be implemented by the Mansfield Center for Pacific Affairs (hereinafter referred to as "the Center"), with the cooperation of the two Governments, as provided in the Act, and subject to the availability of annual appropriations of the Government of the United States of America to the Center. The purpose of the Program is to develop a new generation of United States Government officials with in-depth knowledge of the politics, economy, culture and language of Japan and with professional relationships with officials in Japanese governmental institutions and other individuals in the business, professional, and academic communities. The Program may be facilitated by cooperation between the Center and non-governmental institutions in Japan.
(2) この計画の下、毎年十名を限度として、アメリカ合衆国政府公務員が、研修員(以下「研修員」という。)として、二年間の研修のために選定される。センターの責任の下に構成される非政府機関である選考委員会が、研修員をその能力に基づき選考する。両政府は、選考委員会の構成員の候補を推薦することができる。
(2) Up to ten United States Government officials will be selected as fellows (hereinafter referred to as "Fellows") under the Program each year for the two-year fellowship. Fellows will be selected on the basis of merit by a non-governmental selection panel constituted under the responsibility of the Center. The two Governments may suggest possible members of the selection panel.
(3) 計画は、研修員に対し、二つの主要な学習体験を提供する。
(3) The Program offers two major learning experiences for Fellows:
(a) センターが準備し米国内で実施する日本国の言語、政治、経済及び文化に関する集中的訓練。
(a) intensive training in the language, politics, economy, and culture of Japan arranged by the Center to be conducted in the United States; and
(b) 日本国政府の各機関又は日本国内のその他の機関(以下「受入機関」という。)への配置。研修員は、その受入機関において、日本人の同僚とともに執務環境の中に配置され、受入機関の部内の動きを観察し、政府及びその組織の文化を学び、職業的な関係を築き、実務的な知識を得る。それぞれの配置の期間は、一年間を限度として各研修員のために柔軟に決定される。
(b) placements in Japanese Government agencies or other bodies in Japan (hereinafter referred to as "Host Agencies"), where Fellows will be placed in an office environment with Japanese colleagues to observe the internal dynamics of the Host Agencies, to learn about the government and its organizational culture, to build professional relationships, and to gain practical knowledge. The duration of each placement will be flexibly determined for each Fellow, but may last up to one year.
(4) 計画に参加する研修員は、研修法に従って、センターに派遣されるか、又は、出身機関を離職する。研修員は、研修期間中は米国の出身機関のための業務を行ってはならない。
(4) Pursuant to the Act, Fellows participating in the Program will be either detailed to the Center, or will separate from their United States home agencies, and may not conduct assignments for their home agencies during the fellowship period.
(5) 研修員は、日本国内で研修を始める前に、日本国のすべての関係法令及び受入機関における研修員としての活動に係る受入機関による関連の指示を遵守することに同意する文書に署名する。これらを遵守しないことは、日本国政府による研修員の配置の打切り、センターによる研修員としての身分の停止及びアメリカ合衆国政府による適用可能である適切な懲罰的措置の理由となり得る。
(5) Before starting as Fellows in Japan, Fellows will sign a document agreeing to comply with all appropriate Japanese laws and regulations and with relevant instructions by their Host Agencies on their fellowship activities therein. Non-compliance may be grounds for termination of placement of a Fellow by the Government of Japan, termination of the fellowship by the Center, and for appropriate disciplinary measures as may be applicable by the Government of the United States of America.
(6) 研修員の給与及び手当は、アメリカ合衆国における出身機関又はセンターのうちいずれか適切な機関が支払う。研修員及びその家族のための国際航空運賃、扶養している児童への教育手当、移転経費並びに住居及び生活費の差額のための手当は、研修法その他の関係法令に従って、センターが支払う。
(6) Salaries and benefits for Fellows will be paid either by the United States home agency, as appropriate, or by the Center. Pursuant to the Act and relevant regulations, the Center will provide international airfare for Fellows and immediate family, an educational allowance for their dependent children, and allowances for moving expenses, housing, and cost-of-living differentials.
(7) 受入機関は、適切な場合には、研修員が相談を行う同僚を指名することを含めて、研修員が受入機関の執務環境に適応するための支援を行うことが奨励される。
(7) The Host Agencies are encouraged to help Fellows adjust to their office environments in the agencies, including designating, where appropriate, office colleagues for consultation.
2 両政府は、計画の実施のために最大限の協力を行う。
2. The two Governments will extend their fullest cooperation for the implementation of the Program.
3 アメリカ合衆国政府は、次のことを行う。
3. The Government of the United States of America will:
(a) 資金があることを条件として、センターに対し、計画を実施するための助成金を提供する。
(a) make grants, subject to the availability of funds, to the Center to implement the Program;
(b) センター、研修員及び出身機関との間の三者間契約の条件の履行を含め、センターによる計画の実施及び計画の資金運営を監視する。
(b) monitor the Center's implementation and fiscal operations of the Program, including its enforcement of the terms and conditions of the three-party contract among the Center, Fellows and their home agencies;
(c) 在日本国アメリカ合衆国大使館内にあるアメリカ合衆国広報・文化交流局を通じて、日本国政府の関係部局、就中外務省及びセンターに協力している日本国内の非政府機関との定期的な連絡を維持する。
(c) through the United States Information Service at the Embassy of the United States of America in Japan, stay in regular contact with concerned offices of the Government of Japan, particularly the Ministry of Foreign Affairs, and the non-governmental institutions in Japan which are cooperating with the Center;
(d) 研修員に次のことを義務付けるために、研修法を含む適用可能なアメリカ合衆国の法令の下で必要な措置をとる。
(d) take necessary measures under applicable United States laws and regulations, including the Act, to oblige Fellows:
(i) すべての日本国の関係法令及び受入機関における研修員としての活動に係る受入機関による関連の指示を遵守すること
(i) to comply with all relevant Japanese laws and regulations as well as relevant instructions by their Host Agencies on their fellowship activities therein;
(ii) 研修期間中に、いかなる政府のためにも諜報に関連する活動を行わないこと
(ii) not to engage in intelligence related activities on behalf of any government for the fellowship period; and
(iii) 受入機関が、研修員に対して開示されていないと通告するいかなる情報をも漏洩しないこと
(iii) not to reveal any information that the Host Agencies advise a Fellow is classified.
(e) (d)(i)、(ii)及び(iii)の規定を遵守しない場合には、適切な措置をとる。
(e) in case of non-compliance with the aforementioned sub-paragraphs (d) (i), (ii) and (iii), take appropriate measures.
4 日本国政府は、次のことを行う。
4. The Government of Japan will:
(ａ) 出身機関で研修員が関係していた事項と本質的に同様の事項に関係する受入機関への適切な配置を碓保するため、また、研修員を日本人の同僚と一緒になるような執務環境に配置するため、最大限の努力を払う。その際に、各研修員の言語能力、関心事項、専門分野、背景となる知識、受入機関における一定の情報の秘密保全の必要性等の要素を考慮する。研修員の配置は、研修員が受入機関においてその部内の動きを継続的に観察し、政府及びその組織の文化を学び、職業的な関係を築き、実務的な知識を得ることができるようにするためのものであり、それぞれの配置の期間は、一年間を限度として各研修員のために柔軟に決定される。
(a) make best efforts to ensure appropriate placements of Fellows in the Host Agencies that are concerned with essentially the same subject matter that Fellows are concerned with in their home agencies and to place them in an office environment with Japanese colleagues -- taking into account such factors as each Fellow's language ability, interest, expertise and background knowledge as well as the Host Agency's requirement to maintain confidentiality of certain information -- so that Fellows can observe on an ongoing basis the internal dynamics of the Host Agencies; learn about the government and its organizational culture; build professional relationships; and gain practical knowledge during placements, each of which will be flexibly determined for each Fellow, and each of which may last up to one year.
(ｂ) 関連法令に従い、計画の目的が可能な限り迅速にかつ支障なく実施できるように、研修員及びその家族に対して、適切な査証を発給する。
(b) grant appropriate visas for Fellows and their families in accordance with relevant laws and regulations so that the purpose of the Program can be fulfilled as expeditiously and conveniently as possible.
5 両政府は、必要に応じ、計画及びこの交換公文の実施状況について評価を行う。
5. The two Governments will evaluate the implementation of the Program and this Note as appropriate and necessary.
６ この了解に規定された約束は、両国において資金が使用可能であるとの条件を含む両国の適用可能な法令の範囲で実施される。
6. The undertakings set forth in this understanding are subject to the laws and regulations of both countries, as applicable, including the availability of funds to both countries.
７ 両政府は、計画から又は計画に関連して生ずることのあるいかなる事項に関しても、必要に応じ協議を行う。
7. The two Governments will hold consultations as may be necessary in respect to any matters that may arise from or in connection with the Program.
８ 前記の了解は、両政府の間の文書の交換により改正することができ、また、いずれか一方の政府の外交上の経路を通じた書面による通知により終了させることができる。終了の通知の三十日後にこの了解は終了する。
8. This understanding set out above may be amended by an exchange of notes between the two Governments and terminated by either Government by a written notice through diplomatic channels. Termination is effective thirty days after notification.
本官は、この了解が日本国政府により受諾される場合には、この書簡及び貴官の返簡が両政府間の合意を構成するものとみなし、その合意が貴官の返簡の日付の日に効力を生ずることを提案する光栄を有します。
I have the honor to propose that, if the foregoing understanding is acceptable to the Government of Japan, this Note and your Note in reply shall be regarded as constituting an agreement between the two Governments, which will enter into force on the date of your reply.

I have the honor to confirm on behalf of the Government of Japan the foregoing understanding is acceptable to the Government of Japan and that your Note and this Note shall be regarded as constituting an agreement between the two Governments, which will enter into force on the date of this reply.
