航空業務に関する日本国とノールウェーとの間の協定の付表の修正に関する交換公文

(Norwegian Note)

　Tokyo, March 29, 1996

　書簡をもって啓上いたします。本使は、千九百五十三年二月二十三日にオスロで署名された航空業務に関する日本国とノールウェーとの間の協定(以下「協定」という。)第十五条の規定に従って千九百九十五年十二月十三日及び十四日に東京において行われた日本国の航空当局とノールウェー、デンマーク及びスウェーデンの航空当局との間の協議に関し、前記の協議の結果、日本国の航空当局並びにノールウェー、デンマーク及びスウェーデンの航空当局が協定の付表を別添のとおり修正することにつき合意したことを述べる光栄を有します。

　Excellency,
  With reference to the consultations held in Tokyo on 13th and 14th December 1995 between the aeronautical authorities of Japan and of Norway, Denmark and Sweden in accordance with Article 15 of the Agreement between Japan and Norway for Air Services, signed at Oslo on 23rd February 1953(hereinafter referred to as the "Agreement" )I have the honour to state that, as a result of the said consultations, the aeronautical authorities of Japan and Norway, Denmark and Sweden agreed to amend the Schedule to the Agreement as set out in the Attachment.

　よって、本使は、更に、別添の新たな付表が協定の現行の付表に代わることをノールウェー政府に代わって提案する光栄を有します。

　Accordingly, I have further the honour to propose, on behalf of the Government of Norway, that the new Schedule as set out in the Attachment shall replace the existing Schedule to the Agreement.

　本使は、前記の提案が日本国政府にとって受諾し得るものであるときは、この書簡及びその旨の閣下の返簡をこの問題に関する両国政府間の合意を構成するものとみなし、その合意が閣下の返簡の日付の日に効力を生ずることを提案いたします。

　If the above proposal is acceptable to the Government of Japan, it is suggested that this Note and Your Excellency's reply to that effect shall be regarded as constituting an agreement between the two Governments on this matter, which shall enter into force on the date of Your Excellency's reply.

　本使は、以上を申し進めるに際し、ここに閣下に向かって敬意を表します。

　I avail myself of this opportunity to extend to Your Excellency the assurances of my highest consideration.

SCHEDULE

I　日本国の一又は二以上の指定航空企業が運営する路線

I. Routes to be served by the designated airline or airlines of Japan.

(A)　両方向に、東京-大阪-福岡-沖縄-中国本土及び(又は)台湾における地点-香港又はマニラ-インド・シナ内の地点-バンコック-ヤンゴン-コロンボ-インド、バングラデシュ及びパキスタン内の地点-中東及び近東内の地点-カイロ-アテネ-ローマ-ジュネーヴ、チューリッヒ又はマドリッド-フランクフルト・アム・マイン-パリ、ブラッセル又はアムステルダム-スカンディナヴィア内の地点及び以遠の地点

(A) Tokyo - Osaka - Fukuoka - Okinawa - points on the Mainland of China and/or on the island of Formosa - Hong Kong or Manila - points in Indo-China - Bangkok - Yangon - Colombo - points in India and Bangladesh and Pakistan - points in the Middle and Near East - Cairo - Athens - Rome - Geneva, Zurich or Madrid - Frankfurt am Main - Paris, Brussels or Amsterdam - points in Scandinavia and points beyond, in both directions.

(B)　両方向に、福岡-大阪-東京-北太平洋及びカナダ内の地点-スカンディナヴィア内の地点及び以遠の地点

(B) Fukuoka - Osaka - Tokyo - points in the North pacific and Canada - points in Scandinavia and points beyond, in both directions.

(C)　両方向に、日本国内の地点-モスクワ-アムステルダム及び(又は)ロンドン及び(又は)パリ-スカンディナヴィア内の地点及び以遠の地点

(C) Points in Japan - Moscow - Amsterdam and/or London and/or Paris - points in Scandinavia and points beyond, in both directions.

(D)　両方向に、大阪-マカオ-インド内の一地点-中東及び近東内の一地点-スカンディナヴィア内の一地点

(D) Osaka - Macau - a point in India - a point in the Middle and Near East - a point in Scandinavia, in both directions.

注1　路線(C)では、日本国の一又は二以上の指定航空企業は、自己が運送する途中降機の旅客についてのみ、アムステルダム、ロンドン及びパリのうちのいずれかの地点とスカンディナヴィア内の地点との間において運輸権を行使することができる。

Note 1: On Route (C), the designated airline or airlines of Japan may exercise traffic rights between any point out of Amsterdam, London and Paris, and points in Scandinavia only for its or their own stopover passengers.

注2　路線(D)では、

Note 2: On Route (D),

(1)　日本国の一又は二以上の指定航空企業は、貨物業務のみを行うことができる。

(1) the designated airline or airlines of Japan may only operate all-cargo services; and

(2)　日本国の一又は二以上の指定航空企業は、スカンディナヴィア内の一地点と中間地点との間において第5の自由の運輸権を行使することができない。

(2) the designated airline or airlines of Japan may not exercise fifth freedom traffic rights between a point in Scandinavia and any intermediate point.

　日本国の一又は二以上の指定航空企業が提供する協定業務は、日本国の領域内の一地点を起点とするものでなければならない。ただし、路線上の他の地点は、いずれかの又はすべての飛行に当たって、当該指定航空企業の選択により省略することができる。

　The agreed services provided by the designated airline or airlines of Japan shall begin at a point in the territory of Japan, but other points on the route may at the option of the designated airline be omitted on any or all flights.

Ⅱ　ノールウェーの一又は二以上の指定航空企業が運営する路線

II. Routes to be served by the designated airline or airlines of Norway.

(A)　両方向に、スカンディナヴィア内の地点-ヨ-ロッパ内の地点-近東及び中東内の地点-パキスタン内の地点-インド内の地点-スリ・ランカ内の地点-ミャンマー内の地点-バンコック-香港又はマニラ-東京及び以遠の地点

(A) Points in Scandinavia - points in Europe - points in the Near and the Middle East - points in Pakistan - points in India - points in Sri Lanka - points in Myanmar - Bangkok - Hong Kong or Manila - Tokyo and points beyond, in both directions.

(B)　両方向に、スカンディナヴィア内の地点-アラスカ及びアリューシャン諸島内の地点-東京及び以遠の地点

(B) Points in Scandinavia - points in Alaska and the Aleutian Islands - Tokyo and points beyond, in both directions.

(C)　両方向に、スカンディナヴィア内の地点-モスタワ-東京

(C) Points in Scandinavia - Moscow - Tokyo, in both directions.

(D)　両方向に、スカンディナヴィア内の地点-モスクワ-大阪

(D) Points in Scandinavia - Moscow - Osaka, in both directions.

(E)　両方向に、スカンディナヴィア内の一地点-近東及び中東内の一地点-インド内の一地点-マカオ-大阪

(E) A point in Scandinavia - a point in the Near and Middle East - a point in India - Macau - Osaka, in both directions.

注　路線(E)では、

(1)　ノールウェーの一又は二以上の指定航空企業は、貨物業務のみを行うことができる。

(2)　ノールウェーの一又は二以上の指定航空企業は、大阪と中間地点との間において第5の自由の運輸権を行使することができない。

(2) the designated airline or airlines of Norway may not exercise fifth freedom traffic rights between Osaka and any intermediate point.

　ノールウェーの一又は二以上の指定航空企業が提供する協定業務は、スカンディナヴィアの領域内の一地点を起点とするものでなければならない。ただし、路線上の他の地点は、いずれかの又はすべての飛行に当たって、当該指定航空企業の選択により省略することができる。

　The agreed services provided by the designated airline or airlines of Norway shall begin at a point in Scandinavia, but other points on the route may at the option of the designated airline be omitted on any or all flights.

Ⅲ　この付表においてスカンディナヴィアとは、デンマーク、ノールウェー及びスウェーデン並びにデンマークの属領をいう。

III. The word Scandinavia in this Schedule means Denmark, Norway, Sweden and Danish territorial possessions.

  I have the honour to acknowledge the receipt of Your Excellency's Note of today's date which reads as follows:

　本大臣は、更に、日本国政府がノールウェー政府の前記の提案を受諾する旨を日本国政府に代わって閣下に通報するとともに、閣下の書簡及びこの返簡をこの問題に関する両国政府間の合意を構成するものとみなし、その合意がこの返簡の日付の日に効力を生ずることを確認する光栄を有します。

　I have further the honour to inform Your Excellency, on behalf of the Government of Japan, that the Government of Japan accepts the above proposal of the Government of Norway and to confirm that Your Excellency's Note and this reply shall be regarded as constituting an agreement between the two Governments on this matter, which shall enter into force on the date of this reply.

　本大臣は、以上を申し進めるに際し、ここに閣下に向かって敬意を表します。
