Vienna, July 27, 1995
書簡をもって啓上いたします。本使は、日本国政府(以下「政府」という。)の代表者と国際連合パレスチナ難民救済事業機関(以下「機関」という。)の代表者との間で最近行われたパレスチナ難民に対する食糧援助計画に関する協議に言及するとともに、千九百八十六年の食糧援助規約に関連して政府が機関を通じて供与する意向を有する援助に関する次の取極を提案する光栄を有します。
Excellency, I have the honour to refer to the recent discussions held between the representatives of the Government of Japan (hereinafter referred to as "the Government") and of the United Nations Relief and Works Agency for the Palestine Refugees in the Near East (hereinafter referred to as "the UNRWA") in relation to the food aid programme for the Palestine Refugees and have further the honour to propose the following arrangements concerning the assistance which the Government intends to extend through the UNRWA in connection with the Food Aid Convention, 1986:
1 政府は、日本国の関係法令に従い、八億円(八〇〇、〇〇〇、〇〇〇円)を贈与の形で機関の使用に供する。
1. The Government shall make available to the UNRWA, in accordance with the relevant laws and regulations of Japan, the amount of eight hundred million yen (~80,000,000) in the form of grant.
2 政府は、日本国の外国為替公認銀行の東京店に開設されている機関の勘定に、1に定める額を日本円で払い込む。この額は、政府の関係当局と機関との間の合意によって延長されない限り、この取極が効力を生ずる日から千九百九十六年三月三十一日までの期間中に払い込まれる。
2. The Government shall make a payment of the amount referred to in paragraph 1 in Japanese yen to the UNRWA Account opened in the Tokyo office of an authorized foreign exchange bank of Japan. This amount shall be paid during the period between the date of coming into force of the present arrangements and March 31, 1996, unless the period is extended by mutual agreement between the authority concerned of the Government and the UNRWA.
3 政府は、2の規定に従って払込みを行うことにより、その払込みを行ったときにその払込みの金額までこの取極に基づく援助を実施したとみなされる。
3. By and upon making the payment under the preceding paragraph, the Government shall be deemed to have made the assistance under the present arrangements to the extent of the amount of such payment.
4(1) 1に定める総額は、アメリカ産及び(又は)カナダ産及び(又は)オーストラリア産小麦から製粉された小麦粉の購入及びこの購入に関連する費用(輸送費及び保険料を含む。)に使用される。
4.(1) The total amount referred to in paragraph l above shall be used for the purchase of the flour milled from American and/or Canadian and/or Australian wheat and for the expenditures related to such purchases, including freight and insurance premium.
(2) アメリカ産及び(又は)カナダ産及び(又は)オーストラリア産小麦から製粉された小麦粉の現在の価格、運賃及び保険料を考慮して、最小限五億三千百万円(五三一、〇〇〇、〇〇〇円)相当のアメリカ産及び(又は)カナダ産及び(又は)オーストラリア産小麦から製粉された小麦粉が購入され、船積みされ、パレスチナ難民に引き渡されることが期待される。
(2) Taking into account the current price of the flour milled from American and/or Canadian and/or Australian wheat, freight rates and insurance premium, it is expected that a minimum of five hundred and thirty-one million yen (531,000,000) of the flour milled from American and/or Canadian and/or Australian wheat will be purchased, shipped and delivered to the Palestine refugees.
(3) 機関は、2にいう小麦粉の購入並びに輸送及び保険のため、機関の財務規則に従い供給者と契約を締結する。
(3) The UNRWA shall enter into contracts with suppliers for the purchase of the flour referred to in sub-paragraph (2) and for the shipping and insurance in accordance with the UNRWA'S financial rules.
5 機関は、4の規定に従って購入した小麦粉をできる限り速やかにパレスチナ難民に引き渡すために必要なすべての措置をとる。
5. The UNRWA shall take all the necessary measures to deliver as soon as possible the flour purchased under the preceding paragraph to Palestine refugees.
6 政府及び機関は、いずれか一方の要請により、この取極から又はこれに関連して生ずるいかなる事項についても、相互に協議する。
6. The Government and the UNRWA shall consult with each other, at the request of either of them, on any matter that may arise from or in connection with the present arrangements.
7(1) 機関は、供給者と契約を締結した後、遅滞なく次の事項を政府に通報する。
7.(1) When the UNRWA has entered into contracts with suppliers, it shall inform the Government, without delay, of the following:
(a) 機関が契約に従って支払う総額
(a) Total amount of payments to be made by the UNRWA under the contract;
(b) 購入した小麦粉の総額
(b) Total value of the flour purchased;
(c) 小麦粉の数量及び品質
(c) Quantity and quality of the flour;
(d) 小麦粉のFOB単価
(d) Unit F.O.B. price of the flour;
(e) 輸送費
(e) Freight costs;
(f) 保険料
(f) Insurance premium;
(g) 供給者の名称
(g) Names of the suppliers; and
(h) 船積みの予定日及び配布地への到着の予定日
(h) Expected dates of shipment to and arrival at distribution sites.
(2) 船積み、荷揚げ及び配布地への到着のたびに、機関は、これらの日付並びに小麦粉の数量及び品質を政府に通報する。
(2) Each time a shipment is loaded aboard a ship or unloaded therefrom or arrives at the distribution sites, the UNRWA shall inform the Government of the date and the quantity and condition of the flour.
(3) 機関は、最初の積荷が配布地に到着した後、三箇月ごとに小麦粉の配布に関する報告書を政府に提出する。
(3) After the arrival of the first shipment at the distribution sites, the UNRWA shall submit to the Government a report on the distribution of the flour every three months.
(4) 機関は、この取極に従って購入した小麦粉の配布が完了した後、配布に関する最終報告書を、できる限り配布地における写真を付して、政府に提出する。
(4) Upon the completion of the distribution of the flour purchased under the present arrangements, the UNRWA shall provide for the Government a final report on the distribution, if possible together with photographs taken at the distribution sites.
(5) 機関は、小麦粉が日本国により贈与された旨の標示を小麦粉の袋に付すことを確保する。本使は、更に、この書簡及び前記の取極を確認される閣下の返簡が政府と機関との間の合意を構成するものとみなし、その合意が閣下の返簡の日付の日に効力を生ずることを提案する光栄を有します。本使は、以上を申し進めるに際し、ここに閣下に向かって敬意を表します。
(5) The UNRWA shall ensure that markings the flour bags bear indicate the flour has been donated by Japan. I have further the honour to propose that the present Note and Your Excellency's reply confirming the foregoing arrangements shall be regarded as constituting an agreement between the Government and the UNRWA, which shall enter into force on the date of Your Excellency's reply. 書簡をもって啓上いたします。本官は、本日付けの閣下の次の書簡を受領したことを確認する光栄を有します。
Excellency, I have the honour to acknowledge the receipt of Your Excellency's Note of today's date which reads as follows:

本官は、更に、国際連合パレスチナ難民救済事業機関に代わって前記の取極を確認するとともに、閣下の書簡及びこの返簡が機関と日本国政府との間の合意を構成するものとみなし、その合意がこの返簡の日付の日に効力を生ずることに同意する光栄を有します。本官は、以上を申し進めるに際し、ここに閣下に向かって敬意を表します。
I have further the honour to confirm the foregoing arrangements on behalf of the United Nations Relief and Works Agency for the Palestine Refugees in the Near East, and to agree that Your Excellency's Note and this reply shall be regarded as constituting an agreement between the UNRWA and the Government of Japan, which shall enter into force on the date of this reply.
