日本国とアメリカ合衆国との間の相互防衛援肋協定に基づくP－三C武器システムの追加取得及び生産に関する交換公文

Tokyo, March 24, 1995
書簡をもって啓上いたします。本使は、千九百五十四年三月八日に東京で署名されたアメリカ合衆国と日本国との間の相互防衛援肋協定(以下「MDA協定」という。)に言及する光栄を有します。同協定は、各政府が、他方の政府に対し、援肋を供与する政府が承認することがある装備、資材、役務その他の援肋を、両政府の間で行うべき細目取極に従って、使用に供するものとすることを特に規定しています。
Excellency, I have the honor to refer to the Mutual Defense Assistance Agreement between the United States of America and Japan, signed at Tokyo on March 8, 1954 (hereinafter referred to as the "MDA Agreement" ), which provides, inter alia, that each Government will make available to the other such equipment, materials, services, or other assistance as the Government furnishing such assistance may authorize, in accordance with such detailed arrangements as may be made between them.
その規定に従い、千九百七十八年六月二十日に、アメリカ合衆国政府と日本国政府との間で、MDA協定の規定に従って四十五機を限度とするP―三C武器システム並びに関連する装備及び資材を取得し及び日本国において生産する計画に関して合意が成立しました。更に、千九百八十五年九月十日及び千九百八十九年三月二十四日には、両政府の間で、それぞれ三十機及び二十五機を限度とするP―三C武器システム並びに関連する装備及び資材を追加的に取得し及び日本国において生産する計画に関して合意が成立しました。
In pursuance of this provision, an agreement was reached between the Government of the United States of America and the Government of Japan on June 20 1978 concerning a program for the acquisition and production in Japan of up to forty-five (45) P-3C Weapon Systems and related equipment and materials under the terms and provisions of the MDA Agreement. Further agreements were reached between the two Governments on September 10, 1985 and on March 24, 1989 concerning additional programs for the acquisition and production in Japan of up to thirty (30) and twenty-five (25) P-3C Weapon Systems respectively, and related equipment and materials.
アメリカ合衆国政府及び日本国政府の代表者は、P－三C計画に基づき取得し及び生産することを承認されるP一三C武器システムの機数を更に増加するための討議を行いました。この討議の結果によるアメリカ合衆国政府の了解は、次のとおりであります。
The representatives of the Government of the United States of America and the Government of Japan have held discussions to further increase the quantity of the P-3C Weapon Systems authorized to be acquired or produced under the P-3C program. The following is the understanding of the Government of the United States of America regarding the results of the above-mentioned discussions:
1 3の規定に基づき締結される細目取極に従い、日本国政府は、前記の既に承認された百機のP－三C武器システム並びに関連する装備及び資材に加えて、更に一機を限度とするP－三C武器システム並びに関連する装備及び資材を取得又は生産するものとし、アメリカ合衆国政府は、これらのものの販売又は生産を承認する。この結果、新たな合計は、百一機のP―三C武器システム並びに関連する装備及び資材となる。
1. In accordance with the detailed arrangements concluded under paragraph 3, the Government of Japan will acquire or produce and the Government of the United States of America will authorize the sale or production of up to one (1) P-3C Weapon System and related equipment and materials in addition to the above-mentioned one hundred (100) P-3C Weapon Systems and related equipment and materials previously authorized for a new total of one hundred and one (101) P-3C Weapon Systems and related equipment and materials.
2 P―三C武器システム並びに関連する装備及び資材の生産は、アメリカ合衆国及び日本国の企業が参加して実施される。アメリカ合衆国政府は、日本国政府に直接販売を行うことにより、前記の計画を補足する。
2. The production of the P-3C Weapon Systems and related equipment and materials will be undertaken through the participation of the industries of the United States of America and Japan. The above-mentioned program will be supplemented by direct sale by the Government of the United States of America to the Government of Japan.
3 この了解は、MDA協定及びこれに基づく取極(千九百五十六年三月二十二日に東京で署名された防衛目的のためにする特許権及び技術上の知識の交流を容易にするためのアメリカ合衆国政府と日本国政府との間の協定を含む。)に従って実施される。その実施のための細目取極は、両政府の権限のある当局の代表者により締結されるP―三C武器システム並びに関連する装備及び資材の取得及び日本国における生産に関する取極及びその修正である。
3. The present understanding will be implemented in accordance with the MDA Agree Agreement and arrangements concluded thereunder, including the Agreement between the Government of the United States of America and the Government of Japan to facilitate Interchange of Patent Rights and Technical Information for Purposes of Defense signed at Tokyo on March 22. 1956. The detailed arrangements to implement the present understanding will be those arrangements concluded between representatives of the competent authorities of the two Governments concerning the acquisition and production in Japan of the P-3C Weapon Systems and related equipment and materials, and any subsequent amendments thereto.
4 この了解及びこれに基づき締結されるすべての取極に基づき日本国政府が行う財政上の債務の負担又は支出は、日本国の憲法上の規定に従った予算の承認を得たところにより行う。
4. Financial obligations or expenditures incurred by the Government of Japan under the present understanding and all arrangements to be concluded hereunder will be subject to budget authorization pursuant to the constitutional provisions of Japan.
本使は、この了解が日本国政府により受諾される場合には、この書簡及び受諾する旨の閣下の返簡が両政府間の合意を構成するものとみなし、その合意が閣下の返簡の日付の日に効力を生ずることを提案する光栄を有します。
I have the honor to propose that, if the above understanding is acceptable to the Government of Japan, the present Note and Your Excellency's reply of acceptance shall be regarded as constituting an agreement between the two Governments which shall enter into force on the date of Your Excellency's reply.

I have the honor to confirm on behalf of the Government of Japan that the foregoing understanding is acceptable to the Government of Japan and to agree that Your Excellency's Note and this reply shall be regarded as constituting an agreement between the two Governments which shall enter into force on the date of this reply.
