日本国政府所有米の売買に関する契約に関連する日本国政府とフィリピン共和国政府との間の交換公文

(Philippine Note)

　Tokyo, August 25, 1995

　書簡をもつて啓上いたします。本官は、フィリピン共和国政府がフィリピン共和国の食糧需給事情を緩和するため日本国の協力を要請したことに基づき千九百九十五年八月十六日に東京においてフィリピン共和国国家食糧庁と日本国農林水産省食糧庁との間で締結された「日本国農林水産省食糧庁とフィリピン共和国国家食糧庁との間の日本国政府所有米の売買に関する契約」(以下「契約」という。)に言及する光栄を有します。契約には、なかんずく次の事項が定められています。

　Excellency,
I have the honor to refer to the "Contract for Sale and Purchase of Japanese Government's Rice between the Food Agency, Ministry of Agriculture, Forestry and Fisheries of Japan and the National Food Authority of the Republic of the Philippines" (hereinafter referred to as "the Contract") concluded on August 16, 1995 in Tokyo between the National Food Authority of the Republic of the Philippines and the Food Agency, Ministry of Agriculture, Forestry and Fisheries of Japan at the request of the Government of the Republic of the Philippines for Japanese cooperation in meeting the food requirements in the Republic of the Philippines. The Contract provides, inter alia, for the following:

(a)　日本国農林水産省食糧庁は、フィリピン共和国国家食糧庁に対し、日本国政府所有のタイ国産うるち精米三万メトリック・トンを、延払によつて、売り渡す。

(a) The Food Agency, Ministry of Agriculture, Forestry and Fisheries of Japan shall supply on a deferred payment basis to the National Food Authority of the Republic of the Philippines a total of thirty thousand (30,000) metric tons of Thai white milled rice stored by the Government of Japan;

(b)　その米穀の船積みは、千九百九十五年八月に開始し、できる限り早期に完了する。

(b) The shipment of the said ice shall start in August, 1995 and be completed as early as possible;

(c)　その米穀の引渡しは、日本国の港における本船積込み渡しによる。

(c) The said rice shall be delivered on the basis of F. O. B. stowed at Japanese ports;

(d)　その米穀の価格は、本船積込み渡しにより、一メトリック・トンにつき、一万八千円とする。

(d) The price of the said rice shall be eighteen thousand (18,000) yen per metric ton on the basis of F. O. B. stowed;

(e)　フィリピン共和国国家食糧庁は、その米穀をフィリピン共和国の国内消費に使用するものとする。

(e) The National Food Authority of the Republic of the Philippines shall use the said rice for domestic consumption in the Republic of the Philippines

(f)　延払の条件は、次のとおりとする。

(f) The terms and conditions of the deferred payment shall be as follows:

(i)　元本の支払は、十年の据置期間の後二十年の期間にわたり、均等年賦によって行う。

(i) The payment of the principal shall be made in equal annual instalments over a period of twenty years after a ten years' grace period;

(ii)　利子率は、据置期間においては年二パーセント、及び据置期間の後二十年の期間においては年三パーセントとし、かつ、その利子は、毎年支払う。

(ii) The rate of interest shall be two percent (2%) per annum during the grace period and three percent (3%) per annum during the period of twenty years after the grace period, and such interest shall be paid annually;

(g)　契約から生ずるすべての債務及び義務は日本国通貨で表示され、かつ、フィリピン共和国国家食糧庁から日本国農林水産省食糧庁への支払は日本円で行われる。

(g) All liabilities and obligations accruing from the Contract shall be quoted in Japanese yen and the payment from the National Food Authority of the Republic of the Philippines to the Food Agency, Ministry of Agriculture, Forestry and Fisheries of Japan shall be made in Japanese yen.

　本官は、フィリピン共和国政府が契約の締結について極めて満足している旨を閣下に通報するとともに、契約に関連する次の了解をフィリピン共和国政府に代わつて確認します。

　I wish to inform Your Excellency that the Government of the Republic of the Philippines is highly satisfied with the conclusion of the Contract and to confirm on behalf of the Government of the Republic of the Philippines the following understanding relating to the Contract:

1　両政府は、それぞれの国の現行法令の範囲内で、契約の円滑な及び適時の実施を容易にするものとし、このため必要な措置をとる。

1. The two Governments will, within the scope of laws and regulations in force in their respective countries, facilitate smooth and timely implementation of the Contract and take necessary measures to this end.

2　両政府は、生産及び国際通商貿易の通常の形態に有害な影響を与えることを避けるという原則が、契約による日本国政府所有米の供給を規律すべきであることを認める。したがつて、フィリピン共和国政府は、日本国政府と必要な協議を行いつつ、前記の米穀の購入との関連でこの原則を遵守するためのすべての妥当な措置をとる。

2. The two Governments recognize that the principle to avoid harmful interference with normal patterns of production and international commercial trade should govern the supply of Japanese Government's rice under the Contract. The Government of the Republic of the Philippines will, therefore, in due consultation with the Government of Japan, take all appropriate measures for the observance of the said principle in connection with the purchase of the said rice.

3　両政府は、この了解から又はそれに関連して生ずることがあるいかなる問題についても、相互に協議する。

3. The two Governments will consult with each other on any problems that may arise our of this understanding or in connection therewith.

　本官は、閣下が前記のことが日本国政府の了解でもあることを日本国政府に代わつて確認されれば幸いであります。

　I should be grateful if Your Excellency would confirm, on behalf of the Government of Japan, that this is also the understanding of the Government of Japan.

　本官は、以上を申し進めるに際し、ここに閣下に向かって敬意を表します。

　I avail myself of this opportunity to extend to Your Excellency the assurance of my highest consideration.
