第二次アミリア浄水場施設改善計画のための贈与に関する日本国政府とエジプト・アラブ共和国政府との間の交換公文

(Japanese Note)
Cairo, May 16, 1995
書簡をもって啓上いたします。本使は、日本国とエジプト・アラブ共和国との間の友好協力関係を強化することを目的として行われる日本国の経済協力に関して日本国政府の代表者とエジプト・アラブ共和国政府の代表者との間で最近行われた討議に言及するとともに、次の取極を日本国政府に代わって提案する光栄を有します。
Excellency, I have the honour to refer to the recent discussions held between the representatives of the Government of Japan and of the Government of the Arab Republic of Egypt concerning Japanese economic cooperation to be extended with a view to strengthening friendly and cooperative relations between the two countries, and to propose on behalf of the Government of Japan the following arrangements:
1 日本国政府は、エジプト・アラブ共和国政府が第二次アミリア浄水場施設改善計画(以下「計画」という。)を実施することに寄与するため、日本国の関係法令に従い、エジプト・アラブ共和国政府に対し、二十八億六千万円(二、八六◯、◯◯◯、◯◯◯円)を限度とする額の贈与(以下「贈与」という。)を行う。
1. For the purpose of contributing to the execution of the Project for Rehabilitation and Upgrading of Amirya Water Treatment Plant (Phase II) (hereinafter referred to as "the Project") by the Government of the Arab Republic of Egypt, the Government of Japan will extend to the Government of the Arab Republic of Egypt, in accordance with the relevant laws and regulations of Japan, a grant up to two billion eight hundred and sixty million yen (2,860,000,000) (hereinafter referred to as "the Grant").
2 贈与は、日本国の関係法令に従い、次の各期についてそれぞれ次のとおり定められた額を限度としてそれぞれの期間に使用に供される。ただし、両政府の関係当局間の合意によってその期間が延長される場合は、この限りではない。
2. The Grant will, in accordance with the relevant laws and regulations of Japan, be made available during each of the following periods within the limit of the corresponding amount for each term, unless such period is extended by mutual agreement between the authorities concerned of the two Governments:
(1) 第一期

この取極の効力発生の日から千九百九十六年三月三十一日までの期間
period between the date of coming into force of the present arrangements and March 31, 1996;
五億二千五百万円(五二五、◯◯◯、◯◯◯円)
five hundred and twenty-five million yen (525,000,000)
(2) 第二期
(2) term II
千九百九十六年四月一日から千九百九十七年三月三十一日までの期間
period between April l, 1996 and March 31, 1997;
十六億二千九百万円(一、六二九、◯◯◯、◯◯◯円)
one billion six hundred and twenty-nine million yen (1,629,000,000)
(3) 第三期
(3) term III
千九百九十七年四月一日から千九百九十八年三月三十一日までの期間
period between April 1, 1997 and March 31, 1998;
七億六百万円(七◯六、◯◯◯、◯◯◯円)
seven hundred and six million yen (706,000,000)
3(1) 贈与は、エジプト・アラブ共和国政府により適正にかつ専ら次に掲げる日本国又はエジプト・アラブ共和国の生産物及び日本国民又はエジプト国民の役務を購入するために使用される。(国民という語は、この取極の中で用いるときはいつでも、日本国民の場合は日本国の自然人又はその支配する日本国の法人を意味し、エジプト国民の場合はエジプトの自然人又は法人を意味する。)
3.(1) The Grant will be used by the Government of the Arab Republic of Egypt Properly and exclusively for the purchase of the products of Japan or the Arab Republic of Egypt and the services of Japanese or Egyptian nationals listed below: (The term nationals whenever used in the present arrangements means Japanese physical persons or Japanese juridical persons controlled by Japanese physical persons in the case of Japanese nationals, and Egyptian physical or juridical persons in the case of Egyptian nationals.)
(a) アミリア浄水場施設(以下「施設」という。)の改善のために必要な生産物及び役務
(a) products and services necessary for the rehabilitation and upgrading of Amirya Water Treatment Plant (hereinafter referred to as "the Facilities");
(b) 計画を実施するために必要な機材及びその調達に必要な役務
(b) equipment necessary for the execution of the Project and services necessary for the procurement thereof; and
(c) (a)及び(b)にいう生産物のエジプト・アラブ共和国の港までの輸送及び同国における国内輸送のために必要な役務
(c) services necessary for the transportation of the products referred to in (a) and (b) above to ports in the Arab Republic of Egypt, and those for internal transportation therein.
(2) (1)の規定にかかわらず、贈与は、両政府が必要と認める場合には、(1)(a)及び(b)にいう生産物で日本国又はエジプト・アラブ共和国の生産物以外のもの並びに(1)(a)、(b)及び(c)にいう役務で日本国民又はエジプト国民の役務以外のものの購入のために使用することができる。
(2) Notwithstanding the provisions of sub-paragraph (1) above, when the two Governments deem it necessary, the Grant may be used for the purchase of the products of the kind mentioned in (a) and (b) of sub-paragraph (1) above, which are products of countries other than Japan or the Arab Republic of Egypt and the services of the kind mentioned in (a), (b) and (c) of sub-paragraph (1) above, which are services of nationals of countries other than Japan or the Arab Republic of Egypt.
4 エジプト・アラブ共和国政府又はその指定する当局は、3にいう生産物及び役務を購入するため、日本国民と円貨建ての契約を締結する。この契約は、贈与の対象として適格であることが日本国政府により認証されなければならない。
4. The Government of the Arab Republic of Egypt or its designated authority will enter into contracts in Japanese yen with Japanese nationals for the purchase of the products and services referred to in paragraph 3. Such contracts shall be verified by the Government of Japan to be eligible for the Grant.
5(1) 日本国政府は、4の規定に従って認証された契約(以下「認証された契約」という。)に基づいてエジプト・アラブ共和国政府又はその指定する当局が負う債務の弁済に充てるための資金を、エジプト・アラブ共和国政府又はその指定する当局によって指定される日本国の外国為替公認銀行(以下「銀行」という。)に開設されるエジプト・アラブ共和国政府名義の勘定に日本円で払い込むことにより、贈与を実施する。
5.(1) The Government of Japan will execute the Grant by making payments in Japanese yen to cover the obligations incurred by the Government of the Arab Republic of Egypt or its designated authority under the contracts verified in accordance with the provisions of paragraph 4 (hereinafter referred to as "the verified Contracts") to an account to be opened in the name of the Government of the Arab Republic of Egypt in an authorized foreign exchange bank of Japan designated by the Government of the Arab Republic of Egypt or its designated authority (hereinafter referred to as "the Bank").
(2) (1)にいう払込みは、エジプト・アラブ共和国政府又はその指定する当局が発行する支払授権書に基づいて銀行が支払請求書を日本国政府に提出した時に行われる。
(2) The payments referred to in sub-paragraph (1) above will be made when payment requests are presented by the Bank to the Government of Japan under an authorization to pay issued by the Government of the Arab Republic of Egypt or its designated authority.
(3) (1)にいう勘定の目的は、日本国政府が払い込む日本円を受領すること及び認証された契約の当事者である日本国民に対する支払を行うことに限られる。勘定の貸記及借記に関する手続細目は、銀行とエジプト・アラブ共和国政府又はその指定する当局との間の協議により合意される。
(3) The sole purpose of the account referred to in sub-paragraph (1) above is to receive the payments in Japanese yen by the Government of Japan and to pay to the Japanese nationals who are parties to the Verified Contracts. The procedural details concerning the credit to and debit from the account will be agreed upon through consultation between the Bank and the Government of the Arab Republic of Egypt or its designated authority.
6(1) エジプト・アラブ共和国政府は、次のことのために必要な措置をとる。
6.(1) The Government of the Arab Republic of Egypt will take necessary measures:
(a) 施設の改善のために必要な土地を確保し、かつ、用地の整地を行うこと。
(a) to secure lots of land necessary for the rehabilitation and upgrading of the Facilities and to clear the site;
(b) 用地の外における配電、給水、排水その他の付随的な施設を提供すること。
(b) to provide facilities for distribution of electricity, water supply and drainage and other incidental facilities outside the site;
(c) 贈与に基づいて購入される生産物のエジプト・アラブ共和国の陸揚港における陸揚げ及び通関並びに同国における国内輸送が速やかに行われることを確保すること。
(c) to ensure prompt unloading and customs clearance at ports of disembarkation in the Arab Republic of Egypt and internal transportation therein of the products purchased under the Grant;
(d) 日本国民につき、認証された契約に基づく生産物及び役務の供与に関してエジプト・アラブ共和国における関税、内国税その他の財政課徴金を賦課しないことを確保すること。
(d) to secure, with respect to the supply of the products and services under the Verified Contracts, that Japanese nationals shall not be subject to any customs duties, internal taxes and other fiscal levies which may be imposed in the Arab Republic of Egypt;
(e) 認証された契約に基づく生産物及び役務の供与に関連して役務を供与することを必要とされる日本国民に対し、エジプト・アラブ共和国の関係法令に従って、その作業の遂行のためのエジプト・アラブ共和国への入国及び同国における滞在に必要な便宣を与えること。
(e) to accord Japanese nationals whose services may be required in connection with the supply of the products and services under the Verified Contracts such facilities as may be necessary for their entry into the Arab Republic of Egypt and stay therein for the performance of their work in accordance with the relevant laws and regulations of the Arab Republic of Egypt;
(f) 贈与に基づいて改善される施設及び購入される生産物が計画の実施のために適正にかつ効果的に維持され及び使用されることを碓保すること。
(f) to ensure that the Facilities rehabilitated and upgraded and the products purchased under the Grant be maintained and used properly and effectively for the execution of the Project; and
(g) 計画の実施のために必要なすべての経費(贈与によって負担されるものを除く。)を負担すること。
(g) to bear all the expenses, other than those covered by the Grant, necessary for the execution of the Project.
(2) 増与に基づいて購入される生産物は、エジプト・アラブ共和国より再輸出されてはならない。
(2) The products purchased under the Grant shall not be re-exported from the Arab Republic of Egypt.
7 両政府は、この取極から又はこれに関連して生ずるいかなる問題についても相互に協議する。
7. The two Governments will consult with each other in respect of any matter that may arise from or in connection with the present arrangements.
本使は、更に、この書簡及びエジプト・アラブ共和国政府に代わって前記の取極を確認される閣下の返簡が両政府間の合意を構成するものとみなし、その合意がその効力発生のために必要なエジプト・アラブ共和国の国内手続を完了した旨の同国政府からの書面による通告を日本国政府が受領した日に効力を生ずることを提案する光栄を有します。
I have further the honour to propose that this Note and Your Excellency's Note in reply confirming on behalf of the Government of the Arab Republic of Egypt the foregoing arrangements shall be regarded as constituting an agreement between the two Governments, which will become effective on the date of receipt by the Government of Japan of the written notification from the Government of the Arab Republic of Egypt of the completion of necessary domestic procedures for the entry into force of such agreement.
この書簡は、ひとしく正文である日本語、アラビア語及び英語により作成され、解釈に相違がある場合には、英語の本文によるものとします。
This Note is written in the Japanese, Arabic and English languages, each text being equally authentic, and in case of any divergence in interpretation, the English text shall prevail.

Excellency, I have the honour to acknowledge the receipt of Your Excellency's Note of today's date, which reads as follows:

I have further the honour to confirm on behalf of the Government of the Arab Republic of Egypt the foregoing arrangements and to agree that Your Excellency's Note and this Note shall be regarded as constituting an agreement between the two Governments, which will become effective on the date of receipt by the Government of Japan of the written notification from the Government of the Arab Republic of Egypt of the completion of necessary domestic procedures for the entry into force of such agreement.
