青年海外協力隊の派遣に関する日本国政府とエジプト・アラブ共和国政府との間の交換公文

Tokyo, March 15, 1995
書簡をもって啓上いたします。本大臣は、日本国とエジプト･アラブ共和国との間の技術協力を促進するため、青年海外協力隊計画(以下｢計画｣という。)に基づき協力隊員をエジプト･アラブ共和国に派遣することに関し、日本国政府の代表者とエジプト･アラブ共和国政府の代表者との間で行われた最近の討議に言及するとともに、これらの代表者の間で到達した次の了解を日本国政府に代わって確認する光栄を有します。
Excellency, I have the honour to refer to the recent discussions held in Cairo between the representatives of the Government of Japan and of the Government of the Arab Republic of Egypt concerning the dispatch of volunteers to the Arab Republic of Egypt under the Japan Overseas Cooperation Volunteers Programme (hereinafter referred to as "the Programme") with a view to promoting technical cooperation between the two countries and to confirm on behalf of the Government of Japan the following understandings reached between them:
1 日本国政府は、エジプト･アラブ共和国政府の要請に基づき、日本国の現行法令に従い、エジプト・アラブ共和国の社会的及び経済的開発に寄与するため、両政府の関係当局間で別個に合意される計画に従い協力隊員をエジプト･アラブ共和国に派遣するために必要な措置をとる。
1. At the request of the Government of the Arab Republic of Egypt, the Government of Japan will, in accordance with the laws and regulations in force in Japan, take necessary measures to dispatch the volunteers to the Arab Republic of Egypt for the purpose of contributing to the social and economic development of the Arab Republic of Egypt, according to the schedules to be separately agreed upon between the authorities concerned of the two Governments.
2 日本国政府は、予算措置がとられることを条件として、協力隊員の日本国とエジプト・アラブ共和国との間の渡航費及びエジプト･アラブ共和国における生活手当を負担し、また、協力隊員の任務の遂行に必要な装備、機械、資材及び医薬品を供与するために必要な措置をとる。
2. The Government of Japan will, subject to budgetary appropriations, take necessary measures to bear the cost of international travel between Japan and the Arab Republic of Egypt and living allowance in the Arab Republic of Egypt for the volunteers and to make available such equipment, machinery, materials and medical supplies as may be necessary for the performance of their functions.
3(1) エジプト･アラブ共和国政府は、協力隊員に対し、次の特権、免除及び便宜を与える。
3.(1) The Government of the Arab Republic of Egypt will grant the volunteers the following privileges, exemptions and benefits:
(i) 2にいう装備、機械、資材及び医薬品の輸入に関して、関税、内国税その他類似の課徴金並びに輸入許可証及び為替証明書の取得義務を免除すること。
(i) Exemption from customs duties, internal taxes and other charges of a similar nature as well as from the requirement of obtaining import license and certificate of foreign exchange coverage in respect of the importation of the equipment, machinery, materials and medical supplies mentioned in paragraph 2 above.
(ii) 協力隊員につき、最初の到着後六箇月以内に行う身回品及び家財の輸入に関し、エジプト・アラブ共和国の法令に基づき納付すべきものとされている関税、内国税その他類似の課徴金並びに輸入許可証及び為替証明書の取得義務を免除すること。
(ii) Exemption from customs duties, internal taxes and other charges of a similar nature, payable under legislation of the Arab Republic of Egypt, as well as from the requirement of obtaining import license and certificate of foreign exchange coverage, in respect of the importation, within six months of their initial arrival, of personal and household goods.
(iii) 協力隊員に対して海外から送金される手当に関し、エジプト･アラブ共和国の法令に基づき納付すべきものとされている所得税その他の財政課徴金を免除すること。
(iii) Exemption from income taxes and other fiscal charges payable under the legislation of the Arab Republic of Egypt in respect of any allowances to be remitted to them from overseas.
(iv) 協力隊員の任務遂行を容易にするため、協力隊員に対し身分証明書を交付すること。
(iv) Issuance of identification cards to the volunteers to facilitate the performance of their functions.
(2) エジプト･アラブ共和国政府は、協力隊員の受け入れ機関が協力隊員のエジプト･アラブ共和国における任期中、無料診療と無料の住居施設を供与することを保証する。
(2) The Government of the Arab Republic of Egypt will ensure that the organizations receiving the volunteers provide them free medical care and rent-free housing accommodations during the term of their assignment in the Arab Republic of Egypt.
4(1) エジプト･アラブ共和国政府は、エジプト･アラブ共和国における計画の活動に関連して日本国政府による技術協力の実施機関である国際協力事業団が与える任務を遂行する駐在員一名及び調整員を受け入れる。
4.(1) The Government of the Arab Republic of Egypt will accept a Representative and Co-ordinators who will discharge the functions to be assigned to them by the Japan International Cooperation Agency, the executing agency for technical cooperation of the Government of Japan, relative to the activities of the Programme in the Arab Republic of Egypt.
(2) エジプト･アラブ共和国政府は、駐在員及び調整員に対し、次の特権、免除及び便宜を与える。
(2) The Government of the Arab Republic of Egypt will grant the Representative and the Co-ordinators the following privileges, exemptions and benefits:
(i) 駐在員及び調整員の任務の遂行に必要な装備、機械、資材及び医薬品の輸入に関して、関税、内国税その他類似の課徴金並びに輸入許可証及び為替証明書の取得義務を免除すること。
(i) Exemption from customs duties, internal taxes and other charges of a similar nature as well as from the requirement of 'obtaining import license and certificate of foreign exchange coverage in respect of the importation of the equipment, machinery, materials and medical supplies necessary for the performance of their functions.
(ii) 駐在員及び調整員につき、その最初の到着後六箇月以内に行う身回品及び家財の輸入に関し、エジプト･アラブ共和国の法令に基づき納付すべきものとされている関税、内国税その他類似の課徴金並びに輸入許可証及び為替証明書の取得義務を免除すること。
(ii) Exemption from customs duties, internal taxes and other charges of a similar nature, payable under legislation of the Arab Republic of Egypt, as well as from the requirement of obtaining import license and certificate of foreign exchange coverage, in respect of the importation, within six months of their initial arrival, of personal and household goods.
(iii) 駐在員及び調整員に対して海外から送付される給与若しくは手当に関し、エジプト・アラブ共和国の法令に基づき納付すべきものとされている所得税その他の財政課徴金を免除すること。
(iii) Exemption from income taxes and other fiscal charges payable under the legislation of the Arab Republic of Egypt in respect of any emoluments or allowances to be remitted to them from overseas.
(iv) エジプト･アラブ共和国に一年以上派遣される駐在員及び調整員各一名につき一台の自動車の無税輸入(又はエジプト･アラブ共和国における保税倉庫からの購入)を行うこと。当該自動車がその後エジプト･アラブ共和国内において、関税その他の租税の免除又は同様の特権を有しない個人又は団体に売却又は譲渡される場合には、当該関税その他の租税が支払われなければならない。
(iv) Importation free of duties (or purchase from bond in the Arab Republic of Egypt) of one motorcar for each the Representative and the Co-ordinators assigned to stay for at least one year in the Arab Republic of Egypt. Such motorcar will be subject to payment of customs duties and taxes if it is subsequently sold or transferred within the Arab Republic of Egypt to individuals or organizations not entitled to exemption from such duties and taxes or similar privileges.
(v) Issuance of identification cards to the Representative and the Co-ordinators to facilitate the performance of their functions.
5 エジプト･アラブ共和国政府は、エジプト･アラブ共和国における協力隊員の公務に起因し、当該公務の遂行中に発生し、又は当該公務の遂行中における作為若しくは不作為に関連する請求が生じた場合には、当該請求に関する責任を負う。ただし、両政府がこれらの請求が協力隊員の重大な過失又は故意から生じたことに同意する場合には、その限りではない。
5. The Government of the Arab Republic of Egypt will bear claims, if any arises, resulting from, occurring in the course of, or otherwise connected with any action performed or omission made in the course of the official functions by the volunteers in the Arab Republic of Egypt, except when the two Governments agree that such claims arise from gross negligence or wilful misconduct on the part of the volunteers.
6 両政府は、エジプト･アラブ共和国における計画の実施を成功させるため随時討議する。
6. The two Governments will hold consultation from time to time, for the successful implementation of the Programme in the Arab Republic of Egypt.
7 この了解は、両政府間の書簡の交換によって修正することができ、かつ、いずれかの政府が他方の政府に対しこの了解を終了させる意思を六箇月前に書面によって通告することにより終了させることができる。
7. The understandings set out above may be amended by an exchange of notes between the two Governments and terminated by either Government by giving to the other six months written notice of its intention to terminate them.
本大臣は、更に、この書簡及び前記の了解をエジプト･アラブ共和国政府に代わって確認される閣下の返簡が両政府間の合意を構成するものとみなし、その合意がその効力発生のために必要なエジプト・アラブ共和国の国内手続を完了した旨の同国政府からの書面による通告を日本国政府が受領した日に効力を生ずることを提案する光栄を有します。
I have further the honour to propose that this Note and Your Excellency's Note in reply confirming on behalf of the Government of the Arab Republic of Egypt the foregoing understandings shall be regarded as constituting an agreement between the two Governments, which will become effective on the date of receipt by the Government of Japan of the written notification from the Government of the Arab Republic of Egypt of the completion of necessary domestic procedures for the entry into force of such agreement.

書簡をもって啓上いたします。本大臣は、本日付の閣下の次の書簡を受領したことを確認する光栄を有します。
Excellency, I have the honour to acknowledge the receipt of Your Excellency's Note of today's date, which reads as follows:

本大臣は、更に、前記の了解をエジプト・アラブ共和国政府に代わって確認するとともに、閣下の書簡及びこの返簡が両政府間の合意を構成するものとみなし、その合意がその効力発生のために必要なエジプト・アラブ共和国の国内手続を完了した旨の同国政府からの書面による通告を日本国政府が受領した日に効力を生ずることに同意する光栄を有します。
I have further the honour to confirm on behalf of the Government of the Arab Republic of Egypt the foregoing understandings and to agree that Your Excellency's Note and this Note shall be regarded as constituting an agreement between the two Governments, which will become effective on the date of receipt by the Government of Japan of the written notification from the Government of the Arab Republic of Egypt of the completion of necessary domestic procedures for the entry into force of such agreement.
