(Japanese Note)
Cairo, January 10, 1995
書簡をもって啓上いたします。本使は、日本国とエジプト・アラブ共和国との間の友好協力関係を強化することを目的として行われる日本国の経済協力に関して日本国政府の代表者とエジプト・アラブ共和国政府の代表者との間で最近行われた討議に言及するとともに、次の取極を日本国政府に代わって提案する光栄を有します。
Excellency, I have the honour to refer to the recent discussions held between the representatives of the Government of Japan and of the Government of the Arab Republic of Egypt concerning Japanese economic cooperation to be extended with a view to strengthening friendly and cooperative relations between the two countries, and to propose on behalf of the Government of Japan the following arrangements:
1 日本国政府は、エジプト・アラブ共和国政府がバハル・ヨセフ灌漑用水路整備計画(以下「計画」という。)を実施することに寄与するため、日本国の関係法令に従い、エジプト・アラブ共和国政府に対し、九千四百万円(九四、○○○、○○○円)を限度とする額の贈与(以下「贈与」という。)を行う。
1. For the purpose of contributing to the execution of the Project for Rehabilitation and Improvement of Bahr Yusef Canal (hereinafter referred to as "the Project") by the Government of the Arab Republic of Egypt, the Government of Japan will extend to the Government of the Arab Republic of Egypt, in accordance with the relevant laws and regulations of Japan, a grant up to ninety-four million yen (94,000,000) (hereinafter referred to as "the Grant").
2 贈与は、両政府の関係当局間の合意によって延長されない限り、この取極の効力発生の日から千九百九十六年一月九日までの期間に使用に供される。
2. The Grant will be made available during the period between the date of coming into force of the present arrangements and January 9, 1996, unless the period is extended by mutual agreement between the authorities concerned of the two Governments.
3 贈与は、エジプト・アラブ共和国政府により、適正にかつ専ら次に掲げる日本国民の役務を購入するために使用される。(日本国民という語は、この取極の中で用いるときはいつでも、日本国の自然人又はその支配する日本国の法人を意昧する。)
3. The Grant will be used by the Government of the Arab Republic of Egypt properly and exclusively for the purchase of the services of Japanese nationals listed below: (the term Japanese nationals whenever used in the present arrangements means Japanese physical persons or Japanese juridical persons controlled by Japanese physical persons.);

services necessary for the detailed design to be required for the execution of the Project.
4 エジプト・アラブ共和国政府又はその指定する当局は、3にいう役務を購入するため、日本国民と円貨建ての契約を締結する。この契約は、贈与の対象として適格であることが日本国政府により認証されなければならない。
4. The Government of the Arab Republic of Egypt or its designated authority will enter into contracts in Japanese yen with Japanese nationals for the purchase of the services referred to in paragraph 3. Such contracts shall be verified by the Government of Japan to be eligible for the Grants.
5(1) 日本国政府は、4の規定に従って認証された契約(以下「認証された契約」という。)に基づいてエジプト・アラブ共和国政府又はその指定する当局が負う債務の弁済に充てるための資金を、エジプト・アラブ共和国政府又はその指定する当局によって指定される日本国の外国為替公認銀行(以下「銀行」という。)に開設されるエジプト・アラブ共和国政府名義の勘定に日本円で払い込むことにより、贈与を実施する。
5.(1) The Government of Japan will execute the Grant by making payments in Japanese yen to cover the obligations incurred by the Government of the Arab Republic of Egypt or its designated authority under the contracts verified in accordance with the provisions of paragraph 4 (hereinafter referred to as "the Verified Contracts") to an account to by opened in the name of the Government of the Arab Republic of Egypt in an authorized foreign exchange bank of Japan designated by the Government of the Arab Republic of Egypt or its designated authority (hereinafter referred to as "the Bank").
(2) (1)にいう払込みは、エジプト・アラブ共和国政府又はその指定する当局が発行する支払授権書に基づいて銀行が支払請求書を日本国政府に提出した時に行われる。
(2) The payments referred to in sub-paragraph (1) above will be made when payment requests are presented by the Bank to the Government of Japan under an authorization to pay issued by the Government of the Arab Republic of Egypt or its designated authority.
(3) (1)にいう勘定の目的は、日本国政府が払い込む日本円を受領すること及び認証された契約の当事者たる日本国民に対する支払を行うことに限られる。勘定の貸記及び借記に関する手続細目は、銀行とエジプト・アラブ共和国政府又はその指定する当局との間の協議により合意される。
(3) the sole purpose of the account referred to in sub-paragraph (1) above is to receive the payments in Japanese yen by the Government of Japan and to pay to the Japanese nationals who are parties to the Verified Contracts. The procedural details concerning the credit to and debit form the account will be agreed upon through consultation between the Bank and the Government of the Arab Republic of Egypt or its designated authority.
6 エジプト・アラブ共和国政府は、次のことのために必要な措置をとる。
6. The Government of the Arab Republic of Egypt will take necessary measures:
(1) 日本国民につき、認証された契約に基づく役務の供与に関して、エジプト・アラブ共和国における関税、内国税その他の財政課徴金を賦課しないことを確保すること。
(1) to secure, with respect to the supply of the services under the Verified contracts that Japanese nationals shall not be subject to any customs duties, internal taxes and other fiscal levies which may be imposed in the Arab Republic of Egypt;
(2) 認証された契約に基づく役務の供与に関連して役務を供与することを必要とされる日本国民に対し、エジプト・アラブ共和国の関係法令に従ってその作業の遂行のためのエジプト・アラブ共和国への入国及び同国における滞在に必要な便宜を与えること。
(2) to accord Japanese nationals whose services may be required in connection with the supply of the services under the Verified Contracts such facilities as may be necessary for their entry into the Arab Republic of Egypt and stay therein for the performance of their work in accordance with the relevant laws and regulations of the Arab Republic of Egypt and
(3) 計画の実施のための詳細設計に必要なすべての経費(贈与によって負担されるものを除く。)を負担すること。
(3) to bear all the expenses, other than those covered by the Grant, necessary for the detailed design to be required for the execution of the Project.
7 両政府は、この取極から又はこれに関連して生ずるいかなる問題についても相互に協議する。
7. The two Governments will consult with each other in respect of any matter that may arise from or in connection with the present arrangements.
本使は、更に、この書簡及びエジプト・アラブ共和国政府に代わって前記の取極を確認される閣下の返簡が両政府間の合意を構成するものとみなし、その合意がその効力発生のために必要なエジプト・アラブ共和国の国内手続を完了した旨の同国政府からの書面による通告を日本国政府が受領した日に効力を生ずることを提案する光栄を有します。
I have further the honour to propose that this Note and Your Excellency's Note in reply confirming on behalf of the Government of the Arab Republic of Egypt the foregoing arrangements shall be regarded as constituting an agreement between the two Governments, which will become effective on the date of receipt by the Government of Japan of the written notification from the Government of the Arab Republic of Egypt of the completion of necessary domestic procedures for the entry into force of such agreement.

This Note is written in Japanese, Arabic and English languages, each text being equally authentic, and in case of any divergence in interpretation, the English text shall prevail.

Excellency,I have the honour to acknowledge the receipt of Your Excellency's Note of today's date, which reads as follows:

本大臣は、更に、エジプト・アラブ共和国政府に代わって前記の取極を確認するとともに、閣下の書簡及びこの返簡が両政府間の合意を構成するものとみなし、その合意がその効力発生のために必要なエジプト・アラブ共和国の国内手続を完了した旨の同国政府からの書面による通告を日本国政府が受領した日に効力を生ずることに同意する光栄を有します。
I have further the honour to confirm on behalf of the Government of the Arab Republic of Egypt the foregoing arrangements and to agree that Your Excellency's Note and this Note shall be regarded as constituting an agreement between the two Governments, which will become effective on the date of receipt by the Government of Japan of the written notification from the Government of the Arab Republic of Egypt of the completion of necessary domestic procedures for the entry into force of such agreement.
