(Japanese Note)

　Beijing, March 23, 1995

　書簡をもって啓上いたします。本官は、日本国と中華人民共和国との間の友好協力関係を強化することを目的として行われる日本国の経済協力に関し、日本国政府の代表者と中華人民共和国政府の代表者との間で最近行われた討議に言及するとともに、次の取極を日本国政府に代わって提案する光栄を有します。

　Excellency,
I have the honour to refer to the recent discussions held between the representatives of the Government of Japan and of the People's Republic of China concerning Japanese economic cooperation to be extended with a view to strengthening friendly and cooperative relations between the two countries, and to propose on behalf of the Government of Japan the following arrangements:

1　日本国政府は、中華人民共和国政府がチベット結核病治療センター機材整備計画(以下「計画」という。)を実施することに寄与するため、日本国の関係法令に従い、中華人民共和国政府に対し、七億九百万円(七〇九、〇〇〇、〇〇〇円)を限度とする額の贈与(以下「贈与」という。)を行う。

1. For the purpose of contributing to the execution of the project for Improvement of Equipment for the Thibet Tuberculosis Control Centre (hereinafter referred to as " the Project") by the Government of the People's Republic of China, the Government of Japan will extent to the Government of the People's Republic of china, in accordance with the relevant laws and regulations of Japan, a grant up to seven hundred and nine million yen (709, 000, 000) (hereinafter referred to as " the Grant ").

2　贈与は、両政府の関係当局間の合意によって延長されない限り、この取極の効力発生の日から千九百九十六年三月二十二日までの期間に使用に供される。

2. The Grant will be made available during the period between the date of coming into force of the present arrangements and March 22, 1996, unless the period is extended by mutual agreement between the authorities concerned of the two Governments.

3(1)　贈与は、中華人民共和国政府により適正にかつ専ら次に掲げる日本国又は中華人民共和国の生産物及び日本国民又は中華人民共和国国民の役務を購入するために使用される。(国民という語は、この取極の中で用いるときはいつでも、日本国民の場合は日本国の自然人又はその支配する日本国の法人を意味し、中華人民共和国国民の場合は中華人民共和国の自然人又は法人を意味する。)

3.(1) The Grant will be used by the Government of the People's Republic of China properly and exclusively for the purchase of the products of Japan or the People's Republic of china and the services of Japanese or Chinese nationals listed below: (The term nationals whenever used in the present arrangements means Japanese physical persons or Japanese juridical persons controlled by Japanese physical persons in the case of Japanese nationals, and Chinese physical or juridical persons in the case of Chinese nationals.)

(a)　計画の実施のために必要な機材及びその据付けのために必要な役務

(a) equipment necessary for the execution of the Project and services necessary for the installation thereof;

(b)　計画の実施のために必要な車両及びその調達のために必要な役務

(b) vehicles necessary for the execution of the Project and services necessary for the procurement thereof; and

(c)　(a)及び(b)にいう生産物の中華人民共和国の港までの輸送のために必要な役務及び同国における国内輸送のための役務

(c) services necessary for the transportation of the products referred to in (a) and (b) above to ports in the People's Republic of China, and those for internal transportation therein.

(2)　(1)の規定にかかわらず、贈与は、両政府が必要と認める場合は、(1)(a)及び(b)にいう生産物で日本国又は中華人民共和国の生産物以外のもの並びに(1)(a)、(b)及び(c)にいう役務で日本国民又は中華人民共和国国民の役務以外のものの購入のために使用することができる。

(2) Notwithstanding the provisions of sub-paragraph (1) above, whey the two Governments deem it necessary, the Grant may be used for the purchase of the products of the kind mentioned in (a) and (b) of sub-paragraph (1) above, which are products of countries other than Japan or the People's Republic of China and the services of the kind mentioned in (a), (b) and (c) of sub-paragraph (1) above, which are services of nationals of countries other than Japan or the People's Republic of China.

4　中華人民共和国政府又はその指定する当局は、3にいう生産物及び役務を購入するため、日本国民と円貨建ての契約を締結する。この契約は、贈与の対象として適格であることが日本国政府により認証されなければならない。

4. The Government of the People's Republic of China or its designated authority will enter into contracts in Japanese yen with Japanese nationals for the purchase of the products and services referred to in paragraph 3. Such contracts shall be verified by the Government of Japan to be eligible for the Grant.

5(1)　日本国政府は、4の規定に従って認証された契約(以下「認証された契約」という。)に基づいて中華人民共和国政府又はその指定する当局が負う債務の弁済に充てるための資金を、中華人民共和国政府又はその指定する当局によって指定される日本国の外国為替公認銀行(以下「銀行」という。)に開設される中華人民共和国政府名義の勘定に日本円で払い込むことにより、贈与を実施する。

5.(1) The Government of Japan will execute the Grant by making payments in Japanese yen to cover the obligations incurred by the Government of the People's Republic of China or its designated authority under the contracts verified in accordance with the provisions of paragraph 4 (hereinafter referred to as "the Verified Contracts") to an People's Republic of China in an authorized foreign exchange bank of Japan designated by the Government of the People's Republic of china or its designated authority (hereinafter referred to as "the Bank").

(2)　(1)にいう払込みは、中華人民共和国政府又はその指定する当局が発行する支払授権書に基づいて銀行が支払請求書を日本国政府に提出した時に行われる。

(2) The payments referred to in sub-paragraph (1) above will be made when payment requests are presented by the Bank to the Government of Japan under an authorization to pay issued by the Government of the People's Republic of China or its designated authority.

(3)　(1)にいう勘定の目的は、日本国政府が払い込む日本円を受領すること及び認証された契約の当事者たる日本国民に対する支払を行うことに限られる。勘定の貸記及び借記に関する手続細目は、銀行と中華人民共和国政府又はその指定する当局との間の協議により合意される。

(3) The sole purpose of the account referred to in sub-paragraph (1) above is to receive the payments in Japanese yen by the Government of Japan and to pay to the Japanese nationals who are parties to the Verified Contracts. The procedural details concerning the credit to and debit from the account will be agreed upon through consultation between the Bank and the Government of the People's Republic of China or its designated authority.

6(1)　中華人民共和国政府は、次のことのために必要な措置をとる。

6.(1) The Government of the People's Republic of China will take necessary measures:

(a)　贈与に基づいて購入される生産物の中華人民共和国の陸揚港における陸揚げ及び通関並びに同国における国内輸送が速やかに行われることを確保すること。

(a) to ensure prompt unloading and customs clearance at ports of disembarkation in the People's Republic of China and internal transportation therein of the products purchased under the Grant

(b)　認証された契約に基づく生産物及び役務の日本国民による供与に関して中華人民共和国において課される関税、内国税その他の財政課徴金を負担すること。

(b) to meet the charge of customs duties, internal taxes and other fiscal levies which may be imposed in the People's Republic of China with respect to the supply of the products and services under the Verified Contracts by Japanese Nationals;

(c)　認証された契約に基づく生産物及び役務の供与に関連して役務を供与することを必要とされる日本国民に対し、その作業の遂行のための中華人民共和国への入国及び同国における滞在に必要な便宜を与えること。

(c) to accord Japanese nationals whose services may be required in connection with the supply of the products and services under the Verified Contracts such facilities as may be necessary for their entry into the People's Republic of China and stay therein for the performance of their work;

(d)　贈与に基づいて購入される生産物が計画の実施のために適正かつ効果的に維持され及び使用されることを確保すること。

(d) to ensure that the products purchased under the Grant be maintained and used properly and effectively for the execution of the Project; and

(e)　計画の実施のために必要なすべての経費(贈与によって負担されたものを除く。)を負担すること。

(e) to bear all the expenses, other than those covered by the Grant, necessary for the execution of the Project.

(2)　贈与に基づいて購入される生産物は、中華人民共和国より再輸出されてはならない。

(2) The products purchased under the Grant shall not be re-exported from the People's Republic of China.

7　両政府は、この取極から又はこれに関連して生ずるいかなる問題についても相互に協議する。

7. The two Governments will consult with each other in respect of any matter that may arise from or in connection with the present arrangements.

　本官は、更に、この書簡及び中華人民共和国政府に代わって前記の取極を確認される閣下の返簡が両政府間の合意を構成するものとみなし、その合意が閣下の返簡の日付の日に効力を生ずることを提案する光栄を有します。

　I have further the honour to propose that this Note and Your Excellency's Note in reply confirming on behalf of the Government of the People's Republic of China the foregoing arrangements shall be regarded as constituting an agreement between the two Governments, which will enter into force on the date of Your Excellency's reply.

　I have further the honour to confirm on behalf of the Government of the People's republic of China the foregoing arrangements and to agree that your Note and this Note shall be regarded as constituting an agreement between the two Governments, which will enter into force on the date of this reply.

　書簡をもって啓上いたします。本官は、日本国と中華人民共和国との間の友好協力関係を強化することを目的として行われるチベット結核病治療センター機材整備計画の実施のための日本国の贈与に関する本日付けの交換公文に関し、日本語、中国語及び英語により作成された同交換公文の解釈に相違がある場合には英語の本文によるものとすることを日本国政府に代わって提案する光栄を有します。

　Excellency,
 With reference to the Exchange of Notes dated today concerning a Japanese grant for the execution of the project for Improvement of Equipment for the Tibet Tuberculosis Control Centre to be extended with a view to strengthening friendly and cooperative relations between Japan and the People's Republic of China, I have the honour to propose, on behalf of the Government of Japan, that in case there is any divergence of interpretation of the said Exchange of Notes which is done in the Japanese, Chinese and English languages, the English text shall prevail.
