債務救済措置に関する日本国政府とブルガリア共和国政府との間の交換公文

(Japanese Note)
Sofia, January 31, 1995
書簡をもって啓上いたします。本使は、千九百九十四年四月十三日にパリで開催されたブルガリア共和国政府の代表者と関係債権諸国政府の代表者との間の協議において到達した結論に基づき日本国政府の代表者とブルガリア共和国政府の代表者との間で行われた最近の交渉に言及する光栄を有します。本使は、更に、当該交渉において到達した次の了解を確認する光栄を有します。
Excellency, I have the honour to refer to the recent negotiations between the representatives of the government of Japan and of the Government of the Republic of Bulgaria that were held on the basis of the conclusions reached during the consultations between the representatives of the Government of the Republic of Bulgaria and of the Governments of the creditor countries concerned held in Paris on April 13, 1994. I have further the honour to confirm the following understanding reached in the course of the said negotiations:
1 債務繰延方式による債務救済措置が、日本輸出入銀行及び関係民間銀行(以下「銀行」という。)により、日本国の関係法令に従ってとられることになる。
1. A debt relief measure in the form of rescheduling will he taken by the Export-Import Bank of Japan together with private banks concerned (hereinafter referred to as "the Banks") in accordance with the relevant laws and regulations of Japan.
2(1) 繰り延べられる債務(以下「繰延債務」という。)は、ブルガリア外国貿易銀行株式会社が銀行に対して負う次の債務から成る。繰延債務の内訳は、この書簡の付表に掲げられる。
2.(1) The debts to be rescheduled (hereinafter referred to as "the Rescheduled Debts") consist of the following debts owed by Bulgarian Foreign Trade Bank, L.T.D. to the Banks. The breakdown of the Rescheduled Debts is shown in the List attached hereto.
(a) 千九百九十四年四月一日から千九百九十五年四月三十日までの間(両期日を含む。)に弁済期限の到来したか又は到来する元本及び利子
(a) The principal and interest having fallen or falling due between April 1, 1994 and April 30, 1995, both dates inclusive;
(b) 千九百九十四年三月三十一日以前に弁済期限の到来した元本及び利子
(b) The principal and interest having fallen due on or before March 31, 1994; and
(c) (b)にいう債務の遅延利子であって、この書簡の付表に掲げる当初の弁済期日から千九百九十四年三月三十一日までの間(両期日を含む。)に生じたもの
(c) The late interest on the debts referred to in (b) above, having accrued during the period between the original due dates mentioned in the List attached hereto and March 31, 1994, both dates inclusive.
(2) 繰延債務の総額は、日本円によって契約された債務については、九十億九百十二万三千六百八円(九、〇〇九、一二三、六〇八円)、また、合衆国ドルによって契約された債務については、千三百三十万六千七合衆国ドル六セント(一三、三〇六、〇〇七・〇六合衆国ドル)になる。
(2) The total amount of the Rescheduled Debts will be nine billion nine million one hundred twenty three thousand six hundred and eight yen (9,009,123,608) for the debts contracted in Japanese yen and thirteen million three hundred six thousand seven United States dollars a and six cents ($13,306,007.06) for the debts contracted in United States dollars.
(3) (2)にいう総額及びこの書簡の付表は、ブルガリア共和国政府の関係当局、ブルガリア外国貿易銀行株式会社及び銀行が行う最終的照合の後に日本国政府及びブルガリア共和国政府の関係当局間の合意により修正されることがある。
(3) Modifications may be made to the total amount referred to in sub-paragraph (2) above and to the List attached hereto by agreement between the authorities concerned of the Governments of Japan and of the Republic of Bulgaria, after the final verification to be made by the authorities concerned of the Government of the Republic of Bulgaria, Bulgarian Foreign Trade Bank, L.T.D., and the Banks.
3 債務繰延べの条件は、ブルガリア共和国政府、ブルガリア外国貿易銀行株式会社及び銀行との間で締結される債務繰延契約であって、なかんずく次の原則を含むものにおいて規定される。
3. The terms and conditions of the rescheduling will be stipulated in rescheduling agreements to be concluded between the Government of the Republic of Bulgaria, Bulgarian Foreign Trade Bank. L .T. D. and the Banks, which will contain, inter alia, the following principles:
(1) 2(1)にいう債務の各々は、二千一年三月三十一日に始まる八回の均等半年賦払によって支払われる。
(1) Each of the debts referred to in sub-paragraph (1) of paragraph 2 will be paid in eight (8) equal semi-annual installments beginning on March 31, 2001.
(2) 繰延債務に対する利子率は、日本円によって契約された債務については、年六・四五パーセントとし、また、合衆国ドルによって契約された債務については、適用可能なロンドン銀行間取引金利(六箇月の貸出しに適用される年利)に年〇・八一二五パーセントを加えたものとし、2(1)(a)にいう債務についてはこの書簡の付表に掲げる弁済期日から、2(1)(b)にいう債務及び2(1)(c)にいう遅延利子については千九百九十四年四月一日からそれぞれ適用される。
(2) The rate of interest on the Rescheduled Debts will be six point four five per cent (6.45%) per annum for the debts contracted in Japanese yen and nought point eight one two five per cent (0.8125%) per annum above the applicable London inter-bank offered rate (per annum, applied for six months lending) for the debts contracted in United States dollars beginning from the due dates mentioned in the List attached hereto for the debts referred to in (a) of sub-paragraph (1) of paragraph 2, and from April 1, 1994 for the debts referred to in (b) of the said sub-paragraph and the late interest referred to in (c) of the said sub-paragraph.
本使は、更に、この書簡及びブルガリア共和国政府に代わって前記の取極を確認される閣下の返簡が両政府間の合意を構成するものとみなし、その合意がその効力発生のために必要なブルガリア共和国の国内手続を完了した旨の同国政府からの書面による通告を日本国政府が受領した日に効力を生ずることを提案する光栄を有します。
I have further the honour to propose that this Note and Your Excellency's Note in reply confirming on behalf of the Government of the Republic of Bulgaria the foregoing arrangements shall be regarded as constituting an agreement between the two Governments, which will become effective on the date of receipt by the Government of Japan of the written notification from the Government of the Republic of Bulgaria of the completion of necessary domestic procedures for the entry into force of such agreement.

書簡をもって啓上いたします。本官は、本日付けの閣下の次の書簡を受領したことを確認する光栄を有します。
Excellency, I have the honour to acknowledge the receipt of Your Excellency's Note of today's date, which reads as follows:

本官は、更に、ブルガリア共和国政府に代わって前記の取極を確認するとともに、閣下の書簡及びこの返簡が両政府間の合意を構成するものとみなし、その合意がその効力発生のために必要なブルガリア共和国の国内手続を完了した旨の同国政府からの書面による通告を日本国政府が受領した日に効力を生ずることに同意する光栄を有します。
I have further the honour to confirm on behalf of the Government of the Republic of Bulgaria the foregoing arrangements and to agree that Your Excellency's Note and this Note shall be regarded as constituting an agreement between the two Governments, which will become effective on the date of receipt by the Government of Japan of the written notification from the Government of the Republic of Bulgaria of the completion of necessary domestic procedures for the entry into force of such agreement.
