PROTOCOL MODIFYING THE AGREEMENT BETWEEN THE GOVERNMENT OF JAPAN AND THE GOVERNMENT OF THE FEDERATIVE REPUBLIC OF BRAZIL FOR THE RESCHEDULING OF THE BRAZILIAN DEBTS OWNED TO THE OVERSEAS ECON0MIC COOPERATION FUND
日本国政府及びブラジル連邦共和国政府は、
The Government of Japan and the Government of the Federative Republic of Brazil,
千九百九十三年一月二十九日にブラジリアで署名された海外経済協力基金に対するブラジルの債務の繰延べのための日本国政府とブラジル連邦共和国政府との間の協定(以下「協定」という。)を修正することを希望して、
Desiring to modify the Agreement between the Government of Japan and the Government of the Federative Republic of Brazil for the Rescheduling of the Brazilian debts owed to the Overseas Economic Cooperation Fund, signed at Brasilia on January 29, 1993 (hereinafter referred to as "the Agreement"),
次のとおり協定した。
Have agreed as follows:
1 協定2(1)(c)を次のように改める。
1. (c) of sub-paragraph (1) of paragraph 2 of the Agreement shall be deleted and replaced by the following:
(c) (a)及び(b)の規定にかかわらず、関係債権諸国が、千九百九十二年二月二十六日にパリにおいてブラジル連邦共和国政府の代表者及び関係債権諸国政府の代表者によって署名された合意議事録の規定を千九百九十三年二月一日から千九百九十三年八月三十一日までの間(両期日を含む。)に弁済期限の到来した債務に対して適用することを中止することを決定した場合には、日本国政府は、いつでも、この協定の規定を(a)及び(b)にいう債務のうち、千九百九十三年二月一日から千九百九十三年八月三十一日までの間(両期日を含む。)に弁済期限の到来した元本、契約上の利子及び繰延利子に対して適用することを中止することができる。
"(c) Notwithstanding the provisions of (a) and (b) above, the Government of Japan may suspend at any time the application of the provisions of the present Agreement to the principal, contractual interest and rescheduling interest having fallen due between February 1, 1993 and August 31, 1993, both dates inclusive, of the debts referred to in (a) and (b) above, if the creditor countries concerned determine to suspend the application of the provisions of the Agreed Minute signed by the representatives of the Government of the Federative Republic of Brazil and of the Governments of the creditor countries concerned in Paris on February 26, 1992, to the debts having fallen due between February 1, 1993 and August 31, 1993, both dates inclusive."
2 この議定書は、署名の日に効力を生ずる。
2. This Protocol shall enter into force on the date of the signature thereof.
以上の証拠として、下名は、正当に委任を受けてこの議定書に署名した。

日本国政府及びブラジル連邦共和国政府は、
The Government of Japan and the Government of the Federative Republic of Brazil,
千九百九十三年一月二十九日にブラジリアで署名された国際協力事業団に対するブラジルの債務の繰延ベのための日本国政府とブラジル連邦共和国政府との間の協定(以下「協定」という。)を修正することを希望して、
Desiring to modify the Agreement between the Government of Japan and the Government of the Federative Republic of Brazil for the Rescheduling of the Brazilian debts owed to the Japan International Cooperation Agency, signed at Brasilia on January 29, 1993 (hereinafter referred to as "the Agreement"),
次のとおり協定した。
Have agreed as follows:
1 協定2(1)(c)の頭書を次のように改める。
1. The introductory clause of (c) of sub-paragraph (1) of paragraph 2 of the Agreement shall be deleted and replaced by the following:
(c) (a)及び(b)の規定にかかわらず、次の債務が千九百九十三年一月三十一日以前にJICAに対して支払われなかった場合、又は、関係債権諸国が、千九百九十二年二月二十六日にパリにおいてブラジル連邦共和国政府の代表者及び関係債権諸国政府の代表者によって署名された合意議事録の規定を千九百九十三年二月一日から千九百九十三年八月三十一日までの間(両期日を含む。)に弁済期限の到来した債務に対して適用することを中止することを決定した場合には、日本国政府は、いつでも、この協定の規定を(a)及び(b)にいう債務のうち、千九百九十三年二月一日から千九百九十三年八月三十一日までの間(両期日を含む。)に弁済期限の到来した元本、契約上の利子及び繰延利子に対して適用することを中止することができる。

日本国政府及びブラジル連邦共和国政府は、
The Government of Japan and the Government of the Federative Republic of Brazil,
千九百九十三年一月二十九日にブラジリアで署名された日本輸出入銀行及び日本国の関係民間銀行に対するブラジルの債務の繰延べのための日本国政府とブラジル連邦共和国政府との間の協定(以下「協定」という。)を修正することを希望して、
Desiring to modify the Agreement between the Government of Japan and the Government of the Federative Republic of Brazil for the Rescheduling of the Brazilian debts owed to the Export-Import Bank of Japan together with private banks concerned of Japan, signed at Brasilia on January 29, 1993 (hereinafter referred to as "the Agreement"),
次のとおり協定した。
Have agreed as follows:
1 協定2(1)(c)の頭書を次のように改める。
1. The introductory clause of (c) of sub-paragraph (1) of paragraph 2 of the Agreement shall be deleted and replaced by the following:
(c) (b)(ii)の規定にかかわらず、次の債務が千九百九十三年一月三十一日以前に銀行に対して支払われなかった場合、又は、関係債権諸国が、千九百九十二年二月二十六日にパリにおいてブラジル連邦共和国政府の代表者及び関係債権諸国政府の代表者によって署名された合意議事録の規定を千九百九十三年二月一日から千九百九十三年八月三十一日までの間(両期日を含む。)に弁済期限の到来した債務に対して適用することを中止することを決定した場合には、日本国政府は、いつでも、この協定の規定を(b)(ii)にいう債務のうち、千九百九十三年二月一日から千九百九十三年八月三十一日までの間(両期日を含む。)に弁済期限の到来した元本及び繰延利子に対して適用することを中止することができる。
"(c) Notwithstanding the provisions of (ii) of (b) above, the Government of Japan may suspend at any time the application of the provisions of the present Agreement to the principal and rescheduling interest having fallen due between February 1, 1993 and August 31, 1993, both dates inclusive, of the following debts have not been paid to the Banks on or before January 31, 1993, or the creditor countries concerned determine to suspend the application of the provisions of the Agreed Minute signed by the provisions of the Agreed Minute signed by the representatives of the Government of the Federative Republic of Brazil and of the Governments of the creditor countries concerned in Paris on February 26, 1992, to the debts having fallen due between February 1, 1993 and August 31, 1993, both dates inclusive."
2 この議定書は、署名の日に効力を生ずる。
2. This Protocol shall enter into force on the date of the signature thereof.

千九百九十三年一月二十九日にブラジリアで署名された日本国政府が保険を引き受けたブラジルの債務の繰延べのための日本国政府とブラジル連邦共和国政府との間の協定(以下「協定」という。)を修正することを希望して、
Desiring to modify the Agreement between the Government of Japan and the Government of the Federative Republic of Brazil for the Rescheduling of the Brazilian debts insured by the Government of Japan , signed at Brasilia on January 29, 1993 (hereinafter referred to as "the Agreement"),
次のとおり協定した。
Have agreed as follows:
